WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: - 1. The proposed project generally conforms to the intent and purpose of the PR zone district. 2. The proposed location of the use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 3. The proposed location of the use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 4. The proposed use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 5. The proposed use complies with the goals, objectives, and policies of the city's adopted General Plan. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which inlcude, but are not limited to design review and building permit procedures. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to allow municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to 111 the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. Detailed exterior lighting plan in compliance with applicable standards to be submitted to the city for approval; lights to be down shining box type to minimize glare with 20 foot high light standards; 7. Six (6) foot high (on both sides) decorative block wall shall be provided as a part of Phase I along west and south (if deemed necessary by the city) property lines, to satisfaction of city; said wall on easterly property line may be constructed with the beginning of Phase II or when development occurs to the east, whichever occurs first. • 8. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all municipal code requirements to the degree that the city could consider each phase a single project. 9. No existing trees shall be removed from the site without approval of the department of environmental services. 10. 24 foot wide driveway to Phase I parking area-to be provided along east and west side so that complete circulation from the street is provided. 11. Parking area to be screened from the street through the use of berming and/or walls and landscaping. - 3 - PLANNING COMMISSION RESOLUTION NO. 808 Department of Environmental Services (Continued) 12. Signs not approved as a part of application; signs to be reviewed and approved by Design Review Board. 13. Blowsand protection to be provided for large outdoor areas as developed. 14. All existing electrical distribution lines, telephone, cable antenna television and similar service wires or cables, which are adjacent to and provide service to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed pursuant to municipal code requirements, unless determined to be unfeasible by the city. Department of Public Works: 1. Dedication of right of way to 44 feet from centerline on Hovley Lane shall be given. 2. Installation of curb and gutter at 32 feet from centerline, matching paving and sidewalk. 3. Complete improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any. street improvements is commenced. 4. The applicant shall submit as-built plans prior to acceptance of the improvements by the city. 5. All public improvements.shall be installed in accordance with city standards. All street improvements are required in conjunction with Phase I of the project. City Fire Marshal: 1. Install a water system capable of delivering 3000 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the following is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 02-82 is in accordance with the requirements prescribed by the fire marshal." 5. The applicant indicates that they have not commenced construction due to a lack of funds and would therefore request a one-year time extension. H. STAFF RECOMMENDATION: Staff feels this request is acceptable since conditions in the area have not changed and the proposed project is the same. RON GREGORY, Landscape Architect, explained that the design review board denied this request, but aesthetically, in his opinion the sign is attractive. Chairman Kryder asked if anyone wished to speak in OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Wood asked if the sign was so important why was the concern not discussed at the time of the lease. MR. HODGES replied that the matter of the signage was discussed with Great Western and they were assured that there would be no problem. Commissioner Wood expressed his reluctance to grant a variance after working for so long on the sign ordinance and felt that the matter of the signs was not looked into properly. Commissioner Richards explained that he agreed this medical center is greatly needed and felt that many signs presently in the city are not visible. He was in favor of granting a variance only on the basis that there are unusual circumstances. Chairman Kryder agreed that it is difficult to find the medical center but felt that this matter has put the planning commission in a difficult position, and no matter how much the commissioners feel they agree with the problem it is something that should be resolved by the tenant and landlord. Chairman Kryder asked staff if a double face freestanding sign could be used as an alternative. Mr. Diaz replied they could not. After further discussion it was determined that this facility is not for emergency purposes and other alternatives could not be used unless the sign ordinance is revised. Moved by Commissioner Wood, seconded by Chairman Kryder, to waive further reading and adopt Planning Commission Resolution No. 806, denying VAR 02-82. Carried 2-1 (Commissioner Richards voting Nay). A FIVE MINUTE RECESS WAS CALLED—THE MEETING RECONVENED AT 8:21 P.M. B. Case No. C/Z 06-82 (UA) - CITY OF PALM DESERT, Applicants Consideration of a negative declaration of environmental impact and a preannexation change of zone from R-1 12,000 (Riverside County) to PR-5 (UA) for 160 acres located at the northeast corner of Portola Avenue and Country Club Drive. Mr. Sawa reviewed the staff report and indicated that there were no negative responses received. Staff recommends approval. Chairman Kryder opened the public hearing and asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Moved by Commissioner Richards, seconded by Commissioner Wood, to adopt reasons for recommending this change of zone. Carried 3-0. Moved by Commissioner Richards, seconded by Chairman Kryder, to waive further reading and adopt Planning Commission Resolution No. 807, recommending approval of C/Z 06-82 (UA). Carried 3-0. C. o. DP 02- ESERT EVANGELICAL FREE CHURCH, Applicant Request for approval of a negative declaration of environmental impact and a development plan to allow construction of a church with related facilities in the PR-5 zone located on the south side of Hovley lane, approximately 1325 feet east of Monterey Avenue. Mr. Sawa reviewed the staff report and indicated staff's concerns were height of the buildings (one being 50' in height), blowsand, parking lighting. Staff is recommending -3- MINUTES PALM DESERT PLANNING COMMISSION JULY 6, -1982 a 6 ft. wall be provided on the east-west property lines to minimize impact on adjacent residential properties. Staff recommended approval. Commissioner Wood asked staff's recommendation of the building height problem. Mr. Sawa stated that there were no elevations submitted but Commission could approve the Development Plan as the phases are developed. Mr. Diaz recommended that the development plan be approved separately without the 50' high building. There was some discussion on this matter. Chairman Kryder opened the public hearing and asked if the applicant wished to make a presentation. MR. JIM THAYER, Architect, explained that the building itself does not need to be 50' in height. The reason they were asking for that height was because they would like to put a cross up next to the sign which would exceed the 30'. He also stated that the other buildings need not exceed the 30 ft. He asked that condition no. 7 be amended so that they do not have to provide a wall on the easterly property line in phase I. Mr. Diaz noted that the sign and the cross would have to be approved by Design Review Board but staff felt there should be no problem. Chairman Kryder asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. The hours of operation would be from 7 A.M. to 10 P.M. seven days per week. The main auditorium will seat 764. Parking has been provided at the rate of one space per 3 seats in the main auditorium. The site is developed as follows; 38% parking, 18% buildings, 1410 playgrounds and 30% landscaping. Layout is courtyard campus type with buildings all facing inner courtyard. The total courtyard dimensions arel80 feet long by 120 feet wide. The courtyard will be used for recreation and outdoor breaks. It also contains a 500 seat amphitheater which will be used for outdoor assemblies. Sur- rounding the courtyard are seven buildings of various size and mass as follows; 1 - Main assembly building, one story, 1 - Gymnasuim, one story, 2 - Classroom buildings, 2 story., 1 - Youth center, one story, 1 - Administration building, 1 story. To the south of the building cluster are two large playground areas. These will be depressed enough to double as a retention basis for rain water run off. They will also double as overflow parking areas. There are two drive- ways providing for two-way traffic surrounding the entire complex. Parking has been held to the perimeter to serve as a buffer between the complex and adjacent residential properties. Ultimate height of the main assembly building will be 50 feet. All other buildings will be approximately 35 feet tall. The trees will be of a tall species to be in scale with the buildings. There will be dense perimeter trees and schrubs to provide a wind break and visual separation between residential property and this complex. To provide limited access the applicant has proposed a 6 foot chain link fence around the property along the side and rear property lines. To limit headlight glare into the street the applicant has proposed a 6 foot tall earth berm along the street property line in the green area 21 feet wide between the parking lot and the street. A double face sign will also be located in this landscaped area as per drawing on site plan. Location and design of parking lot lighting is shown on the site plan. Glare will be cut at an angle to keep from shining onto adjacent property. The proposed architectural style is early California with stucco, wood trim and tile roofs. Use Proposals for Desert Evangelical Free Church: Desert Evangelical Free Church proposes to develop and operate a church and school facility with an ultimate occupancy of 764 on 4.77 acres on the south side of Hovely road approximately 2 mile west of Portola. The hours of operation would be from 7 A.M. to 10 P.M. seven days per week. The main auditorium will seat 764. Parking has been provided at the rate of one space per 3 seats in the main auditorium. The site is developed as follows; 387 parking, 18% buildings, 1410 playgrounds and 30% landscaping. Layout is. courtyard campus type with buildings all facing inner courtyard. The total courtyard dimensions arel80 feet long by 120 feet wide. The courtyard will be used for recreation and outdoor breaks. It also contains a 500 seat amphitheater which will be used for outdoor assemblies. Sur- rounding the courtyard are seven buildings of various size and mass as follows; 1 - Main assembly building, one story, 1 - Gymnasuim, one story, 2 - Classroom buildings, 2 story, 1 - Youth center, one story, 1 - Administration building, 1 story. To the south of the building cluster are two large playground areas. These will be depressed enough to double as a retention basis for rain water run off. They will also double as overflow parking areas. There are two drive- ways providing for two-way traffic surrounding the entire complex. Parking has been held to the perimeter to serve as a buffer between the complex and adjacent residential properties. Ultimate height of the main assembly building will be 50 feet. All other buildings will be approximately 35 feet tall. The trees will be of a tall species to be in scale with the buildings. There will be dense perimeter trees and schrubs to provide a wind break and visual separation between residential property and this complex. To provide limited access the applicant has proposed a 6 foot chain link fence around the property along the side and rear property lines. To limit headlight glare into the street the applicant has proposed a 6 foot tall earth berm along the street property line in the green area 21 feet wide between the parking lot and the street. A double face sign will also be located in this landscaped area as per drawing on site plan. Location and design of parking lot lighting is shown on the site plan. Glare will be cut at an angle to keep from shining onto adjacent property. The proposed architectural style is early California with stucco, wood trim and tile roofs. Phasing is shown on the site plan. All proposed improvements are new. There are no existing structures on the site at present.
