The development of the property shall conform substantially with Exhibits on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval , the applicant shall first complete all the procedural requirements of the City which include, but are not limited to.. Design Review, Subdivision process, and building permit procedures. 3. Construction of a portion of said project shall commence prior to expiration date for recordation of TT 14997, otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to the issuance of any City permits for the commencement of construction on said project, the applicant shall agree in writing to these conditions of approval . 5. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all Municipal Ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 6. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are adjacent to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed. 7. All requirements of the City Fire Marshal shall be met as part of the develop- ment of this project per attached letter dated February 11, 1981. r 8. Construction plans shall be submitted for approval to the City Fire Marshal 111 prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 9. Traffic control provisions shall be provided as required by the Director of Public Works. 10. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the Director of Public Works. 11. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 12. No development shall occur on the subject prior to the recordation of a tract map. PLANNING COMMISSION RESOLUTION NO. 689 Page Three Special Conditions: 1. Provide wind/blowsand protection treatment along north and west boundaries. 2. Provide ornamental parkway landscaping along public street frontage. 3. Provide minimum six (6) foot high masonry wall around the site. 4. If a security gate is planned for entrance, provide stacking for a minimum ` of four automobiles. 1 5. Increase building setback from Hovley Lane to 32 feet. 6. Eliminate both northern parking courts, and relocate bay parking spaces. 7. Provide minimum 20 foot driveway aprons for all units. 8. Restudy egress to unit in the southeast corner of the site to reduce long back-out distance. 9. Dedication of right-of-way shall be 44 feet from centerline of Hovley Lane. 10. Curb and gutter shal be placed at 32 feet from centerline on Hovley Lane. 11. Drainage and signalization fund fees as required by City ordinance shall be paid prior to recordation of the final tract map. 12. Drainage facilities shall be provided per Ordinance No. 218 and the Master Drainage Plan to the specifications of the Public Works Director. 13. Full public improvements including traffic safety lighting as required by ordinance and the Public Works Director shall be installed in accordance with City standards. 14. Improvement plans for water and sewer systems shall be approved by the respective service districts. 15. Complete improvement plans and specifications shall be submitted as required by ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as built" plans prior to acceptance of the subdivision improvements by the City. 16. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 17. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 18. Easements to be recorded for emergency access to the east and/or west, if determined necessary by the City. 19. Exact location of emergency access to be determined during Design Review Process. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. ( 2. Install Riverside County super fire hydrants so that no point of any building tis more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: " I certify that the design of the water system in Case Number DP 01-81 is in accordance with the requirements prescribed by the Fire Marshal ." Commissioner Richards stated he preferred to amend this case to be converted to air space condominiums. Commission agreed. Motion was made by Commissioner Kryder, seconded by Commissioner. Richards, to approve CUP 01-81, and recommended approval of TT 17487, by adoption of Planning Commission Resolution Nos. 687 and 688, to be amended to read as air space condominium conversion, subject to conditions. F i Case No. DP 0 - - & D INVESTMENTS/PRO-CON DEVELOPMENT and NER-STANFORD, Applicants Request for approval of a Planned Residential Development to provide 20 single family attached units, recreational amenities and common open space on approximately 4.5 gross acres within the PR-5 zone. Mr. Sawa presented this case briefly reviewing the background and describing the project. He pointed out that an emergency access was required but further study would be needed as to where it would be located. Staff recommended approval . Commissioner Kryder asked if the road leading to the water district facilities would be shared with the adjacent property. Mr. Sawa stated it would not since it is mainly used for the trucks from the water district. Commissioner Richards asked if the emergency access could be moved further south. Mr. Vogt, Fire Marshal , stated he felt the location of the emergency access, as shown, was not adequate. He pointed out possible locations and felt that it should be further south. He explained why he needed a 40 ft. turning radius. Further discussion continued in .regards to possible locations for the access and width of the turning radius. Chairman Miller opened -the Public Hearing and asked if the applicant wished to make a presentation. MR. ED YEAGER, Wagner-Stanford Consultants, stated that there were other possibilities for the location of the emergency access but needed to study this further. He accepted the conditions of approval . Commissioner Berkey noted that Standard Condition No. 3 did not apply to this project, therefore, recommended deletion. Chairman Miller closed the Public Hearing. Commissioner Kryder made a comment that the projects being developed in ii that area should blend together. On-site improvements illustrate a 24 ft. easement with 12 ft. driveway to be granted to the Coachella Valley County Water District. F. NET SITE AREA/DENSITY CALCULATIONS/OPEN SPACE: - 20 d.u. 's on 4.68' net acres, equals 4.27 d.u./ac. - Proposed Common Open Space, 3.0 acres, equals 64% of net site. G. DWELLING UNIT DESCRIPTION: Single story, duplex buildings, attached two-car garages. Range of unit sizes 1050 to 1650 sq.ft. H. PARKING ANALYSIS AND DESIGN CONSIDERATION: - Required, 2 covered spaces per unit, plus 0.5 spaces per unit guest parking. - Proposed, 2 garage spaces per unit, 10 open bay spaces, plus 32 ft. wide private street which could allow parking on one side. Design Considerations: deficiencies exist in the depth of garage driveways),recommended standard for this project, 20 ft. I . RECREATION AMENITIES: - one swimming pool area - one tennis court III . DISCUSSION: This plan was first approved in July of 1979, and expired before any extensions were filed. The current proposal is identical to the expired plan. Changes previously required have not yet been made since Design Review approval has not yet occured. The project has a single entry from Hovley Lane, with an internal private street terminating in the southern portion of the site. Emergency access is provided to the east. The proposed 20' setback on Hovley Lane, should be increased to 32 feet to provide for adequate blowsand protection and parkway landscaping. Blow- sand protection should also be provided on the west boundary. The use of two parking courts in the northern portion of the site, should be re-evaluated. If eliminated, bay parking could be handled in a different manner and 20 ft. garage driveways could be achieved, which would have more design merit than the scheme now proposed. Egress for the garage in the southeast corner of the site should be redesigned to eliminate a long back-up distance. IV.
