Case No. DP 03-80 (Amendment) STEIN-BRIEF/VISTA AND BALLEW-MCFARLAND, App ica An Amendment of an approved Development Plan to allow the construction of a 6,151 sq.ft. conference facility and 48 additional hotel units on 2.54 acres of a 29.29 acre site on the west side of Highway 111, south of 44th Avenue. Mr. Sawa presented this case indicating that the 2.54 acre site was previously considered as undeveloped and the applicants are now proposing 48 hotel units and a conference facility on this site. He referred to the exhibits pointing out the design of the project with the changes. He explained an additional request by the applicant was to utilize 10% of the hotel units for employees. He stated if Staff determines this is permissable, the applicant can submit a future amendment. Mr. Sawa noted that Staff recommended the 2.54 acre site to be included as part of Phase I. Commissioner Kryder was concerned about the collection of room taxes. He asked how this would be determined. Mr. Sawa replied that the applicant was present and can answer the question. Commissioner Richards felt that there was no justification for 10% of the hotel units to be utilized for employment. Chairman Miller opened the Public Hearing asking if the applicant cared to make a presentation. MR. JIM SMITH, Stein-Brief/Vista, 18071 Fitch Ave. , Irvine, briefly reviewed the background of the project. In describing the conference facility, Mr. Smith stated that it would attract seminar groups, 100 to 300 people. He explained how the redesign of this building created the setback deficiency. Mr. Smith further explained that this part of the project would be part of Phase I. Mr. Smith gave a detailed explanation as to why he. requested the hotel units for employees. He stated that they wanted to keep the management personnel for long- term employment in order to be able to operate a quality hotel . He also felt that the housingmarket would make impossible �t imposs le for employees to afford housing nearby. He I noted that this would require an amendment of one of the original conditions. Commissioner Richards felt that 10% was not needed. Mr. Smith replied that the number of rooms to be used would be determined in the future and that it could be more or less than 10%. Commissioner McLachlan asked for the cost of the units. Mr. Smith stated that a preliminary figure would be about $100,000 to $110,000. Commissioner McLachlan pointed out that housing nearby would probably be available for that amount or less. Mr. Smith stated that the hotel would retain ownership of the units and would be giving up the revenue. REQUESTED EXCEPTIONS FROM DEVELOPMENT STANDARDS: Pursuant to Muni,dipal Code Section 25.30.260, specific standards of the Planned Commercial (PC) zone may be modified by the approval of a Development Plan. The applicant is requesting consideration of the following "exceptions": 1. Minimum building setback from Painters Path. - Development Standards 25 feet - Proposed Standards �20 feet min. 2. Maximum number of Hotel units per acre (2.54 acre site) . - Development Standards max. 30 units/acre - Proposed Density, based on max. yield of 96 hotel units (rentable rooms) 37.8 units/acre III . DISCUSSION: The original project was approved by the Planning Commission on July 1, 1980. A phasing plan was subsequently approved on September 17, 1980. Both previous approvals indicated the 2.54 acre site being considered; as 6,, de le ped 'J � The applicants. are now proposing 48 units (96 rentable, r moo moo s) and a conference center on the 2.54 acre site. Two 24 unit clusters, three stories in height, are proposed. These would match the structures previously approved. The conference center is a separate structure and would be architecturally similar. With this amendment the total number of units of the entire site will increase to 438 (876 rentable rooms) from the previous 390 units (780 rentable rooms). Underground parking spaces for the condo/hotel will increase from 1316 to 1424. STAFF REPORT DP 03-80 (Amendment) November 5, 1980 Page Three III. DISCUSSION (cont. ) Other considerations include the following: A. Exceptions from Development Standards - The exceptions pertaining to building setbacks and hotel density are similar to those granted by the original approval . Therefore, these exceptions appear warranted. B. Request .for long-term living quarters for hotel personnel - The applicants have submitted an addendum to their amendment request. Staff has not had time to adequately review or include it as part of this consideration because of the lateness of the request. The addendum generally requests approval to use up to 10% of the hotel units for on-site "affordable" housing for their employees, in the low and moderate income range (see attached letter dated October 22, 1980). The Commission may wish to give the applicant some preliminary, informal input. With this input, the applicant can determine whether to pursue the subject through a future amendment, if Staff determines the use:. s 'pe:rmiss.ible. i C. Phasing of this amendment - This 2.54 acre site was not included in the phasing plan previously approved on September 17, 1980. It was noted that phasing would be designated at time of approval . Because of the location adjacent to Phase I (96 units, Athlet1U Club and some associated recreation facilities, lobby, administrative, 'restaurant and lounge, and required parking for Phase I) and the fact that it includes a conference facility, Staff recommends this amendment be included in Phase I. I IV. Subsequent to that, the City Council approved the same plan. On September 17, 1980, the Planning Commission also approved an amendment to the plan and on September 17, 1980, the Planning Commission approved a phasing plan for the project. All of these plans depicted a 2.5.4 acre portion of the site located at the Northeast corner of 44th Ave. and Painters Path as a site for future development of PC(4) uses. We herewith submit an amendment to the approved development permit and phasing plan to address the uses on that 2.54 acre portion. Please note that no uses or other aspects of the previously approved permit has been changed in this application. During the time subsequent to Planning Commission consideration of the original application, we have undertaken extensive analyses of the facilities which we have proposed. Comments made by the Planning October 2, 1980 City of Palm Desert Planning Department Page -2- Commission as well as our general concern to maximize the viability of the project.led us to conclude that additional conference oriented uses were appropriate. We therefore propose providing a 6,157 square foot conference facility and 48 additional Hotel units on the 2.54 acre site. We have designed the conference facility for use primarily with gatherings of seminar-sized groups. The interior spaces can be utilized in combination or as smaller individual meeting rooms. Ad- ditionally there is a small food handling room, restrooms, storage areas and outdoor patio spaces. We feel that the addition of this facility will significantly increase our ability to provide for con- ference or convention activities and thereby enhance the overall project. The additional 48 hotel units will be identical to those on the remain- der of the site.. Likewise, parking will also be handled similarily in a subterranean configuration with pedestrian access via elevators from the various levels of the buildings. Parking will be provided at a ratio of 2.2 spaces per unit for a total of 106 additional parking spaces. Additional outdoor recreation areas and open space has also been coporated for the use of those occupying the additional 48 units. The location of the hotel units and conference facility further:-allows this portion of the project to be somewhat separated in the event a particular seminar or conference so dictate it. In summary, we feel that the proposal is not only consistent with the October 2, 1980 City of Palm Desert Planning Department Page -3- City.'s_.policies and desires for the Hotel development, but will also significantly enhance the economic and physical aspects of the development. We feel very strongly that maintaining qualified employees and minimizing turn-over is crucial to the successful and high quality operation of a destination resort complex of this type. It appears that, for the foreseeable future , it will be very difficult for a significant percentage of the project ' s employees , particularly those in the low and moderate income ranges , to find adequate nearby housing. We have been strongly advised , not only by our consultants , but also by operators with considerable experience , to make every attempt to resolve this concern early in the planning process . Rather than look to the ultimate implimentation of the General Plan to provide affordable quarters for our per- sonnel , we would prefer to address this matter as a part of the development of our project. These staff units would be located in such a manner over the site as to not interfere with the normal hotel operation. It appears that a statement of policy from the Commission on this concept is necessary in order to proceed with its implimentation. We therefore request such direction from the Commission. Since the Amendment to Development Permit 03-80 is scheduled to be heard by the Commission on November 5th, we would agree with the staff that this would be a good opportunity to re- view this matter. We feel that, if the City concurs with our assessment, condi- tions and restrictions could be developed which guarantee tha these units would not be used by non-hotel parties and to further insure compliance with the intent of the General Plan and Zoning Ordinance. The development of the property shall conform substantially with Exhibits A thru K (Case Nos. DP 03-80 and VAR 03-80) on file with the Department of Environmental Services, as modified by the following conditions and as superceded by revisions to the site plan. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval , the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permits procedures. 3. Construction of the total development may be done in phases ; however, each individual phase shall meet or exceed all Municipal Code require- ments to the degree that the City could consider each phase as a single project, and have specific approval from the Planning Commission. The Hotel shall be constructed as a part of the first phase. 4. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null , void and of no effect whatsoever. 5. Prior to the issuance of any City permits for the commencement of construction on said project, the applicant shall agree in writing to these Conditions of Approval . 6. The development of•the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 7. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are adjacent to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed. 8. All requirements of the City Fire Marshal shall be met as part of the development of this project per attached letter dated March 18, 1980. 9. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. If proposed hotel units are to be sold to separate individuals, the applicant (developer/subdivider) shall provide, as a part of the Tentative Tract application, proposed covenants, conditions and restrictions which limits the rights of use by said individual (or assignee) to 30 calendar day per year. Except for maintenance and repair, each hotel unit and room shall be made available for transient rental 335 days per year. Further the CC&R's shall specify that hotel unit furnishings are to be provided and owned by the owners association in common. Personal property of the unit owner may not be stored on the premises in conflict with the operation of the facility as a commercial hotel , and shall be so stated in the CC&R's. 3. Hereby granted as a part of this approval action is a Variance from Municipal Code Section 25.30. 170, to allow five (5) site access points on Painters Path; and, Variance from Municipal Code Section 25.30. 120, to allow subparagraph "C" of said section to operate. 4. Special events and tournaments taking place in conjunction with the racquet club facilities shall be the subject of a Temporary Use Permit request as provided in Municipal Code Chapter 25.64. 5. Hereby authorized as a part of this Development Plan approval are the exceptions as listed in the following: a. Minimum setback from Painters Path, twenty (20) feet. b. Maximum number of rentable hotel rooms per area devoted to hotel development, forty-two point two (42.2) . 6. A minimum 32 ft. wide area parallel to the curb line on Highway 111, consisting of the public parkway and an easement granted for public access, shall be developed with ornamental landscaping and a meandering 8 foot wide pedestrain/bicycle path; and, thereafter shall be maintained by the associated owners of the adjacent property. 7. Outdoor tennis courts provided in this project shall be recessed below natural grade or other alternative screening found acceptable. 8. The specific design details of a system 9 providing Y p g alternative emergency vehicular access to all hotel buildings by means of an expanded pedestrian system, as approved by the City Fire Marshal , shall be included in the required exhibits for Design Review of the hotel development. NEW BUSINESS (cont. ) Commissioner Richards felt that a furhter study should be made before any decisions are made by the Commission. The study should include needs, utilization of facilities, maintenance cost, who would be responsible for maintenance, and users fees. MR. FRED ARBUCKLE, of Ballew-McFarland, pointed out that all the reviewing bodies had reviewed and approved this park design. He stated that he had discussed th possibility of lighting and renting the tennis courts with Mr. Doty of the C.V. Parks and Recreation District but Mr. Doty opposed the idea. He indicated that they do anticipate to include lights in the final design but they would not be installing them. The Commission also felt there was inadequate parking provided. Mr. Arbuckle stated that most of the concerns expressed could be worked out and did not want to delay the project further. Commissioner Berkey asked the applicant if the Commission were to decide that it was premature to decide on anything now, would he be willing to bond the completion of the project at a future date. MR. DAVE GUTIERREZ, Project Manager for Mayer Group, 8280 E. Florence, Downey, stated that he would like to look into the bonding amounts. Mr. Crump explained that one of the conditions from the Development Plan states that the park improvements can occur during the last half of development, therefore, the applicants can proceed with development even if no decisions were made tonight. Commissioner Richards suggested that a further study be made and a report be submitted to the Commission. The Commission concurred. Motion was made by Commissioner Richards, seconded by Commissioner Berkey, to continue this item indefinitely for further study. Carried unanimously (5-0) . E. `Case Nos_DP 03-80 and VAR 03-80, STEIN-BRIEF/VISTA, Applicant v 'j Approval of a phasing scheme for an approved Development Plan located at the Southwest corner of Highway III and 44th Avenue. Mr. Crump presented this case illustrating the proposed phasing scheme and uses on the Exhibit. He indicated that Staff recommends the improvements to the Palm Valley Channel occur within the first phase of site development which drains to the channel . Commissioner Richards asked if the Hotel would be developed at the same time the Restaurant would be. Mr. Crump replied that it would. Commissioner Berkey explained that because it was a previous condition to get the CVWD's approval of the improvements, he suggested that Condition No. 3 be amended to read: "Improvements to the Palm Valley Channel shall occur, subject to the Coachella Valley Water District, in the first phase of development to the channel , etc. . . . " He also pointed out that the channel should be improved before any development occurs. Mr. Morgan, Engineering Aide, stated that the Department of Public Works had requested the drainage plan on this site but had not yet received it. He also suggested that Condition No. 3 be amended from "as required by the Director of Environmental Services" to "as required by the Director of Public Works". Mr. Crump clarified the modification to Condition No. 3 as follows: "Improvements to the Palm Valley Channel , as required in the original Development Plan approval , shall occur in the first phase of development. JIM SMITH, of Stein-Brief/Vista Group, explained that they are planning to submit amended plans addressing additional uses and these would be part of Phase I. He explained the purposes of the phasing and did indicate that all improvements to Hwy 111, 44th Avenue, and Painters Path will occur in Phase I. He also requested a modification to Condition No. 3 to read as originally amended by Commissioner Berkey. MR. DAVE WAGNER, of Wagner-Stanford, added that any upstream improvements, as required, will be made as they develop. Commissioner Berkey pointed out that there are two weak spots at the Channel that might create a problem for the development. He felt that this problem should be looked into or improved before any development. The applicants agreed with Commissioner Berkey and stated that they would make improvements as required by the Coachella Valley Water District. Mr. Crump stated that the Commission had a choice in amending Condition No. 3 as requested by the applicant or as stated by Mr. Crump previously. The Commission agreed to modify the condition as follows: "Improvements to the Palm Valley Channel , as required in the original Development Plan approval , shall occur in the first phase of Development." Motion was made by Commissioner Berkey, seconded by Commissioner McLachlan, to approve the phasing plan by adoption of Planning Commission Resolution No. 643, as amended. Carried unanimously (5-0) . He reviewed those revisions and recommended approval of the revised preliminary plans. Motion was made by Commissioner Kryder, seconded by Commissioner Richards, to approve the actions of the Design Review Board by adoption of Planning Commission Resolution No. 644. Mr. Dos Santos made a presentation on this subject and the Commission directed Staff to make the recommended changes in the Housing Element. B. Consideration of Alignment for Magnesia Falls Drive.
