I. DISCUSSION:
The effective approval date of these cases is December 26, 19 3. Extensions have
been granted annually since approval in 1980. TT 16133 is the implementing tract
map for this project and also expires on December 26, 19893. The tract map has
been extended for the last time and will have to be refiled if not recorded by the
expiration date.
H. STAFF RECOMMENDATION:
Staff feels this request is acceptable and recommends approval of an extension to
December 26, 1989t

Development Plan 04-80 provides for the creation of 156 residential units, related
recreational amenities and open space on approximately 34 acres of PR-5, S.P. zoned
property at the northeast corner of Hovley Lane and Cook Street.
The above noted cases were granted a one year time extension by Planning Commission,
March 31, 1981. The Code does not specify a maximum number of time extensions.
STAFF RECOMMENDATION:
That Planning Commission grant a one year time extension to Case Nos. DP 04-80 and
204 MF subject to all previously imposed conditions continuing to be in effect.

UNITS, RECREATIONAL AMENITIES AND OPEN SPACE AND RELATED
DESIGN REVIEW APPLICATION ON APPROXIMATELY 34.06 GROSS ACRES
AT THE NORTHEAST CORNER OF HOVLEY LANE (EXTENDED) AND COOK
STREET.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did hold a duly noticed Public Hearing on March 31, 1981, to consider a request by
J.M. PETERS COMPANY for approval of a one year time extension to allow construction
of 156 residential units, related recreational amenities and open space and related
design review application, on approximately 34.06 gross acres within the PR-5, S.P.
(Planned Residential , max. 5 d.u./acre, Scenic Preservation Overlay) zone at the
northeast corner of Hovley Lane (extended) and Cook Street, more particularly described

WHEREAS, said application has complied with the requirements of the "City of
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined
that the project will not have a significant adverse impact on the environment and a
Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, the Planning Commission did find the following facts and reasons
to exist to justify the approval of the subject Development Plan and Preliminary Design
Review:
1. The proposed development is consistent with the City's
adopted General Plan.
( - 2. The proposed use is similar to and compatible with those
lcontemplated on nearby properties.
3. The design or improvements of the proposed development
will be consistent with the Palm Desert Zoning Ordinance.

CONDITIONS OF APPROVAL ~
CASE NO. DP 04-80 AND 204 MF
Standard Conditions:
1. The development of the property shall conform substantially with Exhibit
A-K (Case No. DP 04-80) on file with the Department of Environmental
Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval , the applicant shall first complete all the
procedural requirements of the City which include, but not limited to,
Design Review, Subdivision process , and building permit procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code requirements
to the degree that the City could consider each phase as a single project.
4. Construction of a portion of said project shall commence within one year
from the date of final approval otherwise said approval shall become null ,
void and of no effect whatsoever. Further, the total project shall be
completed by January 1, 1987. After said date, this approval shall auto-
matically expire for those remaining undeveloped portions of the subject
property and the City Council may initiate rezoning procedures to revert
said undeveloped areas to an S (Study) Zone designation,.
5. Prior to the issuance of any City permits for the commencement of construc-
tion on said project, the applicant shall agree in writing to these conditions
of approval .
6. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and State and Federal Statutes now in force, or which
hereafter may be in force.
7. All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent to
the property being developed shall be installed underground as a part of
development from the nearest existing pole not on the property being
developed.
8. All requirements of the City Fire Marshal shall be met as part of the _
development of this project per attached letter dated March 18, 1980.
9. Construction plans shall be submitted for approval to the City Fire
Marshal prior to issuance of building permits. All conditions shall be
made a part of construction and no certificate of occupancy shall be
issued until completed.
10. Traffic control provisions shall be provided as required by the Director
of Public Works.
11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works.
12. Prior to issuance of a building permit for construction of any use con-
templated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process -
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Department of Building and Safety at the time of
issuance of a building permit for the use contemplated herewith.
13. No development shall occur on the subject property prior to recordation
of a tract map.

SPECIAL CONDITION
1. Secondary access shall be provided to Via Cinta.
DESIGN REVIEW CONDITIONS
A. Site Plan
1. The proposed perimeter wall shall be extended for the full length of
the northerly boundary of the project.
2. Details shall be submitted as a part of the working drawings for all
walls, walks and special materials.
3. The stamped pavement treatment shall be utilized at the main entrance
to the project.
4. All driveway aprons shall be concrete.
5. All units shall have a minimum 320 square foot private yard area.
All units with private yards facing south or west shall have increased
overhangs or patio covers.
6. Show air-conditioning pad locations on final landscaping plans and how
screening will be achieved.
7. For driveways without 20 foot aprons, open parking spaces shall be
provided adjacent to said driveways.
B. Landscape Plan
1. The proposed eucalyptus is not approved. The applicant shall submit �-
an alternative acceptable to the Board as a part of construction
drawings.
2. Delete Cercidium Floridum, Chilopsis Linearis , Eugenia Myrtifolia, and
Grevillea Noellii and provide acceptable alternative with construction
drawings.
C. Building Elevations
1. As a part of construction drawings, the applicant shall submit plans
for all miscellaneous buildings, such as guard houses , storage build-
ings, recreation-related shade structures and buildings.
2. The applicant shall utilize solar panels for all pools and shall
incorporate said panels into the recreation area.
3. Prior to submission of final construction drawings, the applicant shall
submit to the Design Review Board iterim plans to show how shading of
glass areas will be achieved.

Gentlemen:
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1 . Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.

2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
l traval ways. Hydrant spacing not to exceed 500 feet.
A. Hydrants shall not be located closer than 25 feet to any building.

for review. Upon approval , one copy will be sent to the Building Department
and the original will be returned to the developer.

4. The water system plan shall be signed by a registered civil engineer, and
approved by the water company, with the following certification : " I certify
that the design of the water system in Case Number DP 04-80 is in accordance
with the requirements prescribed by the Fire Marshal ."
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
6. Alternate access to this site shall be provided.
7. No cul-de-sac shall exceed 700 feet in length.
8. Parking shall be allowed only on one side of all 32 foot streets.

VI . PUBLIC HEARINGS (continued)
Chairman Snyder asked if the applicant cared to make a presentation.
TOM LEMMON, 124 Las Lomas, gave a brief presentation on the background
and explained the procedures they went through. He also explained that there
wouldn't be additional parking needed because employment would not increase,
and because of this he asked the Commission to grant the Variance.
Chairman Snyder opened the Public Hearing asking if anyone present wished
to speak in FAVOR or OPPOSITION to this case. There being none, the Public
Hearing was closed.
Commissioner Berkey suggested that an agreement might be made in regards
to in lieu parking fees. Mr. Crump stated that the City did not have a program
to construct City parking facilities at this time. Commissioner Berkey then
stated that an agreement to join into such a district in the future might be
appropriate.
Commissioner Kryder. did not feel there would be a parking problem and
therefore, was in favor of granting the Variance. Commissioner Berkey agreed,
but added that a condition should be added requiring the applicant to pay in
lieu parking space fees.
The Commission concurred and upon motion made by Commissioner Kryder,
seconded by Commissioner Miller, Variance No. 02-80 was approved by adoption
of Planning Commission Resolution No. 586, subject to conditions.
Acting on the Commission's direction the following conditions were
subsequently drafted for inclusion in the Resolution:
1. All requirements of any law, ordinance, or regulation of the State
City and any other applicable government entity shall be complied
with as a part of the use of this Variance.
2. Pursuant to City Council Resolution No. 79-7, the applicant shall
pay $4,000 into the City In-Lieu Parking Space Fund, prior to the
use of this Variance. Use of this Variance shall be construed to
be the .issuance of building permits.

Request for approval of a Development Plan and related Design
Review application to allow a 156 unit development with related
recreational amenities and open space on approximately 34.06
gross acres located at the northeast corner of Hovley Lane
and Cook Street in the PR-5, S.P. (Planned Residential , max.
5 .d.u./ac. , Scenic Preservation Overlay) zone district.
Mr. Crump presented this case showing the location on the exhibit and
reviewing the staff report. The main issue in this case was access off Cook St.
Staff felt that a main entrance should be provided off Hovley Lane from Via
Cinta. Mr. Crump stated that the main reason for this was to restrict the number
of access points to Cook Street to a minimum. He stated that the applicant chose
to have its major entry from Cook Street. He then gave a number of reasons as
to why the entrance should be from Via Cinta. Staff recommended approval sub-
ject to conditions.
Chairman Snyder asked if the applicant cared to make a presentation.
MR. STEPHEN FLESHMAN, Representative, 74-075 El Paseo, stated that they
had no objections to all the conditions except Special Condition No. 1, which
addressed the main entrance* He explained that all other projects off Cook St.
also had their main entrance off Cook. He then pointed out on the site plan
exhibit a proposed secondary entrance from Via Cinta. Mr. Fleshman concluded
that because of desired visibility and identification of the project, they would
like the access to remain as proposed.

Commissioner Miller asked if the guard gate on Cook Street had
sufficient turn-around. Mr. Fleshman replied that it did and illustrated
on the exhibit how this would be provided.
Chairman Snyder opened the Public Hearing asking if anyone present wished
to speak in FAVOR or OPPOSITION to this case. There being none, the Public
Hearing was closed.
Commissioner Berkey believed that it would be discriminative to not
allow access of Cook Street, and with the new access being proposed he suggested
to delete Special Condition No. 1. Commissioner Kryder concurred.
Commission agreed to amend Special Condition No. 1 to read as follows:
"A secondary access shall be provided from Via Cinta. "
Chairman Snyder asked Mr. Beebe, City Engineer, if he had any comments.
Mr. Beebe referred to his memorandum, which concurred with Staff that
the proposed main entrance should be relocated to Via Cinta.
After a brief discussion the motion was made by Commissioner Berkey,
seconded by Commissioner Kryder, to approve Case Nos. DP 04-80 and 204 MF,
by adoption of Planning Commission Resolution No. 587, as amended. Carried
unanimously (4-0) .

Request for approval of a Development Plan to allow construction
of a hotel/condominium complex, racquet club, and commercial and
professional spaces, located at the southwest corner of Highway
111 and 44th Avenue.
This application was noticed for Public Hearing, but subsequently found
to be incomplete, and processing was suspended.
MR. STEPHEN FLESHMAN briefly explained to the Commission what the request
was for and what the problems were at this point. He requested from the Commission
that they grant the applicant more time to complete the necessary processing and
for this case to be put on the April 16th Agenda.
Mr. Crump stated that State Law provides for the rejection of applications
if found incomplete within 30 days of filing.
Mr. Fleshman pointed out that they were not notified of the case not being
on the Agenda until last week. He also added that there were several pre-filing
meetings with Staff.
Mr. Crump stated that the applicant was aware that Staff needed more
application information along with other procedural requirements.
Commissioner Berkey asked if this matter could be done within the next
meeting date.
Mr. Crump again stated that this case has not been properly submitted
therefore, action could not be taken.

E. DESCRIPTION OF DESIGN ELEMENTS:
1. Perimeter Streets - improvement of Cook Street, Hovley Lane and
Via Cinta.
2. Internal Private Streets/Driveways - major central loops serving
nine cul-de-sacs.
3. Recreational Amenities
- Six (6) swimming pools with jacuzzis
- Eight (8) tennis courts
- Small recreation building
4. Open Space Analysis
- Required, 50% of net site - 16. 1 acres
- Proposed, 57.6% of net site, 18.56 acres
5. Dwelling Unit Configuration - one hundred fifty-six (156) units -
4.43 dwelling units per acre - arranged in duplex buildings with
attached garages. A majority of the buildings front on cul-de-sacs.
6. Unit Design - the proposed units range from one bedroom plus den to
three bedrooms with from 1250 square feet to 1570 square feet.
Architecture to consist of flat tile roof with three different
colors and two selections of stucco color - sandstone and eggshell .
7. Parking Analysis
- Required, 312 covered spaces and 78 guest open spaces
- Proposed, 312 covered spaces, 104 open bay spaces and 118 street

III . DISCUSSION OF DEVELOPMENT PLAN:
A. General Concept - In terms of the overall design, Staff believes that
the proposed project is commendable. It is sensitive to the site and
would create a pleasant living environment for the ultimate occupants .
However, there are some concerns and/or suggestions that the Commission
may want to consider during its deliberations on this project. A
majority of the concerns deal with the design review aspect of the
project and will be discussed in the next section. Focusing on the
Development Plan, the Commission should consider the following:
B. Project Entrance - The subject project was previously considered as a
lot in Parcel Map No. 13406. As a part of that review, the concept of
access to the subject parcel was developed. This concept was the
creation of a public street cul-de-sac off of Hovley Lane to serve the

subject parcel and the property to the east. This concept was
implemented to restrict the number of access points to Cook Street
to a minimum. The proposed project ignores this concept and pro-
vides its major entry from Cook Street. The applicant has indicated
verbally that this approach is desirable from a marketing standpoint.
While the applicant is justified in his position, Staff believes that
the original concept should be implemented for the following reasons:
1. With the ultimate extension of Hovley Lane to connect with 42nd
Avenue in the east, the relocation of the main entrance to the
existing cul-de-sac will provide more flexibility to the ultimate
occupants in terms of circulation.
2. Ultimately, a signal is proposed at this intersection of Hovley
Lane and Cook Street. The use of the existing cul-de-sac for the
main entrance to the project will provide for better westerly and
northerly circulation.
3. Because of ultimate traffic volumes , the design of Cook Street as
a major arterial with a raised center median precedes the possi-
bility of a left turn pocket for the proposed main entrance. The
relocation to the cul-de-sac overcomes this problem.
4. The relocation of the main entrance to the cul-de-sac improves the
mitigation for the total project in terms of noise and blowsand
impacts.
5. The use of the cul-de-sac as the main entrance to the complex
improves the concept of privacy of the project.
6. The original concept would appear to improve the overall security
for the complex.
7. It seems disfunctional to plan for access to properties based upon
many valid reasons ; to require implementation by one project; and
then to allow the other project to be developed with a less desira-
ble alternative. The result would be a public cul-de-sac serving
a single project.
If the Commission agrees that the original concept of the main entrance
to this property being from the existing cul-de-sac, Staff would recommend
that the following minor changes be made to the Development Plan:
1. The proposed main entrance be relocated to Via Cinta and the former
location be incorporated into .the green belt system.
2. The area within the center of the loop street system be reversed so
that the major recreation area is oriented to the east.
3. The four units abutting the bulb of this cul-de-sac be relocated
elsewhere in the project and/or deleted to provide for the new
entrance location.
4. An emergency entrance should be provided to Cook Street from the
private street cul-de-sac in the northwest corner of the project.
5. A pedestrian entrance to the project from Cook Street should be
provided near the center of the project.
These suggestions have been incorporated into the suggested conditions
of approval as Special Condition No. 1.
C. Development Standard Conflicts
1. Private Yards - The plans submitted reaches no provision for
required yard area. The suggested condition of approval requires
conformance to this provision and suggests increased overhangs or
patio covers for all south or, west facing yard areas.

2. Setbacks - The applicant is proposing a reduction of the required
setbacks between units from 20 feet to 15 feet. Since this is to
occur only in relatively few places , at corners of garages, Staff
believes this request is justified and has provided for this excep-
tion in the suggested conditions of approval .
D. Miscellaneous Concerns
1. Maintenance Storage - It would appear that this size project
requires a building for the storage of maintenance equipment and
supplies. The recommended conditions of approval provides for
matter and suggests that it be incorporated into the revised
entrance.
2. Recreational Vehicular Storage - The applicant has provided, far
in excess, the required guest parking which could also function
for long term parking of recreational vehicles. The Commission
may want to evaluate this alternative in relation to a separate
storage area.
IV. DESIGN REVIEW APPLICATION:
The Design Review Board considered the companion Design Review case at their
March 25, 1980, meeting. The Board had several site plan, landscape plan,
and building elevation revisions and conditions which they recommended (refer
to draft Resolution Conditions).
The applicant's representative gave an elaborate presentation to the Board
members on the specific subject of project access. The applicant's representa-
tive succeeded in convincing the members present, that the design of the main
access to Cook Street was acceptable. Staff finds that access to a major
arterial is more properly a subject for City Traffic Engineering Policy, rather
than a site design matter normally considered by the Board. The question of
access is a policy matter addressed by both the General Plan Circulation Element
and the Subdivision Ordinance; the proposed location conflicts with the policies
of those City documents.
V. STAFF RECOMMENDATION:
The land plan appears to be a logical , well-thought out design concept, which
may be improved with some minor modifications.
Therefore, based on the justification provided in the Resolution, Staff
recommends:
Approval of DP 04-80 and 204 MF, by adopting Planning Commission Resolution
No. , subject to conditions.
PROJECT LOCATION
The J. M. Peters Co. project is located on the northeast corner
of Cook Street and Hovley Lane, comprising 34. 06 acres .
CONCEPT
This residential planned development , consistent with the desig-
nated zoning - PR-5 , S .P. , focuses clusters of single family
attached duplex units around a central recreation area which
includes a clubhouse and eight tennis courts . Additionally,
there are six pool areas scattered throughout the development as
shown on the site plan.
SITE PLAN
The resulting site plan consists of a main "loop" street circula-
tion with cul-de-sacs feeding off of it surrounded by the clusters
of residential units . Again , the recreational node is located
in the center of the project and faces ontio-the entry street
enhancing the entering movement into the development.
There will be a total of 156 units ranging in size from 1250
square feet to 1570 square feet. The units range from one bed-
room plus den to three bedroom.
PHASING
Phasing for this project consists of three phases :
Phase one will include the main recreation areas , two pool
areas , 68 units , the entrance street and the other streets
necessary for access to the units . This first phase will
account for the western half of the project property.
Phase two, being the northeast quarter of the property,
will consist of two additional pool areas and an additional
56 residential units . The streets will be constructed
actor dingly.
The third pnd final phase will include the last two pool
areas and another 32 residential units to total 156 units .
With this phase will be the completion of the "loop" street
and subsequent circulation.
The overall design features varying setbacks between
units that range from 15 ' where units come together at
a corner to as far as 50 '

Dear Paul:
Thank you for giving us the opportunity to comment on the
above referenced case.
The City of Indian Wells has no objection to the development
as proposed. We would, however, recommend that certain con-
ditions be placed on the project so as to mitigate possible
impacts on circulation in the area. We suggest that the
Conditions of Approval include provisions whereby the developer
is required to:
1. Provide right-of-way and improvements on Cook Street
for a 55 foot half street using the section shown in
Riverside County Road Department Improvement Standard
No. 100 .
2 . Provide for the signalization of the intersection of
Cook Street and Hovely Lane. This intersection will
become a major traffic problem in the near future
given the current rate of development.
3. Provide and maintain a landscaped parkway on Hovely
Lane and on Cook Street. We suggest a minumum of
12 feet in depth.
4 . Provide more on-site parking to serve the tennis
facility or reduce the size of the facility. It
would appear that this tennis complex could accom-
modate outside members and/or tournaments . This
could lead to excessive congestion within the project
and possibly on Cook Street.

5. If the project is to be a private, gated community,
care should be taken in the design of the gate facility.
The gates should be designed so that there will be
adequate stacking capacity and turn-around capability
for vehicles that are refused admittance.
We are sure that your Environmental Review will address the
impact of additional storm water runoff from the project as well
as suggest methods of mitigating the blowsand hazard that exists
on the site.
If clarification or elaboration is needed on any of the points
raised, please contact us at your convenience.

Gentlemen:
This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1984.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. Ile now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
through 1979.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

(1 ) Emergency entrance should be provided off Cook Street near the most northerly
boundary of this development.
(2) It is recommended that the entrance off Cook Street be eliminated as Via
Cinta was planned on the original development plan of the entire area to
be utilized as the main entrance to this property. Cook Street is con-
templated to be one of our major street carriers of automobile traffic
and another entrance off Cook would be detrimental to the auto traffic as
planned. The future signalization of Hovley Lane and Cook Street makes
this an ideal intersection to take the transfer of traffic from the major
street to a secondary street. It is the recommendation of the Public Works
Department that Via Cinta be utilized for the main entrance to this subdivision.
