Gilligan: I am unable to execute a certificate of completion for the subject proposal dug to minor deficiencies as indicated below: 1. Rather than refer only to the annexation, your resolution must refer to each change of organization included within the approved reorganization (including the detachment from the Waste Resources Management District) , particularly in the title and in the order of the reorganization. Remaining paragraphs should at least refer to the reorganization rather than only an annexation. [Government Code Section 57082 (b) ] . 2. The exhibit referenced in the resolution includes only the approved map. The approved legal description should be part of that exhibit. There was a Notice of Determination attached to the resolution which appears to be unrelated to the reorganization. Perhaps this NOD was inadvertently substituted for the legal description. [Government Code Section 57082 (c) ] Please forward three certified copies of the corrected resolution at your earliest convenience. A copy of Resolution No. 06-97, approving the reorganization is enclosed. A copy of the map and legal description of this proposal as approved by the Local Agency Formation Commission are attached to this notice which must be used in all further actions regarding this proposal . Any previous maps . and legal description which do not conform to the attachment should be destroyed. Any special conditions, authorizations, or amendments are noted in the attached resolution, and must be complied with by your Council in its role as conducting authority. LAFCO NO. 96-19-4 WHEREAS, on June 13, 1996, the City Council did adopt Resolution No. 96-37 initiating annexation proceedings for Annexation No. 33; and WHEREAS, the Local Agency Formation Commission held a public hearing relative to Annexation No. 33 on February 27, 1997, and approved said reorganization with the determination that the City Council of the City of Palm Desert be authorized to proceed without notice and hearing; and WHEREAS, the reasons for the reorganization are: 1 . Mr. Johnson of Santa Rosa Country Club, Inc. , indicated that they had no desire to be able to develop the property with residential units . They wish to see the golf course remain and prosper. The prezoning was before Planning Commission May 7, 1996 at which time it was recommended for approval to the city council on a 5-0 vote. Prior to the Planning Commission hearing we mailed in excess of 180 legal notices to property owners within 300 feet of the site and no one spoke in opposition at the Planning Commission hearing. The second part of this matter at this time involves the adoption of a resolution requesting LAFCO to initiate proceedings . The matter will go through the city council . It has already been through the annexation committee and they directed staff to proceed. Following the council confirming the zoning it would then go to LAFCO and then come back to the city. He felt that maybe around Christmas time they would be able to say that Santa Rosa Country Club is in the city. Mr. Smith stated that the findings could be met and they were outlined in the staff report. Staff recommended approval . Chairperson Beaty opened the public hearing and asked if the applicants wished to address the commission. They declined. Chairperson Beaty asked if anyone wished to speak in FAVOR or OPPOSITION. MISCELLANEOUS A. Case No. CUP 96-4/PP 96-2 - MICHAEL FEDDERLY, Applicant Request for a determination that an amendment to condition #8 of Planning Commission Resolution No. 1725 is a director's modification pursuant to Code Section 25.72 . 120 . Mr. Smith noted that at the time the city reviewed the conditional use permit for Mr. Fedderly the applicant felt that providing a ten year lease for the parking was P 9 achievable. The bank was only prepared to grant them a three year lease, which the commission had a copy of. The condition was fairly significant, except there was another condition requiring that the whole matter be reviewed again in three years . Staff felt that mitigated some of the concerns for the reduced term of the lease. If commission had no problem with a director' s modification, which the ordinance permitted, then staff would just go ahead with it. If that was not the case and the commission felt this was not something they wanted staff to do under a director' s modification, then staff would set the matter for hearing and bring it back in about four weeks, which would be after the neighborhood was noticed. Commissioner Jonathan asked if the commission requested 12 or 14 parking spaces. Mr. Smith clarified that it was 12 as outlined in condition 8 . Mr. Rudolph stated that the director's modification was supposed to apply to minor revisions so what the commission was being asked to determine was that this was a minor revision. Chairperson Beaty asked if Mr. Rudolph had an interpretation for the commission. He replied no. Fax 619-776-1543 Phone 619-776-1542 r RESOLUTION NO. 96-37 A RESOLUTION OF APPLICATION BY THE CITY OF PALM DESERT REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE CHANGE OF ORGANIZATION KNOWN AS PALM DESERT ANNEXATION NO. 33 . RESOLVED, by the City Council of the City of Palm Desert, that WHEREAS, City of Palm Desert desires to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for annexation; and WHEREAS, the territory proposed to be annexed is uninhabited and a description of the boundaries of the territory is set forth in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with the sphere of influence of the City of Palm Desert; and WHEREAS, the reasons for this proposed annexation are as follows : .1 . The proposed territory to be annexed is adjacent to and substantially surrounded by the City of Palm Desert and therefore represents a logical expansion of the city' s boundary. 2 . The area is predominately urban in character and requires a higher level of urban services then are currently offered by the County of Riverside. The City of Palm Desert can provide these services . NOW, THEREFORE, this Resolution of Application is hereby adopted and approved by the City Council of the City of Palm Desert and the Local Agency Formation Commission of Riverside County is hereby requested to take proceedings for the annexation of territory as described in Exhibit "A" , according to the terms and conditions stated above and in the manner provided by the Cortese-Knox Local Government Reorganization Act of 1985 .
