RESOLuri N NO, 90-133 A RESOLUTION OF APPLICATION BY THE CITY OF PALM DESERT REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE CHANGE OF ORGANIZATION KNOWN AS PALM DESERT ANNEXATION NO. 27. RESOLVED, by the City Council of the City of Palm Desert, that WHEREAS, the City of Palm Desert desires to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for annexation; and WHEREAS, the territory proposed to be annexed is uninhabited and a description for the boundaries of the territory is set forth in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with the sphere of influence of the City of Palm Desert; and WHEREAS, the reasons for this proposed annexation are as follows: 1. The proposed territory to be annexed is part of the city's sphere of influence and is adjacent to the City of Palm Desert and therefore represents a logical expansion of the city's boundary. 2. The area is experiencing development pressures and requires a higher level of urban services then are currently offered by the County of Riverside. The City of Palm Desert can provide these services. NOW, THEREFORE, this Resolution of application is hereby adopted and approved by the City Council of the City of Palm Desert and the Local Agency Formation Commission of Riverside County is hereby requested to take proceedings for the annexation of territory as described in Exhibit "A", according to the terms and conditions stated above and in the manner provided by the Cortese-Knox Local Government Reorganization Act of 1985. The area is predominately urban in character and requires a higher level of urban services than are currently offered by the County of Riverside. The City of Palm Desert can provide these services which include higher levels of police, fire, paramedic and general code enforcement. WHEREAS, the regular county assessment roil is utilized by this city; and WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of this city; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. The traffic study of the proposal is not adequate because it is still showing Level of Service "D" for some County roads affected by the _ development. The County , of Riverside circulation policy recommends Level of Service "C" or better for all County circulation system roads. We strongly recommend that adequate road improvements be incorporated into the development proposal to mitigate all County roads affected by the project to a Level of Service "C" or better. Also the traffic study analysis needs to include a table for "Intersection Improvement With Project" and "Level of Service Standard" after incorporating proposed mitigation measures. Regional impacts of the project need to be part of the traffic study utilizing current Land Use Plan for areas outside the study zone. The affected territory is generally located entirely within Section 11, north of 42nd Avenue, south of Country Club Drive and Interstate 10, east of E1 Dorado Drive and west of Oasis Club Drive and is consistent with the established sphere of influence of the City of Palm Desert. The application is initiated by the City of Palm Desert through a Resolution of Application adopted by the City Council on September 13, 1990. LEGAL REQUIREMENTS: All legal filing requirements have been met. The County Surveyor approved the map and legal description on October 26, 1990. As lead agency, the City of Palm Desert conducted an environmental review pursuant to the provisions of the California Environmental Quality Act resulting in the filing of a Negative Declaration filed with the Clerk of the Board of Supervisors on September 14, 1990. POPULATION: The affected territory is legally uninhabited as the County Registrar of Voters 'reports nC-registered—voters -within the proposed boundaries. Additionally, the applicant reports no population residing on the site. The affected territory is under two separate ownerships: Sunrise Desert Partners and Southern California Edison Company. Each have submitted written support to LAFCO for the proposed change of organization. The County General Plan indicates the territory is within the Upper Coachella Valley Land Use Planning Area, Category IIB (Urban) and is presently zoned R-1- 12, 000 (One Family Dwelling Unit, 12,000 min. lot size) . The City of Palm Desert adopted prezoning PR-5 (Planned Residential, Five Dwelling Units Per Acre) and P (Public) for the site which is consistent with the City's North Sphere Specific Plan. Proposed development for the site includes a 1270-unit residential condominium country club (Indian Ridge Country Club) ; an 18-hole golf course; and an 105,000 square foot clubhouse; a restaurant, pro shop, and health club are envisioned. The development is consistent with adjacent land uses which include similar country club/residential-type developments. Project build- out is projected to be six years. In accordance with the City's initial environmental report, the affected territory does not contain any unique geologic or physical features and is relatively flat. The site does not contain any unique, rare or endangered species of plant life but does contain habitat area for the Coachella Valley Fringe Toed Lizard, an endangered species. The developer will be required to mitigate impacts through pre-established policies and procedures. ANALYSIS: PLAN FOR THE PROVISION OF MUNICIPAL SERVICES: Law Enforcement: The City contracts with the Riverside County Sheriff's Department for law enforcement services within their corporate boundaries. A service level of 120 hours per day for city-wide patrols would be extended to the affected territory. The City's Fiscal Impact Analysis projects reasonable per capita cost increases to the City by annual increments based on expected development build-out. Fire Protection: The City receives fire protection and emergency medical services from the Riverside County Fire Department. According to station officials, a five-minute response time to the proposed annexation site can be achieved through the "first-in" engine company, Station No. 71 at Portolo and Country Club; and Station No. 31 in Bermuda Dunes. Emergency medical services will be provided from Station No. 55 in Indian Wells. For future capital facilities. expansion, the City collects an $100 development mitigation fee in addition to an annual special tax of $48 per residential unit. Transportation: Annexation boundaries extend to the centerline of 42nd street currently improved along the easterly one-half portion. It is expected that all improvements required along 42nd Street (Hovley Lane) as a condition of development will improve circulation patterns in the vicinity. Any street improvements along 42nd Street will require coordination between the City of Indian Wells and the County of Riverside, responsible agencies for the southerly right-of-way portions. To date, no response has been filed by either affected agency. FISCAL ANALYSIS• An analysis of projected fiscal impacts to the City and the County demonstrate overall positive net revenue impacts. RESOLVED, by the City Council of the City of Palm Desert, that WHEREAS, the City of Palm Desert desires to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Division 3, catmencing with Section 56000 of the California Government Code, for annexation; and WHEREAS, the territory proposed to be annexed is uninhabited and a description for the boundaries of the territory is set forth in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with the sphere of influence of the City of Palm Desert; and WHEREAS, the reasons for this proposed annexation are as follows: 1. The proposed territory to be annexed is part of the city's sphere of influence and is adjacent to the City of Palm Desert and therefore represents a logical expansion of the city's boundary. 2. The area is experiencing development pressures and requires a higher level of urban services then are currently offered by the County of Riverside. The City of Palm Desert can provide these services. NOW, THEREFORE, this Resolution of application is hereby adopted and approved by the City Council of the City of Palm Desert and the Local Agency Formation Cartnission of Riverside County is hereby requested to take proceedings for the annexation of territory as described in Exhibit "A", according to the terms and conditions stated above and in the manner provided by the Cortese-Knox Local Government Reorganization Act of 1985. CITY OF PALM DESERT, CLAIFORNIA. BE IT RESOLVED by the City Council of the City of Palm Desert in regular session assembled on this 24th day of Sept. 1981, that: 1. The County of Riverside and the City of Palm Desert are the agencies whose area or responsibility for service would be affected by annexations to the City of Palm Desert, 2. Representatives of each of the affected agencies have met and negotiated an exchange of property tax revenue as follows, to become effective for tax purposes beginning July 1, 1981, for all areas annexed to the City until such time as this resolution is rescinded or superceded. A. The City of Palm Desert shall assume responsibility for all general municipal services to areas annexed as are required by law or presently provided throughout the City, and for such service, the City shall receive 25% of that portion of the property tax revenue generated wll:hin territoricr annexed under the ad valorem tax rate established by Article X111 A of the Constitution of the State of California, that represents the County of Riverside's share of such property tax revenue. B. The County Auditor shall upon annexation by the City convert the above-established percentage figure into actual dollar figures and thereafter allocate to the City such property [ tax revenue in accord with the provisions of Section 95 et. seq. of the Revenue and Taxation Code. 3. The City Council of the City of Palm Desert does hereby agree to the above-recited exchange of property tax revenue. 4• The Clerk shall transmit a certified copy of this resolution to each affected agency and to the Executive Office of the Local Agency Formation Commission and to the Auditor of the County of Riverside pursuant to Section 99 of the Revenue and Taxation Code.
