Because of the magnitude of the proposed Project, much research and planning must be expended before a blade of dirt can be turned. Although the final realization of this Project is drawing closer, our client requires additional time to finalize plans and potential tenants. Therefore, as representatives for Gooden Industries , we are asking for a year extension on the C.U.P. granted by the Planning Commission dated January 25, 1977 . We hope you, as well as the Planning Commission, Will realize the importance of this extension and approve our request at your next scheduled meeting. DP 01-77 TO PROVIDE FOR A ONE-YEAR EXTENSION OF TIME TO ALLOW FOR THE DEVELOPMENT OF A 160-UNIT RESORT HOTEL. ( CASE NO. DP 01-77 t WHEREAS, the Planning Commission of the City of Palm Desert did receive an application from FRANCISCO URRUTIA for GOODEN IN- DUSTRIES requesting approval of a one-year extension of the period of time during which construction shall commence on a 160-unit re- sort hotel on property more particularly described as : APN 629-023-004 WHEREAS, on January 18, 1978, the Planning Commission did con- sider this request for time extension approval ; and, WHEREAS , at that time , upon receiving and considering the testimony and arguments, if any, of all_,persons who desired to be heard, said Commission did find the following facts and reasons to exist to approve the one year time extension : 1. The proposed project will not have an adverse impact on the public health, safety, or general welfare. 2 . The proposed project conforms to the requirements of the Zoning Ordinance . ( NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of Lthe City of Palm Desert as follows : 1 . That the above recitations are true and correct and consti- tute the findings of the Commission in this case. 2. That Standard Condition No. 7 for Case No. DP 01-77 is hereby amended to read as follows : 7. Construction shall commence prior to Jan . 25, 1979, other- wise said approval shall become null and void and of no effect what- soever. WILLIAMS, Secretary /ks PLANNING COMMISSION REVISED RESOLUTION NO. 327 JANUARY 18, 1978 CONDITIONS OF APPROVAL CASE NO. DP 01-77 I. STANDARD CONDITIONS: 1. The development of the property shall conform substantially with that as shown on plot plan marked Exhibit 'A-1' and related Exhibits B & C on file with the Department of Environmental Services, Case No. DP 01-77, unless otherwise amended by the following conditions. The plot plan marked Exhibit A is hereby denied. 2. Prior to the issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following public agencies: County Department of Public Health City Engineer-City of Palm Desert Palm Desert Design Review Board Process City Fire Marshall-City of Palm Desert Coachella Valley County Water District Regional Water Quality Control Board #7 Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of is- suance of a building permit for the use contemplated herewith. 3. A landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Process. The building permit when issued shall include the grading, lighting, amenities, trash storage, walkways , swimming pool equipment, and irrigation systems. No final inspection or occupancy shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. 4. The Fire Protection Requirements as specified in the Fire Marshall ' s memo dated January 12, 1977, attached hereto, shall apply. 5. Construction of the development permitted hereby shall be done as a single project. 6. The sewerage disposal system shall be submitted to and approved by the Coachella Valley County Water District prior to issuance of a building permit. . 7. Construction shall commence prior to January 25, 1979, otherwise said approval shall become null and void and of no effect whatsoever. 8. Prior to the issuance of any permits, the applicant shall agree in writing to any conditions of approval. 9. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements , limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which here- after may be in force. II. SPECIAL CONDITIONS: 1. The maximum uses approved by this Development Plan are as follows: - 156 unit hotel - 8,000 square foot restaurant - 7,500 square feet of commercial uses which must be clearly auxiliary to the proposed hotel REVISED 1-18-78 CASE NO. DP 01-77 recreation facilities totalling 12,000 square feet of building area, and their related open recreation areas which are construed as auxiliary to the hotel activity. 2. The applicant shall underground all existing and proposed overhead utility distribution lines on the property and/or along the full frontage of the project. 3. The applicant shall be responsible for the improvement of 44th Avenue for the full frontage of the property to City Standards and as approved by the City Engineer on the basis of a 70' half street right-of-way. Improvements shall consist of, but not be limited to: a. Completion of curb, gutter, and related tie-in paving for the full frontage. b. Installation of a meandering 10' wide P.C.C. pedestrian and bicycle path for the full length of the subject property. c. Street lights as required by the City Engineer. d. Landscaping, sprinkler system, and earth berming of a minimum average height of three feet above the ultimate curb height as approved by the Director of Environmental Services. e. Any required drainage structures as deemed necessary by -the City Engineer to guarantee drainage from 44th Avenue to the Palm Valley Channel will occur. 4. The applicant, subject to an encroachment permit issued by the State of California Department of Transportation and approval of the City Engineer, shall be responsible for the improvement of the full frontage of the property on Highway 111 on the basis of 55' half street right-of- way. Said improvements shall include, but not be limited to: a. Completion and/or modification of the curb, gutter, and tie-in paving to provide for the proposed deceleration lane. b. Street lights. c. Landscaping and sprinkler system. 5. That all landscape areas adjacent to parking areas shall be enclosed by a raised concrete curb or low wall . All planters adjacent to the street right-of-way shall be constructed with weep holes. 6. That prior to construction the applicant shall submit a drainage plan to the Building Official for consideration and approval . 7. That this approval is subject to the City of Palm Desert receiving all necessary dedications and easements from the applicant. 8. That all areas shown as open parking areas shall be surfaced with asphalt concrete and shall be suitably marked, outlining individual parking spaces and traffic flow. Said surfacing and marking shall be completed prior to final inspection of the structure or struc- tures by the Department of Building and Safety. All open parking space shall be a minimum of 9' wide by 20' deep and the surface shall be maintained in a reasonable state of repair at all times. 9. Prior to the issuance of any building permits , the applicant shall dedicate to the City an easement on the 30' wide area for the full frontage of the subject property on State Highway 111. Said ease- ment shall provide for the usage of the area for public access. The installation of the indicated improvements and future maintenance of the area shall be the responsibility of the developer and at his cost. The form of the agreement shall be subject to the approval of the City Attorney. 10. Fire protection conditions as required by the City Fire Marshall in his memo dated January 12, 1977, attached hereto, shall be met as a part of the development. -2- . REVISED 1_18_78 CASE NO. DP 01-77 11. A landscaped strip along the frontage of Highway ill, 47' in width shall be provided and maintained. (This area shall consist of a 17' parkway and a 30' setback. ) A minimum of 19 shade trees shall be provided therein , along with a 10' wide meandering bike and pe- destrian path and undulating berms averaging 3' in height. An ease- ment encompassing this area shall be given to the City for public circulation. Maintenance of this area shall be the responsibility -of the developer in perpetuity. 12. A landscaped screen (minimum 7' in height) shall be provided along the Palm Valley Channel . The prescribed height shall be obtained within 19 months from the time construction begins. 13. Shade trees as prescribed by ordinance (one tree per five parking spaces) shall be provided and maintained throughout the parking area. 14. No signs shall be considered approved as a part of this action. 15. All window areas on store fronts of all stores shall be "tinted glass". 16. An automatic underground sprinkler system shall be provided to all landscaped areas. 17. All sidewalks at intersection points with streets shall be ramped instead of curbed. Specific details shall be as required by the City Engineer. 18. As a part of development, the subject property shall be annexed to Improvement Districts No. 54 and No. 80 of the Coachella Valley County Water District for sanitation service. 19. As a part of development, a center line stripeing, stop sign designa- tion, loading area designation, and other traffic directional signs shall be provided throughout the proposed parking areas as approved ' by the City Engineer. 20. The developer, as part of his application for building permits shall enter into an agreement with the City to pay one-eighth of the actual cost of the installation of a traffic signal system at the intersection of Highway 111 and 44th Avenue or the City's cost, whichever is less , if the project is funded under a grant program. Accompanying said agreement shall be a payment in the amount of $12,500 which is the ap- plicant's estimated cost for the installation of said .traffic signal system to State standards at the time of agreement. 21. Prior to the issuance of any building permits, a detailed plan of all proposed exterior lighting, including required parking lot lighting, tennis court lighting, etc. , shall have been reviewed and approved by the Design Review Board and the Planning Commission. 22. Where practical , on-site drainage shall be conducted directly to a storm drain or channel . 23. A raised median shall be installed in Highway 111 for sufficient length east of Avenue 44 to adequately control access to eastbound Highway 111. AGREEMENT I accept and agree, prior to use of this permit or approval , to comply with all the conditions set forth, and understand that the Department of Building & Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. Install a water system capable of delivering 5500 GPM fire flow for a five (5) hour duration in excess of sprinkler system or domestic supply. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Development Plan Number DP 01-77 is in accordance with the requirements prescribed by the Fire Marshal." 5. The hotel building shall be equipped with complete automatic fire sprinkler i protection in accordance with National Fire Protection Association Standard #13. Williams noted that the conditions could be modified to request the Design Review Board to forward the final plans to the Planning Commission for their final approval . It is the intent of the developer to lease both commercial and restaurant space, retaining complete ownership. January 25, 1977 Page Two Development Plan-Support Data 1. A planned commercial center consisting of multiple uses, all consistent and complimentary to the existing PC-4 zone. Such uses shall consist of : a) Restaurant capable of serving breakfast, lunch & dinners as well as banquets and private functions . A large outdoor eating area is planned. c) A commercial complex consisting of ; a possible raquet ball center complete with health spa, courts, and a pro-shop; retail stores , such as beauty shops , barber shops, gift shops, clothing stores, etc. , which would cater to both the public and hotel patrons; small offices such as real estate, manage- ment, etc. d) Recreational facilities in addition to the raquet ball courts, there will be two sunken tennis courts, an adult swimming pool , a children ' s pool, a ther- apy pool, and a small putting and chipping green. As an integrating element, water and landscaping will be used to the fullest to provide both an exciting and pleasant at- mosphere for all patrons of the complex. 2. Based on the "intent" of the zoning ordinance, it is our be- ' lief that what is proposed for this site best satisfys that "intent" . The site planning is both innovative and practical for the site as well as the zone. The uses of a pure hotel with-out eating or shopping within the structure lended itself to the development of both restaurant and shopping areas outside the hotel structure, yet within the site 'thereby taking advan- tage of serving both the public and hotel patrons. Each use, therefore, assists the other becoming a very important factor in satisfying both the city' s "intent" as well as the devel- oper' s intent. 3. First, rather than be a detriment, we feel this development will be a great asset to the entire community. The uses being proposed would function, indirectly, as to support each other . The hotel is designed to only contain rooms, therefore, relying entirely upon the support of the retaurant and retail shops to provide the variety and needs required by hotel patrons. The commercial area will contain a possible raquet ball complex complete with indoor courts, gymnasium and health spa facilities, and a pro shop which will also be respon- sible for the administration of the tennis courts and put- ting greens. These facilities, most likely, will be of- fered as an amenity to hotel patrons. In addition, retail shops will derive a great deal of sup- port from hotel patrons by offering such personalized ser- January 25, 1977 Page Three vices as clothing boutiques, barbers, beauty shops , gifts, camera shop, candy stores, etc. The end result being an integral complex of related uses all assisting each other to generate a self-contained complex. 4 . The development Standards for this zone require a minimum of 420 parking spaces . The proposed development includes a total of 341 parking spaces. A variance is requested to allow a joint usage of 79 parking spaces. Such joint usage is justified due to the non-paralled opening periods of the commercial complex verses the hotel and restaurant. During the evenings the commercial complex would be closed to bus- iness allowing the respective parking spaces to be used by customers of the restaurant, which would be operating at its maximum during the dinner period. 4a. Should the variance not be allowed it would mean a sharp reduction of building area. Due to the cost of the land in relationship to the developer' s requirements , it would mean this development would not be economically feasible to construct. 4b. NONE 4c. Actually none, since at the present there are no other properties in the immediate vicinity with the same zoning, which have been as yet developed similarly. January 25, 1977 Page Four V. DISCUSSION: This project represents the first hotel development. to .occur in the City since incorporation. The staff feels that this project will be used as a prototype of future projects and should receive careful analysis from the Planning Commission. The staff has carefully analyzed the project in relation. to the Zoning Ordinance, General Plan, and Redevelopment Plan. Through this review, �_�we have only one serious matter to resolve - parking. When the Ordinance is followed to the letter, the development is 79 spaces short. While the Zoning Ordinance provides for the waiving of some of the parking spaces and sufficient justification may be made to grant approval with such a shortage; the staff is concerned with the amount of parking ad- jacent to the restaurant site. We therefore recommend that the parking arrangement be revised as shown on Exhibit A-1. This causes a revision and/or deletion of some of the commercial areas. The exit on Highway 111 must be deleted. With these changes, the shortage of spaces is brought to less than 20 spaces , which is only a 5% deficiency and acceptable to the Planning Staff. Justification for granting approval for this deficiency is based upon: 1. Provision o.rlemployee parking 2. There will be a large amount of joint use parking. 3. . The peak .hours of the various uses will not conflict with each other. The .Planning Commission should also note that portions of the hotel are 3 stories, but are under the 30' height limit as set forth in the Zoning Ordinance. The Design Review Board has approved the preliminary plans for the project which the Planning Commission will also review. The Planning Commission will have the review of the final construction drawings through the Design Review Board Process. The sewerage disposal system shall be submitted to and approved by the 'Coachella Valley County Water District prior to issuance of a building permit. 7. Construction shall commence within one (1) year after final approval , otherwise said approval shall become null and void and of no effect whatsoever. 8. Prior to the issuance of any permits, the applicant shall agree in writing to any conditions of approval . 9. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations , and restrictions of all municipal i ordinances and State and Federal statutes now in force, or which here- after may be in force. II. SPECIAL CONDITIONS: 1. The maximum uses approved by this Development Plan are as follows: - 156 unit hotel - 8,000 square foot restaurant - 7,500 square feet of commercial uses which must be clearly auxiliary to the proposed hotel -1- :VISED 1-25-77 CASE NO. DP 01-77 recreation facilities totalling 12,000 square feet of building area, and their related open recreation areas which are construed as auxiliary .to the hotel activity. 2. The applicant shall underground all existing and proposed overhead utility distribution lines on the property and/or along the full frontage of the project. 3. The applicant shall be responsible for the improvement of 44th Avenue for the full frontage of the property to City Standards and as approved by the City Engineer on the basis of a 70' half street right-of-way. Improvements shall consist of, but not be limited to: a. Completion of curb, gutter, and related tie-in paving for the full frontage. b. Installation of a meandering 10' wide P.C.C. pedestrian and bicycle path for the full length of the subject property. c. Street lights as required by the City Engineer. d. Landscaping, sprinkler system, and earth berming of a minimum average height of three feet above the ultimate curb height as approved by the Director of Environmental Services. e. Any required drainage structures as deemed necessary by the City Engineer to guarantee drainage from 44th Avenue to the Palm Valley Channel will occur. L/ 4. The applicant, subject to an encroachment permit issued by the State of California Department of Transportation and approval of the City Engineer, shall be responsible for the improvement of the full frontage of the property on Highway lil on the basis of 55' half street right-of- way. Said improvements shall include, but not be limited to; a. Completion and/or modification of the curb, gutter, and tie-'in paving to .provide for the proposed deceleration lane. b. Street lights. c. Landscaping and sprinkler system. 5. That all landscape areas adjacent to parking areas shall be enclosed by a raised concrete curb or low wall. All planters adjacent to the street right-of-way shall be constructed with weep holes. 6. That prior to construction the applicant shall submit a drainage plan to the Building Official for consideration and approval . 7. That this approval is subject to the City of Palm Desert receiving all necessary dedications and easements from the applicant. 8. That all areas shown as open parking areas shall be surfaced with asphalt concrete and shall be suitably marked, outlining individual parking spaces and traffic flow. Said surfacing and marking shall be completed prior to final inspection of the structure or struc- tures by the Department of Building and Safety. All open parking space shall be a minimum of 9' wide by 20' deep and the surface shall be maintained in a reasonable state of repair at all times. i ! i 9. Prior to the issuance of any building permits , the applicant shall '- dedicate to the City an easement on the 30' wide area for the full frontage of the subject property on State Highway 111. Said ease- ment shall provide for the usage of the area for public access. The installation of the indicated improvements and future maintenance of the area shall be the responsibility' of the developer and at his cost. The form of the agreement shall be 'subject to the approval of the City Attorney. 10. fire protection conditions as required by the City Fire Marshall in his memo dated January 12, 1977, attached hereto, shall be met as a part of the development. -2- REVISED 1-25-77 CASE NO. A landscaped strip along the frontage of Highway 111, 47' in width shall be provided and maintained.. :, (This area shall consist of a 17' parkway and a 30' setback. ) A minimum of 19 shade trees shall be provided therein, along with a 10' wide meandering bike and pe- destrian path and undulating berms averaging 3' in height. An ease- ment encompassing this area shall be given to the City for public circulation. Maintenance of this area shall be the responsibility of the developer in perpetuity. i 12. A landscaped screen (minimum 7' in height) shall be provided along the Palm Valley Channel . The prescribed height shall be obtained within 19 months from the time construction begins. 13. Shade trees as prescribed by ordinance (one tree per five parking spaces) shall be provided and maintained throughout the parking area. 14. No signs shall be considered approved as a part of this action. 15. All window areas on store fronts of all stores shall be "tinted glass". 16. An automatic underground sprinkler system shall be provided to all landscaped areas. 17. All sidewalks at intersection points with streets shall be ramped. instead of curbed. Specific details shall be as required by the City Engineer. 18. As a part of development, the subject property shall be annexed to Improvement Districts No. 54 and No. 80 of the Coachella Valley County Water District for sanitation service. 19. As a part of development, a center line stripeing, stop sign designa- tion, loading area designation, and other traffic directional signs shall be provided throughout the proposed parking areas as approved by the City Engineer. 20. The developer, as part of his application for building permits shall enter into an agreement with the City to pay one-eighth of the actual cost of the installation of a traffic signal system at the intersection of Highway III and 44th Avenue or the City's cost, whichever is less, if the project is funded under a grant program. Accompanying said agreement shall be a payment in the amount of $12,500 which is the ap- plicant's estimated cost for the installation of said traffic signal system to State standards at the time of agreement. 21. Prior to the issuance of. any building permits, a detailed plan of all proposed exterior lighting, including required parking lot lighting, tennis court lighting, etc. , shall have been reviewed and approved by the Design Review Board and the Planning Commission. 22. Where practical , on-site drainage shall be conducted directly to a storm drain or channel . 23. Mr. Urrutia stated that there would be no glare as the metal did not have a shine to it. i Chairman Wilson then stated that he was concerned about the accent ` colors and he questioned where and how the colors would be used. Mr. Urrutia stated that the accent colors would be used for trim in the small access areas and would not be used on any large walls. Further, he stated that he did not believe these colors would be used on any doors. Chairman Wilson stated that he was still concerned that a "circus effect" would be created with the use of the accent colors. Mr. Fleshman assured Chairman Wilson that the colors would again be reviewed during the construction drawing' s stage. Chairman Wilson then asked the applicant if he had any questions per- taining to the Conditions of Approval . Mr. Urrutia stated that he had a question pertaining to Special Condition No. 3b on Case No. DP 01-77. He questioned why the width of ten (10) feet was required for the sidewalk. Mr. Williams explained that this would conform to the concept of f- the width required for commercial areas. ` There was a short discussion among the Commission, staff, and Mr. Urrutia !— -pertaining to the sidewalk requirements, the median strip requirements, and the entrances and exists for the project. Mr. Fleshman suggested that the following sentence be added to Condition of Approval No. 1 on Case No. 46C: This project shall also conform to all requirements of Case No. DP 01-77. Chairman Wilson then asked what the pleasure of the Commission was per- taining to the remainder of the Design Review Board items. Chairman Wilson asked if there were any further questions of the ap- plicant by the Commission. Mr. Williams stated that the matter should not be discussed any further as it may prejudice the case. He asked the Commission to direct staff to re-notice the matter and continue the Change of Zone to the March 1, 1977 meeting. Commissioner Mills moved to continue this item to the regularly scheduled Planning Commission meeting of March 1, 1977 with a direction for staff to re-notice the matter to contact all property owners within 300 feet; taking special care with the Sandroc residents. Commissioner .Kelly se- conded the motion; motion unanimously carried. E. CASE NO. DP 01-77, R. B. GOODEN, APPLICANT Request for approval of a Planned Commercial Development for a 160 room hotel complex with related recreational and commercial uses on a 9-acre parcel in the PC(4) ,S.P. Zone District and lo- cated at the southeast corner of Highway 111 and 44th Avenue. Mr. Williams presented the staff report to the Commission. Said report included the applicant's request, a background of the pro- ject, description of the project, and a discussion pertaining to the staff's major concern regarding the parking deficiency. Mr. i. Williams also explained that the issue in review of this project was whether or not it met the intent and purpose of the Planned ._.. Commercial-Resort Zone. He stated that staff felt that the pro- ject did meet said intent and purpose. With regard to the parking situation, Mr. Williams explained that if the Zoning Ordinance was followed to the letter, the development would be 79 parking spaces short. Mr. Williams then reviewed the Special Conditions of Approval per- taining to the project. He noted that there was an error in Con- dition No. 15, and stated that it should read "glass" instead of "smoke". Chairman Wilson asked if there were any questions of staff at this time. Commissioner Kelly asked for a clarification of Condition No. 14. Mr. Williams stated that staff was suggesting that signs not be discussed at this time but as a part of the Design Review Board 4 Process. Commissioner Berkey asked staff what the actual number of parking spaces was as depicted on the re-design, which will be required to provide ade- quate parking according to the Zoning Ordinance. ? Mr. Williams answered 409 spaces. i January 25, 1977 Page Eight There was a brief discussion pertaining to the number of parking spaces required and the number of accesses. The Commission and staff concurred that the following revisions should be made to the Resolution: On page 1 of. said resolution, change 390 spaces to 378 spaces. Also on page 1, change the maximum number of accesses to read: "from two to four" Also on page 1, change 19 spaces to 31 spaces. I , On page 2, change 19 spaces to 31 spaces. ' Also on Page 2, change number. "5" as follows: "The increase in the number of accesses to the project is justified since the single in- gress and the single egress approved for the Highway 111 frontage is limited to entry only which requires at least two openings on 44th Avenue." Commissioner Berkey then asked for a clarification of Special Condition No. 20 pertaining to the applicant's participation in the cost of a traffic signal to be installed at Highway 111 and 44th Avenue. He questioned whether or not the applicant would have to pick up all of the City's cost involved. Mr. Williams explained that the applicant would be required to pay for 1/8 of the cost or the City's cost, whichever is less. City Engineer Cook explained that this was in case the City gets the grant pertaining to participation in the cost of the instal- lation of the signal . Commissioner Berkey asked the City Engineer if this intersection meets the warrants for installation of a traffic signal at this time. r� Mr. Cook answered yes. Mr. Williams stated this would depend on whether or not the funding program goes through. Chairman Wilson asked if there were any other questions of staff at this time. Commissioner Reading questioned Condition No. 23 pertaining to the raised median and asked how far the 450 feet would go. o Mr. Fleshman pointed out the exact length on the map for Commissioner z Reading. w Commissioner Reading then stated that if the applicant was going to be cn required to install a median, they should be required to install it for j \ the full length to the intersection. The Commission concurred and staff recommended that Condition No. 23 be re-worded as follows: g 23. A raised median shall be installed in Highway 111 for sufficient length east of 44th Avenue to adequately control access to east- bound Hingway 111. Chairman Wilson opened the Public Hearing on Case No. DP 01-77 and asked if the applicant was present. FRANK URRUTIA, 73-350 El Paseo, spoke to the Commission as a repre- sentative of Mr. Gooden, the applicant. fir. Urrutia stated that Mr. Gooden could not be present at tonight's meeting. Further, Mr. Urrutia stated that staff had pretty well explained the intent of the project. Mr. Urrutia also stated that they had had little time to review the revised set of conditions and he would like to reserve his comments until a later time. Further, he stated they were not opposed to the changes to the parking plan and that they concurred with the turn-around concept. January 25, 1977 Page Nine f MINUTES PALM DESERT PLANNING COMMISSION SPECIAL MEETING Chairman Wilson asked Mr. Urrutia approximately how many rooms would be located on the third floor of the structure. Mr. Urrutia answered that there would be 35 rooms. j { Chairman Wilson then asked if there was anyone present wishing to speak in FAVOR of the proposed project. Being no one, he then asked if there was anyone present wishing to speak in OPPOSITION to the proposed project. Being no one, Chairman Wilson then closed the Public Hearing on Case No. DP 01-77 and asked the Commission to take the matter under discussion. Commissioner Mills asked the staff if the Commission would see this . project again in some other fashion. Mr. Williams answered that the Commission would see this project again during the Design Review Board Process and also if there were any later changes to the project. Commissioner Kelly stated her first concern was the parking deficiency; but that with staff' s proposed revisions, she could not see any problems. Commissioner Kelly also stated that with regards to the raised median located at the first entrance to the hotel site, she could not foresee any problems. wW TrChairman ommissioner Berkey stated that he agreed with Commissioner Reading and wommissioner Kelly. Wilson stated that he was still concerned about the parking situation due to the type of activities that would be going on within the project. Further, he stated that we have seen projects where we have met the parking standards and still have parking problems that exist. He stated that he would like to see the square footage of the restaurant reduced to bring the parking deficiency more in line. Commissioner Reading asked Mr. Urrutia what type of restaurant was pro- posed for the complex. 0 o Chairman Wilson re-opened the Public Hearing to allow Mr. Urrutia to w answer Commissioner Reading's question. Mr. Urrutia stated that it would definitely not be a "chain" type restaurant and that it would possibly be line a "steakhouse" type. z Chairman Wilson asked P1r: Urrutia if there were any hotel rooms to be located in the basement. Mr. Urrutia stated there would be no rooms located in the basement. Chairman Wilson asked if there were any additional questions. Being none, he closed the Public Hearing and asked the Commission for their i feelings. Mr. Williams asked if that would be subject to the revision of Condition No. 15 and No. 23. Commissioner Berkey answered yes. Chairman Wilson stated he was still concerned about the parking dis- crepancy and asked how much flexibility there would be in the Design Oe� Review Board Process. Mr. Williams answered that the intent here with the recommendations ¢- would be to provide the maximum number of parking spaces. Further, C you will be limiting the development to a 156 hotel rooms, a 10,000 j square restaurant, and 379 parking spaces. Further, with the re- visions to the square footage of the restaurant there will be some additional flexibility. Chairman Wilson then stated that a minute motion to amend Commissioner Berkey's motion would be in order. After a short discussion pertaining to parking space requirements, Chair- man Wilson moved that the resolution be changed to read 8,000 square feet for the restaurant. CUP 10-77 CITY OF PALM DESERT, APPLICANT Request for approval of a City Maintenance Yard in the 'P' (Public Institutional ) Zone District and located on the south side of High- way 111, 200 feet east of Shadow Hills Road. Mr. Fleshman reviewed the request with the Commission. He stated that the establishment of a full-time Department of Public Works for the City of Palm Desert has created a need for a facility to store various items of public works construction, within the com- munity where it will be easily accessible. His report included a background and description of the project. Also, he explained that this was one of the only pieces of property properly zoned for such a use. Therefore, the staff was recommending approval of Planning Commission Resolution No. 211, subject to the attached conditions of approval ; based upon the following justifications: 1. The proposed facility is necessary for the implementation of numerous public works projects and for use during emer- gencies within the City of Palm Desert. 2. The proposed project dues insure the protection of the public health, safety, and general welfare. 3. While the proposed project is not intended to be permanently located at the subject site, sufficient measures have been taken to mitigate any potential adverse impacts during its existence. (2) The actual amount of CITY ' S share of the expense of preparation of plans and specifications, and construction engineering (including all - direct and indirect costs (functional and administrative overhead Page 4 assessment) attributable to such work, applied in accordance with STATE ' S standard accounting procedures) , and construction costs will be determined after completion of work and a financial settlement made upon final accounting of costs . Said share of the traffic control signal system and safety lighting will be a. sum bearing the same proportion to the total cost of the above-mentioned traffic control signal system and. safety lighting construction, construction engineering and preparation of plans and specifications as the number of legs of highways under jurisdiction of CITY at the inter- section involved bears to the total number of legs of highways at such intersection. Said share of the construction of roadway improve- ments will be a sum bearing the same proportion to the total cost of the above-mentioned construction of roadway improvements, construction engineering and preparation of plans and specifications essentially as shown on the plan entitled Exhibit "A" . (3) To reimburse STATE for CITY ' S proportionate share of the cost of maintenance and operation of said traffic control signal system and safety lighting, such share to be determined in the manner i provided in that Agreement for Maintenance of State highways within the CITY which is in effect at the time said costs are incurred , or if no such agreement exists, such share to be a sum bearing the same proportion to the total cost of maintenance and operation of said traffic control signal system and safety lighting as the number of legs of highways under jurisdiction of the CITY bears to the total number of legs of highway at such intersection. Page 5 (4 ) To furnish the necessary right of way and the clearance of conflicting utilities, if any, unless otherwise provided for and to certify to STATE that an unobstructed right of way is owned by CITY or that CITY has right of entry to do work prior to advertising . SECTION III IT IS MUTUALLY UNDERSTOOD AND AGREED: (1) That obligations of STATE under terms of this Agreement are subject to the allocation of funds by the California Highway Commission. (2) STATE shall not award a contract for the work unless and until receipt of CITY ' S deposit required in Section II (1) . (5) That, should any portion of the project be financed with Federal Funds or State Gas Tax Funds, all applicable procedures and. policies relating to the use of such funds shall apply not- withstanding other provisions of this Agreement . (6) That the costs referred to herein are only "matching funds" based on the assumption that Federal.-Aid Urban Funds will be allocated for financing approximately 83% of the costs . In the event that Federal-Aid participation is not approved, either party may either terminate this agreement at any time prior to advertisement of the construction contract, subject to the provisions of Section III, Article 9 herein or renegotiate each party ' s participation to "Make up" the anticipated federal funds . (7) If upon acceptance of bids, it is found the amount deposited by CITY is in excess of the cost of the work on the basis of bid prices plus contingency items, expense of preparation of plans and specifications, construction engineering, administration and overhead costs, the balance remaining shall be promptly refunded by STATE to CITY. If however, the cost of the work on the basis of bid prices plus contingency items, expense of preparation of plans and speci- fications, construction engineering, administration and overhead Page 7 costs exceeds the amount deposited by CITY, CITY will promptly, upon receipt of claim therefor, pay its portion of the amount of said excess to STATE. If the excess in either case is less than five hundred dollars ($500. 00) , a refund or demand of additional deposit will be waived until final accounting. (8) That should work to be performed by STATE on behalf of CITY pursuant to this Agreement; based on unit bid prices on the responsible low bidder, indicate that said cost will exceed the estimates by no more than 10 percent as set forth in this Agreement, the STATE may award the contract . That should the estimates be exceeded by more than 10 percent STATE will notify CITY of the revised estimate of final cost . STATE may award contract upon written approval by CITY within a period not to exceed ten (10) days after notification. (9) In the event that construction of the traffic control signal system, safety lighting, and roadway improvements is terminated, the full amount of all costs incurred prior to termination shall. be borne by the party requesting termination. In the event that the decision to terminate is mutually agreeable to all parties, the above cost shall be shared jointly in direct proportion to the number of legs of the intersection under juris- diction of each respective party. (10) That in the event there are existing public and private utilities which conflict with the construction of the project, CITY will make all necessary arrangements with the owners of said utilities for their removal or relocation in accordance with the applicable law or the provisions of any franchise which is in effect with the respective utility owners at the time of construction of the project _ Page B CITY will inspect the removal or relocation of said utilities . We note that the site plan indicates a 55' half-width for State Route 111. Our right of way records indicate only a 501 half- width at this location. We would like a copy of any documents that provide additional highway right of way. It should be noted that we are preparing plans to signalize the Route 111 and ,44th Street intersection and to provide for a two- way left turn lane on the highway through this area. Construc- tion is proposed for 1977. Therefore, we strongly recommend that standard 401 wide commercial driveways allowing two directional ingress and egress to the highway be provided at both locations. An additional 121 right turning lane with adequate transitions for northbound Route 111 traffic at both entrances would be beneficial in maintaining traffic flow on the highway. Care should be taken when improving this property to preserve and perpetuate the existing drainage patterns at the highway. The developer must obtain an encroachment permit from the District 8 office of the Department of Transportation prior to doing any work within the State highway right of way. Route 111 is included in the State Scenic Highway System Master Plan, and in the future the County may wish to have this route officially designated as a scenic highway. Development in this corridor should be compatible with the scenic highway concept. It is recognized that there is considerable public concern about noise levels adjacent to heavily traveled highways. January 25, 1977 Page Two Development Plan-Support Data 1. A planned commercial center consisting of multiple uses, all consistent and complimentary to the existing PC-4 zone. Such uses shall consist of : a) Restaurant capable of serving breakfast, lunch & dinners as well as banquets and private functions . A large outdoor eating area is planned. c) A commercial complex consisting of ; a possible raquet ball center complete with health spa, courts, and a pro-shop; retail stores , such as beauty shops , barber shops , gift shops , clothing stores , etc . , which would cater to both the public and hotel patrons; small offices such as real estate, manage- ment, etc. d) Recreational facilities in addition to the raquet ball courts, there will be two sunken tennis courts, an adult swimming pool , a children' s pool , a ther- apy pool , and a small putting and chipping green. As an integrating element, water and landscaping will be used to the fullest to provide both an exciting and pleasant at- mosphere for all patrons of the complex. 2. Based on the "intent" of the zoning ordinance, it is our be- lief that what is proposed for this site best satisfys that "intent" . The site planning is both innovative and practical for the site as well as the zone. The uses of a pure hotel with-out eating or shopping within the structure lended itself to the development of both restaurant and shopping areas outside the hotel structure , yet within the site thereby taking advan- tage of serving both the public and hotel patrons. Each use, therefore, assists the other becoming a very important factor in satisfying both the city ' s "intent" as well as the devel- oper ' s intent. 3. First, rather than be a detriment, we feel this development will be a great asset, to the entire community. The uses being proposed would function, indirectly, as to support each other . The hotel is designed to only contain rooms, therefore, relying entirely upon the support of the retaurant and retail shops to provide the variety and needs required by hotel patrons. The commercial area will contain a possible raquet ball complex complete with indoor courts, gymnasium and health spa facilities, and a pro shop which will also be respon- sible for the administration of the tennis courts and put- ting greens. The development Standards for this zone require a minimum of 420 parking spaces. The proposed development includes a total of 341 parking spaces. A variance is requested to allow a joint usage of 79 parking spaces. Such joint usage is justified due to the non-paralled opening periods of the commercial complex verses the hotel and restaurant. During the evenings the commercial complex would be closed to bus- iness allowing the respective parking spaces to be used by customers of the restaurant, which would be operating at its maximum during the dinner period. 4a. Should the variance not be allowed it would mean a sharp reduction of building area. Due to the cost of the land in relationship to the developer' s requirements , it would mean this development would not be economically feasible to construct. 4b. NONE 4c. DISCUSSION: This project represents the first hotel development to occur in the City since incorporation. The staff feels that this project will be used as a prototype of future projects and should receive careful analysis from the Planning Commission. The staff has carefully analyzed the project in relation to the Zoning Ordinance, General Plan, and Redevelopment Plan. Through this review, we have only one serious matter to resolve - parking. When the Ordinance is followed to the letter, the development is 79 spaces short. A planned commercial center consisting of multiple uses, all gonsisteny and complimentary to the existing PC-4 zone. Such uses shall consist of: a) Restaurant capable of serving breakfast, lunch & dinners as well as banquets and private functions. A large outdoor eating area is planned. c) A cc.-amercial complex consisting of; a possible raquet ball center complete with health spa, courts, and a pro-shop; retail stores, such as beauty shops , barber shops, gift shops, clothing stores, etc . , which would cater to both the public and hotel patrons; small offices such as real estate, manage- ment, etc. d) Recreational facilities in addition to the raquet ball courts, there will be two sunken tennis courts, an adult swimming pool, a children ' s pool, a ther- apy pool , and a small putting and chipping green. As an integrating element, water and landscaping will be used to the fullest to provide both an exciting and pleasant at- mosphere for all patrons of the complex. 2. Based on the "intent" of the zoning ordinance, it is our be- -lief that what is proposed for this site best satisfys that "intent" . The site planning is both innovative and practical for the site as well as the zone. The uses of a pure hotel with-out eating or shopping within the structure lended itself to the development of both restaurant and shopping areas outside the hotel structure, yet within the site 'thereby taking-advan- tage of sewing both the public and hotel patrons. Each use, therefore, assists the other becoming a very important factor in satisfying both the city' s "intent" as well as the devel- oper' s intent. ` 3. First, rather than be a detriment, we feel this development will be a great asset to the entire community. The uses being proposed would function, indirectly, as to support each other. The hotel is designed to only contain rooms, therefore, relying entirely upon the support of the retaurant and retail shops to provide the variety and needs required by hotel patrons. The commercial area will contain a possible raquet ball complex complete with indoor courts, gymnasium and health spa facilities, and a pro shop which will also be respon- sible for the administration of the tennis courts and put- ting greens. These facilities, most likely, will be of- fered as an amenity to hotel patrons. In addition, retail shops will derive a great deal of sup- port from hotel patrons by offering such personalized ser- vices as clothing boutiques, barbers, beauty shops , -lifts, camera shop, candy stores, etc. The end result being an integral complex of related uses all assisting each other to generate a self-conta_:.•_d complex. 4. The development Standards for this zone require a minimum of 420 parking spaces. The proposed development includes a total of 341 parking spaces. A variance is request^_c to allow a joint usage of 79 parking spaces. Such joint usage is justified due to the non-paralled opening periods of the commercial complex verses the hotel and restaurant. During ' the evenings the commercial complex would be closed to bus- iness allowing the respective parking spaces to be used by customers of the restaurant, which would be operating at its maximum during the dinner period. 4a. Should the variance not be allowed it would mean a sharp reduction of building area. Due to the cost of the land in relationship to the developer' s requirements, it would mean this development would not be economically feasible to construct. 4b. NONE 4c. Actually none, since at the present there are no other properties in the immediate vicinity with the same zoning, which have been as yet developed similarly. Development Plan Support Material 1. a .
