Chairman Snyder asked Mr. Crump if he had any comments.
Mr. Crump explained that the Public Wo s Director required left
turn pockets at the intersection of Country ub Drive and Monterey,
which was not the same area Special Condit' n No. 2 referred to. He also
explained relative to the Master Plan of ainage,'that the subject request
is a project that is being built upstrea and anyone developing in that area
would be responsible for connecting the system. He added that they don't
have to install the whole system. Mr. Crump stated that there was no way of
anticipating the cost because this wa based on the future engineering data
to be supplied to Public Works.
Commissioner Kryder asked w y the divider was rejected since Mr.
White did point out that there wo ld be no conflict. Chairman Snyder
explained that the major concern was that the divider should not have a
break less than 1000 feet. He tated that if they provided for a median
island break into the site, th break between that area and the intersection
at Monterey and Country Club uld be approx mate1 200 feet.
Commissioner Berkey a ked Mr. Crump how the people going east, who
lived right off Country Clu Drive, would get in. Mr. Crump explained,
illustrating on the map, t t they could turn left into the project at
Monterey.
After more discus 'on on the matter of the median island break,
Commissioner Berkey Bugg sted that they provide for a temporary left turn
pocket and after a peri d of time, the matter be reviewed to see if it
would work out or not. The Commission agreed to have Special Condition
No. 2 amended to read s follows: Subdivider shall be permitted left turn r
access into the site rom Country Club Drive subject to the design and bond-
ing approval of the rector of Public Works, to serve initial phases of the
tract development. irector of Public Works shall investigate the accept-
ability of the medi n break after installation and use. The Department of
Environmental Servi es shall forward his report to the Planning Commission
for determination f whether the median island -break, permitting left turn
access, is to be intained permanently.
Chairman nyder opened the Public Hearing asking if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none,
the Public Hear ng was closed.
Chairma Snyder reviewed the discussion and explained to the applicant
why implement tion of the drainage plan was necessary. A short discussion
continued bet een the Commission, staff and the applicant concerning the
responsibili ies for implementing the Master Plan of Drainage facilities.
Upon motion made by Commissioner Kryder, seconded by Commissioner
Miller, Ca a No. TT 1601 ado tion of Planning Commission
Resolutio No. 57 s amended and subject to con i ions. Carried unanimously
(4-0) .

Approval of a Development Plan, Residential , consisting of 48 L

zone located on the north side of Hovley Lane approximately 2250
.feet east of Monterey Avenue.
Mr. Crump presented this case stating this request was a. slightly
redesigned concept plan to reinitiate an expired conceptual Development Plan
approval : There were three items the Commission needed to consider: 1) pro-
visions for a pedestrian/bicycle system; 2) Master Plan of Drainage facilities;
and, 3) one northern dwelling unit (on either side of the tennis courts) , to be
deleted. Mr. Crump stated that with these modifications staff recommended
approval .

Commissioner Berkey questioned Condition No. 4, relative to the
one year period the applicant had to commence construction. Commissioner
Berkey reminded Commission and Staff about the new policy that was established
regarding the Tentative Tract Map and Development Plan expiration dates coin-
ciding.
Mr. Crump explained that if the Council granted an extension of time
for the Tentative Tract Map, there would be no other extension beyond that.
There was a short discussion relative to the Tentative Tract Map con-
forming with this Development Plan approval and having the expiration dates
coincide. It was decided to changethe Standard Condition No. 4 to read as
follows: Construction of a portion of said project shall commence within one
year from the date of final approval , March 8, 1981, otherwise said approval
shall become null , void and of no effect whatsoever.
Commissioner Kryder asked staff why the Fire Marshal was not equally
concerned for servicing this project as he was for the previous Case TT 16015,
being it was the same situation.
Mr. Steve Fleshman answered his question explaining that the distance
was the same, but it would take a shorter time to get to this project.
Chairman Snyder asked if the applicant cared to make a presentation.
TONI QUEZADA, Kaufman & Broad, 18902 Bardeen Way, Irvine, asked if the
Commission would amend Special Condition No. 5 with an additional statement
referring to the drainage fees paid by the applicant shall go towards the work
they do on this project.
Chairman Snyder explained to Ms. Quezada why the condition was necessary
and that the Commission had no authority other than to keep Special Condition
No. 5 as was written. Ms.Quezadaaccepted the conditions and asked for approval .
Chairman Snyder opened the Public Hearing asking if anyone present wished
to speak in FAVOR or OPPOSITION to this case. There being none, the Public
Hearing was closed.
Commissioner Kryder asked if staff was making sure that as developments
go in on Hovley Lane, that they are relating to one another in terms of entrances ,
frontages, etc. Mr. Crump replied that they were.
Upon motion made by Commissioner Miller, seconded by Commissioner Berkey,
Case No. DP 01-80 was approved by adoption of Planning Commission Resolution
No. 577, as amended and subject to conditions. Carried unanimously (4-0).

construction of 24 residential units on approximately five (5)

Mr. Crump viewed the staff report and stated that this Development
Plan was similar t the previous one. The application was simply for a refiling
of the expired conce tual Development Plan approval . He briefly pointed out on
the map the design sc me of the project and recommended approval .
Commissioner Berk asked if this was similar to the one previously
approved, in relation to S cial Condition No. 4. Mr. Crump replied that it
was and also amended SNecid Condition No. 4 to read as follows: Construction
of a portion of said project all commence within one year from the date of
final approval , March 22, 1981, otherwise said approval shall become null ,
void and of no effect whatsoever.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A RESIDENTIAL DEV-
ELOPMENT PLAN, TO ALLOW CONSTRUCTION OF 47 DWELLING
UNITS AND RECREATIONAL AMENITIES ON APPROXIMATELY 9.5
ACRES LOCATED ON THE NORTH SIDE OF HOVLEY LANE BETWEEN
MONTEREY AVENUE AND- PORTOLA AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 4th day of March, 1980, hold a duly noticed Public
Hearing to consider a request by KENT LAND CO. for approval of a Development
Plan, Residential , consisting of 48 dwelling units and recreational ameni-
ties on approximately 9.5 acres within the PR-5 (Planned Residential , max.
5 d.u./ac. ) zone located on the north side of Hovley Lane approximately
2250 feet east of Monterey Avenue, more particularly described as:

WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32" in that the Director of Environmental Services has determined
that the project has previously been assessed in connection with Case
No. DP 17-78, and no further documentation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring
to be heard, said Planning Commission did find the following facts to
justify their actions, as described below:
a. The proposed project as modified by this approval generally
conforms to the intent and purposes of the PR Zone District.
b. The proposed project as modified by this approval is adequately
suited for the specific site and is compatible with existing
and proposed development in the area.
C. The proposed project will not be detrimental to the health,
safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. That the Planning Commission does hereby approve conceptual
Development Plan No. 01-80 (Exhibit A) subject to those
conditions attached hereto, which modify that plan.

Desert Planning Commission, held on this 4th day of March, 1980, by the

CONDITIONS OF APPROVAL
CASE NO. DP 01-80
Standard Conditions:
1. The development of the property shall conform substantially with Exhibit
A (Case -No. DP 01-80) on file with the Department of Environmental
Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval , the applicant shall first complete all
the procedural requirements of the City which include, but are not
limited to, Design Review, Subdivision process and building permit
procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code require-
ments to the degree that the City could consider each phase as a single
project.
4. Construction of a portion of said project shall commence within one
year from the date of final approval , March 8, 1981, otherwise said
approval shall become null , void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, .the applicant shall agree in writing to
these Conditions of Approval .
6. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in additions
to all municipal ordinances and State and Federal Statutes now in force,
or which hereafter may be in force.
7. All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent to
the property being developed shall be installed underground as a part of
development from the nearest existing pole not on the property being
developed.
8. All requirements of the City Fire Marshal shall be met as part of the
development of this project per attached letter dated February 19, 1980.
9. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
10." Traffic control provisions shall be provided as required by the Director
of Public Works.
11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works.
12. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Dept. of Building and Safety at the time of issuance
of a building permit for the use contemplated herewith.
13. No development shall occur on the subject property prior to the record-
ation of a tract map.

SPECIAL CONDITIONS
1. Provide a 20 ft. wide public access easement along Hovley Lane,
to be used in conjunction with the parkway for development of an
8 ft. wide meandering pedestrian/bicycle path.
2. Provide ornamental landscaping in the parkway/easement installed
and maintained by the project.
3. Provide a minimum 6 ft. high solid maso nary wall around the project
with the wall along Hovley Lane to be set back 20 ft. from the
property line.
4. Provide wind/blowsand protection planting along the north and west
site boundaries.
5. Provide easements and improvements as necessary to implement the
Master Plan of Drainage.
6. Provide for retention of approximately a ten-year storm volume on-
site.
7. Delete one northern dwelling from the east or west side of the
tennis court; for a total of 47 dwelling units on the site.
8. Provide 20 ft. minimum distance between buildings.
9. Provide a minimum of 50% of the net site area in common open space.
AGREEMENT
I accept and agree, prior to use of this permit or approval , to comply with
all the conditions set forth, and understand that the Department of Building L
and Safety will not issue a building permit or allow occupancy on the use
permitted until this signed confirmation has been received by the Department
of Environmental Services.

Gentlemen:
Prior -to construction of any of the proposed buildings, the following conditions
must be met:
1 . Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways. Spacing not to exceed 400 feet.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs, if installed, shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification : "I certify that the
design of the water system in Case Number DP 01-80 is in accordance with the
requirements prescribed by the Fire Marshal ."

5. Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating and delivering the
required flow.

E. MAJOR PROJECT IMPROVEMENTS AND PERIMETER TREATMENT (Requirements)
The improvements listed in the following would only be implemented
by conditions of the Tract Map, but some items do have a bearing
on the design of the concept plan now under consideration, and
are therefore noted here:
• HaJf-street improvement of Hovley Lane, with enriched
parkway, consisting of a 20 ft. public access easement
and 12 ft. wide parkway development with an 8 ft. wide
meandering pedestrian/bicycle path; and, 32 ft. wide
travel way.
• Implementation of the Master Plan of Drainage, with
project site being designed to retain approximately
a ten-year vo.l�me,storm on-site, and with system ease-
ments provided along the north boundary and through
the project as required to implement the Master Plan.
• Wind/blowsand protection planting on the north and
west boundaries.
• Six foot high masonary wall along the east, west and
north boundaries; inset 20 ft. from the southern
property line.
• Ornamental landscaping in the parkway and easement `;i
installed and maintained by the project.
F. DEVELOPMENT FEATURES
Density: 5.05 units per gross acre
- Common Open Space 4.48 acres, 47.23% of net site
'area .(50% required)
- Recreation Amenities: Two swimming pools, and one
.tennis court.
- .Average dwelling unit size, 1460 sq. ft.
- Parking provided: Two garage spaces for each unit, plus
58 open spaces.

IV. DISCUSSION:
The subject request::is a slightly redesigned concept plan prepared
to reinitiate an expired conceptual Development Plan approval for
the site. As noted, previously the City Council hasccontinued
consideration of a time extension for the Tentative Tract Map to
allow the expired Development Plan to be refiled.
Since the Commission origifially considered development of this site,
two subjects have surfaced that will need to be addressed by this
project: (a) provision for an enriched parkway/easement design along
the north side of Hovley Lane, providing for a pedestrian/bicycle
system; and, (b) Master Plan of Drainage, facilities, easements. and
site water retention. ' Also it is noted that the project density is
.05 units per average gross acre over the zoning allowance, based on
the more precise gross site area calculated at the time the subse-
quent Tentative Tract Map exhibit was prepared. Therefore, the
maximum number of dwelling units the site may contain under the
present zoning is 47. In this regard, one of the northern units on
either side of the tennis court would be an appropriate unit to
del.ete, and consideration given to recreational vehicle storage or
common activity area.
V. STAFF RECOMMENDATION:
Based on the justification contained in the draft Resolution:
Grant modified approval of conceptual Development Plan, DP 01-80,
by adopting Planning Commission Resolution No. 577 subject to
conditions.

Dear Mr. Wagner:
You requested that we review the necessity for a proposed street
running between Hovley Lane and Country Club Drive as an extension of
the entry street between Tentative Tract 14996 and property east
thereof. The proposed street would bisect the subject tentative tract.
We see no need for this street from a traffic circulation point of
view. Residents along 'Hovley Lane have access to Country Club Drive via
either Monterey Avenue or Portola Avenue, and there are no through
streets running north from Country Club Drive between these two streets.
The only future residents who might benefit from this roadway would be
residents of TT 14996 or the westerly portion of the property east of
TT 14996 who wished to gain access to Monterey Avenue without using
Country Club Drive. Information furnished on proposals for the property
east of TT 14996 indicates streets will be dedicated and will provide
public access between TT 14996 and Portola Avenue. With about 260
single family units planned east of TT 14996 to Portola Avenue and 116
condominium units in TT 14996, the estimated use of the proposed roadway
to reach Monterey Avenue and return would be about 50 vehicles in the
peak mid-afternoon hour or perhaps 500 vehicles per day.
With respect to emergency services, we are informed that the prime
response today is from the fire station (fire and resucitation) located
on E1 Paseo west of Highway 74-Monterey Road. However, within two
years, subject to the outcome of Proposition A at the next municipal
elections in Rancho Mirage, Palm Desert and Indian Wells (or alternate
financing) a new fire station will be located on Country Club Drive
somewhere between Monterey Avenue and Portola Avenue. In addition there
is proposed also a fire station site on or within the Hahn Shopping
Center development on Monterey Avenue. Paramedic services are currently
furnished from Indio.

From the existing station or the proposed station at the Hahn
Center, the suggested street would shorten response time to TT 14996 and
the properties east thereof by about one-quarter mile and less than 30
seconds.
Response time from the future station on Country Club Drive is
dependent on the final location. If it is, close to Monterey Avenue or
to Portola Avenue , the proposed road would have little or no effect. If
located at some point in between, then the proposed street would shorten
response time to some locations on Hovley Lane.
In summary, while the proposed street would provide a small
improvement in emergency response time to some properties, the ordinary
use it would receive is very small and does not appear to justify the
costs involved in Tentative Tract 14080.
