A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNEXING CERTAIN
CONTIGUOUS TERRITORY TO SAID CITY UNDER THE
PROVISIONS OF THE MUNICIPAL ORGANIZATION ACT
OF 1977, WHICH PROCEEDINGS ARE DESIGNATED AS
ANNEXATION NO. 13.
WHEREAS, on August 13, 1981, the City Council did adopt Resolution No. 81-118
p
initiating annexation proceedings for Annexation No. 13; and
i. : WHEREAS, the Local Agency Formation Commission held a Public Hearing relative
to Annexation No. 13 on January 14, 1982, and approved said annexation with the
recommendation that the City Council of the City of Palm Desert be authorized to
proceed; and
WHEREAS, a duly noticed Public Hearing was held by the City Council at their
regularly scheduled meeting of March 11, 1982, at which time all persons desiring to be
heard did give input and 'no written protests were filed by any owners of land and
improvements within the territory to be annexed.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. That the territory described in Exhibits "A" and "B" attached hereto and made a
part hereof by reference, be, and the same is hereby, by this Resolution annexed to the
City of Palm Desert.
2. That the City Clerk is hereby instructed and directed to transmit a certified
copy of this Resolution to LAFCO along with any other required submittals.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNEXING CERTAIN
CONTIGUOUS TERRITORY TO SAID CITY UNDER THE
PROVISIONS OF THE MUNICIPAL ORGANIZATION ACT
OF 1977, WHICH PROCEEDINGS ARE DESIGNATED AS
ANNEXATION NO. 13.
WHEREAS, on August 13, 1981, the City Council did adopt Resolution No. 81-118

initiating annexation proceedings for Annexation No. 13; and

to Annexation No. 13 on January 14, 1982, and approved said annexation with the

6 BE IT RESOLVED AND DETERMINED by the Local Agency Formation
7 Commission in regular session assembled on January 14, 1982, that
8 the annexation of approximately 1407 acres generally located to the
9 north of the City of Palm Desert, as more particularly described in
10 Exhibit "A", attached hereto and made a part hereof, to the City of
11 Palm Desert, is approved .
12 BE IT FURTHER RESOLVED, DETERMINED AND FOUND that:
13 1. Preliminary proceedings were commenced by Resolution of
14liapplication by the City of Palm Desert.
1511 2. The owners of land within the territory to be annexed
161have not given written consent to the annexation.
171 3. The annexation is proposed to provide development of

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, DETERMINING THE
AMOUNT OF PROPERTY TAX REVENUE TO BE EXCHANGED
BETWEEN THE COUNTY OF RIVERSIDE AND THE CITY
OF PALM DESERT RELATING TO ANNEXATIONS TO THE
. CITY OF PALM DESERT, CLAIFORNIA.
BE IT RESOLVED by the City Council of the City of Palm
Desert in regular session assembled on this 24th day of Sept .
1981, that :
1 . The County of Riverside and the City of Palm Desert
are the agencies whose area or responsibility for service
would be affected by annexations to the City of Palm Desert.
2 . Representatives of each of the affected agencies have
met and negotiated an exchange of property tax revenue as follows ,
to become effective for tax purposes beginning July 1 , 1981 ,
for all areas annexed to the City until such time as this
resolution is rescinded or superseded.
A. The City of Palm Desert shall assume responsibility
for all general municipal services to areas annexed as are
required by law or presently provided throughout the City, and
for such service, the City shall receive 25% of that portion
of the property tax revenue generated within territories annexed
under the ad valorem tax rate established by Article XIII A of
the Constitution of the State of California, that represents
the County of Riverside' s share of such property tax revenue.
B. The County Auditor shall upon annexation by the City
convert the above-established percentage figure into actual
dollar figures and thereafter allocate to the City such property
tax revenue in accord with the provisions of Section 95 et, seq.
of the Revenue and Taxation Code .
3 . The City Council of the City of Palm Desert does hereby
agree to the above-recited exchange of property tax revenue.
4. The Clerk shall transmit a certified copy of this
resolution to each affected agency and to the Executive Office
of the Local Agency Formation Commission and to the Auditor of
the County of Riverside pursuant to Section 99 of the Revenue
and Taxation Code.

CALIFORNIA, MAKING APPLICATION TO THE LOCAL AGENCY FORMATION
COMMISSION FOR A CHANGE OF ORGANIZATION KNOWN AS, "PALM
DESERT ANNEXATION NO. 13" , PURSUANT TO SECTION 35140 OF THE
STATE GOVERNMENT CODE

WHEREAS, one hundred percent of the property owners have given their
consent to be included in the area known as, "Palm Desert Annexation No. 13"
and more particularly described in the attached map and legal description; and
WHEREAS, the California Environmental Quality Act has been complied
with, pursuant to City Council Resolution 80-89, in that all responsible
agencies have been contacted and a Negative Declaration has been prepared in con-
junction with preannexation zoning consideration; and,
WHEREAS, the City Council has determined that the proposed change,of
organization is appropriate for the following reasons:
1 . The request is a logical expansion of the City boundaries.
2. The proposed annexation is consistent with the-Munici-pa-
Organizat-ion :Act of 1977-which encourages limiting the
number of annexations to those areas considered logical
growth areas.
3. The proposed area to be annexed is of satisfactory size
to provide municipal services without adversely affecting
the rest of the community.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1 . The above recitations are hereby determined to be true
and correct and represent the findings of the Council in
this matter.
2. The City Clerk is hereby instructed to file an official
application with the Local Agency Formation Commission
for Palm Desert Annexation No. 13, pursuant to the Muni-
cipal Organization Act of 1977 for uninhabited territory
a since less than twelve registered voters reside in the
area.

proposal by the City of Palm Desert to annex 1,496 acres located between Country
Club Drive and Interstate 10. This annexation is identified by LAFCO #81-48-4
(Your No. 13) . Please provide information and comments on the following.
Palm Desert proposes to annex a very large area without a showing of the reasons
therefor. The application states that, "The proposed annexation represents a
logical expansion at present city limits. The city is in a position to offer
future urban residents a higher level of community services." How did you deter-
mine that the area is a "logical" expansion? Please explain your rationale. Keep
in mind that the area now is totally vacant, and that you project it will not be
built-out until the year 2000. Specifically, how does the City of Palm Desert
justify an annexation now of 2. 34 square miles of territory (an increase in city
boundaries of over 20%) which apparently will not be occupied for 20 years? Which
part or parts of the annexation require urban services in the near-term future?
Please show in detail approved projects and projects in-the-works, including types
of developments, numbers of units (housing/commercial ) and estimated completion
dates. I would appreciate it if you would avoid generalities.
I invite your attention to the attached map, which shows your proposed annexation
and adjoining territory. You will note that the proposed annexation effectively
forms an island of unincorporated territory. For this purpose, "island" is defined
as any territory substantially surrounded. The configuration of the annexation is
not in consonance with recognized standards of planning. I suggest that you may
wish to review again the proposed boundaries.

COMMENTS:
This is a proposal by the City of Palm Desert to annex approximately 2.34 square
miles (1496 acres) to the city. The territory is adjacent to Palm Desert on the
north side. The territory is vacant desert land in eight ownerships.
The city states that it desires to annex this territory because it ". . . respresents
a logical expansion at present city limits. The city is in a position to offer
future urban residents a higher level of community services. "
A consortium of land owners has been organized to promote development of the land.
Ambitious development plans of the consortium include construction of major roads,

Improvement Bond Act of 1915 by formation of an assessment district and the issuance
of bonds.
Palm Desert reports that build-out of the 2.34 square miles might not occur for
20 years. The city does have proposals before it for construction of a mobile
home subdivision and a conventional residential subdivision in the area proposed
for annexation.
Commissioners will note by reference to the-attached__map that the_proposed annx;
ati.on:�eff_ectively forms=an;'island of unincorporated territory _Thisisland_
contains a developed community_of..some 1500 .residents.As Commissioners know,
the charge to the Commission_in. the Knox-Nis.bet..Act_is to U-omote_ordevly_forma;
tion of_governmenta-i-a eencies._Creating-an_effective island.and-isolating a large
de-veloped_cummunity cannot be considered orderly or logical .
While not specifically mentioned by Palm Desert as a reason for requesting annex-
ation, it seems apparent that a consideration of the city is a desire to control
land use in the area , thus assuring development satisfactory to the city. This
in itself is not a compelling reason to annex. Proper and orderly development
in an unincorporated area which is within a city's sphere of influence can be
assured by close, coordinated planning between the County planning agency and the
city planning agency. However, we must point out that there is a disparity between
the County General Plan and the Palm Desert General Plan in the area proposed for
annexation. The County General Plan designates the area as open space, Planned
Development or Very Low Residential . The latter two designations permit three
units per acre. The city's general plan allows from three to fi.ve units per acre
to as many as seven to 18 units per acre.
Because the land proposed for annexation is vacant, there can be no present require-
ment for urban services. And because the city envisages build-out to be well into
the future, there is no urgent need to annex to provide urban services. This sug-
gests that annexation need not be immediate. A counter-argument will be that
developers are anxious to press forward and need to know whether they can or must
work with the city in planning. .
Palm Desert informs us that the city is working on annexation of the %A4&A4L in
a separate proposal . A preferable course of action would be to annex the developed
community first, then look at the vacant desert land which the city now proposes
to annex. The developed community is adjacent to Palm Desert and in itself
represents a logical annexation. Alternatively, it might be acceptable to include
the two territories in one annexation, although it would represent a large expanse
of land -- most of which does not require urban services. Another alternative is
to reduce the size of the proposed annexation so that formation of an island is
precluded.
To annPY thp territorynow proposed by Talm Desert and then at a future date find
that the developed community cannot _annexen wni Id create an untenable situation.
The Commission would cr to an isolated area.
A solution is to permit the City of Palm Desert to re-examine its expansion to
the north. This can be done by denying this annexation without prejudice, thus
allowing the city to reapply at any time.

As I mentioned on the telephone last Friday, I should like to have information in
addition to that provided in your October 20 letter on the matter of the proposed
Palm Desert Annexation #13 (.LAFCO 81-48-4) .
My perception at this point of your annexation indicates that two principle reasons
exist for your proposal : first a desire to control land use and, second, to
generate development fees. I emphasize that this is my analysis made on the infor-
mation submitted by your city so far, and I am confident you will wish to comment
on this .
You mention in your October 20 letter that your city wishes to insure that develop-
ments within the area to be annexed adhere to the same planning policies and
development standards as the incorporated area. That is one reason for establishing
spheres of influence. It is anticipated that the city and the county will coordinate
on development within the sphere so there is homogeneous planning. There should be
no difficulty in fashioning a master plan for development if coordination is effected.
In this regard, please inform me of the actions taken by your city to engender and
to facilitate joint planning in the area proposed for annexation.
You state that two projects have received Conditional Use Permits. Since these
CUPS have not been issued by the County, I assume they were issued by the city. It
would be helpful if you would inform me of your attorney's opinion on issuance of
CUPS in unincorporated territory.
You say that your proposed annexation does not create an island of unincorporated
territory. The Municipal Organization Act of 1977 speaks of an unincorporated
island as territory substantially surrounded by a city. Your proposal would leave
an island of unincorporated territory surrounded by over 92% of Palm Desert, which
is substantial .

SUBJECT: Plan for Services for Palm Desert Annexation No. 13
I . INTRODUCTION:
Pursuant to Section 35102 of the State Government Code, the City is
required to file with any new Annexations effective January 1 , 1978, a
plan outlining the method by which services will be provided in the area
to be annexed. This report represents the required plan for services for
Proposed Annexation No. 13. The City of Palm Desert, being a contract City,
must rely on many other agencies to provide for services both in the
community and areas subsequently annexed. In addition, many services provided
such as water and sewer, electricity and gas, are provided without regard
to city limit lines. Therefore, the area proposed to be annexed is presently
served or has the capability of being served by many of these agencies. The
fact is substantial by the letters received from responsible agencies as a
part of the Environmental Review process, and in conjunction with pre-
annexation zoning considerations.
The major emphasis of this report is to address those services provided
directly by the City either through City Staff or direct contract with the
City by other agencies. In addition, wherever possible, this report will
address the methods by which other service agencies would provide needed
facilities in the area.
II. DESCRIPTION OF SERVICES:
The utilities which would be extended into the area proposed to be annexed
would be as part of actual development and they would consist of the services
of the Coachella Valley County Water District in the area of water and sewer,
Southern California Edison Company in the area of electricity, Southern
California Gas Company in the area of gas, General Telephone Company in the
area of telephone, and Able Cable in the area of cable television. The services
provided by this city directly would be in planning and building, public
works, parks, administration and code enforcement services. By contract the
City would also provide for trash disposal , police and fire services. Public
transportation would be provided by the Sunline Agency.
The major road improvements would include extension of Cook Street from
Country Club Drive, to I-10, Portola Avenue from Country Club Drive to 36th
Avenue, Frank Sinatra Drive between Del Safari Road and Portola Drive, 36th
between Portola and I-10 and Kansas Road between 36th Avenue and Del Safari
Road.
Public park needs in the area to be annexed will partially be fulfilled by
on-site recreational amenities. In addition, land dedication and in-lieu
fees will be collected as development occurs for the implementation of the
Recreation Element of the General Plan.
III . LEVEL AND RANGE OF SERVICES:
The level and range of services provided would include sufficient sized
water and sewer, gas, and electrical facilities to service development
proposed for the area. Planning and building, public works, and code enforce-
ment services as provided by the City directly, would be on the basis of
need. Police and fire services capability exist to meet the need of the area
at its present stage of development and are proposed to be expanded to meet
the needs of subsequent development in the area. Public transportation would
be provided by the expansion of the existing system to serve the area. Sub-
sequent development will result in the need for the City to add additional
police vehicles and the need for an additional fire station in the vicinity
of Country Club Drive.

III. LEVEL AND RANGE OF SERVICES (CONTINUED)
Since fire services are provided on a volunteer basis in conjunction
with the County of Riverside and State Department of Forestry, the
City would be required to provide for a facility in the area which
would be manned by these agencies. A fire station has been planned for
in the City's General Plan in this area and will be provided at the
time it is needed. It will be financed by a $100 per unit fee charged
to developments presently outside the five minute response area of
existing facilities. In addition, said area will be served by a proposed
fire station on the extension of El Paseo, south of 44th Avenue, the
existing Palm Desert Station at El Paseo and Highway 74 with backup
being provided by the Rancho Mirage, Thousand Palms and Bermuda Dunes
stations. The basic administration services of Planning, Building,
Public Works, and Code Enforcement would be provided by existing City
Staff.
IV. TIMING FOR SERVICE EXTENSIONS:
Basic utility services would occur as a part of development. The City
has on file letters from the various utilities assuring us that these
services would be available. The City services would be available
immediately in the area of planning, building and code enforcement,
public works, and police and fire. Road improvements would occur as a
part of new development. The fire facility would be constructed prior to
December 1983. Parks would be built as development occurs through
dedication and collection of in-lieu fees.
V. REQUIREMENTS OF NEW DEVELOPMENT AND FINANCING:
New development would be required to extend roads around the area and
to provide for needed Municipal facilities through the City's Subdivision
Ordinance. A Fire facilities fee of $100.00 per residential unit and
$100.00 per 1 ,000 square feet of commercial space will be used to construct
the necessary fire facilities.
The provision of planning and building services would be>provided through
the fees generated from new development. On-going maintenance of roads,
created in the area, would be provided on the basis of Sales Tax generated
from commercial facilities in the area. In summary, it is felt that develop-
ment of this area would result in a balance between needed services and
the revenues to provide said services.
