HomeMy WebLinkAboutRes No 2559PLANNING COMMISSION RESOLUTION NO. 2559 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT TO OPERATE A SHORT-TERM RENTAL LOCATED AT 44-600 SAN JOSE AVE., APN: 627-164-005. CASE NO. CUP 11-244 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of July, 2011, hold a duly noticed public hearing to consider the request by the Alan and Susan Parker for consideration of the above noted; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify denial of the said request: 1. A complaint was filed during the public hearing process regarding noise generated, on occasion, by rental parties and trash left at the curb on days other than the neighborhood specific pick-up day. Applicant was absent from the public hearing and did not respond to these complaints. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Planning Commission in this case. 2. That approval of Conditional Use Permit 11-244 is hereby denied. PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 2nd day of August, 2011, by the following vote, to wit: AYES: DE LUNA, DASH AND LIMONT NOES: CAMPBELL AND TANNER ABSENT: NONE ABSTAIN: NONE /SONIA CAMPBELL, Chairperson ATTEST: LAURI AYLAIAN, Secretary Palm Desert Planning Commission
