I . REQUEST: Request for approval of a Development Plan and Preliminary Design Review to provide for approximately 460 condominium units, a nine hole golf .course, twelve swimming pools and accompanying therapy pools on approxi- mately 155 acres within the PR-4, S.P. and PR-6, S.P. zones as an exten- sion of the previously approved 780 units, 18 hole golf and tennis club development known as Desert Squire Country Club. II . STAFF RECOMMENDATION: Approve the Development Plan by Planning Commission Resolution No. ,�. Justification: 1 . Proposed development will conform to the intent and purpose of the PR Zone District. 2. Proposed development will conform to the adopted General Plan. 3. The site is physically suited for the type of Development proposed. III . BACKGROUND: A. Location: The subject site is located on the east side of Monterey Avenue adjoining the southern boundary of the proposed Desert Squire Country Club. B. Size: Approximately 155 acres C. Zoning: PR-4, S.P. , O.S. and PR-6, S.P. D. Adjacent Zoning: North - PR-5 South - P East - PR-4, S.P. West - City of Rancho Mirage E. Type of Units : 460 single story, single-family condominium units with two car attached garages in buildings of 3, 4 94 5 units per building. IV. DESCRIPTION OF PROJECT: The project will contain approximately 460 condominium units surrounding a portion of a regulation length, 27-hole golf course. This is an exten- sion of the previously approved 780 unit, 18-hole golf and tennis club development known as Desert Squire Country Club. The additional nine holes will be built in conjunction with this Development Plan request. Case No. DP 04-78 Page Two March 28, 1978 IV. DESCRIPTION OF PROJECT: (Cont. ) The condominium units will be of the same design, layout and construction as those on the balance of the Desert Squire project. Twelve swimming and accompanying therapy pools will be added and spread throughout the 460 units. With the addition of all 460 units to the development, nine tennis courts will ultimately be added on a phased basis at the main clubhouse area bringing the total to twenty-six. Approximately 95% of these units will be contiguous to the golf course while the remaining units will be immediately adjacent to a green belt common area. Owners of these units will enjoy the same rights to the golf, tennis , clubhouses and other recreational facilities as the initial 780 owners. V. DP 04-78 & 114MF WHEREAS , the Planning Commission of the City of Palm Desert, California, did receive a verified application from SUNRISE COMPANY requesting approval of a Development Plan and Preliminary Design Review to allow construction of approximately 460 condominium units, a nine-hole golf course , twelve swimming pools and accompanying therapy pools on approximately .155 acres located east of Monterey Avenue and adjoining the southern boundary of the Desert Squire Country Club, more particularly described as : APN 621-350-005 APN 621-350-006 APN 621-350-025 APN 621-350-026 WHEREAS , said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7" , in that the Director of Environmental Services has deter- mined that this project will not have a significant adverse effect on the environment on March 13, 1978 and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, the Planning Commission did find the following facts and reasons to exist to justify the approval of the subject Development Plan : 1 . Proposed development will conform to the intent and pur- pose of the PR Zone District . 2. Proposed development will conform to the adopted General Plan . 3 . The site is physically suited for the type of Development proposed. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows : 1. The development of this project shall conform substantially to all plans submitted in behalf of this case and as revised accord- ing to the Design Review Board process and/or Planning Commission action . Any minor changes requires approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission . 2. All requirements of any law, ordinance , or regulation of the State , City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project , commencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust , or air conditioning equipment shall be fully concealed from view from any public rights-of-way and ad- joining properties by architecturally. integrated means . 5. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 6. All utility service and distribution lines on or abutting the sub- ject. property, shall be placed underground prior to occupancy clearance. 7. Traffic control provisions shall be provided as required by the Director of Public Works . 8. Curb, gutter , sidewalk or approved pathways , and tie-in paving shall be provided in conformance with City Standards and/or as re- quired by the Director of Public Works . 9. The Fire Protection Requirements as specified in the Fire Marshal ' s � memo dated March 14, 1978, attached hereto, shall apply. 10. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies : r Riverside County Department of Health Palm Desert Design Review Board Process i City Fire Marshal Coachella Valley County Water District Evidence of said permit or clearance from the above agencies shall be presented to the Dept . of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. Install a water system capable of delivering 2500 GPM fire flow for a (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) , shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the. water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned. to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 04-78 is in accordance with the require- ments prescribed by the Fire Marshal . This letter is not to be interpreted as a contractual commitment to serve the proposed project; but only as an information service. Its intent is to notify you that the Southern California Gas Company has facilities in the area where the above named project is proposed. Gas service to the project could be provided from an existing main without any significant impact on the environment. The service would be in accordance with the Company's policies and extension rules on file with the California Public Utilities Commission at the time contractual arrangements are made. The availability of natural gas service, as set forth in this letter, is based upon present conditions of gas supply and regulatory policies. As a public utility, the Southern California Gas Company is under the jurisdiction of the California Public Utilities Commission. We can also be affected by actions of federal regulatory agencies. This is an exten- sion of the previously approved 780 unit, 18-hole golf and tennis club development known as Desert Squire Country Club. Install a water system capable of delivering 2500 GPM fire flow for a (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) , shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 04-78 is in accordance with the require- ments prescribed by the Fire Marshal .
