A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, MAKING APPLICATION TO THE
LOCAL AGENCY FORMATION COMMISSION FOR A CHANGE OF
ORGANIZATION KNOWN AS , "PALM DESERT ANNEXATION NO . 7 , "
PURSUANT TO SECTION 35140 OF THE STATE GOVERNMENT
CODE .
I WHEREAS , one hundred percent of the property owners have
111 requested, by petition, within the area hereafter known as , Palm
Desert Annexation No . 7 , " and more particularly described in the
attached map and legal description; and
WHEREAS , the California Environmental Quality Act has
been complied with, pursuant to City Council Resolution No. 78-32 ,
in that an Environmental Impact Report has been prepared and certi-
fied as complete by the City Council of the City of Palm Desert; and
WHEREAS , the City Council has determined that the proposed
change of organization is appropriated for the following reasons :
1. The request is a logical expansion of the City boundaries .
2 . The proposed annexation is consistent with the Municipal
Organization Act of 1977 which encourages limiting the
number of annexations to those areas considered logical
growth areas .
3 . The proposed area to be annexed is of satisfactory size
to provide municipal services without adversely affecting
rthe rest of the community.
NOW, THEREFORE , BE IT RESOLVED by the City Council of the City
111 of Palm Desert, California, as follows :
1 . The above recitations are hereby determined to be true
and correct and represent the findings of the Council in
this matter .
2 . The City Clerk is hereby instructed to file an official
application with the Local Agency Formation Commission
for Palm Desert Annexation No . 7 , pursuant to the Muni-
cipal Organization Act of 1977 for uninhabited territory
since less than twelve registered voters reside in the
area.
PASSED, APPROVED and ADOPTED at a regular meeting of the
Palm Desert City Council , held on this day of 1979 , by
the following vote, to wit :

Beginning at a point in the southerly line of the City of Palm Desert, County
of .Riverside, State of California, said point being the common Section corner
of Section 6 and 31 , Township 6 South, Range 6 East, and Sections 1 and 36,
Township 6 South, Range 5 East, San Bernardino Base and Meridian;
Thence, easterly along the aforementioned common Section line of Section 6
and 31 , a distance of 1 ,154.58 feet to a point, said point being the center-
line of State Highway No. 74;
Thence, South 170 55' 56" West along the centerline of State Highway No. 74,
a distance of 3,410.71 feet to a point;
Thence, South 890 39' 59" West, a distance of 213.58 feet to a point;
Thence, South 000 01 ' 00" East, a distance of 1 ,662.25 feet along the easterly
line of the aforementioned Sections 1 and 6 to a point, said point being the

This will confirm my telephone conversation
today with Paul Williams and supplements the telegram
sent this date concerning the above matters .
It is the decision of Western Allied Properties,
Inc . to withdraw its Petition for Annexation filed on or
about August 3, 1978, which Petition is the subject of
Annexation No . 7. The reasons for this decision are
numerous, all of which at one time or another have been
stated by the applicant at public hearings , both before
the Planning Commission and the City Council and no
purpose would be served by repeating them here .

tract is coming up for expiration, and the applicant is
requesting an extension of time because of the extreme
complexity of the design of the subdivision and its improve-
ments wherein the applicant was required to do a great deal
of offsite drainage study work, additional storm drain
design, and revision to the maps to accommodate the Depart-
ment of Public Works ' s request to revise the ingress-egress
to the subdivision along Haystack. Mr. Williams stated
that upon receipt of the request , Staff reviewed the conditions
and found there was no need for additional conditions . Staff
recommended approval .
Councilman Wilson asked where the project stood now, and
Mr. Beebe responded that their plans were now in Plan Check.
He pointed out that his department had held the project up
because of. the realignment of a street.
Mayor Mullins declared the Public Hearing open and invited input
in FAVOR of the extension.
i MRS . BETTY WILLIAMS , Division Manager , -Lewis Homes , stated
that they were just about out of Plan Check and have received
Improvement Agreements . She stated that it was taking a
little longer than anticipated due to the change requested
by Mr. Beebe.
Mayor Mullins invited input in OPPOSITION to the -extension, and
none was offered. He declared the Public Hearing closed.
Councilman McPherson moved and Councilman Wilson seconded to
waive further reading and adopt. Resolution No. 79-3 , approving a one
year extension of time. Motion carried on a 4-0-1 vote.
E. CASE 0. TT11_883 FFILIATED CONSTRUCTION COMPANY, APPLICANT:
Consid t ' a Request for Approval of a 1-Year Extension
of Time on the Approval of a Tentative Tract Map to Create 65
Lots to Provide for a Condominium Hotel , 7 Single-Family Resi-
dences , and 57 Condominium Units on Approximately 17 . 8 Acres
Generally Located Between Highway 111 and Candlewood Street ,
West of Palm Desert-Indian Wells City Limit Line.
Mr. Williams stated that this subdivision .will not expire
until the end of February, but the applicant has requested
an extension of time. He has had problems with his engineer-
ing and financing and is requesting a one-year extension.
Staff reviewed the conditions of approval and found that no
additional requirements were necessary. Staff recommended
approval of the extension.
Mayor Mullins declared the Public Hearing open and invited input
in FAVOR of the extension. None was offered.
Mayor Mullins invited input in OPPOSITION to the extension , and
none was offered. He declared the Public Hearing closed.
Councilman McPherson moved and Councilman Newbrander seconded
to waive further reading and adopt Resolution No . 79-4 , approving a
1-year extension of time. Motion carried on a 4-0-1 vote.

In accordance with the proposed annexation of the
real property described below located in the County of
Riverside, pursuant to the Uninhabited Territory Act of 1939,
as amended, Government Code §§35300-35326, we respectfully
represent as follows :
1 . Pursuant to those certain Option Agreements
dated March 22 , 1978 and April 26 , 1978 , both of which are
recorded in the office of the County Recorder of Riverside
County in Book 1978, page 60700 and Book 1978 , page 100411,
respectively, the undersigned is the prospective owner of
that certain real property described on Exhibit A attached
hereto and incorporated herein by reference and bearing
Assessor ' s Parcels as follows :
