HomeMy WebLinkAboutANNEXATIONS COOK STREET/WHTEWATER STORM CHANNEL NO 24 FILE 2 1988 REso MCN ND.?�R-aS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ANNEXING CERTAIN CONTIGUOUS TERRITORY TO SAID CITY UNDER THE PROVISIONS OF THE CORTESE/KNOX LOCAL GOVERNMENT REORGANIZATION ACT OF 1985, WHICH PROCEEDINGS ARE DESIGNATED AS PALM DESERT ANNEXATION NO. 24 LAFCO NO. 88-51-4. WHEREAS, on March 24, 1988, the City Council did adopt Resolution No. 87- IM initiating annexation proceedings for Annexation No. 24; and WHEREAS, the Local Agency Formation Commission of the County of Riverside adopted its Resolution No. 02-89 on February 23, 1989, making determinations and approving the proposed annexation to the City of Palm Desert of territory described in Exhibits A & B, attached hereto and by this reference incorporated herein; and WHEREAS, the reasons for the annexation are: 1. The proposed territory to be annexed is adjacent to and substantially surrounded by the City of Palm Desert, and, therefore, represents a logical expansion of the city's boundary. 2. The area is predominately urban in character and requires a higher level of urban services than are currently offered by the County of Riverside. The City of Palm Desert can provide these services which include higher levels of police, fire, paramedic and general code enforcement. WHEREAS, the regular county assessment roll is utilized by this city; and WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of this city; and WHEREAS, a public hearing on this annexation was called for and held by this council on March 23, 1989, and this council finds and determined that the value of written protests filed and not withdrawn is less than 25 percent of the number of owners of land owning less than 25 percent of the assessed value of land within the territory to be annexed. INITIATED BY: City of Palm Desert, 73-510 Fred Waring Drive, Palm Desert, California 92260. LEGAL REQUIREMENTS: This proposal has met all legal filing requirements. The map and legal description were approved by the County Surveyor on October 12, 1988. The City of Palm Desert conducted an environmental assessment which resulted in the filing of a negative declaration. POPULATION: The applicant estimates the population within the proposed annexation is zero. The Registrar of Voters reports there are no registered voters within the affected area. LAND USE: The proposed annexation is located within the Upper Coachella Valley Land Use Planning Area and is subject to the Western Coachella Valley Community Policies. Under the Western Coachella Valley Plan, the area is designated industrial manufacturing, water resources and 2-B (Urban Residential with 2-5 dwelling units per acre permitted) . The Open Space and Conservation Map of the Comprehensive General Plan designates the site as "Areas Not Designated As Open Space." LAFCO 88-51-4 December 8, 1988 Page 2 The subject area is currently zoned R-1-12,000 (Single-family Residential, with minimum lot size of 12,000 sq. ft. ) , R-1 (Single-family Residential , with 80-ft. minimum frontage and 9,000 sq. ft. minimum lot size) , W-1 (Watercourse, Watershed and Conservation Areas) , M-SC (Manufacturing-Service Commercial) and I-P (Industrial Park) . The City of Palm Desert has prezoned the area Service Industrial , Public Institutional and Open Space. MARKET VALUE: The County Assessor reports the total 1988-89 land value is $5,640,953 and structure value is $4,333, 754 for a total market value of $9,974,707. COMMENTS: The proposed annexation encompasses approximately 222 acres and is generally located east of Cook Street between the Whitewater Storm Channel and 42nd Avenue. The site is uninhabited, contiguous to the City of Palm Desert and consistent with the City's sphere of influence. An industrial park comprises approximately 48 acres of the site and the Coachella Valley Water District sewage treatment facility comprises approximately 138 acres of the site. The remaining area includes the storm channel and additional vacant undeveloped properties. The City of Palm Desert gives the following reasons for initiating the proposed annexation: 1. "The proposed territory to be annexed is adjacent to and substantially surrounded by the City of Palm Desert, and therefore, represents a logical expansion of the City' s boundary. 2. The area is predominately urban in character and requires a higher level of urban services than are currently offered by the County of Riverside. The City of Palm Desert can provide these services." Additionally, the City of Palm Desert indicates this annexation would eliminate a narrow strip of County unincorporated territory immediately adjacent to the City and thus lead to more efficient patterns of providing urban services. FISCAL IMPACTS: The County Auditor-Controller reports the total property taxes generated within the affected area are $99,747. At present, the County's Share of the property tax is approximately 29.73 percent, or $29,655. In accordance with the negotiated property tax split agreement between the County of Riverside and the City of Palm Desert, the City would receive 25 percent of the County' s share or approximately $7,414. The remainder of the taxes generated will continue to be divided among the other affected agencies including: County Free Library, Desert Sands Unified School District, Coachella Valley Water District and Coachella Recreation and Park District, just to name a few. Additionally, this annexation would also result in a corresponding exchange in LAFCO 88-51-4 December 8, 1988 Page 3 service responsibility. For example, the County would no lonqer be responsible for providing a number of services, including but not limited to: police and fire protection (unless by contract) , planning and land use regulations, street cleaning and maintenance and building inspection. However, certain Countywide services such as health, general hospital , social services and justice systems would continue to be the responsibility of the County. To provide for these ongoing services, the County would retain approximately $65,436 of the property tax generated within the affected area. Due to the limited amount of developable vacant land, it is not anticipated that any future development will have any major fiscal implications. PLAN FOR THE PROVISION OF MUNICIPAL SERVICES: To support its application, the City of Palm Desert has submitted a Plan for the Provision of Municipal Services. Following are excerpts from that Plan: - Water and Sewer: The area is currently provided with water and sewer services by the Coachella Valley Water District (CVWD). The District currently has water and sewer lines located along the streets within the proposed annexation site. If necessary, CVWD could provide additional service through line extensions from existing facilities should future development warrant the extension of such facilities. In addition, CVWO's sewage treatment plant is located within the boundaries of the proposed annexation. - Police Protection: If annexed, the City of Palm Desert would provide police protection service under contract with the Riverside County Sheriff' s Department. Existing equipment and manpower include: 4 cars, 20 officers and a full-time crime prevention officer. The City estimates response time to the annexation site would be 3-5 minutes. - Fire Protection: If annexed, the City of Palm Desert would provide fire protection services under contract with the Riverside County Fire Department. The area is within a 3-5 minute response zone from the Portola Avenue and Country Club Drive fire station. Manpower and equipment include: 54 full-time personnel , 15 volunteers, 4 pumpers, 2 rescue squads, 2 rescue salvage vehicles and 2 paramedic units. SUMMARY: - The proposed annexation is contiguous to the City of Palm Desert and consistent with the City's sphere of influence. - The area is legally defined as uninhabited, as there are fewer than 12 registered voters within the proposed boundaries. - The City of Palm Desert has prezoned the site Service Industrial , Public Institutional and Open Space. - The City of Palm Desert is willing and able to extend municipal services as required. DESCRIPTION OF SERVICES The area proposed to be annexed is currently being developed and is served by the Southern California Edison Electric Ccupany, Southern California Gas Company, General Telephone Company, Palmer Cable Vision, Coachella Valley Water District and the Coachella Valley Recreation and Park District. The provisions of these utilities will not be impacted by the proposed annexation. Services provided directly by the City of Palm Desert would be in land use planning, building and safety, building code review and inspections, public works - street cleaning maintenance and repair, abatement of public nuisances and general code enforcement. By contract, the city provides for trash disposal with Palm Desert Disposal and police, fire and paramedic service with the County of Riverside through the Tri-Cities District. II. LEVEL OF SERVICE Current utility service would be maintained and improved as demands requires by the various utility companies and special districts. Land use planning, building and safety review and inspection and general code enforcement would be provided on the basis of need. Police Services: The City of Palm Desert provides, under contract with Riverside County Sheriff's Department, 4 cars and 20 officers per 24 hour period in addition to a full-time crime prevention office at city hall. On a daily basis 112 hours of police services are provided. See attached memo from Lieutenant Bowser for more details. RI V. CO. Back-up coverage by County Fire Department stations in Bermuda Dunes and Rancho Mirage. Mutual aid agreement with City of Indio. Fire Insurance Classification: source of rating: Robinson Is Rating Service, 4 to 6. Adjacent uninoorporated area, 6 to 9. The area is within the five minute response zone of both the Portola and Indian Wells fire stations. Backup would be provided by the Town Center, Rancho Mirage, Bermuda Ares and Thousand Palms stations. Paramedic ambulance service would be provided by the Indian Wells fire station. III. TIMING, OF SERVICE EXTENSIONS City services would be available immediately in the areas of planning, building and general code enforcement, road maintenance and repair, police, fire and paramedic. The extension of new facilities (ie: sewers) and road redesign (ie: curb, gutters and storm drains) would be timed according to the needs and desires of the residents and property owners in the area. IV. FINANCING Generalized city services for the area would be financed through property taxes and state subventions tied to increased population. The expanded level of police, fire and paramedic services.would be financed through the special fire tax of approximately $40/year for a typical 5,000 square foot industrial building. New commercial buildings would be required to pay a one time fire facility fee of $.10 per square foot. The city in general has experienced a substantial increase in sales tax and hotel occupancy tax revenues which will provide increasing levels for existing and new services to Palm Desert residents.
