A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ADOPTING A NOTICE OF EXEMPTION IN
ACCORDANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
(CEQA); AND APPROVING A PRECISE PLAN TO INCREASE THE HEIGHT
OF AN EXISTING BUILDING PAD BY TWO FEET FOR THE FUTURE
DEVELOPMENT OF TWO CASITAS AT 48-322 NORTH RIDGE TRAIL
LOCATED AT LOTS 6 AND 7 OF TR 30438-2
CASE NO: PP 18-0006
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 21st day of August 2018, hold a duly noticed public hearing to consider the request by
Marco and Debbie Paolella for approval of the above -noted; and
WHEREAS, the project is located within the City's Hillside Planned Residential (HPR)
zone and Drainage (D) Overlay Districts; and
WHEREAS, the City Council, in 2002, granted approval of Resolution 02-137,
approving Tentative Tract Map 30438 and the development of the Stone Eagle residential
community; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,"
Resolution No. 2015-75, the Director of Community Development has determined that
the project will not have a negative impact on the environment and qualifies as a Class 32
Categorical Exemption for the purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify the approval of said request:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, AS FOLLOWS:
1. That the above recitations are true and correct and constitute the findings of the
Planning Commission in this case.
2. That the Planning Commission does hereby approve Precise Plan 18-0006, subject
to conditions attached.

PASSED, APPROVED, AND ADOPTED by the Planning Commission of the City of
Palm Desert, California, at its regular meeting held on the 21st day of August 2018, by the
following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. PP 18-0006
DEPARTMENT OF COMMUNITY DEVELOPMENT:
1. The operation of the facility shall conform substantially with approved exhibits on file with
the Department of Community Development, except as modified by conditions herein.
2. The project site shall be developed and maintained in conformance with the approved
plans and exhibits on file with the City. Any variation from the approved plans must be
reviewed and approved by the Community Development Department prior to building
permit issuance, and may require review and approval by the Planning Commission
and/or City Council.
3. Prior to issuance of a building permit for construction of any use contemplated by this
approval, the Permittee shall first obtain permits and/or clearance from the following
agencies:
Building & Safety Department
City Fire Marshal
Public Works Department
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to the
Department of Building & Safety at the time of issuance of a building permit for the use
contemplated herewith.
4. The Permittee shall agree to defend, indemnify, and hold harmless, the City of Palm
Desert or its agents, officers, and employees from any claim, action or proceeding against
the City of Palm Desert or its agents, officers or employees, to attack, set aside, void, or
annul, any approval of the City of Palm Desert, whether by its City Council, Planning
Commission, or other authorized board or officer of the City. The City of Palm Desert
shall promptly notify the Permittee of any such claim, action, or proceeding, and the City
of Palm Desert shall cooperate fully in the defense.
5. The Permittee/owner shall comply with all applicable provisions of federal, state and local
ordinances in effect at the time of building permit issuance.
6. All cuts, fills, or other areas temporarily disturbed by grading shall be re -naturalized,
colored, and landscaped to blend with the adjacent undisturbed natural terrain.
7. All conditions of approval established by City Council Resolution 02-137 shall remain in
effect unless modified by conditions herein.

8. The Permittee shall submit a grading plan to the Department of Public Works for review
and approval. Any changes to the approved civil or landscape plans must be reviewed
for approval prior to work commencing.
9. The Permittee shall submit a PM10 application for approval. The Permittee shall comply
with all provisions of Palm Desert Municipal Code Section 24.12 regarding Fugitive Dust
Control.
10. The Permittee shall abide by all provisions of the City of Palm Desert Ordinance 843,
Section 24.20 Stormwater Management and Discharge Ordinance.
11. The Permittee shall record PMW18-0001 prior to grading permit issuance.
12. The Permittee shall receive Planning Commission approval of the pad height.
