HomeMy WebLinkAboutRes No 2579PLANNING COMMISSION RESOLUTION NO. 2579 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT TO ALLOW CHASE BANK TO INSTALL A REMOTE ATM DRIVE -UP LANE WITHIN THE DESERT SPRINGS MARKETPLACE PARKING LOT LOCATED AT 74-884 COUNTRY CLUB DRIVE. WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of December, 2011, hold a duly noticed public hearing, which was continued to the 3rd day of January, 2012, to consider the request by JP Morgan Chase for approval of the above noted; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons exist to justify denial of said request: Findings for Denial: 1. The Planning Commission finds that at full occupancy, the commercial center would not have sufficient parking, and would ultimately cause a parking problem for neighboring businesses. 2. The Planning Commission finds that the ATM drive -up lane as designed would create a safety problem where cars exiting the drive -up lane meet cars backing out of parking stalls. 3. The City allows drive -up lanes for banks and pharmacies, but the Planning Commission does not want to set a negative precedent, since there are no other ATM drive -up lanes in the city, and since the bank has a walk-up ATM on -site. 4. The Planning Commission believes that removing parking spaces will be detrimental to the other businesses in the commercial center. 5. The Planning Commission finds that the location of the ATM drive -up lane is not an appropriate for Desert Springs Market Place, and will cause disturbances to adjacent businesses. PLANNING COMMISSION RESOLUTION NO. 2579 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby deny Conditional Use Permit 11-401.
