HomeMy WebLinkAboutRes No 2427PLANNING COMMISSION RESOLUTION NO. 2427 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST BY TOLL BROTHERS, INC., TO AMEND DEPARTMENT OF COMMUNITY DEVELOPMENT CONDITION OF APPROVAL NO. 7 OF PLANNING COMMISSION RESOLUTIONS 2356 AND 2379 FOR TENTATIVE TRACT MAPS 33935 AND 34391 TO INCREASE THE 18-FOOT HEIGHT LIMIT TO ALLOW CONSTRUCTION OF 64 SINGLE FAMILY HOMES WITH HEIGHTS UP TO 21'-8". THE PROJECT SITE IS LOCATED EAST AND WEST OF SHEPHERD LANE, NORTH OF FRANK SINATRA DRIVE. CASE NOS. TT 33935 & 34391 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 17th day of October, 2006, hold a duly noticed public hearing to consider the request by TOLL BROTHERS, INC., for approval of the above described project; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to justify denial of an amendment to Department of Community Development Condition No. 7 of Planning Commission Resolution Nos. 2356 and 2379: 1. The seven models proposed with heights above 18 feet would not be compatible height -wise with existing homes to the north and to the south, which have heights of 18 feet or less. 2. The pad elevations of several developed lots to the north and to the south are up to twenty-three (23) inches lower than the pad elevations of adjacent Tots within Tracts 33935 and 34391, therefore adding to view impacts on adjacent residents from proposed homes above 18 feet. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Planning Commission in this case. 2. That the amendment to Department of Community Development Condition No. 7 of Resolution Nos. 2356 and 2579 of Tentative Tract Map Nos. 33935 and 34391 is hereby denied. PLANNING COMMISSION RESOLUTION NO. 2427 PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 21 st day of November, 2006, by the following vote, to wit: AYES: CAMPBELL, FINERTY, TANNER, TSCHOPP, LOPEZ NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: STEPHEN R.
