A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, DENYING A DEVELOPMENT
AGREEMENT AMENDMENT TO ALLOW THE INCREASE OF
FRACTIONAL SHARES FROM 4 TO 12 PER HOME WITHIN A
RESIDENTIAL PROJECT KNOWN AS STONE EAGLE, LOCATED ON
PROPERTY IN SECTION 25 T5S R5E AND A PORTION OF SECTION
31 T5S R6E.
CASE NO. DA 02-01 AMENDMENT #1
WHEREAS, the Planning Commission of the City of Palm Desert, Califomia, did on the 3rd day
of July, 2007, hold a duly noticed public hearing to consider the request by EAGLE 6.5 LLC for
approval of DA 02-01 AMENDMENT # 1 to the City Council; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments,
if any, of all interested persons desiring to be heard, said Planning Commission did find the following
facts and reasons to exist to justify denial of said request:
1. As proposed, the amendment allowing 12 fractional ownerships per home is not
consistent with the Hillside Planned Residential Zone and previously approved project
known as Stone Eagle.
2. As proposed, the amendment will increase traffic and negatively impact the peace,
health, and general welfare of the surrounding neighbors in the Hillside Planned
Residential Zone.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
2. That the above recitations are true and correct and constitute the findings of the
Commission in this case.
3. That Development Agreement 02-01 Amendment #1 is hereby denied.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning
Commission, held on this 17th day of July, 2007, by the following vote, to wit:

NOES: 0
ABSENT: 0
ABSTAIN: 1 LIMONT
