REQUEST: Request for approval of a Development Plan for a 44,000 sq. ft. restaurant complex consisting of five sit-down restaurant facilities and a related Variance to reduce the number of parking spaces from the required 660 spaces to 536 spaces on an 8.5 acre site located south of Highway 111 , east of Painters ' Path and north of 44th Avenue. II. STAFF RECOMMENDATION: Approve the Development Plan and related Variance for parking by Planning Commission Resolution No. 329. Justification is based upon the following: Development Plan 1 . The proposed development is consistent with the City's adopted General Plan. 2. The proposed development is consistent with the City's adopted Re- development Plan. 3. The design or improvement of the proposed development will be consistent ,with the Palm Desert Zoning Ordinance. Variance for Parking 1 . Employment of joint-use parking will compensate for a considerable amount of the deficient parking spaces. 2. Variations in the hours of operation among the proposed restaurants will assist in reducing the peak number of vehicles at the site at any given time. 3. The mandatory findings •the'Planning Commission must make when granting a Variance as specified in Sec. 25.78.070 of the Palm Desert Municipal Code are applicable to the subject case. III. Development Plan Support Material : ® 74.133 EL PASEO/PALM DESERT, CA.92260/714-346-2272 GENERAL CORPORATION A TOTAL C EPT ORGANIZATION FOR REAL ESTATE A=RSITION PLANNING,OEWLOPMENT.MARKETING AND MANAGEMENT STATEMIMT OF OBJECTIVES The applicant and/or property owners intend to develop a "Restaurant Row" in the City of Palm Desert. The oroiect should consist of aporox- imately 44,000 sq. ft. of restaurants within 5 separate structures. Each of the restaurants will be a complete sit-down type facilitv. Each restaurant will have optional valet service, and enclosed screened service areas. There are 536 parking spaces provided which is a ratio of 12.2 spaces per 1000 sq.-Tt—. of floor area. The parking area will bi considered as cannon area and will have adequate handicap spaces The mix of restaurant types will allow an overlapping of use based upon peak hours of operation for each different facility. The ratio of parking spaces to gross square fcotape in this 'project is 12.2/1000. This reflects an ability for ioint usage and is indicative of the type of restaurants proposed. The large sit down tvpe facility proposed reflects the following general demands on parking: 1. 1 enployee for each 500 sq. ft. 2. 1 seat for each 50 sq. ft. This breaks down for a 10,000 sq. ft. restaurants as follows: 1. 20 spaces for employees 2. 200 seats ( with 1 car for each 2 seats ) 3. 120 parking spaces maximum for an overall ratio of 12/1000 The architecture of each of the buildings will be unique, yet compatible. The master developer will retain architectural Control and all materials and Colors used will be consistent with those used in the desert. DISCUSSION: The proposed use is in accord with the objectives of the Zoning Ordinance relative to the uses prescribed by the Planned Commercial Resort Zoning district. Additionally, it is apparent that the proposed restaurant facili- ties would fill a specific need within the community for such facilities. As a result, the primary issues that must be addressed pertain to traffic circulation and parking. Due to the location of the site which is bounded by Painters Path, Highway 111 and Avenue 44, traffic circulation is crucial . r Case Nos. DP 01-78 and VAR 01-78 January 31 , 1978 Page Three IV7 DISCUSSION: (Cont. ) Access to the proposed development will be provided by one entrance off of Avenue 44 and three entrances off of Painters Path. There will be no-access provided directly off of Highway 111 . This arrangement is viewed as the most desirable by the Staff. As restaurants attract high volumes of vehicular traffic and these vol- umes are highest during specific short time periods, sufficient parking necessarily becomes a primary concern with regard to projects such as the one now being reviewed. The applicant is providing 536 parking spaces which represents a 12.2sp aces/:1000 sq. ft. ratio where 660 spaces are required by the City' s Ordinance requirements which represents a 15.0 space/1000 sq. ft. ratio. The applicant believes the deficiency,. is justi- fied for the reasons outlined in the Statement of objectives contained in the background section of this report, namely that the mix of restau- rant types will allow an overlapping of use based upon peak hours of oper- ation for each of the different facilities, i .e. , some restaurants will specialize in lunches while others primarily cater to dinners. This situation is similar to the joint-use. situation experienced in shopping centers which contain movie theaters. The Staff believes that employment of joint-use parking will compensate for a considerable amount of the deficient parking spaces. Variations in the hours of operation among the proposed will assist in reducing the peak number of vehicles at the site at any given time. Further, when the original parking requirement for restaurants was developed, the national average of 12 spaces per 1+;000 sq. ft. of gross floor area was not consideved_suffi-cient for an individual free-standing restaurant. However, such a requirement was considered sufficient for restaurants in a group cluster concept particularly if said restaurants varied in terms of emphasis on lunch trade vs dinner trade. Since it was thought that most groupings of restaurants would be located in a shopping center complex which has an overall ratio or in the C-1 Zone District which has provisions for common parking reduction, no spe- cial provisions were developed for this situation. The applicant is being required to assist in paying the cost for traffic signals at Highway 111 and Avenue 44 since the proposed project will benefit greatly from such an installation. The actual location and design of the buildings, landscaping, grading etc. , will be determined through the City's Design Review process. • r P PLANNING COMMISSION RESOLUTION NO. 329 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FIND- INGS AND APPROVING A DEVELOPMENT PLAN AND RELATED PARKING VARIANCE ON PROPERTY LOCATED SOUTH OF HIGH- WAY 111 , EAST OF PAINTERS PATH AND NORTH OF 44TH AVENUE . CASE NOS . DP 01-78 and VAR 01-78 WHEREAS, the Planning Commission of the City of Palm Desert , California, did receive a verified application from HMS GENERAL CORPOR- ATION requesting approval of a Development Plan for a 44, 000 sq . ft . restaurant complex consisting of five sit-down restaurant facilities and a related Variance to reduce the number of parking spaces from the re- quired 66 spaces to 536 spaces on an 8 . 5 acre site located south of Highway 111, east of Painters Path and north of 44th Avenue , more par- ticularly described as : APN 621-302-003 WHEREAS , said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No . 77-7" , in that the Director of Environmental Services has determined that this project is exempt on the basis of the Environmental Impact Report prepared for the Redevelopment Plan ; and, WHEREAS , at said Public Hearing, upon hearing and considering all testimony and arguments , if any, the Planning Commission did find the following facts and reasons to exist to justify the approval of the subject Development Plan : 1 . The proposed development is consistent with the City ' s Adopted General Plan ; l2 . The proposed develpment is consistent with the City ' s Adopted Redevelopment Plan ; 3. The mandatory findings the Planning Commission must make .when granting a Variance as specified in Sec. 25. 78. 070 of the Palm Desert Municipal Code are applicable to the subject case . NOW, THEREFORE , BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows : 1. The development of this project shall conform substantially to f all plans submitted in behalf of this case (Exhibits A-B) , and (t as revised according to the Design Review Board process and/or Planning Commission Action . Any minor changes requires approval by the Director of Environmental Services . Any substantial change requires approval by the Planning Commission . 2. All requirements of any law, ordinance , or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable , subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust , or air conditioning equipment shall be fully concealed from view from any public rights-of-way and ad- joining properties by architecturally integrated means . 5. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits . All con- ditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. �- 6 . All utility service and distribution lines on or abutting the sub- ject property, shall be placed underground prior to occupancy clear- ance . 7. Traffic control provisions shall be provided as required by the Director of Public Works . 8. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as re- quired by the Director of Public Works. 9. A landscaping, grading, lighting, amenities , trash storage, walkway layout , and irrigation plan shall be submitted through the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. 10. The Fire Protection Requirements as specified in the Fire Marshal ' s memo dated January 16, 1978 , attached hereto, shall apply, 11. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies : Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley County Water District Evidence of said permit or clearance from the above agencies shall be presented to the Dept . of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. PLANNING COMMISSION RESOLUTION NO. 329 Page Four Special Conditions : 1 . No vehicular access shall be permitted from Highway 111 . 2 . An agreement shall be consummated between the applicant and the City of Palm Desert for maintaining the City 's entrance sign and landscaped areas dedicated to the City prior to issuance of any building permits . Any additional improvements or amenities pro- posed by the applicant , i . e , fountain , small lake, etc. , shall be approved through the City' s Design Review Board process prior to construction. 3. Traffic safety lighting shall be provided on all three sides of the proposed development in accordance with the Director of Public Works approval . 4 . The applicant shall make a contribution of $5,000 towards traffic signals to be installed at 44th Avenue and Highway 111 . 5. Storm waters shall be dispersed by adequate means for the .subject development satisfactory to the Director of Public Works . 6. Applicant shall pay drainage fees in an amount to be determined by the City of Palm Desert ordinance provisions. 7. A complimentary architectural theme shall be utilized in the formulation of a design concept for the entire restaurant complex. 8. A comprehensive sign program shall be submitted for the entire project through the City ' s Design Review process prior to the issuance of any building permits. 9. A five (5) foot sidewalk shall be constructed along 44th Avenue and Painters Path. 10. Parking lot lighting shall be approved by the Design Review Board. AGREEMENT f I accept and agree , prior to use of this permit or approval , to com- ply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow oc- cupancy on the user permitted until this signed confirmation has been received by the Department of Environmental Services . Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the origi- nal and three (3) copies of the water system plan to the Fire Marshal for re- view. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification : "I certify that the de- sign of the water system in Case Number DP-01-78 is in accordance with the re- quirements prescribed by the Fire Marshal . A meeting regarding drainage in this area was held on the site with Mr . Paul Williams from your office, Mr. Robert P. Brock of the Riverside County Road Department, and several representatives from Caltrans . A record of that meeting is attached for your convenience . A project for widening, signals , and lighting will soon be underway at this intersection. An 18" CMP is being extended onto this northwesterly corner which will carry storm runoff from this development under 44th Street and into a 24" CMP which runs easterly along the south side of 44th Street, under Route 111 and empties into the Palm Desert Flood Control Channel. Drainage from this tract should be directed to this 18" storm drain inlet. The developer should prepare a hydrology report to determine if the storm drain is adequate for the increased flow. Route 111 is a major traffic artery in this area . Portions of this road are already experiencing congestion and flooding. Future major improvements that will increase traffic and drainage capacity cannot be anticipated by this Department in the foreseeable future for a number of reasons, funding being one of the major ones . Apparently the only process left by which some control can be exercised to,maintain the highest level of service on the facility is planning of development. By proper development of vacant land and redevelopment of improved property, the value of this traffic carrier to the area can be continued and even enhanced. For example, elimina- tion of random driveways or access to each parcel along with removal of the need to park on the facility would increase its traffic carrying capacity as well as the safety. Making use of existing public roads to provide access would accomplish Page 2 ' February 15 , 1978 one of the desired effects. Making sure that the continued development of impervious surfaces does not add additional water to that already reaching the facility would accomplish another of the desired effects . Even though Site Development Plan No. DP 01-78 in itself may not cause serious consequences, it will have a cumulative effect. For this reason we offer the following comments : Driveways should not be directed onto Route 111. Access to this development should be made via Painters' Path or 44th Street. We note that the site plan does not indicate the right of way width for State Route 111. Our records indicate an existing 50' half-width at this location. Development of this property should include the normal dedication of right of way and improvement of the highway in accordance with the City Master Plan of Highways . Improvements to the highway should include curb and gutter with curb placed 38' from the centerline of the highway. We would like an opportunity to review the highway improvement plans when they become available. An encroachment permit must be obtained by the developer from the District 8 office of the State Department of Transportation prior to doing any work within the State highway right of way. It is recognized that there is considerable public concern about noise levels adjacent to heavily traveled highways . Land development, in order to be compatible with this concern, may require special noise attenuation measures . This develop- ment should include any necessary noise attenuation. This portion of Route Ill is included in the California Master Plan of State Highways Eligible for Official Scenic Highway Designation, and in the future the City may wish to have this route officially designated as a scenic highway. Development in this corridor should be compatible with the scenic highway concept. We would like to receive a copy of any conditions of approval for this proposal and any documents providing additional highway right of way when they become available. Mr. Griffin believed this drainage structure can dis- charge into a transverse drain installed with the completed half-width construction of 44th Avenue. 2. No additional inlets except as noted under Item No. 1 above need be provided in the new 44th Avenue curb . 3. Maintain existing AC spillway located in the existing AC dike approximately right of Station 641+20 centerline Route 111. 4. Riverside County maintains the ,.aster Plan, performs engineering, and should be the source of information for planning on 44th Avenue.. 3. Concrete curb should be provided along 44th Avenue. 4. A single 4'--wide wheelchair ramp should be installed in the northwest quadrant of the Route Ill/44th Avenue Intersection (only quadrant involved in our roadway construction) . Mr. Williams said that since sides:aiks are not generally being required in the area, wheelchair ramps need not be provided at this time in the other corners of this intersection. Mr. Williams reviewed the cases and noted the graphic of the development . He stated that the main concern of the staff was the parking and he explained the reasoning for the Variance request. Chair- man Berkey asked for further clarification of the reasoning behind the Variance request . Mr. Williams noted the section of the. Palm Desert Municipal Code that covered the reasoning for a variance request (see attached Exhibit A) . Some discussion followed with regard to the Ordinance being changed instead of asking for a Variance and the formula that - was used for determining the number of proposed parking spaces . Chairman Berkey opened the Public Hearing at this time and asked if the applicant wished to speak. STEVE FLESHMAN, 74-133 E1 Paseo, representing HMS General Corp. , addressed the Commission noting that the parking was analyzed and figured with the same formula that is used_ by restaurant developers. He noted that with the valet parking service for all restaurants and the joint usage proposal, the de- ficiency in the parking should not be a problem. There was some discussion as to the 'restaurants involved and the turn over if the restaurants were not successful . Mr. Fleshman stated that the restaurants would sign a 35 year lease and that they were all AAA national chain restaurants, if one went down the whole chain would go down . Chairman Berkey noted his reluctance to use the Variance as a way of alievating the problem and noted that perhaps there was one too many restaurants . Commissioner Reading asked if perhaps some of the landscaping could be omitted and more spaces provided that way. The Commission agreed that the concept of the proposal is very attrac- tive and will be an asset to the City especially since it will be located at an entrance to the City. Mr. Fleshman noted the revenue that the proposed "restaurant row" would generate for the City. There was further discussion as to whether Painters Path could be used for parking. Pair. iilliams stated that Painters Path was 66 ft . wide and that there could be parking on one side with no interference with the present businesses , which are day time operations. The Commission commended the applicant on the landscaping and the service area concept of the project noting that it would be an asset to the community Chairman Berkey asked if there was anyone one wishing to speak in FAVOR or in OPPOSITION to the proposed project . Being none , he declared the Public Hearing closed and asked the pleasure of the Com- mission. It was moved by Commissioner Snyder , seconded by Commissioner Reading to approve Case Nos . DP 01-78 and VAR 01-78 by Planning Com- mission Resolution No. 329. Commissioner Kelly asked that the Resolu- tion be changed to note the fact that Painters Path could be used for parking. Mr. Williams noted the following change to Resolution No . 329, under the 4th whereas, make a new subsection 3 to' read : That unique circumstances dealing with the fact that Painters Path is presently intended for day-time usage of adjacent uses that are not open at night , exist .
