A RESOLUTION OF THE CITY COUNCIL OF THE CITY Of
PALM DESERT , CALIFORNIA. ANNEXING CERTAIN
CONTIGUOUS TERRITORY TO SAID CITY UNDER THE
PROVISIONS OF THE CORTESE/KNOX LOCAL GOVERNMENT
REORGANIZATION ACT OF 1985. WHICH PROCEEDINGS
ARE DESIGNATED AS PALM DESERT ANNEXA_T10N NO7,2

LAFCO NO. 87-07-A.
WHEREAS, on November 13, 1986, ' the City Council did adopt Resolution No.
86-117 initiating annexation proceedings for Annexation No. 21 ; and
WHEREAS, the Local Agency Formation Commission held a public hearing
relative to Annexation No. 21 on May 28, 1987, and approved said annexation
with the determination that the City Council of the City of Palm Desert be
authorized to proceed without notice and hearing; and
WHEREAS, the proposed annexation represents a logical extension of the
City of Palm Desert's boundaries and will not be taxed for existing general
bonded indebtedness by the City of Palm Desert, and the regular Riverside
County assessment roll shall be utilized in the future.
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
I 1 . That the territory described in Exhibits "A" and "B" attached
hereto and made a part hereof by reference, be and the same is hereby, by this
resolution annexed to the City of Palm Desert.
2. That the city clerk is hereby instructed and directed to transmit
seven (7) certified copies of this resolution to LAFCO along with any other
required submittals.
PASSED. APPROVED, and ADOPTED at a reaular meetinq of the Palm Desert

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, DETERMINING THE
AMOUNT OF PROPERTY TAX REVENUE TO BE EXCHANGED
BETWEEN THE COUNTY OF RIVERSIDE AND THE CITY
OF PALM DESERT RELATING Tr ANNEXATIONS TO THE
CITY OF PALM DESERT, CLA1 RNiA.
BE IT RESOLVED by the City Council of the City of Palm
Desert in regular session assembled on this 24th day of Sept.
1981, that:
1. The County of Riverside and the City of Palm Desert
are the agencies whose area or responsibility for service
would be affected by annexations to the City of Palm Desert.
2. Representatives of each of the affected agencies have
met and negotiated an exchange of property tax revenue as follows,
to become effective for tax purposes beginning July 1, 1981,
for all areas annexed to the City until such time as this
resolution is rescinded or superceded.
A. The City of Palm Desert shall assume responsibility
for all general municipal services to areas annexed as are
required by law or presently provided throughout the City, and
for such service, the City shall receive 25% of that portion
of the property tax revenue generated within territories annexed
under the ad valorem tax rate established by Article XIII A of
the Constitution of the State of California, that represents
the County of Riverside's share of such property tax revenue.
B. The County Auditor shall upon annexation by the City
r convert the above-established percentage figure into actual
• 1 dollar figures and thereafter allocate to the City such property
Il tax revenue in accord with the provisions of Section 95 et. seq.
of the Revenue and Taxation Code.
3. The City Council of the City of Palm Desert does hereby
agree to the above-recited exchange of property tax revenue.
4. The Clerk shall transmit a certified copy of this
resolution to each affected agency and to the Executive Office
of the Local Agency Formation Commission and to the Auditor of
the County of Riverside pursuant to Section 99 of the Revenue
and Taxation Code.

Palm Desert City Council, held on this 24th day of September,

The filing of the above-noted annexation does not meet the requirement ocal
tax purposes. �����11111
Article II, Paragraph J, of our Agreement for State Administration of Local Sales
and Use Taxes provides that the city agrees to furnish two maps of the annexed
area with appropriate addresses for city sales and use tax purposes. Annexations
are processed by this Department to identify any business in the area so that
your city will receive the local sales and use tax collected.
Please send two (2) maps with street addresses inserted or with two lists of all
streets with inclusive number. In either case, the streets must be delineated on
the maps. If the territory is undeveloped, a statement to that effect should be
placed on the map. The maps should clearly define the existing city limits and
the area which has been annexed. If the annexation map does not show adjacent
city streets, then a locator map should also be provided. Also, when the city
and county are using different block numbering systems for the same area, we
should be provided with both.
You can send the maps directly to the Local Tax Unit, Department of Business
Taxes at the above address. The annexation will be processed for local tax
purposes as soon as the maps are received.

PALM DESERT. CALIFORNIA, ANNEXING CERTAIN
CONTIGUOUS TERRITORY TO SAID CITY UNDER THE
PROVISIONS OF THE CORTESE/KNOX LOCAL GOVERNMENT
REORGANIZATION ACT OF 1985. WHICH PROCEEDINGS
ARE DESIGNATED AS PALM DESERT ANNEXATION NO. 21
LAFCO NO. 87-07-4.
WHEREAS. on November 13. 1987, the City Council did adopt Resolution No.
86-117 initiating annexation proceedings for Annexation No. 21 ; and
WHEREAS, the Local Agency Formation Commission held a public hearing
relative to Annexation No. 21 on May 28. 1987, and approved said annexation
with the determination that the City Council of the City of Palm Desert be
authorized to proceed without notice and hearing; and
WHEREAS, the proposed annexation represents a logical extension of the
City of Palm Desert's boundaries and will not be taxed for existing general
bonded indebtedness by the City of Palm Desert, and the regular Riverside
County assessment roll shall be utilized in the future.
NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Pa 1 m
Desert. California, as follows:
1 . That the territory described in Exhibits "A" and "B" attached
hereto and made a part hereof by reference. be and the same is hereby, by this
resolution annexed to the City of Palm Desert.
2. That the city clerk Is hereby instructed and directed to transmit
seven (7) certified copies of this resolution to LAFCO along with any other
required submittals.

SUBJECT: LAFCO 87-07-4--ANNEXATION 21 TO CITY OF PALM DESERT
PROPOSAL:
This is a proposal to annex approximately 24.68 acres to the City of Palm
Desert for municipal services.
INITIATED BY:
City of Palm Desert, 73-510 Fred Waring Drive, Palm Desert, California 92260.
LEGAL REQUIREMENTS:
This proposal has met all legal requirements. The map and legal description
were approved by the County Surveyor on March 13, 1987. The City of Palm
Desert prepared an environmental assessment and determined the proposed
annexation would not have a significant effect on the environment. A negative
declaration was filed, and no comments have been submitted.
POPULATION:
The applicant states there is no population within the proposed annexation and
the Registrar of Voters reports there are no registered voters within the
boundaries.
LAND USE:
The Riverside County General Plan (Western Coachella Valley Plan) designates
this area as Category 2B. Category 28 uses permit urban residential uses to
range from two to five dwelling units per acre.

The zoning of the property is R-1-9,000 (Single-family Residential , 9,000
square feet minimum lot size per dwelling) . The City has prezoned the
property P-R-7 (Senior Overlay)•. There are no pending land use applications
in the proposed annexation site with the County.
The applicant proposes a 276-unit housing development, which is inconsistent
with the County's General Plan designation of two to five units per acre;
however, the proposal is consistent with the City's General Plan. The County
Planning Department has no objection to the proposed annexation.
MARKET VALUE:
The County Assessor reports the full 1986 land value is $816,000. The parcel
had no structure value for the 1986 tax year.
COMMENTS:
The area proposed for annexation is generally bounded by the Whitewater River
Storm Channel to the north, Fred Waring Drive to the south, easterly of Cook
Street and westerly of Washington Street. The territory is contiguous to the
City of Palm Desert and within the City's sphere of influence. The site
consists of a single parcel of land under one ownership. The sole property
owner has submitted written documentation in support of the proposed
annexation.
In its application, the City of Palm Desert indicates the property owner
desires to develop the property under the jurisdiction of the City. Planned
development for the area includes rental senior retirement housing.
The City of Palm Desert has identified the following reasons which support the
proposed annexation:
1 . The request is a logical extension of the City's boundaries.
2. The proposed annexation is consistent with the Act which encourages
limiting the number of annexations to those areas considered logical
growth areas.
3. The proposed annexation is of satisfactory size to provide municipal
services without adversely affecting the rest of the community.
PLAN FOR THE PROVISION OF MUNICIPAL SERVICES_:
To support the proposed annexation, the City of Palm Desert has submitted a
Plan for the Provision of Municipal Services. Following are excerpts from
that Plan:

- Water and Sewer: The proposed annexation is located within the
jurisdiction of Coachella Valley Water District. Service will be
extended to the site via line extensions from existing facilities
located along Cook Street.
- Police Protection: The City of Palm Desert contracts with the Riverside
County S eri f' s Department for law enforcement services. Currently,
the City contracts for 120 hours per day for citywide patrol to be
expanded as needs require.
- Fire Protection: The City also contracts with the County of Riverside
for fire protection services. The proposed annexation is located within
five-minute response zone of the Indian Wells Fire Station. Back up
would be provided by the El Paseo/Town Center and Portola, Rancho
Mirage, Bermuda Dunes and Thousand Palms Station.
Paramedic ambulance service would be provided by the Indian Wells Fire
Station.
SUMMARY:
- The area proposed for annexation is within the City of Palm Desert's
sphere of influence and contiguous to the City.
- Property owner support for annexation to the City of Palm Desert has
been obtained.
- The City of Palm Desert has demonstrated its willingness to extend
municipal services to the site.
- Annexation would provide a logical extension of the City's boundaries
and facilitate the delivery of public services.
- The City has prezoned the property P-R-7 and plans for a 276-unit senior
housing project for the site.
RECOMMENDATIONS:
Based upon the factors outlined above, It Is Recommended that the Commission:
1 . Certify it has reviewed and considered the City's environmental assessment
which resulted in the filing of a negative declaration;
2. Find that the annexation is uninhabited;
3. Find that all affected property owners have given written consent to the
annexation;
4. Find that the annexation is consistent with the City of Palm Desert's
sphere of influence and the spheres of influence of all affected agencies;

6. Designate the City of Palm Desert as Conducting Authority and authorize

INITIAL STUDY OF ENVIRONMENTAL IMPACTS
I . EARTH
The site is an Isolated wedge between two highly developed man made
structures : the Whitewater Channel and Fred Waring Drive. While the
engineering of the project must take into account possible slope stability
adjacent to the storm channel . there are no unique geological problems
associated with the site. The proposed project will not have any special
impacts other than those normally ocrurring when land is graded and
building constructed. These impacts are mitigated through the city's
site development ordinances.
2. AiR
The low levels of traffic and total mileage generated by senior citizens
along with the project's proposed private transit system will have a
lower impact on air quality than alternate residential uses.
3. WATER
There will be no significant impacts on water movements as a result of
the rezoning or development . Drainage problems would be addressed
through standard engineering practices.
4. 8 5. NATURAL RESOURCES AND ENERGY
:The proposal represents an efficient use of land and other nonrenewable
natural resources.
8. RiSK OF UPSET
The proposal will not involve hazardous substances.
9. ECONOMIC USES
The project will not contribute to loss due to flood or geologic risk.
10. NOISE
Senior citizen developments generate less noise than any other alternate
land uses other than undeveloped open space.
11 . LAND USE
The proposed land use will remain residential . The total mass of
buildings will increase over lower density residential land uses. The
ratio of area covered by buildings to open landscaped are will be similar
to lower density residential uses.

12. OPEN SPACE
The site is not designated open space.
13. POPULATION
The rezone and precise plan will result in a higher total population on
the site compared to a lower density residential use. This increase is
mitigated by significant lower activity levels of the senior citizen
residents.
14. EMPLOYMENT
The high levels of service associated with the type of senior housing
proposed will generate more employment than a typical residential
development.
15. HOUSING
The proposal will greatly expand the supply and variety of senior housing
available in the area.
16. TRANSPORTATION CIRCULATION
The type of senior housing proposed represents the lowest rate of traffic
generation of any residential use. Using the 2.8 trips from the Institute
of Traffic Engineers ( 1976) for a development of this type, a potential
of 773 daily trips might be generated. this is equivalent to the trips
generated by the site If It were developed as a single family detached
subdivision of 77 units (3 . 4 du/acre - 10 ADT per unit) . Traffic
generated by a senior housing development has a lower impact in general
since it is spread more evenly throughout the day Instead of being.
concentrated into short peak commute periods as is the case in standard
family housing. This particular site is also located in a major Sunline

access hazards. Traffic courts (ADT) on Fred Waring Drive range from
6220 east of Cook Street to 12 ,003 at Deep Canyon. Capacity is
approximately 24.000 ADT.
17. PUBLIC SERVICES
Senior citizen developments generally required fewer public services than
typical family housing. The type of development proposed will provide
residents with most essential services on-site as well as provided
transportation off-site.
18. PUBLIC FISCAL BALANCE
Due to the low level of public services required by senior citizen
projects. the proposed will not significantly impact public fiscal
balance.

The various utilities have indicated their ability to serve the project.
20. HUMAN hIEALTH
Project will increase level of health care available to senior citizens.
21 . SOCIAL SERVICES
Since the proposal provides many required social services on-site, there
will not be a significant Impact on publicly provided services.
22. AESTHETICS
Adherence to height and setback requirements of the PR zone and senior
overlays will protect the view of adjacent parcels. Overall architectural
design of the project will be of high quality.
23. LIGHT AND GLARE
Downshining lighting will be employed to minimize spillover to adjacent
areas.
24. ARCHEOLOGICAL/HISTORICAL
The site does not contain any significant archeological or other

I. INTRODUCTION:
Pursuant to Section 56653 of the State Government Code. the city is
required to file with any new annexations a plan outlining the method by
which services will be provided in the area to be annexed. This report
represents the required plan for services for proposed Annexation No. 21 .
The City of Palm Desert. being a contract city. must rely on many other
agencies to provide for services both in the community and areas
subsequently annexed. In addition, many services provided such as water
and sewer, electricity and gas are provided without regard to city limit
lines: therefore, the area proposed to be annexed is presently served or
has the capability of being served by many of these agencies. The fact
is substantiated by the letters received from responsible agencies as a
part of the environmental review process and in conjunction with
oreannexation zoning considerations.
The major emphasis of this report is to address those services provided
directly by the city either through city staff or direct contract with
the city by other agencies. In addition, wherever possible this report
will address the methods by which other service agencies would provide
needed facilities in the area.
ll . DESCRIPTION OF SERVICES:
The utilities which would be extended into the area proposed to be
annexed would be as part of actual development and they would consist of
the services of the Coachella Valley County Water District for water and
sewer, Southern California Edison Company, Southern California Gas
Company, General Telephone Company and Able Cable. The services provided
by this city directly would be in planning and building, public works,
parks, administration and code enforcement services. By contract the
city would also provide for trash disposal , police and fire services.
Public transportation would be provided by the Sunline Agency.
There are no major road improvements necessary to facilitate access to
the subject property.

Station. The present Riverside County Sheriff contracts 120 hours per day
citywide patrols which will be expanded as needs require.

from commercial facilities in the area. in summary, it is felt that
development of this area would result in a balance between needed services

WHEREAS, the California Environmental Quality Act has been complied with,
pursuant to City Council Resolution No. 80-89, in that all responsible agencies
have been contacted and a negative declaration has been prepared.
WHEREAS, the City Council has determined that the proposed change of
organization Is appropriate for the following reasons:
1 . The request is a logical expansion of the city boundaries.
2. The proposed annexation Is consistent with the Municipal Organization
Act which encourages limiting the number of annexations to those
areas considered logical growth areas.
3. The proposed area to be annexed is of satisfactory size to provide
