CUP 08-76(AMEND) , DESERT EMPIRE TELEVISION CORPORATION, KMIR-TV, APPLICANT Request for an Amendment of an approved Conditional Use Permit to allow for a revised Development Plan for a television studio and office facility on a 3-acre site located on the north side of Park View Drive, west of rlonterey Avenue, in the PR-7,S.P. District. Continued from the Planning Commission meeting of March 1, 1977. Staff Recommendation: Approve by Planning Commission Resolution No. 225, subject to compliance with conditions. Action: Motion by Berkey, seconded by Wilson, to approve the project. Vote was as follows: Ayes: Berkey, Wilson - Noes: None Absent: Kelly, Mills - Abstain: Reading Project approved by P. C. DP 03-77, BIDDLE DEVELOPMENT INC. for M & T INC. , APPLICANT Request for a new Development Plan consisting of 191 condominium units on the remaining 33.6 acre-portion of a planned residential development known as Mountainback, located in the PR-8 District on the west side of Highway 74, northerly of Portola (Carriage Trail) Avenue extended. Continued from the Planning Commission meeting of March 1, 1977. Staff Recommendation: Approve by Planning Commission Resolution No. 226, subject to compliance with conditions. Action: Motion by Reading, seconded by Berkey, to approve Resolution No. 226, passed with a unanimous vote. (3-0) Kelly and Mills absent. C. CONTINUED CASE N0. TT 9377, BIDDLE DEVELOPMENT INC. for M & T INC. , APPLICANT Request for approval of a Tentative Tract for a 191-unit planned residential development in the PR-8 District on approximately 33.6 acres of land located westerly of and adjacent to Highway 74, northerly of Portola (Carriage Trail) Avenue extended, known as the Mountainback Development. Continued from the Planning Commission meeting of March 1, 1977. Staff REcommendation: Forward a recommendation for approval to the City Council by Planning Commission Resolution No. 227 , subject to compliance with conditions. Action: Motion by Berkey, seconded by Reading, to approve Resolution No. 227, passed with a unanimous vote (3-0). HILL, APPLICANTS A request for an Amendment to Article 25.46 of the Palm Desert Zoning Ordinance to Change the Zone from Multi-Family Residential (R-3(4)) to General Commercial (C-1) on a 1.9-acre parcel located south of El Paseo and east of Ocotillo Drive. Staff Recommendation: Approve by Planning Commission Resolution No.228 . Action: Motion by Reading, seconded by Berkey, to approve Resolution No. 228, was unanimously carried (3-0). Kelly and Mills absent, E. CASE N0. CUP 02-77, STEPHEN HERMAN and COLIN McDERMOTT, APPLICANTS Request for a Conditional Use Permit to build a private health club on two (2) adjacent parcels on the north side of Alessandro Drive, 420 feet east of Portola Avenue. Staff Recommendation: Approve by Planning Commission Resolution No. 229, subject to compliance with conditions. Action: Motion by Berkey, seconded by Reading, to approve Resolution No. 229, was unanimously carried (3-0). Kelly and Mills absent. F. CASE N0. DP 05-77, 0. MICHAEL HOMME, APPLICANT A request to amend the Development Plan for the Sandpiper Condominium Project to permit construction of a duplex on an 18,700 square foot parcel located north of Pitahaya and east of Shadow Mountain Drive. ' Staff Recommendation: Approve by Planning Commission Resolution No. 230, subject to compliance with conditions. Activn: Motion by Rea'ding, seconded by Berkey, to approve Resolution No. 230, was unanimously carried (3-0). Kelly and Mills absent. VII. OLD BUSINESS - None VIII. NEW BUSINESS A. Request for the Planning Commission to Initiate Amendment to the Zoning Ordinance and Zoning Map to Reflect Changes in Service Industrial Uses and Zoning for the Area adjacent to 18th Fairway Drive. Staff Recommendation: By Planning Commission Resolution No.231 , set for Public Hearing on May 3, 1977. Action: Motion by Berkey, seconded by Berkey, to approve Resolution No. 231, was unanimously carried (3-0). Kelly and Mills absent. IX. DESIGN REVIEW BOARD ITEMS A. Review of Cases acted on by the Design Review Board at their meeting of March 29, 1977. Staff Recommendation: Approve the Design Review Board actions by Planning Commission Resolution No. 232. Action: Motion by Reading, seconded by Berkey, to approve Resolution No. 232, was unanimously carried (3-0).
