APPROVAL OF MINUTES A. MINUTES of the Planning Commission Meeting of February 15, 1977. Action: V. WRITTEN COMMUNICATIONS - None VI. PUBLIC HEARINGS A. CASE N0. C/Z O1-77, A. D, BABCOCK & DURCO CONSTRUCTION CO. , APPLICANTS A request for a Change of Zone from PR-16 (Planned Residential , 16 Units Per Acre) to R-3 (Multiple Family Residential , 1 Unit for Each 2,500 Square Feet of Land Area) , or other more appropriate zones on 2.475 acres of land located on the north side of Shadow Mountain Drive between Lupine Lane and Tumbleweed Lane. (This matter was continued from the Special Planning Commission Meeting of January 25, 1977, due to inadequate noticing procedure. ) Recommendation: Recommend approval to the City Council of the Change of Zone on said property from PR-16 to R-3-40,000 (Multiple Family, 40,000 Square Foot Minimum Size, 2,500 Square Foot of Land Area Per Dwelling Unit} , by Planning Cornrnission Resolution No. ACt1011: Mills moved, Kelly seconded, motion to accept, without prejudice, Mr. Wayne E. Mullin's request for withdracaal of this item. Motion unanimously carried. (Berkey absent) B. CASE N0. DP 02-77, DEEP CANYON LTD. , APPLICANT Request for approval of a Development Plan for a 200-unit planned residential development in the PR-5,N Zone District on 47.5 acres of land located at the southeast corner of 44th Avenue and Deep Canyon Road. (This matter was continued from the Special Planning Commission Meeting of January 25, 1977. ) Recommendation: Accept the applicant's request fo� withdrawal to allow for re-designm Action: Reading moved, Kelly seconded, motion to accept, without prejudice, applicant's request for withdrawal for further study and possible re-design of the project, Motion unanimously carried. TT 9144, DEEP CANYON LTD. , APPLICANT Request for approval of a Tentative Tract for a 200-1ot subdivision for a planned residential development on 47.5 acres of land located in the PR-5,N Zone District and situated at the southeast corner of 44th Avenue and Deep Canyon Road. (This matter was continued from the Special Planning Commission Meeting of January 25, 1977. ) Recomrnendation: Accept the applicant's request for withdrawal to allow for re-design. CUP 08-76 AMEND , DESERT EMPIRE TELEVISION CORPORATION KNIIR-TV APPCICANT Request for an Amendment of an approved Conditional Use Permit to allow for a revised Development Plan for a television studio and office facility on a 3-acre site located on the north side of Park View Drive, west of Nlonterey Avenue, in the PR-7,S.P. Zone District. Recommendation: Continue to April 5, 1977, and require specific revisionse Action: Kelly moved, & Reading seconded, motion to continue this case to April 5th, to allow time for the staff and architect to work together on more specific revisions as discussed in the staff report. Motion unanimously carried. (Berkey absent) E. CASE N0. DP 03-77, BIDDLE DEVELOPMENT INC. for M & T INC. , APPLICANT Request for a new Development Plan consisting of 191 condominiums on the remaining 33.6 acre portion of a planned residential develop- ment known as Mountainback, located in the PR-8 Zone District on the west side of Highway 74, northerly of Portola (Carriage Trail ) Avenue extended. Recommendation: By Planning Commission Resolution No. , do the following: 1. Repeal Planning Commission Resolution No. 181 which extended the previous Development Plan on the property under consideration known as CUP 1357. 2. Approve the Development Plan for 193 condominium units subject to compliance with conditions. ACt1011: Reading moved, Mills seconded, a motion to continue this case to April 5th, and instructed staff to research the access easement question and clarify the matter to the Commission. (Motion unani- mously carried - Berkey absent). F. CASE NO TT 9377, BIDDLE DEVELOPMENT COMPANY for M & T INC. , APPLICANT Request for approval of a Tentative Tract for a 191-unit planned residential development in the PR-8 Zone District on approximately 33.6 acres of land located westerly of and adjacent to Highway 74, northerly of Portola (Carriage Trail ) Avenue extended, known as the Mountainback Development. Recommendation: Recommend approval to the City Council by Planning Commission Resolution No. , subject to compliance with conditions, including correct7on of the discrepancy between the Tentative Map wh7ch shows 193 units and the application for the Development Plan which shows 191 un i ts. ACt1011: Kelly moved, Reading seconded, a motion to continue this case to April 5th, for the same reasons as mentioned above (DP 03-77) . Motion unanimously carried - Berkey absent. DP 04-77, PRELUDE DEVELOPMENT CO. , APPLICANT Request for approval of a Development Plan for 55 condominium units on an approximate 8.94-acre parcel located in the PR-7,S.P. Zone District and situated northerly of and adjacent to the intersection of Park View Drive and Fairhaven Drive. Recommendation: Approve by Planning Commission Resolution No. , subject to compliance with conditions. ACti011: Due to the applicant's submission of revised plans calling for a reduction in the number of units, Kelly moved, and Mills seconded, a motion to continue this case to March 15th. Motion unanimously carried - Berkey absent. H. CASE N0. TT 9396, PRELUDE DEVELOPMENT CO. , APPLICANT Request for approval of a Tentative Tract Map for a 55-Lot condominium subdivision on an approximate 8.94-acre parcel located in the PR-7,S.P. Zone District and situated northerly of and adjacent to the intersection of Park View Drive and Fairhaven Drive. Recommendation: Forward a recommendation for approval to the City Council by Planning Commiss�on Resolution No. , subject to compliance with conditions. ACt1011: Reading moved, Kelly seconded, a motion for continuance of this case to March 15th, (same reasons as above DP 04-77). Motion unanimously carried - Berkey absent) VII. OLD BUSINESS A. CASE N0. 52MF� DEEP CANYON LTD. , APPLICANT Request for approval of design review of a 200-unit condominium development located in the PR-5,N Zone District and situated at the southeast corner of the intersection of Deep Canyon Road and 44th Avenue. Recommendation: Accept �he applicant's request for withdrawal to allow for re-designe ACt1011: Kelly moved, Mills seconded, a motion to accept the applicant's request for withdrawal, without prejudice; motion unanimously carried - Berkey still absent) . VIII. NEW BUSINESS A. CONSIDERATION OF REQUEST BY THE COACHELLA 11ALLEY COUNTY WATER DISTRICT FOR DETERI�INATION OF COMPLIANCE TO TNE CITY'S GENERAL PLAN FOR PROPOSED CONSTRUCTION PROJECT CONSISTIPJG OF A 900 FOOT EXTENSION OF DOMESTIC WATER DISTRIBUTION MAIN IN IRONWOOD STREET, VERBA SANTA DRIVE, BETWEEN 11ERBA SANTA AND OCOTILLO DRIVE. Recommendation: Determine by Planning Commission Resolution No. 220 , that said project does conform with the City's General General Plan. Action: Motion by Reading, seconded by Mills, to approve the above Resolution unanimously carried. Review of Cases acted on by the Design Review Boa rd at their meeting of February 22, 1977. Recornmendation: Approve the act7ons of the Design Review Board by Planning Commission Resolution No. 221. ACt10n: Motion by Kelly, seconded by Mills, to approve Resolution PJo. 221, unanimously carried. (Berkey is still absent) Also a minute motion by Kelly, seconded by Reading, to approve modifications to Case No. 30C. Motion unanimously carried. X. ORAL COMMUNICATIONS Any person wishing to discuss any item not on the agenda may address the Cot�nission at this point by stepping to the podium and giving their name and address for the record. Remarks shall be limited to a maximum of five (5) minutes unless additional time is authorized by the Plannin� Commission. XI. COMMENTS A.
