answer any questions the Commission might have.
Chairman Miller asked if there was anyone present who wished to speak in
FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed.
Motion was made by Commissioner Kryder, seconded by Commissioner McLachlan,
to recommend approval to the City Council by adoption of Planning Commission
Resolution No. 708, subject to conditions. Carried unanimously (5-0) .
D, Case Nos. DP 05-80 and 207 MF - LEWIS HOMES OF CALIFORNIA, Applicant
Request for approval of a 12 month time extension of an approved
Development Plan and related Design Review case, to allow
construction of 282 single family and duplex units and associated
recreational facilities and a public park dedication, on approx-
imately 70.3 acres, in the PR-4, S.P. (Planned Residential , 4
d.u./acre, Scenic Preservation Overlay) zone, located at the
northwest corner of 44th Avenue and San Pascual Avenue.
Mr. Diaz presented this case stating that the applicant's reason for the
delay in initiating the project is the depressed condition of the local housing
market. Staff recommended approval subject to the original conditions.
Chairman Miller opened the Public Hearing and asked if the applicant wished
to make a presentation.

A .RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A ONE YEAR TIME EXTENSION OF
AN APPROVED DEVELOPMENT PLAN TO ALLOW THE CONSTRUCTION OF 24
CONDOMINIUM UNITS ON 5 ACRES LOCATED ON THE SOUTH SIDE OF
HOVLEY LANE, APPROXIMATELY 1 ,700 FEET EAST OF MONTEREY AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did hold a duly noticed Public Hearing on the 5th day of May, 1981 , to consider
a request by DAVID MOSS, T&D INVESTMENTS, for a 12 month Time Extension of an
approved Residential Development Plan to allow the construction of 24 condominium
units on 5 acres within the PR-5 (Planned Residential maximum density 5 d.u./ac. )
zone, located .on the south side of Hovley Lane approximately 1 ,700 feet east of
Monterey Avenue, more particularly described as:

WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89" , in that the Director of Environmental Services has
determined that the project has previously been assessed in connection with Case
No. DP 18-78 and no further documentation is deemed necessary;
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments, if any, of all interested persons desiring to be heard, said
Planning Commission did find the following facts to justify their actions, as
described below:
a. The proposed project generally conforms to the intent
and purpose of the PR Zone District.
b. The proposed project is adequately suited for the
specific site and is compatible with existing and
proposed development in the area.
c. The proposed project will not be detrimental to the
health, safety and general welfare of the community.
d. The considerations relating to the original approval
are still valid.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1 . That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That the Planning Commission does hereby approve a
one year time extension of conceptual Development
Plan No. DP 02-80, subject to those conditions contained
in Planning Commission Resolution No. 578.

CONDITIONS OF APPROVAL
CASE NO. DP 02-80
Standard Conditions:
1. The development of the property shall conform substantially with Exhibit
A (Case-No. DP 02-80) on file with the Department of Environmental
Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of
any uses contemplated by this approval , the applicant shall first
complete all the procedural requirements of the City which include,
but are not limited to, Design Review, Subdivision process, and building
permit procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code require-
ments to the degree that the City could consider each phase as a
single project.
4. Construction of a portion of said project shall commence within one
year from the date of final approval , March 22, 1981, otherwise said
approval shall become null , void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing to
these Conditions of Approval .
6. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in additions
to all municipal ordinances and State and Federal Statutes now in force,
or which hereafter may be in force.
r 7. All existing electrical distribution lines, telephone, cable antenna
r television, and similar service wires or cables, which are adjacent
t to the property being developed shall be installed underground as a
part of development 'from the nearest existing pole not on the property
being developed.
8. All requirements of the City Fire Marshal shall be met as part of the
development of this project per attached letter dated February 19, 1980.
9. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
10: Traffic control provisions shall be provided as required by the Director
of Public Works.
11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works.
12. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Dept. of Building and Safety at the time of issuance
of a building permit for the use contemplated herewith.
13. No development shall occur on the subject property prior to the record-
ation of a tract map.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING RESIDENTIAL DEVELOP-

. SPECIAL CONDITIONS
1. Provide a 25 ft.. wide drainage easement along the southern site
boundary, clear of encroachments. (Redesign R.V. storage area)
2. Provide wind/blowsand protection treatment along north and west
boundaries, adjust dwelling units and improvements accordingly.
3. Provide ornamental parkway landscaping along public street front-
age.
4. Provide minimum six (6) foot high masonry wall around the site.
5. Project shall be designed to retain approximately a 10 year volume Il
storm on site.
6. Close first east and west driveway entrance to northern dwelling
unit parking area.
7. Redesign entrance and/or provide 20 ft. driveway apron for units
with projecting garages.
8. Provide additional open guest bays between dwelling units in the
southern portion of the site.
9. Provide minimum 24 ft. wide driveway isles and 20 ft. deep parking
stalls.

Prior to construction of any of the proposed buildings, the following conditions
must be met:
1 . I.nstall a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
fmain from which the flow is measured at the time of measurement.
( 2. Install Riverside County super fire hydrants so that no point of any building
lis more than 250 feet from a fire hydrant measured along approved vehicular
travel ways. Spacing not to exceed 400 feet.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs, if installed, shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water sompany, with the following certification: "I certify that the
design of the water system in Case Number DP 02-80 is in accordance with the
requirements prescribed by the Fire Marshal ."
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
6. Alternate access for emergency vehicles shall be provided.

D. Case No. DP 01-80 (continued)
Commissioner Berkey questioned ndition No. 4, relative to the
one year period the applicant had to c mmence construction. Commissioner
Berkey reminded Commission and Staff out the new policy that was established
regarding the Tentative Tract Map and Development Plan expiration dates coin-
ciding.
Mr. Crump explained that if he Council granted an extension of time
for the Tentative Tract Map, there ould be no other extension beyond that.
There was a short discussi n relative to the Tentative Tract Map con-
forming with this Development P an approval and having the expiration dates
coincide. It was decided to ch gethe Standard Condition No. 4 to read as
follows: Construction of a por ion of said project shall commence within one
year from the date of final ap roval , March 8, 1981, otherwise said approval
shall become null , void and o no effect whatsoever.
Commissioner Kryder ked staff why the Fire Marshal was not equally
concerned for servicing thi project as he was for the previous Case TT 16015,
being it was the same situ tion.
Mr. Steve Fleshma answered his question explaining that the distance
was the same, but it wo d take a shorter time to get to this project.
Chairman Snyder asked if the applicant cared to make a presentation.
TONI QUEZADA, Kaufman & Broad, 18902 Bardeen Way, Irvine, asked if the
Commission would am nd Special Condition No. 5 with an additional statement
referring to the d ainage fees paid by the applicant shall go towards the work
they do on this p oject.
Chairman nyder explained to Ms. Quezada why the condition was necessary
and that the C mission had no authority other than to keep Special Condition
No. 5 as was ritten. Ms. Quezada accepted the conditions and asked for approval .
Chai an Snyder opened the Public Hearing asking if anyone present wished
to speak i FAVOR or OPPOSITION to this case. There being none, the Public
Hearing w closed.
C mmissioner Kryder asked if staff was making sure that as developments
go in o Hovley Lane, hat they are relating to one another in terms of entrances ,
fronta es, etc. Mr. Cr replied that they were.
Upon moti ade' by Commissioner Miller, seconded by Commissioner Berkey,
Case o. DP . -80 was approved by adoption of Planning Commission Resolution
No. 5 , as amended and subject to conditions. Carried unanimously (4-0) .
E. Case No. DP 02-80 - T&D CALIFORNIA INVESTMENTS (David Moss) ,
Applicant
Request for approval of a Residential Development Plan to allow
construction of 24 residential units on approximately five (5)
gross acres within the PR-5 (Planned Residential , max. 5 d.u./ac. )
zone located on the south side of Hovley Lane, approximately
1600 feet east of Monterey Avenue.
Mr. Crump reviewed the staff report and stated that this Development
Plan was similar to the previous one. The application was simply for a refiling
of the expired conceptual Development Plan approval . He briefly pointed out on
the map the design scheme of the project and recommended approval .
Commissioner Berkey asked if this was similar to the one previously
approved, in relation to Special Condition No. 4. Mr. Crump replied that it
was and also amended Spooial Conditlon No. 4 to read as follows: Construction
of a portion of said project shall commence within one year from the date of
final approval , March 22, 1981 , otherwise said approval shall become null ,
void and of no effect whatsoever.

Mr. Crump stated that there ere two subjects for consideration.
A. Consideration of cases ac ed on by the Design Review Board at
their meeting of February 6, 1980.
Case No. 176 MF -: Mr. Sawa prese ted this case stating that there was one
area that required specific Commission nformation of revisions by the_Detign
Review Board, which involved not moving , e driveway further to the west. He
recommended approval.
Upon motion made by Commissioner Be ey, seconded by Commissioner Kryder,
the actions by the Design Revew Board for C e No. 176 MF, were approved by
adoption of Planning Commission Resolution N . 579, as written. Carried unan-
imously (4-0).
B. Case No. 202 MF - TED R. LENNON, App icant
Letter to appeal Design Review Board' denial of a security
gate entry on Juniper Circle for Shado Mountain Resort and
Racquet Club.
Mr. Sawa presented this case stating that the esign Review Board
reviewed this case and felt there was inadequate stac 'ng area and turn
around. They also felt that this case was not in comp *ante with the
development standards, therefore, denied this request.
Chairman Snyder asked if the applicant cared to pr sent his case.
MR. TED LENNON, explained briefly the process he wen through, stating
he agreed the original design needed revisions. He redesign d the plan mov-
ing the security guard gate back. He further explained that here was suf-
ficient turn around space within the project. He asked Commi ion to recon-
sider for approval .
Chairman Snyder asked Mr. Lennon if it were possible to cre to a circular
condition east of the gate for the turn around problem. Mr. Lenn n explained
why it would not be possible.

The attached data was prepared by the applicant and is being forwarded
to you for comments and recommended Conditions of Approval . The City
is interested in the probable impacts on the natural environment (e.g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals , parks, power generation, sewage treatment, etc. )
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 p.m. February 22 , 1980, in order to be
discussed by the Land Division Committee at their meeting of February 275 1980.
The Land Division Committee (comprised of Director of Environmental
Services , City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission

access/entrance to Hovley Lane.

- Recreation Structure
• Open Space Analysis - Required, 50% of net site = 2.35 acres
- Proposed, 51.7% of net site = 2.43 acres
• Dwelling Unit Configureation - Twenty-four (24) dwelling units
arranged in duplexes wi.th attached
garages .
• Parking Analysis - Required, two .covered spaces per unit, plus 0.5
guest spaces per unit (total 60 spaces)
- Proposed, two covered spaces per unit, plus
guest spaces and recreational vehicle storage
spaces (total spaces) .
III . DISCUSSION:
As noted in the Background section of this report, conceptual Development Plan
approval for the subject site has expired, the present application represents
a refiling of the same project. A request for time extension of the related
Tentative Tract Map has been continued by the City Council until March 13,
1980, to allow for action on a new Development Plan application.
The design scheme of- the development features duplex units arranged around
the peri.meter of the site. The center core of the development is used for
vehicular circulation, guest parking (islands and bays) , and active recreation.
The northern portion of the site contains guest parking rows opposite dwelling
units , divided by an entrance driveway. At the approximate mid-point of the
site the main entrance and circulation driveway splits to circle around the
active recreation area.
IV. STAFF. RECOMMENDATION:
Based on the justification contained in the draft Resolution :
Approve DP 02-80, by adopting Planning Commission Resolution No. 578 ,
subject to conditions.

is interested in the probable impacts on the natural environment (e. g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals , parks, power generation, sewage treatment, etc. )
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 p.m. February 22 , 1980, in order to be
discussed by the Land Division Committee at their meeting of February 275 1980.
The Land Division Committee (comprised of Director of Environmental
Services, City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received by this office after
the receipt deadline will not be discussed by the Land Division Com-
mittee nor will it be forwarded to the Planning Commission for consid-
eration.
