PALM DESERT VENTURE, LTD. , APPLICANT Request for approval of an Amendment to an existing Development Plan to construct 46 condominium units on property located east of San Luis Rey and Juniper, as the final phase of Shadow Mountain Resort and Racquet Club. Mr. Williams reviewed this case showing the existing conditions with the aid of slides. He indicated that the Shadow Mountain Resort and Racquet Club project has been in progress since 1972. The Development Plan has . been approved by the Planning Commission for the entire parcel previously. The applicants are now seeking an Amendment to a portion of the overall Development Plan. Mr. Williams then reviewed the site plan during which he indicated that the setback along San Luis Rey will be a minimum of twenty (20) feet and that 13 of the 46 units to be constructed will be two-story units. He also indicated that the project conforms to the PR-7 zone density requirements. Mr. Williams then pointed out that the project does not meet the requirement of twenty (20) foot setbacks between buildings but that this situation is not a problem as none of the two-story projects are abutting. The elevations were then reviewed at which time it was indicated that the height of the twa-story units is 28 feet and the single-story units is 18 feet. The units vary in size from 1,300 square feet to 1,700 square feet in living area. Mr. Williams then referred to the Palm Desert Property Owners Association letter pertaining to this project. He then indicated that the Design Review Board during their review of the project had requested that the Planning Commission give consideration to both circulation and a possible reduction in the number of units or a change in the configuration of the units. Mr. Williams indicated that the Fire Marshall believes there is no circulation problem with regard to fire protection. Mr. Williams then referred to a letter from Mr. York, a nearby property owner, who is concerned with the two-story structures and the possible increase in traffic on San Luis Rey. Mr. Williams concluded his presentation by reviewing the Conditions of Approval which include a master trash agreement, the conversion of the present lighting of the tennis courts, and uhdergrounding of utilities along San Luis Rey. Commissioner Berkey asked if the conditions had been discussed with the appli- cant. Mr. Williams indicated that the applicant would address the conditions. Mr. Cipriani then informed the Planning Commission that the streets had already been approved as part of the overall Development Plan so that Condition No. 6 was irrelevant and that it should be deleted. Chairman Wilson opened the Public Hearing and asked if the applicant was present. FRANK J. URRUTIA, 73-350 El Paseo(applicant's representative) , spoke to the Commission and indicated that the applicant was already complying with Condition No. 5. He indicated that Condition No. 3 had already been discussed with Mr. Williams and that the applicant had no problem with complying with that condition. Mr. Urrutia then addressed the Pro- perty Owners Association's concerns regarding guest parking and private recreation space. He indicated that the bulk of the parking is located on the south portion of the site because a majority of the guests use the Club House and the pool. With regard to the size of the rear yards for units on Juniper, he indicated that there is recreation space but that it has to be viewed on floor plans and plot plans combined. He also indicated that there will be mounding and extensive landscaping on Juniper which will offer privacy to these units. ` Minutes Palm Desert Planning Commission May 3, 1977 Page Three Commissioner Reading indicated that there is not sufficient parking for guests since this is a resort, and that the project cannot accommodate overflow. Mr. Urrutia stated that presently there is adequate parking. § . Chairman Wilson asked if there was anyone present wishing to speak in FAVOR of the project. Being no one, he asked if there was anyone present wishing to speak in OPPOSITION to the project. MR. JAMES SCRIBNER, Palm Desert, approached the Commission and stated that he represented eight property owners. He said he welcomed the development but objected to the two-story units. He maintained that the two-story units would block the sun and destroy the view for some of the adjacent property owners. In addition, he questioned the fire protection for specific houses. Regarding parking, he urged the Com- mission to consider the parking requirements for guests who do not reside in the project. MR. GEORGE RITTER, 73-899 Highway 111, spoke to the Commission and indicated that he did not intend to speak in opposition but would like to make a request. He urged the Commission to consider a right-hand turn-only provision for motorists exiting on Juniper. He believed this wouldn't inconvenience any residents or guests but it would pre- vent more through traffic from attempting to avoid Highway 111 by meandering through this neighborhood. MR. TED LENNON, a developing partner, indicated that he wished to answer questions regarding. parking. He said that Shadow Mountain has no outside memberships and that for most residents of the project, these units will be second homes. As a result, there will be. no parking problems. Chairman Wilson closed the Public Hearing and indicated that the primary con- cerns regarding the project appeared to be the two-story element in the southwest corner of the project, the question of parking, and the possibility of a right- turn-only exit from the project. Commissioner Reading stated that he agreed with Mr. Scribner; that the two-story units will affect the property previously pointed out. He in- dicated that he wanted the project re-designed so that there would be no two-story units on the perimeter. Commissioner Berkey indicated that he agreed with Commissioner Reading. Commissioner Berkey was concerned with guest parking in the northerly portion of the project and that the right-turn-only provision would be impossible to enforce. Commissioner Kelly agreed with the other commissioners regarding the two- story element and indicated she was not satisfied with the fire protection as guest cars might create obstructions should emergency vehicles need to enter the project. Mr. Williams stated that the chances of an auto accident blocking fire trucks is extremely remote and indicated that he relies on the Fire Marshall's judgment relative to this point. Chairman Wilson concurred with the other Commissioners. He indicated he wanted the two-story units removed; that he is satisfied with the circula- tion; and that he questioned whether the right-turn-only provision could be enforced. With regard to the right-turn-only provision, Mr. Williams stated that previously the Commissioners themselves had decided to delete this condition as the City Engineer had recommended against it. Minutes Palm Desert Planning Commission May 3, 1977 Page Four Chairman Wilson then indicated that the two-story unit on the west property line on San Luis Rey should also be reduced to single story. Mr. Williams revised Condition No. 6 to indicate a reduction of the two-story unit on San Luis Rey to a single-story unit and the two (2) two-story units on the southwest corner of the parcel to single-story units. The applicant indicated that he would comply with this condi- tion. The motion unanimously carried (4-0) . B. CASE NO. C/Z 05-77, AFFILIATED CONSTRUCTION COMPANY, APPLICANT Request for a Change of Zone from R-1 to R-3(3) on a 0.51-acre parcel located south of Larrea and east of Lantana. Mr. Williams reviewed the location, adjacent zoning, and adjacent land uses. He indicated that from a zoning standpoint, the area is in a tran- sition period and is moving toward multi-family zoning. Therefore, staff was recommending approval of the Change of Zone request by Planning Commis- sion Resolution No. 236. Furthermore, any development would have to be single story and have similar setbacks as those R-1 residences located to the east. He then reviewed two letters of opposition. Chairman Wilson opened the Public Hearing and asked if the applicant was present. FRANK GOODMAN, 77-900 Avenue of the States, spoke to the Commission and indicated that he concurred with the staff's opinion and that he believes that the area can be upgraded. Chairman Wilson asked if there was anyone present wishing to speak in FAVOR of the proposed Change of Zone. Being no one, he asked if there was anyone present wishing to speak in OPPOSITION to the request. MR. CHARLES SCHOENDIENST, 45-496 Garden Square, representing DR. FARBER, indicated that he objected to the concept of changing the area from R-1 to R-3. Chairman Wilson closed the Public Hearing on C/Z 05-77 and asked the Commis- sion for their feelings. Commissioner Kelly stated that she favored the R-1 designation in order to protect the present home owners. Commissioner Berkey stated that he believed that the subject property was not located in a desirable area for R-1 development. He felt that the Design Review Board process could mitigate any displeasures that might be caused to adjacent neighbors. He favored the R-3 designation. Commissioner Reading indicated that he favored denying the zone change. Chairman Wilson stated that he sympathized with Commissioner Berkey but that he remembered when Lantana seemed a logical break between R-1 and R-3. He, therefore, favored the R-1 designation. Commissioner Reading moved that the Planning Commission deny the request by Resolution No. 236. Commissioner Kelly seconded the motion. REQUEST A request for approval of an amendment to an existing Development Plan to construct 46 condominium units on property east of San Luis Rey and Juniper as the final phase of Shadow Mountain Resort and Racquet Club. II. . STAFF RECOMMENDATION: Approve an amended Development Plan (DP 06-77) to construct 46 condo- minium units by Planning Commission Resolution No. 235 , subject to compliance with conditions of approval. Justification is based upon the following: 1. The proposed development is consistent with the City's adopted General Plan. 2. The proposed use is similar to and compatible with those existing on adjacent and nearby properties. 3. The design or improvement of the proposed development as modified by the recommended conditions will be consistent with the Palm Desert Zoning Ordinance. 4. The site is physically suited for both the type of development proposed and the proposed density as modified by the recommended conditions. 5. The design of the development as amended by the recommended conditions and the proposed improvements are not likely to cause substantial environmental damage or have a serious effect on the public health, safety, and general welfare. III. BACKGROUND: A. Description: The subject property is located east of San Luis Rey and Juniper and is more particularly described as the SE 144, Sec. 20, T55S, R6E, S.B.B. & M. and 1/1 M Tract 4545 (CM 015/171 175) . B. Location: The subject property is, located on the east side of San Luis Rey Avenue, slightly more than one quarter mile south of Highway 111. C. Size: Approximately 5.2 acres in this phase. D. Total No. of Units: 46 units in this phase and 97 units overall. E. Density: 8.79 units per acre in this phase and 5.1 units per acre overall. April 25, 1977 Page one i ' w III. BACKGROUND: (Continued) F. Coverage: Approximately 50% of the gross area will be covered by structure or paving. Approximately 46% of the area will be in open space or recreational space. G. EIR Funding: An environmental impact report was filed on the overall project in June of 1973. The current proposal is substantially in conformance with original development plan and no further environ- mental documentation is required by law. A Negative Declaration was filed on April 11, 1977 and the appeal period has expired. H. Existing Zoning: PR-7. I. Adjacent Zoning: North - R-1 12,000 South - O.S. East - PR-7 West - R-1, 16,000 and R-1 20,000 J. General Plan Commitment: Low density, 3.5 dwelling units per acre. K. Utilities: Water & Sewer - Coachella Valley County Water District Power - Southern California Edison Company Gas - Southern California Gas Company Telephone - General Telephone Company L. Type of Units: Project will consist of single and double story condominium units, with two or three bedrooms and `ranging in size from 1,290 to 1,690 square feet. Thirteen (13) of the units will be two story. M. Parking: Each unit has two covered spaces. There are a total of 92 covered spaces and 27 uncovered spaces. N. Previous Action: The Conditional Use Permit approved for this case in January, 1974 provided for 108 units in the overall Development Plan. The central portion of the project contained two story motel-condo- minium units and single story triplexs to the west. This plan was amended on June 1, 1976 to provide for 51 units in the central portion of the project, with minor changes in the configura- tion of structures and the size of units. The applicant is presently presenting an amended Development Plan which indicates a revision in the design of the triplex .units previously shown to provide a more marketable unit with attached garages. The present proposal provides 46 one and two story condominium units in this phase, bringing the total project to 97 units, a reduction of 11 units from the total approved in 1973 under the original Conditional Use Permit. IV. DISCUSSION OF ISSUES: The purpose of the case under discussion is to allow the development and extension of a proposed amendment to an existing development plan. Such amendment will meet the intent of the zoning ordinance. The proposed amendment will decrease the number of units from 54 to 46 which falls within the approved P.R. 7 density verses the entire project. It is the intent of the Developer to improve the marketability of the condo- minium product they now offer. The proposed development will consist of both single story and two story attached dwellings ranging in area from 1300 s.f. to 1700 s.f. A mix of three basic units: 1) 2 bedroom-2 bath; 2) 3 bedroom - 2 bath; 3) and a 3 bedroom - 3 bath Townhouse unit, will be used in attached configurations. Attached carports and garages will be provided with central acgess to groups of buildings leaving perimeter open spaces to be enjoyed by each unit. April 25, 1977 Page two IV. DISCUSSION OF ISSUES: (Continued) All streets are intended to be private and will be maintained by the Owners Association which will be established. Architecturally two story townhouses are mixed with single story units achieving a variety of interesting roof planes and shapes. Previously all units were in triplex configurations, all being repeated. The proposed amendment will allow for the architecture to flow together both with open spaces and buildings. Common areas will consist of two types. The first will flow throughout the project tying the pool areas with other open areas. Views and patios have been emphasized in the site layout. The second type will be the entrance courts. These areas are intended to be landscaped both with planting and fountains creating a pleasant entrance to groups of units. All common areas will be maintained by an Owners Association set up as a normal necessity to a condominium project. It is anticipated that some units will become part of the Club's management program which will offer rental services to owners who participate. The proposed development generally conforms to the development standards mandated in the Zoning.Ordinance for the PR zone. With regard to parking, the Applicant has provided 119 spaces where 115 are required. In addition,__ _ 92 covered_ spaces have been provided in the plan where an equal amount':•are required. The'20',"perimeter setback required for those areas lying adjacent e to public-rights-of-way has been provided. The Applicant has also conformed to the minimum open space requirement (plan includes 46% open space where 40% is required) and the maximum building coverage requirement,(50% of the site being covered with structures and paving where 50% is permitted by the Zoning Ordinance) . The maximum height of the two story units is 28' where 30" is permitted. The minimum 20:' separation between buildings required by the Ordinance has not been met. Staff believes the Applicant should be permitted flexibility in this area due to the fact that none of the two story units lies directly across from another two story unit. Another minor area of concern is the 12' half-width of Club Circle as a minimum 15' half-width is required by the Zoning Ordinance. These two minor concerns actually point to staff's major concern with regard to the project. Namely, that the interior of the project does not utilize space in the most efficient way. As a result, those units adjacent to Juniper have only a negligible amount of rear yard space. In addition, the uncovered parking spaces in the south portion of the project are located right up to the property line with no landscaping between the spaces and the property line. This situation suggests that the interior of the project is somewhat compressed as a result of the provision of a large amount of landscaped area on the western border of the project along San Luis , Rey. However, staff believes the area adjacent to San Luis Rey is an extremely strong statement in design and landscaping and staff would like to see that portion of the project untouched. Therefore, it appears that the only way to mitigate the sense of compression in the interior of the project area would be to redesign some of the project to provide an alternative configuration . of structures or perhaps to delete one or more units. April 25, 1977 Page three PLANNING COMMISSION RESOLUTION NO. 235 A RESOLUTION OF THE PLANNING COMMISSiON OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING APPROVAL OF AN AMENDMENT TO AN EXISTING DEVELOPMENT PLAN TO ALLOW CONSTRUCTION OF 46 CONDOMINIUM UNITS ON PROPERTY GENERALLY LOCATED EAST OF SAN LUIS REY AND JUNIPER CASE NO. DP 06-77 WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert l Zoning Code, the Planning Commission did on May 3, 1977, hold a duly noticed public hearing to consider the application of PALM DESERT VENTURE, LTD for approval of an amendment to an existing development plan to allow the con- struction of 46 condominium units on property located in the PR-7 Zone and situated east of San Luis Rey and Juniper and more particularly described as: a portion of SE 4, Sec. 20, T.5S, R6E, S.B.B. & M. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7, in that the Director of Environmental Services has determined on April 11, 1977 that the project would not have a significant impact on the environment and ( the appeal period did expire on April 18, 1977, and; lWHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the following facts and reasons to exist to justify the granting of said approval: 1) The proposed development is consistent with the City's adopted General Plan; 2) The proposed use is similar to and compatible with those existing on adjacent and nearby properties; 3) The design or improvement of the proposed development as modified by the recommended conditions will be consistent with the Palm Desert Zoning Ordinance; 4) The site is physically suited for both the type of development proposed and the proposed density, as modified by the recommended conditions; 5) The design of the development as amended by the recommended conditions and the proposed improvements are not likely to cause substantial environmental damage or have a serious effect on the public health, safety, and general welfare. -1- PLANNING COMMISSION MAY 3, 1977 RESOLUTION NO. 235 CONDITIONS OF APPROVAL CASE NO. DP 06-77 I. STANDARD CONDITIONS 1. The development of the property shall conform substantially with that as shown on plot plan and related Exhibits A-E, on file with the De- partment of Environmental Services, Case No. DP 06-77, unless other- wise amended by the following conditions. 2. Prior to the issuance of a building permit, for any condominium structure, a subdivision shall be recorded conforming substantitally with said Exhibits A-E. 3. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following public agencies : County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of the issuance of a building permit for the use contemplated herewith. 4. A landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Board Process. The building permit when issued shall include the grading, lighting, amenities, trash storage, walkways, swimming pool equipment, and irrigation systems. No final inspection or oc- cupancy shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construc- tion shall have been completed. 5. The applicant shall conform to all requirements and improvements deemed necessary by the City Fire Marshal, per attached interoffice memorandum. 6. Construction of the development permitted hereby may be done pro- gressively in stages, provided adequate vehicular access is constructed for all dwelling units and further provided that such stage development conform substantially with the intent and purposes of this approval for the provision of open areas, recreation facilities, park dedication, and off-street automobile parking. 7. The sewerage disposal system and flood control considerations shall be submitted to and approved by the Coachella Valley County Water District prior to issuance of a building permit. S. This approval shall be used within one (1) year of this action, otherwise it shall become null and void and of no 'effect whatsoever. By "use" is meant recordation of a subdivision map and beginning of construction of a portion of the project. 9. Prior to utilization of this Development Plan, the applicant shall agree in writing to any conditions of approval. 10. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which here- after may be in force. -1- PLANNING COMMISSION RESOLUTION NO. 235 CONDITIONS OF APPROVAL CASE NO. DP 06-77 II. SPECIAL CONDITIONS: 1. The applicant shall underground all existing overhead utility distri- bution lines on or immediately adjacent to the property on San Luis Rey Avenue. 2. A masonry wall or landscape berm with equivalent noise abatement 4,E capabilities shall be required along the full frontage ofSan Luis Rey except for approved openings site, design, and materials as approved by the Design Review Board process. 3. A private patio or yard area of at least three hundred and twenty (320) square feet shall be provided for each dwelling unit. 4. A master trash agreement shall be developed for the total project and enclosed trash storage areas shall be provided through the development as approved as a part of. the Design Review Board process. 5. Any proposed lighting of the tennis courts shall be approved as a part of the Design Review Board process. In addition, as a part of this development, the existing tennis court lighting shall be modified to conform to the approved system. 6. The two proposed two-story units in the southwest corner of the pro- ject and the two-story unit adjacent to San Luis Rey shall be limit- ed to a single story. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environ- mental Services. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any build- ing is more than 250 feet from a fire hydrant measured along approved vehic- ular travel ways. A.. Hydrants shall not be located closer than 25, feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. ! C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Depart- ment, and the original will be returned to the developer. 4. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the ! design of the water system in Case No. DP 06-77 is in accordance with the requirements prescribed by the Fire Marshal." Our total system demand is expected to continue to increase annually; and, if our plans to proceed with future construction of new gener- ating facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1981 . In addition, the major fuel used in Edison's generating facilities is low sulfur fuel oil. ' We now believe that our low sulfur fuel oil inventory, together with our contractual commitments for delivery and our customers' conservation efforts, will permit us to meet the forecasted demand for electricity during 1977. 1 It is our intention to continue to do everything that can reasonably be accomplished to provide our customers with a continuous and sufficient supply of electricity. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour. duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of - any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall fur- nish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engi- neer and approved by the water company, with the following certif- ication: "I certify that the design of the water system in Case No. DP 06-77 & DP 07-77 is in accordance with the requirements prescribed by the Fire Marshal . " -Z- 5. The proposed buildings on the west end of Fairway would pose some real problems for the Fire Department because of the, limited access. The buildings should be located so an emer- gency vehicle can drive within 100 feet of all points of the building. Also with only ten feet between the rear of the proposed building and a fence it would hamper our efforts to fight a fire from the rear of the building. We would recom- mend that this building be relocated to a point where there is clear access for fire equipment in the front and twenty feet in the rear. The proposed amendment will decrease the number of units from 54 to 46 which falls within the approved P.R. 7 density verses the entire project. 2. It is the intent of the Developer to improve the marketability of the condominium product they now offer. The proposed development will consist of both single story and two story attached dwellings ranging in area from 1300 s. f . to 1700 s . f. .
