NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the territory described in Exhibits "A" and "B" attached hereto and made a part hereof by reference, be and the same is hereby, by this resolution annexed to the City of Palm Desert. 2. That the city clerk is hereby instructed and directed to transmit a certified copy of this resolution to LAFCO along with any other required submittals. INITIATED BY: City of Palm Desert, 45-275 Prickly Pear Lane, Palm Desert, California 92260. LEGAL REQUIREMENTS: This proposal has met all requirements of the law. The map and legal description were approved by the County Surveyor on September 20, 1982. The City of Palm Desert, serving as lead agency for environmental review, determined the annexation would not have a significant effect on the environment. A negative declaration was filed, and no appeals have been submitted. However, County Planning staff has offered some comments as described subsequently under "Land Use." POPULATION: There is no population at the present time. LAND USE: According to the Cove Communities General Plan, the site is designated as Open Space and Planned Communities which allows a density of three or less dwelling units per acre. The Open Space and Conservation Elements designated the site as a rural area. Current zoning is R-2-12,000 (Multiple-family Dwellings, 12,000 square feet minimum lot size) and W-2-20 (Controlled Development Area, 20-acre minimum lot size) . Existing land use is vacant. According to the Coachella Valley Blowsands Regi;n Map, the site is located in an active blowsand area. In addition, the northeasterly portion of the site may be subject to noise intrusion from the railroad inasmuch as rail traffic along this line is quite heavy. County Planning Department staff ROBERT J. In addition, the Planning .Department is considering a change of zone for property located northerly of the proposed annexation. Under Change of Zone 3604, the appli- cant proposes to amend the zoning from W-2-20 to I-P (Industrial Park) on approxi- mately 133 acres located adjacent to Interstate 10 and southeasterly of Kubic Road. According to the Desert Regional Team of the County Planning Department, this annexa- tion would block future expansion of the proposed industrial park into the City of Palm Desert. If Change of Zone 3604 is ultimately approved by the Board of Supervisors; and if the proposed annexation results in a planned residential develop- ment, two potential areas of conflict may result. First of all , there would be a conflict between increased passenger car traffic along Monterey Avenue and heavy trucking required for industrial activity. Secondly, the border between residential development and industrial park necessitates an effective buffer to mitigate noise and other nuisance factors associated with industrial activity. MARKET VALUATION: The County Assessor reports 1982 market value for land to be $9,424,950, structure value at $14,242 for a total market valuation of $9,439,192. COMMENTS: The area proposed for annexation is generally located westerly of Interstate 10, north of Frank Sinatra Drive including Section 32, and 90 acres within Section 29, Township 4 South, Range 6 East. The city was initially approached by two property owners who represent the 90 acres in Section 29 and 480 acres in Section 32. These landowners anticipate constructing a Planned Residential Development which generally envisions approximately 1,280 residences with 20 acres reserved for com- mercial development. The city has prezoned the majority of this property as PR-5 (Planned Residential Development, 5 dwelling units per acre) and 20 acres as PC-2 (Neighborhood Commercial ) . The applicant states this proposed development should in- crease population in .the area by 3,000 when it is targeted for full occupancy by the year 2000. MUNICIPAL SERVICES: In its plan for the provision of municipal services, the city acknowledges it is a contract city with several basic services provided either by independent agencies or .another jurisdiction by contractual agreement. . Highlights of the plan include: - Water and Sewer - These services are provided by the Coachella Valley Water District. The District has stated it is willing and able to serve this proposed development. Such services would be available whether or not the property is annexed. - Police and Fire - The city contracts with the County of Riverside for law enforcement and fire protection services. With respect to both, the city would be required to provide additional police vehicles when development occurs as well as a fire station in this area which has also been designated in the city' s General Plan. The city indicates LAFCO #82-33-4 November 12, 1982 Page 3 in its plan for services that the fire facility will be financed pri- marily by the levy of a $100 per residential unit fee for those developments outside the five-minute response area as well as a $100 fee per 1,000 feet of commercial space. Those services directly provided by the city would include planning and building, public works, parks, general administration, and code enforcement. In addition to those mentioned above, the city would also provide for trash disposal by contract. Public transportation is offered by the Sunline Agency. BOUNDARY CONFIGURATION: Prior to submitting its application, the city expanded the proposal to include all of Section 32 to provide a more logical extension of city boundaries. The city also acknowledged in its application the boundary problem associated with Palm Desert Greens, a 400-acre mobilehome subdivision occupied by approximately 1,200 permanent residents . This community is located directly south of the proposed annexation in Section 5, Township 5 South, Range 6 East. If the Commission approves the annexation without including Palm Desert Greens, an island of unin- corporated territory will be created. The City perceives this differently and offered a State Attorney General 's Opinion (#60-258) to support its position that this area does not constitute an island of unincorporated territory. The opinion was published in 1961,- prior to the establishment of LAFCO and prior to the enactment of MORGA (Municipal Organization Act of 1977) . This opinion, dating 21 years ago, concluded that: "applicable legislation did not prohibit annexation of unincorporated territory even though such annexation results in an island of unincorporated territory surrounded by the annexing city on three sides and a different city on the remaining side." County Counsel was requested to evaluate this opinion and its applicability to the proposal now before the Commission for consideration. The Commission's legal counsel has advised that: - The legislation on which this opinion was based has been repealed by statues (with the enactment of the Municipal Organization Act of 1977) and, therefore, this opinion should not be given great weight in the deliberations of the Commission; - No subsequent opinions of the Attorney General could be located which interpret or clarify this opinion under current statues, subsequent to the enactment of MORGA; - There is no legal prohibition in designating the area known as Palm Desert Greens as an island, inasmuch as "island" is not con- tained within the definitional section of MORGA (G.C. Sections 35020 - 35051) . Rather, certain parts of the Act indicate that an island can include territory surrounded or zuba•tanti,atty surrounded by the city of which the annexation is proposed (G.C. 35150(a)). LAFCO #82-33-4 November 12, 1982 Page 4 Legislation has been enacted by Section 1.5 of Chapter 855 of the Statutes of 1981 which amended Government Code Section 35150 to provide, in part, that: "As a condition to the annexation of an area, which is surrounded or substantially surrounded by the city to which the annexation is proposed, the commission may require, where consistent with the purposes of this chapter, that the annexation include the entire island of surrounded or substantially surrounded territory. " Despite differences between the city.'s and LAFCO's definitional interpretation of what constitutes an "..island" of- unincorporated territory, the attached map clearly reflects that should. Annexation #14 be approved by the Commission, the remaining area would be totally surrounded by incorporated cities. The intent of MORGA obviously was to preclude the creation Of illogical boundary configurations as a result of a change in organization. The creation o f these islands or pockets of unincorporated territory contribute to confusion in the delivery of services. The City expresses the desirability of including this area, and it has, in fact, attempted to inform residents of the benefits of annexation. The city also stated its traditional policy has been not to encourage inhabited areas to annex, but rather to respond to those who actively pursue an annexation proposal with the city. t In response to the city's efforts to communicate with residents/property owners within Palm Desert Greens, there was considerable opposition to annexation expressed both verbally and in writing. The City of Palm Desert has also submitted a 160-acre annexation proposal bordering Palm Desert Greens on Portola Avenue. It is generally located within the southwest quarter of Section 4, Township 5 South, Range 6 East. Regrettably, sufficient in- formation had not been returned in order to schedule both cases on the same agenda. This matter, however, will be heard in three weeks at the Commission's next meeting on December 9. Since this is a separate proposal, it must have an opportunity for public hearing; but approval of Annexation No. 14, including the expanded Palm Desert Greens, should be conditioned upon the ultimate approval of Annexation No. 15. This quarter section is currently bordered by the City of Palm Desert on three sides; and without considering it as an integral component of this proposal would potentially create a separate island of unincorporated territory. The compelling factor in this case remains that one of the basic tenets upon which LAFCO was established continues to be a responsibility to discourage urban sprawl and promote the orderly development of local governmental agencies by approving Zogiea.e changes in organization. PROPERTY OWNERS' DESIRES: The applicant states the proposal now involves 27 property owners, and concurrence has been received from 22 of these landowners. Although one property owner has communicated regularly with LAFCO staff, written concurrence of the other landowners has not yet been submitted with the application. LAFCO #82-33-4 November 12, 1982 Page 5 SUMMARY: - The proposed annexation is contiguous to the City of Palm Desert and within its sphere of influence; - The applicant reports a majority of the affected property owners concur with the proposal ; - Approval of the annexation would create an island of unincorporated territory which would be substantially surrounded by the City of Palm Desert on three sides and totally surrounded by two incorporated cities including Palm Desert and Rancho Mirage. - Annexation of a substantial territory (738 acres) without in this surrounded unincorporated community would result in an inappro- priate boundary configuration for the City of Palm Desert; - Since residents/property owners of Palm Desert receive their basic services from independent agencies and the County by contractual agreement, property owners within this area proposed for annexation can develop their land within the County as an alternative to annexation; - Initial resistance from Palm Desert Greens to annexation should not deter the city's willingness to communicate with property owners. One particular area of leverage invovles the city' s abiltiy to provide a higher level of law enforcement through its contract with the county. Recent publicity noted that Palm Desert Greens' residents had initiated a volunteer police patrol in an effort to curtail burglaries. Responsiveness to the needs of this particular community may open the door for offering higher levels of other urban services which could positively influence the perspective of these residents with respect to the effects of annexation. RECOMMENDATIONS: Based upon the factors outlined above, it is recommended that the Commission: 1. Certify it has 'reviewed and considered the City's environmental assessment on this annexation which resulted in the filing of a negative declaration; 2. Approve Annexation #14 to the City of Palm Desert with the following conditions: a. That the boundaries be modified to include the territory as reflected on Map "B" and the legal description dated November 8, 1982. LAFCO #82-33-4 November 12, 1982 Page 6 b. CITY OF PALM DESERT TRANSMITTAL LETTER TO: Honorable Mayor and City Council DATE: August 12, 1982 SUBJECT: Plan for Services for Palm Desert Annexation No. 14 I. INTRODUCTION: Pursuant to Section 35102 of the State Government Code, the city is required to file with any new annexations effective January 1, 1978, a plan outlining the method by which services will be provided in the area to be annexed. This report represents the required plan for services for proposed Annexation No. 14. The City of Palm Desert, being a contract city, must rely on many other agencies to provide for services both in the community and areas subsequently annexed. In addition, many services provided such as water and sewer, electricity and gas are provided without regard to city limit lines. Therefore, the area proposed to be annexed is presently served or has the capability of being served by many of these agencies. The fact is substantial by the letters received from responsible agencies as a part of the environmental review process and in conjunction with preannexation zoning considerations. The major emphasis of this report is to address those services provided directly by the city either through city staff or direct contract with the city by other agencies. In addition, wherever possible, this report will address the methods by which other service agencies would provide needed facilities in the area. 11. DESCRIPTION OF SERVICES: The utilities which would be extended into the area proposed to be annexed would be as part of actual development and they would consist of the services of the Coachella Valley County Water District in the area of water and sewer, Southern California Edison Company in the area of electricity, Southern Califronia Gas Company in the area of gas, General Telephone Company in the area of telephone and Able Cable in the area of cable television. The services provided by this city directly, would be in planning and building, public works, parks, administration and code enforcement services. By contract the city would also provide for trash disposal, police and fire services. Public transportation would be provided by the Sunline Agency. The major road improvement would include the construction of Frank Sinatra Drive along the southern boundary of the property west to Monterey Avenue. Public park needs in the area to be annexed will partially be fulfilled by on-site recreational amenities. In addition, land dedication and in-lieu fees will be collected as development occurs for the implementation of the recreation element of the Palm Desert General Plan. III. LEVEL AND RANGE OF SERVICES: The level and range of services provided would include sufficient sized water and sewer, gas and electrical facilities to service development proposed for the area. Planning and building, public works and code enforcement services as provided by the city directly, would be on the basis of need. Police, paramedic and fire service capability exist to meet the need of the area at its present stage of development and are proposed to be expanded to meet the needs of subsequent development in the area. Public transportation would be provided by the expansion of the existing system to serve the area. Subsequent development will result in the need for the city to add additional police vehicles and the need for an additional fire station in the vicinity of Country Club Drive. A fire station has been planned for in the city's general plan in this area and will be provided at the time it is needed It will be financed by a $100.00 per unit fee charged to develoments presently outside the five minute response area of existing facilities. In addition, said area will be served by a proposed fire station on the extension of El Paseo, south of 44th Avenue, the existing Palm Desert station at E1 Paseo and Highway 74 with backup being provided by the Rancho Mirage, Thousand Palms and Bermuda Dunes stations. The basic administration services of planning, building, public works and code enforcement would be provided by existing city staff. IV. TIMING FOR SERVICE EXTENSIONS: Basic utility services would occur as a part of development. The city has on file letters from the various utilities assuring us that these services would be available. The city services would be available immediately in the area of planning, building and code enforcement, public works and police and fire. Road improvements would occur as a part of new development. The fire facility would be constructed prior to December 1983. Parks would be built as development occurs through dedication and collection of in-lieu fees. V. REQUIREMENTS OF NEW DEVELOPMENT AND FINANCING: New development would be required to extend roads around the area and to provide for needed municipal facilities through the city's subdivision ordinance. A fire facilities fee of $100.00 per residential unit and $100.00 per 1,000 square feet of commercial space will be used to construct the necessary fire facilities. The provision of planning and building services would be provided through the fees generated from new development. Ongoing maintenance of roads created in the area, would be provided on the basis of sales tax generated from commercial facilities in the area. The city has never actively pursued annexation nor will it force annexation upon unwilling inhabitants of any area. The proposed Annexation No. 14 is comprised of 730 acres of uninhabited territory contained in Section 32 and 29, T45 R6E. It is contiguous along a one mile line with the existing city boundaries. In July of 1981, two property owners representing 480 acres of Section 32 and 90 acres in Section 29, approached the city requesting annexation. The city determined that the remaining 160 acres of Section 32 would have to be included to meet the requirements of the Municipal Organization Act. A letter was sent to the remaining property owners and petitions requesting annexation were received covering 115 of the 160 acres. There were no letters indicating a negative response. There was no opposition at the preannexation zoning public hearing. Prompted by a suggestion from the Local Agency Formation Commission, staff embarked on a program to include Section 5, T55 R6E directly south of Section 32 in the proposed annexation. Within this section is Palm Desert Greens, a 400 acre mobile home subdivision occupied by approximately 1,200 permanent residents and over 1,800 property owners. In November of 1981, the city sent each property owner within Section 5, a self addressed stamped questionnaire and a letter discussing the advantages of annexation. Three months later, city staff and representatives of the fire department met with over 400 property owners at a homeowner association meeting. The results of the questionnaire and the input of the meeting indicated overwhelming opposition to annexation. On May 27, 1982, see attached letter, the board of directors unanimously passed a resolution opposing annexation. On July 8, signed petitions opposing annexation representing over 51% of the registered voters in Section 5 were submitted to the city. If Section 5 was included in the proposed annexation, these petitions would instantly terminate the proceedings. To comply with the wishes of both the residents of the inhabited territory and the property owners of Section 32 and 29, Annexation No. 14 will include only the 730 acres designated in Exhibit A. As is discussed in the State Attorney General's Opinion 60-258.
