Dear Mr. Williams :
Prior to construction of any of the proposed buildings, the following conditions
must be met:
Residential :
1 . Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways. Spacing not to exceed 500' .
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome -�
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if Installed) shall be painted red 15 feet in either direction from
each hydrant.
3'. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: " I certify that the
design of the water system in Case Number DP 02 - 79 is in accordance with the
requirements prescribed by the Fire Marshal ."
5. Prior to delivery of combustible- materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
Commercial :
Fire protection requirements will be established for the commercial area
as more detailed plans are received.
Additionally, it should be noted that this project is beyond the five minute
response limit for existing fire stations.

g. Driveways closest to the intersection of Cook and Country Club
shall be eliminated.
9. A 50 foot wide easement shall be provided along the western site
boundary for drainage purposes.
10. Site water retention shall be increased 15% from that shown on the
grading plan.
ll . The north and west boundaries of the site shall be provided with wind/
blowsand protection planting (to be installed on the inside of the
50' drainage easement along the west boundary) .
12 . The residential development shall be completely enclosed by a minimum
6 ' high solid masonry wall, except for approved entrances.
13. Public parkways and street improvements shall be provided as directed
by the City.
14. This development will be required to make a contribution of $1, 500. 00
per gross acre into the Drainage Fund of the City of Palm Desert .
15. This development shall be required to pay $34 , 100. 00 into the Signali-
zation Fund of the City of Palm Desert , . which shall be applicable
to the signal to be located at Cook Street and Country Club Drive.

Developmeni Plan
1. The maximum number of dwelling units shall be limited to 682. .
2 . Each phase of construction shall conform to all requirements of
Chapters 25. 24 and 25. 26 of the Palm Desert Municipal Code.
3 . All residential buildings shall conform to a unifying architectural
theme, as illustrated in DP 02-79.
4. All landscaping shall conform to an overall landscape master plan
with particular emphasis on abutting public streets.
5. All landscaping installed within the required parkway area along
all public streets shall thereafter be maintained by the owners
and/or occupants of the total development .
6. All uses within the club houses shall be specified, and parking
shall be provided in accordance with Chapter 25. 58 of the Palm
Desert Municipal Code, as approved by the Planning Commission in
Design Review.
7. . A Design Review application shall be submitted for the residential
area in accordance with Chapter 25.70 of the Municipal Code, and
providing for the following specific items:
a. Golf course homes in the southeast corner of the site shall
maintain an increased 40 ft . setback from =the property line Cook St .
b. 15-16 swimming pools shall be provided in the golf .-course
home area.
c. The size of the swimming pools in the tennis condominium area
should be adequate to accommodate the anticipated demand (or at
the applicant ' s option, : increase the number of pool area by two) .
d. Restudy commercial/residential boundary interface to unify
design along common rear line.
8. Prior to any development of the proposed P.C. (2) , S .P. zoning areas,
an amended Development Plan shall be submitted concerning development-,
of the commercial area, with the following design features:
a. A residential style of architecture, similar to the proposed
dwelling units, with a maximum height of 25 feet .
b. Minimum setback from Cook .Street and .Country Club Drive should be
50 feet , with not more than 50% of the street frontage paralleled
by buildings closer than 100 feet .
C. Cook and Country Club street frontages should be screened by
large mounded/landscaped areas (except where corner sight re-
striction is a problem) , and all vehicle parking should be hidden
from view by such mounding and landscaping. l
d. The interior of the center should use an extensive number of JJ
_. trees in the parking areas to provide a shade canopy for vehicles.
e. All necessary loading docks should be recessed and enclosed.
f . The transition from commercial to residential should be by means
of high landscaped berm areas ( in addition to the proposed walls) .
The treatment on the commercial side of the property should be
carried over and unified with perimeter treatment on the resi-
dential development .

Standard Conditions :
1. The development of the property shall conform substantially with
Exhibit 'A' (Case No. DP 02-79) on file with the Department of
Environmental Services, as modified by the following conditions.
2. Prior to the- issuance of a building permit for construction of
any uses contemplated by this approval, the applicant shall first
complete all the procedural requirements of the City which includes,
but not limited to, Design Review, Subdivision process, and build-
ing permit procedures.
3 . Construction of the total development may be done in phases; how-
ever, each individual phase shall meet or exceed all Municipal
Code requirements to the degree that the City could consider each
phase as a single project .
4 . Construction of a portion of said project shall commence within
one year from the date of final approval; otherwise, said approval
shall become null, void and of no effect whatsoever. Further,
the total project shall be completed by January 1, 1985 . After
said date, this approval shall automatically expire for those
remaining undeveloped portions of the subject property and the
City Council may initiate rezoning procedures to revert said
undeveloped areas to a residential zone designation.
5. Prior to the issuance of any City permits for the commencement of
construction on said project , the applicant shall agree in writing
to these Conditions of Approval.
l6. The deveiopment of the property described herein shall be subject
J to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal Statutes
now in force, or which hereafter may be in force.
7. All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables . which are adjacent
to the property being developed shall be installed underground as
a part of development from the nearest existing pole not on the
property being developed. .
8. All requirements of the City Fire Marshall shall be met as part of
the development of this project , per attached letter dated
February 16, 1979.
9. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
10. Traffic control provisions shall be provided as required by the
Director of Public Works.
11 . Curb, gutter, sidewalk or approved pathways, and tie-in paving shall
be provided in conformance with City standards and/or as required
by the Director of Public works.
12. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall
be presented to the Dept . of Building and Safety at the time of
issuance of a building permit for the use contemplated herewith.

C. RESOLUTION NO. 79-39 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, ADOPTING AN EMPLOYEES '
DEFERRED COMPENSATION PLAN AND AUTHORIZING THE EXECUTION
OF AGREEMENTS .
Mr . Ortega reported that the purpose of this resolution was
to enable employees to defer portions of their compensation
to this type of plan. The employees ' earnings are set aside
and remain an asset of the City until the employee chooses
to withdraw their funds for retirement or other reasons .
The only minor expense to the City would be that of book-
keeping. It would be administered by a Plan Administrator ,
generally an insurance carrier. Mr . Byers pointed out that
proposals had been received from both a savings and loan
bank and an insurance carrier. Councilman McPherson pointed
out that he was aware of other firms dealing in this type
of plan and would provide Staff with their names if so
desired.
Councilman McPherson moved and Councilman Brush seconded to
waive further reading and adopt Resolution No . 79-39 . Motion carried
unanimously.

Mr. Williams reviewed the Staff Report indicating that this
request in conjunction with the Siegle development would
represent the total allocation of Planned Commercial desig-
nation in this area. However, one of the concerns looked
at as a part of the North Sphere Study will be the commer-
cial allocation. He reviewed the Planning Commission' s
recommendations, stating that they felt this zone desig-
nation appropriate. In terms of recreational amenities ,
the Commission felt the number of pools should be increased
substantially to the number proposed by the applicant . In
terms of Commercial, the Commission felt there should be
precise development standards applied. He concluded by
reviewing the special conditions applied by the Commission
dealing funds for the extension of the Whitewater Channel ,
participation in the amount of $34, 000 for signalization
fund, and set backs to be increased to provide for greater
yard area.
Mayor Pro-Tem McPherson opened the Public Hearing and invited
input in FAVOR of the project :
MR. STEPHEN FLESHMAN, 74-075 E1 Paseo , addressed Council as
the architect for the project and indicated the applicant ' s
agreement with all conditions .
MR. TOM TAYLOR, 70-707 Frank Sinatra Drive, addressed Council
indicating they had never believed that such a beautiful pro-
ject could have been planned for this land.
Mayor Pro-Tem McPherson invited input in OPPOSITION to the
project , and none was offered. He declared the Public Hearing
closed.
Councilman Brush moved and Councilman Wilson seconded to waive
further reading and pass Ordinance No. 205 to second reading, approving
a Change of Zone from PR-4 to P .C. (2) and a Preliminary Development
Plan to allow 682 condominium units and commercial shopping center.

for property where there was no development .
Mayor Pro-Tem McPherson declared the Public Hearing open and
invited input in FAVOR of the zone change . None was offered.

Mr. Crump reviewed the Staff Report , relating the background
details of the project , which include the development calculations,
open space tabulation, a parking analysis, .recreational amenities,
and residential and commercial structures. He then pointed out that
the proposal is found to satisfy the intent and purpose of the Planned
Residential zone in that it offers variety and imagination in the
development approach; and the proposed commercial Change of Zone
appears to be a reasonable application of the balance of the General
Plan Land Use allocation. Therefore, approval is recommended to the
City Council .
Chairman Kelly asked if the applicant wished to make a
presentation.
JOHN BALLEW, of Ballew/McFarland, representative of applicant ,
stated that they. have no objections to the conditions of
approval . He also indicated that there is a strong relation-
ship between residential and commercial districts, and they
would like the architecture to be compatible.
Commissioner Kryder mentioned that , although the commercial
idea is a good one to serve the people, these structures presumably
will be open in the evening, and previous developments have separated
commercial from residential primarily to keep out those who do not
belong.
Mr. Ballow pointed out that this is controllable; there
could be a card-operated gate, or some other measure of
control .
There were no further questions or comments; Chairman Kelly
then declared the Public Hearing closed, and asked for the pleasure of
the Commission.
On a motion by Commissioner Kryder, seconded by Commissioner
Snyder, the case was approved by Planning Commission Resolution No . 466;

on the environment and a Negative Declaration has been prepared; and,
WHEREAS, at said Public Hearing, upon hearing and considering
the testimony and arguments, if any, of all interested persons desiring
to be heard, said Planning Commission did find the following facts
to justify their recommendations and actions as described below:

a. The land use resulting from the revised Change of
Zone would be compatible with adjacent existing and

CONDITIONS OF APPROVAL
CASE NO. DP 02-79
Standard Conditions :
1 . The development of the property shall conform substantially with
Exhibit 'A ' (Case No. DP 02-79) on file with the Department of
Environmental Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of
any uses contemplated by this approval, the applicant shall first
complete all the procedural requirements of the City which includes,
but not limited to, Design Review, Subdivision process , and build-
ing permit procedures.
3 . Construction of the total development may be done in phases; how-
ever, each individual phase shall meet or exceed all Municipal
Code requirements to the degree that the City could consider each
phase as a single project .
4 . Construction of a portion of said project shall commence within
one year from the date .of final approval ; otherwise, said approval
shall become null , void and of no effect whatsoever . Further,
the total project shall be completed by January 1 , 1985. After
said date, this approval shall automatically expire for those
remaining undeveloped portions of the subject property and the
City Council may initiate rezoning procedures to revert said
undeveloped areas to a residential zone designation.
5. Prior to the issuance of any City permits for the commencement of
construction on said project , the applicant shall agree in writing
to these Conditions of Approval .
�. 6 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and State and Federal Statutes
now in force, or which hereafter may be in force.
7 . All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables which are adjacent
to the property being developed shall be installed underground as
a part of development from the nearest existing pole not on the
property being developed.
8 . All requirements of the City Fire Marshall shall be met as part of
the development of this project , per attached letter dated
February 16, 1979.
9. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
10. Traffic control provisions shall be provided as required by the
Director of Public Works.
11 . Curb, gutter, sidewalk or approved pathways, and tie-in paving shall
be provided in conformance with City standards and/or as required
by the Director of Public Works.
12. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:

Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall
be presented to the Dept . of Building and Safety at the time of

Development Plan
1 . The maximum number of dwelling units shall be limited to 682 .
2 . Each phase of construction shall conform to all requirements of
' Chapters 25. 24 and 25. 26 of the Palm Desert Municipal Code.
3. All residential buildings shall conform to a unifying architectural
theme, as illustrated in DP 02-79.
4 . All landscaping shall conform to an overall landscape master plan
with particular emphasis on abutting public streets.
5. All landscaping installed within the required parkway area along
all public streets shall thereafter be maintained by the owners
and/or occupants of the total development .
6. All uses within the club houses shall be specified, and parking
shall be provided in accordance with Chapter 25. 58 of the Palm
Desert Municipal Code, as approved by the Planning Commission in
Design Review.
7. A Design Review application shall be submitted for the residential
area in accordance with Chapter 25. 70 of the Municipal Code, and
providing for the following specific items:
a. Golf course homes in the southeast corner of the site shall
maintain an increased 40 ft . setback from the property line Cook St .
b. 15-16 swimming pools shall be provided in the golf course
( home area.
C . The size of the swimming pools in the tennis condominium area
should be adequate to accommodate the anticipated demand (or at
the applicant ' s option, increase the number of pool area by two) .
d. Restudy commercial/residential boundary interface to unify
design along common rear line.
8 . Prior to any development of the proposed P.C. (2) , S .P. zoning areas,
an amended Development Plan shall be submitted concerning development
of the commercial area, with the following design features :
a. A residential style of architecture , similar to the proposed
dwelling units, with a maximum height of 25 feet .
b. Minimum setback from Cook Street and Country Club Drive should be
50 feet , with not more than 500,/o of the street frontage paralleled
by buildings closer than 100 feet .
C. Cook and Country Club street frontages should be screened by
large mounded/landscaped areas (except where corner sight re-
striction is a problem) , and all vehicle parking should be hidden
from view by such mounding and landscaping.
d. The interior of the center should use an extensive number of
trees in the parking areas to provide a shade canopy for vehicles.
e. All necessary loading docks should be recessed and enclosed.
f . The transition from commercial to residential should be by means
of high landscaped berm areas (in addition to the proposed walls) .
The treatment on the commercial side of the property should be
carried over . and unified with perimeter treatment on the resi-
dential development .

g. Driveways closest to the intersection of Cook and Country Club
shall be eliminated.
9. A 50 foot wide easement shall be provided along the western site
boundary for drainage purposes.
10. Site water retention shall be increased 15% from that shown on the
grading plan.
11 . The north and west boundaries of the site shall be provided with wind/
blowsand protection planting (to be installed on the inside of the
50' drainage easement along the west boundary) .
12 . The residential development shall be completely enclosed by a minimum
61 . high solid masonry wall , except for approved entrances.
13 . Public parkways and street improvements shall be provided as directed
by the City.
14. This development will be required to make a contribution of $1 , 500. 00
per gross acre into the Drainage Fund of the City of Palm Desert .
15. This development shall be required to pay $34, 100. 00 into the Signali-
zation Fund of the City of Palm Desert , which shall be applicable

STATEMENT OF PLANNING OBJECTIVES
The primary objective of this design problem was to
create two(2) distinct product types , integrated into
a residential-recreational community.
The primary emphasis of the project was to create an
imaginative integration of golf and tennis with 682
dwelling units on 184 net acres . This problem was com-
pounded by the small size of the parcel. The basis of
the design solution was the introduction of a golf course
that consists of only 9 holes , but has oversized greens
and numerous tee placements . This allows one to play the
course many different ways .
In order to create the proper atmosphere for each area
of the project two unique unit types are proposed.
The golf course units are only located on cul-de-sac
streets and are duplex oriented units . The tennis units
are clusters at a higher density and are oriented
around motor courts .
The street scenes created by the placement of the structures
was of primary importance in the design. Thus the
two primary loop roads have no units backing to them.
The orientation of the units pays particular attention to
the views of the area as well as the golf course and other
amenities .
The parking was deemed to be of great importance so
the project shows an overall parking ratio of 4. 7 : 1
in the residential area plus a additional 102 RV parking
spaces and 132 spaces within the golf and tennis club
lots .
PHASING
The project has three major elements which can be further
broken down into smaller units . The attached exhibit
shows a potential phasing plan.

Prior to construction of any of the proposed buildings, the following conditions
must be met:
Residential :
1 . Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. , Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways. Spacing not to exceed 500' .
A. Hydrants shall not be located closer than 25 feet to any building.
( B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
l C. Curbs (if Installed) shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: " I certify that the
design of the water system in Case Number DP 02 - 79 is in accordance with the
requirements prescribed by the Fire Marshal ."
5, Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
Commercial :
Fire protection requirements will be established for the commercial area
as more detailed plans are received.
Additionally, it should be noted that this project is beyond the five minute
response limit for existing fire stations.

III. DISCUSSION:
A. Land Use Considerations:
The subject request utilizes the balance of the District Commercial
allocation provided by the City General Plan for this area. The
provision of any additional commercial land use ;would',•�therefore,
only come from considerations in the North Sphere Area Study. Nine
acres of the overall allocation has previously been committed on the
southwest corner of .Country Club Drive and Cook Street. The subject
request provides a slightly different scale of neighborhood con-
venience center development because it is proposed to occupy 12
acres and contain 122,000 sq. ft. of gross leasable area. Recognizing
the scenic status of Cook St.', the Scenic Preservation Overlay
designation should be added to the application of commercial zoning.
Two major types of residential uses are proposed for the site: a
lower density golf course oriented development; and, a tennis oriented
higher density project. The Planned Residential zone provides for
the combination of dwelling unit types and densities, subject to a
maximum average number of units per acre. At 3.7 dwelling units per
acre, the subject proposal is within the specific zoning and General
Plan density range.

B. '',PROJECT.,DESIGN (COMMERCIAL DEVELOPMENT): r'
The applicant represents that the design of the commercial area is
only schematic to illustrate its relationship and linkages to the
residential development, and for purposes of illustrating the zoning
request. Therefore, it may be considered as a subsequent phase,
requiring a new Development Plan application at the time implementation
is desired.
Future phase commercial design considerations would include:
-- The proximity of driveway openings to the intersection of Cook
and Country Club (elimination of the driveways nearest to the
intersection is desirable in this case. ).
-- Minimum setback from Cook Street should be 50' , with not more than
50% of the street frontage paralleled by buildings closer than 100' .
-- Cook and Country Club street frontages should be screened by large
mounded/landscaped areas (except where corner sight restriction 'is
a problem), and all vehicle parking should be hidden from view
by such mounding and landscaping. Landscaping should tie in
with residential development site frontage.
-- The interior of the center should use an extensive number of trees

C. PROJECT DESIGN (RESIDENTIAL DEVELOPMENT) :
As previously noted, the residential development proposes two
distinct dwelling unit types: tennis condominiums, located adjacent
to the proposed commercial center in the northeast portion of the site;
and, duplex golf course homes on the balance of the site. The
tennis condominiums are clustered around motor courts, and circle
a central club house with 14 practice courts and one exhibition
court. Golf course homes are arranged around cul-de-sac streets,
each with an open space orientation.
1 . Site Circulation -- Country Club and Cook St. both have major
controlled access entrances which are linked together by a
median boulevard. Access to the tennis condominiums is from
two intersections on the entrance boulevard. -A loop collector
street begins`,at these two int.er_sections;, to, connect the•.__.:__,
golf course homes. Site circulation appears to be quite
functional , as well as the entrance detail .
2. Perimeter Treatment/Boundary Considerations -- The Master Drainage
Plan, which is now being developed, will necessitate the provision
for a 50' wide channel easement for area drainage purposes along
the western boundary of the site. This will require the Develop-
ment Plan to be modified to absorb the additional 50 feet. The
north and west boundaries of the site will also need to be
provided with wind/blowsand protection planting; in the case of
the west boundary, this should occur on the inside (east side) of
the drainage channel . Building setbacks should observe the
Ordinance minimum of 32 feet adjacent to the perimeter public
streets; and, in one instance, where golf course homes occur in
the southeast corner of the site, an additional setback should
be provided by bending the cul-de-sac street further to the west.
3. Recreational Amenities -- Each of the club houses should meet
ordinance requirements for parking, to be reconciled with a list
of uses at the Design Review stage.

Four swimming pool areas have been provided for the 200 tennis
condominiums, rather than suggesting that this number be
increased, it .would appear that the sites are well located and
the consideration should be the size of the pools. Eight swimming
pools are illustrated to serve 482 golf course homes. Swimming
pools are recognized as a primary recreation amenity, and therefore,
this number should be .increased to 15 or 16. Some areas of the
golf course are served, quite well , by the proposed pool locations,
the additional pools should be located in the areas of highest
demand based on the proximity to the greatest number of dwelling
units.
D. ARCHITECTURAL DESIGN:
Renderings have been provided to suggest the architectural approach
to the various elements of the project. The predominant theme is
Early California/Spanish, featuring stucco walls, heavy columns and
low garden walls, with barrel tile roofs. Fireplaces also appear to
be provided for each unit.
DESIGN REVIEW BOARD:
On February 20, 1979, the Board viewed the Development Plans for
purposes of providing design input to Staff and the Commission. The
Board found the plans to be conceptually acceptable and had no
specific comments.
IV.' STAFF RECOMMENDATION:
The proposal.1'is found to satisfy the intent and purpose of the Planned
Residential zone in that it offers variety and imagination in the
development approach; and the proposed commercial Change of Zone
appears to be a reasonable application of the balance of the General
Plan Land Use allocation. Therefore, based on the justification pro-
vided in the Resolution:
Recommend approval to the City Council of CZ 03-79, and related
Case DP 02-79, by adopting Planning Commission Resolution No. ,
subject to conditions.
