HomeMy WebLinkAboutANNEXATIONS NEC COOK STREET/44TH AVENUE NO 11 1979 L RESOLUTION NO. 79- 147 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ANNEXING CERTAIN CON- TIGUOUS TERRITORY TO SAID CITY UNDER THE PROVI- SIONS OF THE MUNICIPAL ORGANIZATION ACT OF 1977 , WHICH PROCEEDINGS ARE DESIGNATED AS ANNEXATION NO. 11 . WHEREAS , the City Council did, by Resolution No. 79-88 , adopted on July 26 , 1979 , initiate annexation proceedings for Annexation No. 11 ; and WHEREAS , the Local Agency Formation Commission held a public hearing relative to Annexation No . 11 on October 11 , 1979 , and approved said annexation with the recommendation that the City Council of the City of Palm Desert be authorized to proceed; and WHEREAS, a duly noticed Public Hearing was held by the City Council at their regularly scheduled meeting of December 13 , 1979 , at which time all persons desiring to be heard did give input , and no written protests were filed by any owners of land and improve- ments within the territory to be annexed. NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Palm Desert , California, as follows : 1. That the territory described in Exhibit "A" , attached hereto and made a part hereof by reference, be , and the same is hereby annexed, by this Resolution, to the City of Palm Desert . 2 . That the City Clerk is hereby instructed and directed to transmit a certified copy of this Resolution to LAFCO along 1 with any other required submittals . GEORGE MARZICOLA, APPLICANT : Consideration Of Approval Of A One-Year Extension Of The Approval Of A Tentative Tract Map To Create A 40-Lot Industrial Subdivision On Approximately 34. 7 Gross Acres Within The S. I . , S .P . Zone At The Southeast Corner Of Cook Street And Hovely Lane Extended. Mayor Mullins declared the Public Hearing open and asked for Staff' s report . Mr. Williams advised that the Council did consider this matter on December 28 , 1978 , as a Tentative Tract Map. Approval was granted. The applicant is requesting a one-year extension of time, and Staff finds that all conditions are still in order and recommends approval by Resolution No . 79-145 . Mayor Mullins invited input in FAVOR of the request. None was offered. He invited input in OPPOSITION to the request , and none was offered. He declared the Public Hearing closed. Councilman Brush inquired as to when the developer would be ready to commence, and Mr. Williams advised that the developer was finalizing his improvement plans and was prepared to go forward with it as soon as they were complete. Councilman McPherson moved and Councilman Wilson seconded to waive further reading and adopt Resolution No. 79-145 . Motion carried unanimously. C . CASE NO. PALM DESE4, ANNEXATION NO 11 Consideration Of pproval Or TheposedAnnexation No.: 11 , Located At The Northeast Corner Of"Ge St-r-ee-tnd 44th Avenue, To The City Of Palm Desert , California. Mr. Williams reviewed the Staff report , pointing out that Council had previously reviewed it as a zone change request . He stated that LAFCo had approved the annexation as a logi- cal extension of the City' s boundaries . Staff recommended approval. Mayor Mullins declared the Public Hearing open and invited input in FAVOR of the annexation. None was offered. He invited input in OPPOSITION to the annexation, and none was offered. He declared the Public Hearing closed. Upon question by Council , Mr. Williams noted that the City of Indian Wells had been notified of this public hearing, and no response was received. Councilman McPherson moved and Councilman Brush seconded to waive further reading and adopt Resolution No. 79-147 . Motion carried unanimously. VIII . RESOLUTIONS jA. RESOLUTION NO . 79-148 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT , ANNEXING CERTAIN CONTIGOUS TERRITORY TO SAID CITY UNDER THE PROVISIONS OF THE MUNICIPAL ORGANIZATION ACT OF 1977 , WHICH PROCEEDINGS ARE DESIGNATED AS ANNEXATION NO. 10 . Mr. Williams stated that this was a 40-acre parcel which Council had considered for prezoning for mobilehomes . It is a logical extension of the City' s boundaries , and Staff recommended approval . Councilman McPherson moved and Councilman Newbrander seconded to waive further reading and adopt Resolution No . 79-148 . Motion carried unanimously. SUBMITTED BY: The City of Palm Desert. LEGAL REQUIREMENTS: This proposal has met all requirements of the law. The map and legal description were approved by "the County Surveyor on August 8, 1979. The Planning Director filed a Negative Declaration and the appeal period ended on September 26, 1979. There were no appeals. POPULATION: Population is zero. LAND USE: Existing zoning is R-1 (Single-Family Residential) . New zoning is not proposed. ASSESSED VALUATION: Land is assessed at $63,750 (1978-79 assessed values) . COMMENTS: This proposal by the City of Palm Desert, would add approximately 44 acres to the City, at the northeasterly corner of the intersection of 44th Avenue and Cook Street, south of the Whitewater River Storm Channel . The area is within the sphere of influence of the City. The area is vacant at the present time, but is being planned for clustered condo- miniums. The City has submitted a plan of municipal services for the proposed annexation and states that while the City would furnish administration, planning and building services, public works, parks, and code enforcement, the services of police, fire, and trash disposal would be contract services. INTRODUCTION: Pursuant to Section 35102 of the State Government Code, the City is required to file with any new Annexations effective January 1, 1978 , a plan outlining the method by which services will be provided in the area to be annexed. This report represents the required plan for services for Proposed Annexation No. 11. The City of Palm Desert, being a contract City, must rely on many other agencies to provide for -services both in the com- munity and areas subsequently annexed. In addition, many services provided such as water and sewer, electri- city, gas, are provided without regard to city limit lines. Therefore, the area proposed to be annexed is presently served or has the capability of being served by many of these agencies. The fact is substantiated by the letters received from responsibile agencies as a part of the EDvironmental Review process, and in con- junction with preannexation zoning considerations. The major emphasis of this report is to address those services provided directly by the City either through City Staff or direct contract with the City by other agencies. In addition, wherever possible, this report will address the methods by which other service agencies would provide needed facilities in the area. II. DESCRIPTION OF SERVICES : The utilities which would be extended into the area proposed to be annexed would be as part of actual deve- lopment and they would consist of the services of the Coachella Valley County Water District in the area of water and sewer, Southern California Edison Company in the area of electricity, Southern California Gas Company in the area of gas, and Able Cable in the area of cable television. The services provided by this City directly would be in planning and building, public works, parks, administration and code enforcement services. By contract the City would also provide for trash disposal, police and fire services. Public transportation would be pro- vided by the Sunline Agency. The major road improvements would include the widening and improvement of Cook Street and 44th Avenue which border the site on the West and South, respectively. The creation of any local streets would be on the basis of specific projects and would be the responsibility of the developer. Ultimate development of the subject annexation and adjacent properties will necessitate a bridge crossing at the Cook Street crossing of the Whitewater Storm- water Channel. This facility would be constructed with a combination of federal grants and local participation very similar to existing bridges in the Valley. Public park needs in the area to be annexed will partially be fulfilled by on-site recreational amen- ities. Residents will also be able to take advantage of the proposed 120-acre Sand Dune Park to the north- west of the subject area. III. LEVEL AND RANGE OF SERVICES: The level and range of services provided would include sufficient sized water and sewer, gas, and electrical facilities to service development proposed for the area. Planning and building, public works, and code enforcement services as provided by the City directly, would be on the basis of need. Police and fire services capability exist to meet the need of the area at its present stage of development and are proposed to be expanded to meet the needs of subsequent development in the area. Public transportation would be provided by the expansion of the existing system to serve the area. Subsequent development will result in the need for the City to add an additional police vehicle and the need for an additional fire station in the vicinity of Country Club Drive. Since fire services are provided on a volunteer basis in conjunction with the County of Riverside and State Department of Forestry, the City would be required to provide for a facility in the area which would be manned by these agencies. A fire station has been planned for in the City' s General Plan in this area and will be pro- vided at the time it is needed. In addition, said area will be served by a proposed fire station at 44th Avenue and San Pablo (Civic Center Complex) , which is tentatively proposed for construction in 1980/81 budget year. in the meantime, the area would be served by the existing Palm Desert Station at E1 Paseo and Highway 74 with backup being provided by the Rancho Mirage, Thousand Palms and Bermuda Dunes stations. The basic administration services of Planning, Building, Public Works, and Code enforcement would be provided by existing City Staff. IV. TIMING FOR SERVICE EXTENSIONS: Basic utility services would occur as a part of develop- ment. The City has on file letters from the various utilities assuring us that these services would be available. The City services would be available immediately in the area of planning, building and code enforcement, public works, and police and fire. Road improvements would occur as a part of new development. The construction of the new fire station near Country Club Drive would result from the City ' s new construc- tion tax which would be accrued from the new development in the area, which would be 20 cents per sq. ft. of building area. Parks would be developed in the area under the City' s Subdivision Ordinance which provides for the dedication of land and/or payment of fee for community facilities and would provide for sites for the fire station and parks. The proposed residential development contemplated for the area is a condominium project, which would include a majority of necessary recreational facilities to serve the ultimate residents of the area. V. REQUIREMENTS OF NEW DEVELOPMENT AND FINANCING: New development would be required to extend roads around the area and to provide for needed sites for fire, parks and other related municipal facilities provided through the City's Subdivision Ordinance. The new Construction Tax of 20 cents per sq. ft. of building area would provide for construction and additional acquisition of these facilities. The provision of planning and building services would be provided through the fees generated from new development. On-going maintenance of roads, created in the area, would be ,provided through State Gas Taxes generated as a result of population within the area. Police ser- vices and parks maintenance would be provided on the basis of Sales Tax generated from commercial facilities in the area. In summary, it is felt that development fo this area would result in a balance between needed services and the revenues to provide said services.
