A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT , CALIFORNIA, ANNEXING CERTAIN CON-
TIGUOUS TERRITORY TO SAID CITY UNDER THE PROVI-
SIONS OF THE MUNICIPAL ORGANIZATION ACT OF 1977 ,.
WHICH PROCEEDINGS ARE DESIGNATED AS ANNEXATION
NO. 9 .
WHEREAS , the City Council did, by Resolution No . 79-6 adopted
on January 25 , 1979 , initiate annexation proceedings for Annexation
No . 9 ; and
WHEREAS , the Local Agency Formation Commission held a public
hearing relative to Annexation No . 9 on September 13 , 1979 , and
approved said annexation with the recommendation that the City
Council of the City of Palm Desert be "designated conducting
authority, authorized to proceed without notice and hearing" .
1 NOW, THEREFORE , BE IT RESOLVED by the City Council of the City
` of Palm Desert , California, as follows :
`I 1. That the territory described in Exhibit "A" attached hereto
and made a part hereof by reference be, and the same is , hereby by
this resolution annexed to the City of Palm Desert .
2. That the City Clerk is hereby instructed and directed to
transmit a certified copy of this Resolution to LAFCO along with
any other required submittals .

ANNEXATION DESCRIPTION
Beginning at a point in the easterly line of the City of Palm Desert, County
of Riverside, State of California, said point being the common Section corner
of Sections 3 and 4 and Sections 9 and 10, Township 5 South, Range 6 East,
San Bernardino Base and Meridian;
Thence, northerly along the aforementioned common Section line of Sections 3
and 4, a distance of 5,317.65 feet to a point, said point being the north-
westerly corner of said Section 3 and the common corner of Sections 3 and 4;
Thence, North 890 48' 15" East, a distance of 3,311 .14 feet;
Thence, South 010 02' 44" West, a distance of 5,314.10 feet;
Thence, South 890 44' 48" West, a distance of 3,321 .15 feet to the point of
beginning.
This parcel of land contains 404.88 acres more or less.

SUBJECT: LAFCO W79-22-4--Annexation #9 to the City of Palm Desert
PROPOSAL:
This is a proposal to annex 404.88 acres to the City of Palm Desert.
SUBMITTED BY:
The City of Palm Desert
LEGAL REQUIREMENTS:
This proposal has met all requirements of the law. The map and legal description
were approved by the County Surveyor. City of Palm Desert Resolution No. 79-6
states that provisions of the California Environmental Quality Act have been
complied with.
POPULATION :
The land is vacant -- population zero.
LAND USE:
Existing zoning is R-1 12,000. Zoning proposed by Palm Desert is residential
with a maximum of 3 dwelling units per acre.
ASSESSED VALUATION:
Land is assessed currently at $128,350.
COMMENTS:
The 404.88 acres proposed for annexation by the City of Palm Desert are vacant
except for some fencing inside the area. The surrounding area in all directions
also is vacant.

The City of Palm Desert is entertaining a proposal to develop approximately
800 condominiums (by 1981) on the property. The city feels it can provide a
higher level of service to the future residents by annexation.
Palm Desert has provided a plan for the provision of services . This plan speci-
fies that the city itself will provide planning and building, public works , parks ,
administration, and code enforcement services. The plan also states the city
would contract for police, fire, and trash disposal services (actually, structural
fire protection is provided by the County) . Utilities , including water, sewer,
electricity, gas, and cable television would be provided by existing special
districts or private companies.
The area proposed for annexation is contiguous to existing city limits . The
City in Resolution No. 79-6 certifies that this annexation has 100% property
owners consent.
Of the 405 acres, approximately 330 acres are in the sphere of influence of Palm
Desert. The remaining 75 acres are in the sphere of influence of Indian Wells .
I am mindful of the Commission's earlier decision on a Palm Desert application
for annexation which extended into Indian Wells ' sphere of influence in making
the following recommendation.
RECOMMENDATION:
That Annexation #9 to the City of Palm Desert be approved and that the City of
Palm Desert be designated as conducting authority and authorized to proceed
without notice and hearing.

SUBJECT: PLAN FOR SERVICES FOR PALM DESERT ANNEXATION NO. 9

I. INTRODUCTION
Pursuant to Section 35102 of the State Government Code, the City is required to
file with any new annexations effective January 1 , 1978, a plan outlining the
method by which services will be provided in the area to be annexed. This report
represents the required Plan for Services for Proposed Annexation No. 8. The
City of Palm Desert, being a contract city, must rely on many other agencies to
provide for services both in the community and areas subsequently annexed. In
addition, many services provided such as water and sewer, electricity, and gas
are provided without regard to city limit lines. Therefore, the area proposed
to be annexed is presently served or has the capability of being served by many
of these agencies. The fact is substantiated by the letters received from
responsible agencies during the review process.
The major emphasis of this report is to address those services provided directly
by the City, either through City staff or direct contract with the City by other
agencies. In addition, wherever possible, this report will address the methods
by which other service agencies would provide needed facilities in the area.
II. DESCRIPTION OF SERVICES
The utilities which would be extended into the area proposed to be annexed would
be as part of actual development, and they would consist of the services of the
Coachella Valley County Water District in the area of water and sewer, Imperial
Irrigation District in the area of electricity, Southern California Gas Company
in the area of gas, and Able Cable in the area of cable television. The services
provided by this City directly would be in planning and building, public works ,
parks , administration, and code enforcement services. By contract, the City
would also provide for trash disposal , police and fire services . Public trans-
portation would be provided by the Sunline Agency.
The major road improvements would include the widening and improvinq of Cook
Street, Country Club Drive, and Frank Sinatra Drive which form the
west, south and north boundaries of the area to be annexed. " The creation of any
local streets would be on the basis of specific projects and would be the respon-
sibility of the developer. Ultimate development of the area to be annexed and
adjacent areas which are either in the process of being annexed or will be
developed in other governmental jurisdictions , will necessitate a bridge crossing
at the Cook Street crossing of the Whitewater Stormwater Channel . This facility
would be constructed with a combination of Federal grants and local participation
very similar to existing bridges in the Valley.
Public park needs in the area to be annexed are minimal as the entire area will
be developed as a planned residential development which will offer residents
private recreational amenities. Residents whose recreational needs are not
satisfied exclusively by the private recreational amenities of the planned
residential development will be able to take advantage of the proposed 120-acre
Sand Dune Park to the west of the subject area.
III. LEVEL AND RANGE OF SERVICES

The level and range of services provided would include sufficient c ent sized water
and sewer, gas , and electrical facilities to service development proposed for
the area. Planning and building, public works , and code enforcement services
as provided by the City directly, would be on the basis of need. Police and
fire services capability exist to meet the need of the area at its present stage
of development and are proposed to be expanded to meet the needs of subsequent

development in the area. Public transportation would be provided by the expansion
of the existing system to serve the area. Subsequent development will result in
the need for the City to add an additional police vehicle and the need for an
additional fire station in the vicinity of Country Club Drive.
Since fire services are provided for on a volunteer basis on conjunction with
the County of Riverside and State Department of Forestry, the City would be
required to provide for a facility in the area which would be manned by these
agencies. A fire station has been planned for in the City's General Plan in
this area and will be provided at the time it is needed. In addition, said
area will be served by a proposed fire station at 44th Avenue and San Pablo
(Civic Center Complex) , which is tentatively proposed for construction in
1980/81 budget year. In the meantime, the area would be served by the
existing Palm Desert Station at E1 Paseo and Highway 74 with backup being
provided by the Rancho Mirage, Thousand Palms and Bermude Dunes stations.
The basic administration services of Planning, Building, Public Works, and
Code Enforcement would be provided by existing City staff.
IV. TIMING FOR SERVICE EXTENSIONS
Basic utility services would occur as a part of development. The City has on
file letters from the various utilities assuring us that these services would
be available. The City services would be available immediately in the area of
planning, building and code enforcement, public works , and police and fire.
Road improvements would occur as a part of new development. The construction of
the new fire station near Country Club Drive would result from the City's new
construction tax which would be accrued from the new development in the area,
which would be 20t per square foot of new construction.
The proposed residential development contemplated for the area is planned
residential which would include the necessary recreational facilities to
serve the ultimate residents of the area.
V. REQUIREMENTS OF NEW DEVELOPMENT AND FINANCING
New development would be required to improve roads within the area and to provide
for needed sites for fire and other related municipal facilities provided through
the City' s Subdivision Ordinance. The New Construction Tax of 20t per square
foot would provide for construction and additional acquisition of these facilities.
The provision of planning and building services would be provided through the
fees generated from new development. On-going maintenance of roads , created
in the area, would be provided through State Gas Taxes generated as a result of
population within the area. Police services and parks maintenance would be
provided on the basis of Sales Tax generated from commercial facilities in the
area. In summary, it is felt that development of this area would result in
a balance between needed services and the revenues to provide said services.

PALM DESERT, CALIFORNIA, MAKING APPLICATION TO THE
LOCAL AGENCY FORMATION COMMISSION FOR A CHANGE OF
ORGANIZATION KNOWN AS , "PALM DESERT ANNEXATION NO. 9" ,
PURSUANT TO SECTION 35140 OF THE STATE GOVERNMENT CODE .
WHEREAS , one hundred percent of the property owners have
requested, by petition, within the area hereafter known as , "Palm
Desert Annexation No. 9 , " and more particularly described in the

WHEREAS, the California Environmental Quality Act has been
complied with, pursuant to City Council Resolution No . 78-32 , in that
all responsible agencies have been contacted and a Negative Declaration

D. RESOLUTION NO. 79-8 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, AUTHORIZING AN AMEND-
MENT TO THE CITY HALL OFFICE SPACE LEASE .
Mr. Ortega explained that the Department of Environmental
Services had moved into space within the building previously
occupied by IBM. The terms of the lease have just been
agreed on, and Staff is requesting Council ' s approval of
the amendment.

to waive further reading and adopt Resolution No. 79-8 . Motion carried
on a 4-0-1 vote.
E. RESOLUTION NO. 79-9 - A RESOLUTION OF THE CITY COUNCIL OF
HE CITY OF PALM DESERT, CALIFORNIA, ADOPTING MID-YEAR
BUDGET ADJUSTMENTS OF THE 1978-79 FISCAL YEAR BUDGET FOR
THE CITY OF PALM DESERT.
Mr. Ortega stated that at the beginning of the fiscal year,
Staff was somewhat conservative with regard to the ensuing
year' s revenues. Staff was now happy to report that things
have turned out much better than anticipated and is requesting
that the budget be amended to reflect increased revenues . He
reviewed the increased revenues and requested approval of
increased expenditures .
Councilman Newbrander moved and Councilman Wilson seconded to
waive further reading and adopt Resolution No . 79-9 . Motion carried
unanimously on a 4-0-1 vote.
F. RESOLUTION NO. 79-10 - A RESOLUTION OF THE CITY COUNCIL

Mr. Ortega noted that one or two times during the year,
Staff must ask Council to change the Table of Classified
Positions because of increased responsibilities of employees..
In this resolution, Staff is requesting some changes in
allocations of positions , at least 3 of which deal with
CETA funding . Also requested is a change to reflect promo-
tions that have occurred in the Building Department due to
some Building Inspectors receiving their State Certificates..

IV. DISCUSSION:
Change of Zone - The applicant's (amended) request for 800 dwelling units
on 393 + gross acres results in a density of 2.035 units per acre and
would require PR-3 zoning to implement. The proposed density would ap-
pear to be consistant with current land use considerations for the north
sphere area. Subsequent to legal noticing, the applicant revised the
Development Plan to provide for twenty additional multi-family/condo-
minium units, resulting in the present request for 800 dwelling units.
To be consistent with the application of the Scenic Preservation Overlay
on properties with Cook Street frontage, any Change of Zone approval
should include the SP designation.
Development Plan - The design of the proposed project incorporates clusters
of multi-family density condominiums and single-family lots, arranged
around an 18 hole golf course and clubhouse facility.
The project is bounded by three major streets (Country Club, Cook Street,
and Frank Sinatra Drive). The main project entrance is depicted at the
approximate mid-point along the Cook Street frontage, with secondary ac-
cess points on Country Club and Frank Sinatra Drive toward the eastern
site boundary. Internal circulation is by means of a typical loop system
of private streets. The minimum private street widths that should be
maintained in the project are: 40 ft. for double-loaded streets; and,
32 ft. for single-loaded and cul-de-sac streets.
The Design detail of the condominium groups is not distinct in the develop-
ment plan submitted, but is adequate to determine schematic relationships,
given that all ordinance minimums are proposed to be met in the Design Re-
view application submittal . One proposed group of condominiums has a deadend
access street which appears to be excessively long at approximately 1 ,100
feet. Consideration should be given to looping it into one of the private
collection streets, or reducing the length. The amenities package for the
development has been previously noted, and it is observed that swimming
pools have not been detailed for the condominiums. Depending on the size
and location, a minimum of eight to twelve pools should be provided for the
condominiums.

IV. DISCUSSION: (Cont. )
Five hundred, fifty-two (552) single-family lots encompass approximately
36% of the net site area. In a number of situations throughout the site,
flag lots have been used. If these lots are to be marketed in a lot
sales program, retaining walls and decorative common property line sepa-
ration walls between the front and rear flag lots should be provided
prior to sale, so that a degree of design continuity can be achieved.
Probably the least desirable locations for lots i.n the development are
in the corners of Cook Street and Country Club, and Cook Street and Frank
Sinatra Drive; some consideration should be given to holding lots back
from these corners.
Perimeter treatment of the site will need to include a decorative boundary
wall and wind/blowsand protection planting. The design scheme for orna-
mental landscaping and parkway development will need to be estalbished in
accordance with a uniform approach for the subject streets. Planning
Division Staff will be working on developing design concepts for general
parkway treatment.
Site grading should establish drainage patterns to accommodate nuisance
waters on site. Unusual storm water volumes may be channeled to public
street where practical , and approved by the City Director of Public Works.
The general objective for development in the North Sphere Area will be to
see that this type of policy is carried out. Golf course developments
lend themselves quite easily to retaining on site waters.
V. STAFF RECOMMENDATION:
Observing the comments in the preceding report section, staff finds the
overall development concept to be quite acceptable. The Design Review
Board at their December 12, 1978, meeting, also had the apportunity to
view the development plans and reached a similar conclustion. The plans
as presented, at the selected scale, only portray a schematic representa-
tion of the attached condominium unit areas. An additional level of
detail should be defined and reviewed before proceeding to the next pre-
cise (Design Review) application stage. Therefore, it is suggested that
an amended Development Plan be presented for the attached condominiums,
but that the overall Development Plan be approved in concept as follows:
Based on the justification provided in the Resolution, it is recommended
that C/Z 13-78 and DP 20-78 be recommended to the City Council for approval
by approving Planning Commission Resolution No. _, subject to conditions.

Palm DPCPrt (No_9) was approved by the Local Agency
Formation Commission of the County of Riverside at a public hearing
on September 13, 1979
A copy of the legal description of this proposal as approved by the
Local Agency Formation Commission, is attached to this notice and is
the legal description which must be used in all further actions re-
garding this proposal. Any previous descriptions which do not conform
to this description should be corrected or destroyed.
Any special conditions,. authorizations, or amendments are noted below:
City designated conducting authority; authorized to proceed without notice and
hearing.
It is now the responsibility of your Council to proceed to complete
this annexation in accordance with the laws governing annexations to
cities.
Please notify your Local Agency Formation Commission by letter when the
annexation has been completed. If the proposal is abandoned or not
completed, please notify us within 90 days.

7I 1979, that the annexation of 404.88 acres on the east side of Cook

9 Drive, as more particularly described in Exhibit A, attached hereto
10 and made a part hereof, to the City of Palm Desert is approved.
111 BE IT FURTHER RESOLVED, DETERMINED AND FOUND THAT:
121 1. The distinctive short form designation of the proposed
13I annexation is City of Palm Desert WC 79-22-4 (Annexation No. 9) .
141 2. An environmental, assessmemt of the proposal was made
151 by the City of Palm Desert as lead agency pursuant to the

16 California Environmental Quality Act, and negative declaration
17 filed thereon by said lead agency.
18 3. The boundaries of the territory as set forth in
19 Exhibit A attached hereto and incorporated herein by this reference
20 and approved by the County Surveyor, are contiguous to the City
21 and are approved.
22 4. The territory to be annexed is uninhabited there
23 being no registered voters residing therein.
241 5. The annexation shall be subject to the terms and
25 conditions which are presently imposed on similar annexations to
26 the City.
27 6. The City of Palm Desert is designated conducting

Beginning at a point in the easterly line of the City of Palm Desert, County
of Riverside, State of California, said point being the common Section corner
of Sections 3 and 4 and Sections 9 and 10, Township 5 South, Pang-, 6 East,
San 'Bernardino Base and Meridian;
Thence, northerly along the aforementioned common Section line of Sections 3
and 4, a distance of 5,317.65 feet to a point, said point being the north-
westerly corner of said Section 3 and the common corner of Sections 3 and 4;
Thence, North 890 48' 15" East, a distance of 3,311 .14 feet;
Thence, South 010 02' 44" West, a distance of 5,314.10 feet;
