Hurlburt, requested that I respond to your above referenced letter opposing annexation of your Merle Drive property to the City. In May of this year, two property owners in the Country Club Village Estates tract did request that the City initiate annexation of that area, which would include the Country Club Village Estates. As a result of that request, the Council, by Resolution #74-42 dated June 13, 1974, did initiate annex- ation proceedings on some 320 plus acres which does. include the 10 acres owned by you on Merle Drive. This office proposes to submit this annexation request to the Local Agency Formation CTmission (LAFCO), this month. It is possible that the LAFCO will hold a hearing on this matter on October 16, 1974. If this hearing is held, LAFOO will "notice" the matter and would accept any protest against the annexation request. To verify that this hearing is going to be held, I would recommend that you contact Mr. Robert Fitch, Executive Director, LAFCO, at the County Courthouse in Riverside. The reason for the City initiating these proceedings is based on the fact that the property in question is adjacent to the City boundry and that the inclusion of this property in the City would be a logical extension of the City boundry. The consideration by LAFCO of this request is only the initial step in a long process which would include the circulation of a petition and the holding of an election on the annexation. I am of the opinion that this area would be better served if it were annexed to the City of Palm Desert in terms of the services offered by the City. Fitch- We have been advised that the City of Palm Desert has ' referred to you its application for authorization to annex to the City of Palm Desert, certain lands adjoin- ing the present boundaries for that city . We have previously informed the city manager of the op- position to such annexation by the Valley Industrial Park and wish by this letter to go on record opposing such an- nexation, as it affects that area . The Valley Industrial Park is zoned industrial by the County of Riverside, and plans for its development as an industrial park, have been underway for some period of time . All of this is known to the City of Palm Desert, whose real purpose we believe in seeking annexation, is to destroy the industrial park now contemplated . The industrial park consists of 38 .5 acres, and begins at the northwest. corner of the intersection of Merle Drive and Cook . The city manager for the City of Palm Desert .has publicly declared, on more than one occasion, the intention of the city with respect to this industrial park, which we feel goes. far beyond the scope of annexation . Page -2- that the city manager publicly stated, in a meeting and on a radio interview, that the main thrust behind the annexa- tion was to prevent the construction of the industrial park The industrial park is uninhabited, as is surrounding ter- ritory, all of which may be affected by the annexation pro- ceeding . We estimate approximately 90 acres of uninhabited land to be so affected . As previously stated, this industrial park is zoned industrial, and is not now available for resi- dential use . Our evaluation of the situation,_leads us to believe that Government Code sections 35100 through 35158 and 35300 through 35326 are controlling, as is the decision of the court in Johnson v . City of San Pablo, 132 CA 2d 447, 283 P 2d 57 . We request that you advise us as to all hearings which may be held concerning the annexation proceeding, and that the Valley Industrial Park be in fact excluded from any such an- nexation. Smith, requests that the City Council consent to the initiation of annexation proceedings in the area shown on the attached map. Since the area proposed for annexation does include more than 12 registered voters, this request must be considered an inhabited annexation and must, therefore, follow the procedures outlined on the third attachment. The requested area to be annexed extends easterly from Portola Ave. to the quarter section line east of Cook Street and from Country Club Drive on the north and the existing City Boundary on the south. The proposed area by the applicant may cause problems during the annexation procedure because if more than the owners of 50% of the assessed value of the area to be annexed protests, the annexation cannot go through.
