HomeMy WebLinkAboutRes No 2461SOO PLANNING COMMISSION RESOLUTION NO. 2461 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, TO REVIEW CONDITION OF APPROVAL NO. 14 OF RESOLUTION NO. 02-116 TO LEAVE THE EXISITNG WOOD FENCING ALONG THE NORTH AND SOUTH PROPERTY LINES OF 44-530 SAN PABLO AVENUE AND TO BRING THE CONDITION BACK TO THE PLANNING COMMISSION IN THREE YEARS OR LESS IF IT DETERIORATES SOONER. CASE NO. PP 02-08 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18th day of December, 2007, hold a duly noticed public hearing to consider the request by Prest / Vuksic Architects for approval of the above noted; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the said request: 1. The Planning Commission originally allowed the wood fencing to stay along the north and south property lines, because the applicant stated that the wood fencing was new, and in good condition. 2. The wood fencing has been inspected and found to be in good condition at the WIMP end of the three-year review period. 3. Replacement of the fence at this time is unnecessary from an aesthetic standpoint and would be wasteful of natural resources. 4. In the event that the wood fence deteriorates or becomes unsightly and unattractive by the end of three years or sooner if appropriate, the Planning Commission can review and revise Condition of Approval No. 14 of Resolution 02-116 to require replacement of the fence with a masonry block wall. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case.
