REQUEST: A request to amend the Development Plan for the Sandpiper Condominium Project. to permit construction of a 2-unit planned residential condo- minium on an 18,700 square foot parcel located north of Pitahaya Street and east of Shadow Mountain Drive. II. STAFF RECOMMENDATION: Approve the request to Amend the Development Plan of a condominium project to permit construction of a 2-unit planned residential condominium by Plan- ning Commission Resolution No. 230 , subject to compliance with the conditions. Justification is based upon the following: 1. The proposed development is consistent with the City's adopted General Plan. 2. The proposed use is similar to and compatible with .those existing on adjacent and nearby properties. 3. The design or improvement of the proposed development as modified by the recommended conditions will be consistent with the Palm Desert Zoning Ordinance. 4. The site is physically suited for both the type of development proposed and the proposed density. 5. The design of the development as amended by the recommended conditions and the proposed improvements are not likely to cause substantial environ- mental damage or have a serious effect on the public health, safety, and general welfare. III. BACKGROUND: A. Size - 18,700 square feet B. Total Number of Units Proposed - 2 C. Density:- Equivalent of 4 units per acre D. Coverage - Approximately 28% of the area will be covered by structure or paving. E. EIR Finding - An Environmental Assessment of the project was made and a Negative Declaration has been issued and the appeal period has expired. F. .Existing Zoning-- PR-6 G. General Plan Commitfnentt- The General Plan indicates the property to be potentially medium density residential with 5-7 dwelling units per acre. I. Utilities - Power - Southern California Edison Water and Sewer - Coachella Valley County Water District Gas - Southern California Gas Telephone - General Telephone J. Type of Units - The project will consist of a single-story duplex with each unit having two bedrooms and approximately 1,350 square feet of living area excluding a common recreation room. K. Parking - Each unit will have a two-car garage. L. Recreational Amenities - A swimming pool is being proposed as part of the development. IV. DISCUSSION OF .ISSUES: As a low density residential development, the 2-unit project will be compatible with surrounding properties. The project conforms to the General Plan and the applicable zoning. Concern has been expressed by adjacent property owners that run-off problems might materialize if a solid masonry wall is not constructed along the north property line due to the lot's slope to the north. Inspection of the site indicated that a masonry wall would be desirable on the north property line in order to retain surface runoff and thereby insure a certain amount of protection to property north of the subject site. In addition, some form of solid masonry wall would be more aesthetically acceptable than the present chain link. With the exception of the issue regarding the type of fence to be constructed on the north property line, there appear to be no other problems requiring resolution. The design and nature of the project is such that the proposal is not likely to cause any substantial encironmental damage nor have any ad- verse effect on adjacent property owners. Type of Units - The project will consist of a single-story duplex with each unit having two bedrooms and approximately 1,350 square feet of living area excluding a .common recreation room. K. Parking - Each unit will have a two-car garage.. L. Recreational Amenities - A swimming pool is being proposed as part of the development. IV. DISCUSSION OF ISSUES: As a low density residential development, the 2-unit project will be compatible with surrounding properties. The project conforms to the General Plan and the applicable zoning. Concern has been expressed by adjacent property owners that run-off problems might materialize if a solid masonry wall is not constructed along the north property line due to the lot's slope to the north. Inspection of the site indicated that a masonry wall would be desirable on the north property line in order to retain surface runoff and thereby insure a certain amount of protection to property north of the subject site. In addition, some form of solid masonry wall would be more aesthetically acceptable than the present chain link. With the exception of the issue regarding the type of fence to be constructed on the north property line, there appear to be no other problems requiring resolution. The design and nature of the project is such that the proposal is not likely to cause any substantial encironmental damage nor have any ad- verse effect on adjacent property owners. . He stated that there would be no outside noise ' and that the number of people using the facility at any one time I would be limited. Regarding the drainage, Mr. Herman stated that -' he understood that they would build up the rest of the lot and the water would drain onto the street; it would not drain onto the adja- cent property. Chairman Wilson stated that this issue would be taken care of during the Design Review Board process. Mr. Williams' report included a descrip- tioh of the project and a complete background of same. Mr. Williams also read into the record a letter from Mr. R. A. Kronman, 34A-Sandpiper, Palm Desert, California. Said letter is attached to this set of minutes and per- F ' tains to Mr. Kronman's objection to the type of fencing that Mr. Homme had planned on installing. Mr. Kronman requested that the Commission give con- jl sideration to requiring the installation of a block wall as opposed to wood fencing. RALPH BURKE, 72-848 Pitahaya, spoke to the Commission and told them that he was neither for nor against the project; he was mainly con- cerned about the grading of the lot and the potential drainage problem. Chairman Wilson asked the City Engineer to discuss the situation. City Engineer Cook explained that the water would .drain onto the adjacent property unless curb and gutter was installed along the street (Pitahaya) ; then the water would drain to the Palm Valley Storm Channel. There was a discussion between Mr. Burke and Mr. Cook pertaining to how the residents who lived on Pitahaya Street could form a district for the installation of curb and gutter. Chairman Wilson suggested that Mr. Cook follow up on the above discussion with the residents in the area. Chairman Wilson then asked if there was anyone else present wishing to speak regarding the project. Being no one, he closed the Public Hearing and asked the Commission for their feelings. There was a discussion between the Commissioners and staff regarding the drainage problems and the fence situation as pertained to height and loca- tion.
