WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 20th day of September, 1983, hold a duly noticed public hearing to consider a request
by ALEX ADAMEK for approval of a 71 unit condominium project in a PR-5 zone, more
particularly described as APN 622-020-032, 033, 034 & 035.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project has been previously assessed.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Planning Commission did find
the following facts and reasons as justified in the staff report for DP 06-81 Amendment
#1 and TT 17794 Amendment #1, dated September 20, 1983, on file in the department of
environmental services, to exist to recommend approval:
1. That the proposed map is consistent with applicable general and specific
plans.
2. That the design or improvement of the proposed subdivision is consistent
with applicable general and specific plans.
3. That the site is physically suitable for the type of development.
4. That the site is physically suitable for the proposed density of development.
5. That the design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat.
6. That the design of the subdivision or the type of improvements will not
conflict with easements, acquired by the public at large, for access through
or use of property within the proposed subdivision.
7. The proposed project generally conforms to the intent and purpose of the PR
zone district.
8. The proposed location of the use is in accord with the objectives of the
zoning ordinance and the purpose of the district in which the site is located.
9. The proposed location of the use and the conditions under which it will be
operated and maintained will not be detrimental to the pubic health, safety,
or general welfare, or be materially injurious to properties or improvements
in the vicinity.
10. The proposed use will comply with each of the applicable provisions of this
title, except for approved variances or adjustments.
II. The proposed use complies with the goals, objectives, and policies of the
city's adopted General Plan.
WHEREAS, in the review of this tentative tract map the Planning Commission has
considered the effect of the contemplated action on the housing needs of the region for
purposes of balancing these needs against the public service needs of the residents of the
City of Palm Desert and its environs, with available fiscal and environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Via, Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case;
2. That it does hereby approve the above described Tentative Tract Map 17794
Amendment #1 and Development Plan 06-81 Amendment #1 for the reasons
set forth in this resolution and subject to the attached conditions.
FURTHER, BE IT RESOLVED that the conditions of approval do include a
requirement that the applicant ALEX ADAMEK comply with the requirements of Article
PLANNING COMMISSION RESOLUTION NO. 887
26.48 of the City of Palm Desert Subdivision Ordinance. In return, the city agrees to use
said fees for park purposes in conformance with an adopted master plan, within five (5)
years of the recordation of the final map.

CONDITIONS OF APPROVAL
Case Nos. DP 06-81 and TT 17794 Amendments #1
Department of Environmental Services:
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all the
. requirements, limitations, and restrictions of all municipal ordinances and state
and federal statutes now in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as required by ordinance
and the city engineer shall be installed in accordance with city standards.
3. Prior to submittal of the final map, the applicant shall provide the department of
environmental services with a list of proposed street names with at least three
alternatives. The approval of the final street name shall be made by the director
of environmental services.
4. Access rights to Hovley Lane shall be offered to the city as a dedication on the
final map.
5. The CC&R's for this development shall be submitted to the director of
environmental services for review and final approval by the city attorney prior to
the issuance of any building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the city engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the owners
of the units of the project.
6. Improvement plans for water and sewer systems shall meet the requirements of the
respective service districts.
7. Area shall be annexed to appropriate improvement districts having jurisdiction over
the subject area.
8. All dedicated land and/or easements required by this approval shall be granted to
the City of Palm Desert, without cost to the city and free of all liens and
encumbrances.
9. All on-site utilities, including cable.TV, shall be placed underground and shall be
completely concealed from view except certain appurtenances as may be approved
by the director of environmental services.
10. Complete plans and specifications shall be submitted as required by ordinance to
the city engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as-built" plans prior to
acceptance of the subdivision improvements by the city.
11. All private streets shall be inspected by the engineering department and a standard
inspection fee shall be paid.
12. All requirements of the Planning Commission action on Development Plan 06-81
Amendment #1 shall be met as a part of the development of this tract.
*.-a 13. The applicant shall have 2 years from the date of the approval or conditional
approval of the tentative map for filing of the final map unless an extension of
time is granted by a resolution of the city council.
14. Drainage and Signalization Fund contributions as required by city ordinance shall
be made prior to recordation of the final map.
15. Developer shall pay a fee in lieu thereof as a condition of the final map, for park

and recreation purposes. The city shall commit the use of any such fees received
within a five year period.
16. Final map not to be recorded until design changes, if required by approval of
preliminary plans by the architectural review board are incorporated.
17. Blowsand planting to be provided along northern and western boundaries of
subdivision as approved by architectural commission.
18. Subdivision to be provided with minimum six foot high solid masonry wall around
project (except for approved openings) as approved by architectural review
commission.
19. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
20. Landscaping maintenance on Hovley Lane shall be provided by the homeowner's
association.
21. Hovley Lane shall be dedicated and improved to secondary roadway standards.
Curb and gutter to be 32 feet from centerline.
22. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the public works director.
23. Project to receive approval from the city architectural commission prior to
permits being issued.
24. Comply with parking requirements as required by city council action in September,
1983.
25. Traffic safety striping on Hovley Lane shall be provided to the specifications of the
director of public works. A traffic control plan must be submitted to and approved
by the director of public works before placing pavement markings.
Fire Marshal Conditions:
26. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour
duration in addition to domestic or other supply. The computation shall be based
upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the time of measurement.
27. Install Riverside County super fire hydrants at each intersection and so that no
point of any building is more than 250 feet from a fire hydrant measured along
approved vehicular travel ways.
a. Hydrants shall not be located closer than 25 feet to any building.
b. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction from each
hydrant.
28. Prior to issuance of a building permit, the developer shall furnish the original and
three (3) copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department and the original will be
returned to the developer.
29. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case DP 06-81 and TT 17794 is in accordance with the
requirements prescribed by the fire marshal."
30. Prior to delivery of combustible materials to the building site, the required water

system shall be installed, operating and delivering the required flow.
31. Fifty (50) foot turning radius is required at entry for access both directions into
project.
32. Entry gate shall operate by an approved emergency access system.

Mr. Grant explained that these owners made a loan expecting to get principal and
interest back but instead got property back.
Commissioner Richards responded that when they entered into a contract they
should have been aware of the possibility of problems like this arising.
Commissioner Crites concurred.
Moved by Commissioner Richards, seconded by Commissioner Downs, to approve
Item A of the consent calendar, for a one year time extension, and deny Item B,
being a fourth request for time extension. Carried 4-1 (Commissioner Erwood
voting Nay; he was in favor of approval for both requests).
VII. PUBLIC HEARINGS
A. Case No. CUP 12-82 (Amendment) - TOWER GARDEN RESTAURANT and
RICHARD ROEMER, Applicants
Request for an amendment to a conditional use permit (for
a restaurant/bakery) to allow an expansion of 708 sq.ft. for
dining purposes in the C-1, S.P. zone located at the
northeast corner of Sage Lane and El Paseo (73-260 El
Paseo).
Mr. Diaz stated he had received a telepone call from the applicant stating he may
request a continuance at the time of this hearing.
Chairman Wood opened the public hearing and asked if the applicant was present.
MR. JOHN BAKER, explained that their attorney could not be present at
this time and requested a continuance.
Moved by Commissioner Crites, seconded by Commissioner Richards, to continue
this case to October 4, 1983, 7:00 p.m. per applicant's request. Carried
unanimously 5-0.
B. Case No DP 06' 81 aid TT 17794 Amendment Nos. 1 - ALEX ADAMEK and
ROBERT RIC RDI, Applicants
Request for approval of a 71 unit condominium
development on approximately 14.25 acres within the PR-5
(Planned Residential, 5 d.u./acre) zone generally located on
the south side of Hovley Lane, 330 feet west of Portola
Avenue.
Mr. Joy reviewed the staff report and recommended approval.
Chairman Wood opened the public hearing and asked if the applicant cared to make
a presentation.
MR. ROBERT RICCIARDI, 73-725 El Paseo, concurred with staff's
recommendation and was present to answer any questions.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the public hearing was closed.
The commission was concerned with the architecture, specifically the colors and
landscaping.
Mr. Ricciardi provided another rendering which showed the design of the
development more specifically and explained the concept of the design.
Moved by Commissioner Downs, seconded by Commissioner Richards, to approve
findings as recommended by staff; carried unanimously 5-0.

C. Case Nos. CUP 18-83 and PMW 04-83 - CHESTER DORN, Applicant
Request for approval of a conditional use permit and parcel
map waiver to allow construction of a retail commercial
building in a C-1 zone located between the Frontage Road
and Alessandro and on the north side of Alessandro Drive,
370 feet east of Portola Avenue.
Mr. Smith reviewed the staff report and stated one of staff's recommended changes
to the plan was that the applicant's proposed outdoor storage area be eliminated
and the area be landscaped. He reviewed the conditions and stated that the
applicant had agreed to these conditions. Mr. Smith added that a concern was
mentioned by an adjacent property owner in regards to drainage; staff felt drainage
would be adequate. Staff recommended approval.
Commissioner Erwood questioned the parking lot lighting and its impact on
adjacent residential areas. Mr. Smith replied that lighting has not been shown on
the plans yet. Mr. Diaz explained the applicant is required to submit a lighting
plan that would conform to the city's ordinance, which prohibits parking lot lighting
spillover onto residential areas.
Chairman Wood opened the public hearing and asked if the applicant wished to
make a presentation.
MR. CHESTER DORN, stated that they concur with staff's recommended
conditions.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case. There being none, the public hearing was closed.

2200 sq.ft. restaurant in a C-1 zone (General Commercial)
located on the west side of Painters Path, north of Fred
Waring Drive.
Mr. Joy briefly reviewed the staff report and recommended approval.
Chairman Wood opened the public hearing and asked if the applicant cared to make
a presentation.
MR. MICHAEL BECKER, 74-492 Azurite Circle E, agreed to staff's
recommended conditions and was present to answer any questions the
commission might have.

REQUEST:
A request for approval of a 71 unit condominium development on
approximately 14.25 acres within the PR-5 (Planned Residential, 5 d.u./acre)
zone generally located on the south side of Hovley Lane, 330 feet west of
Portola Avenue.

I. BACKGROUND•
A. SITE DESCRIPTION:
The site is just to the south of the Casablanca condominium development
under construction presently. It consists presently of two 4.75 acre parcels,
a third which is 3.02 acres and a fourth which was recently acquired from
the water district, totals 1.73 acres and comprises the major portion of the
amendment. The property then measures 994' in width and 629' in depth or
14.25 acres.
B. ADJACENT ZONING/LAND USE:
North: PR-5/Condominium Project
South: PR-5/Vacant
East: PR-5/Vacant
West: PR-5/Vacant
C. GENERAL PLAN LAND USE DESIGNATION:
Low Density Residential 3-5 d.u./acre
II. DISCUSSION:
A. GENERAL:
This application originated when the applicant proposed to consolidate
duplex units into fourplex structures on an approved development plan. This
change itself necessitated an amendment to both the development plan and
tract map. Recently the applicant negotiated for the 1.7 acres adjacent to
and now part of the site formerly owned by the water district. The
acquisition of this property allowed the applicant to add nine units bringing
the total number of units to 71 on 14.25 acres which is the maximum
permissable in the PR-5 zone.
The site design of the project is identical to the one previously approved in
terms of the roadway layout. The main difference is the additional units at
the southwest portion of the project that does not affect the original
roadway design whatsoever. Two of the original 62 units were transferred
to the southwest portion of the site accounting for the presence of eleven
units in this area on the proposed site plan.
The issue of off-street parking spaces has arisen in planned residential
projects that possess private streets. The ordinance requires 2.5 spaces for

each such cluster unit, two of which must be covered. It has been
acceptable in the past when the developer provides a two car garage for
each unit to allow the extra half space for each unit to be located on the
private street. The developer in this case provides two covered parking
spaces for each unit and has agreed to provide the extra half-space per unit
in any manner that the council determination on September 8 requires.
The architecture of the buildings and landscaping has not been submitted as
of this date and one of the conditions of this application will be to receive
approval by the city's architectural commission. The site is to be
surrounded by a six foot masonry wall with sidewalk along Hovley Lane.
Amenities of the project include three swimming pools with spas and two
sunken tennis courts.
III. ANALYSIS:
A. FINDINGS FOR A DEVELOPMENT PLAN:
1. The proposed location of the use is in accord with the objectives of
the municipal code and the purpose of the district in which the site is
located.
Justification:
The PR zone allows uses of this type with approval of a development
plan.
2. The proposed location of the use and the conditions under which it
would be operated or maintained will not be detrimental to the public
health, safety, or welfare, or be materially injurious to properties or
improvements in the vicinity.
Justification:
The location is in an area with large lots which allow design
flexibility which will insure that the use will not be detrimental.
3. The proposed use will comply with each of the applicable provisions
of the municipal code except for approved variances or adjustments.
Justification:
The use will comply with all municipal codes by design or conditions
imposed by this approval.
4. The proposed use complies with the goals, objectives and policies of
the city's General Plan.
Justification:
The property is designated Low Density Residential, 3-5 d.u./acre on
the General Plan. The PR zone allows this density with approval of a
development plan and as such, is in compliance with the General
Plan.
B. FINDINGS NEEDED FOR APPROVAL OF TENTATIVE TRACT MAP:
1. That the proposed map is consistent with applicable general and
specific plans.
Justification:
The density of the proposed map is 4.98 d.u./gross acre for this
project and is consistent with the general plan designation of
Residential 3-5 d.u./acre.
2. That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
Justification:
All public streets will be dedicated and improved and sufficient

drainage facilities will be provided in conformance with the general
plan guidelines and city ordinances.
3. That the site is physically suitable for the type of development.
Justification:
The net size of 14.02 acres is physically suitable to support a
residential project of the nature proposed due to flat terrain,
adequate access to major streets, and adequate area, width and
depth.
4. That the site is physically suitable for the proposed density of
development.
Justification:
The design of the project indicates that the site is suitable for the
proposed density of development because the site can be served by
respective utilities, the city, and existing or proposed circulation
system.
5. That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
Justification:
The design will not cause substantial environmental damage or injure
fish or wildlife or their habitat because it will be constructed in
compliance with applicable regulations.
6. That the design of the subdivision or the type of improvements are
not likely to cause serious public health problems.
Justification:
The design will not cause serious public health problems because it
will be in compliance with applicable health, safety and building
codes.
7. That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of property within the proposed subdivision.
Justification:
There have been no easements acquired by the public at large for
access through or use of property within the proposed subdivision.
Staff feels these findings can be justified in this case.
V. STAFF RECOMMENDATION:
Based on justifications contained in this report and the attached draft Resolution,
staff recommends that the Planning Commission adopt the findings for the
Tentative Tract Map and Development Plan as noted above, and adopt Resolution
No. , approving Case Nos. DP 06-81 and TT 17794 Amendments.

4. That the site is physically suitable for the proposed density of development.
5. That the design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat.

conflict with easements, acquired by the public at large, for access through

WHEREAS, in the review of this tentative tract map the Planning Commission has
considered the effect of the contemplated action on the housing needs of the region for
purposes of balancing these needs against the public service needs of the residents of the
City of Palm Desert and its environs, with available fiscal and environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case;

CONDITIONS OF APPROVAL
Case Nos. DP 06-81 and TT 17794 Amendments #1
Department of Environmental Services:
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all the
requirements, limitations, and restrictions of all municipal ordinances and state
and federal statutes now in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as required by ordinance
and the city engineer shall be installed in accordance with city standards.
3. Prior to submittal of the final map, the applicant shall provide the department of
environmental services with a list of proposed street names with at least three
alternatives. The approval of the final street name shall be made by the director
of environmental services.
4. Access rights to Hovley Lane shall be offered to the city as a dedication on the
final map.
5. The CC&R's for this development shall be submitted to the director of
environmental services for review and final approval by the city attorney prior to
the issuance of any building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the city engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the owners
of the units of the project.
6. Improvement plans for water and sewer systems shall meet the requirements of the
respective service districts.
7. Area shall be annexed to appropriate improvement districts having jurisdiction over
the subject area.
8. All dedicated land and/or easements required by this approval shall be granted to
the City of Palm Desert, without cost to the city and free of all liens and
encumbrances.
9. All on-site utilities, including cable TV, shall be placed underground and shall be
completely concealed from view except certain appurtenances as may be approved
by the director of environmental services.
10. Complete plans and specifications shall be submitted as required by ordinance to
the city engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as-built" plans prior to
acceptance of the subdivision improvements by the city.
11. All private streets shall be inspected by the engineering department and a standard
inspection fee shall be paid.
12. All requirements of the Planning Commission action on Development Plan 06-81
Amendment #1 shall be met as a part of the development of this tract.
13. The applicant shall have 2 years from the date of the approval or conditional
approval of the tentative map for filing of the final map unless an extension of
time is granted by a resolution of the city council.
14. Drainage and Signalization Fund contributions as required by city ordinance shall
be made prior to recordation of the final map.

Fire Marshal Conditions:
26. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour
duration in addition to domestic or other supply. The computation shall be based
upon a minimum of 20 psi residual operating pressure in the supply main from
which the flow is measured at the time of measurement.
27. Install Riverside County super fire hydrants at each intersection and so that no
point of any building is more than 250 feet from a fire hydrant measured along
approved vehicular travel ways.
a. Hydrants shall not be located closer than 25 feet to any building.
b. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction from each
hydrant.
28. Prior to issuance of a building permit, the developer shall furnish the original and
three (3) copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department and the original will be

by the water company, with the following certification: "I certify that the design

This letter is not to be interpreted as a contractual commitment to serve the
proposed project; but only as an information service. Its intent is to notify
you that the Southern California Gas Company has facilities in the area where
the above named project is proposed. Gas service to the project could be pro-
vided from an existing main without any significant impact on the environment.
The service would be in accordance with the Company's policies and extension
rules on file with the California Public Utilities Commission at the time con-
tractual arrangements are made.
The availability of natural gas service, as set forth in this letter, is based
upon present conditions of gas supply and regulatory policies. As a public
utility, the Southern California Gas Company is under the jurisdiction of the
California Public Utilities Commission. We can also be affected by actions of
federal regulatory agencies. Should these agencies take any action which
affects gas supply or the condition under which service is available, gas ser-
vice will be provided in accordance with revised conditions.
We have developed several programs which are available, upon request, to provide -
assistance in selecting the most effective applications of energy conservation .
techniques for a particular project. If you desire further information on any .

The attached data was prepared by the applicant and is being forwarded to you for
comments and recommended conditions of approval. The city is interested in the probable
impacts on the natural environment (e.g. water and air pollution), public resources (e.g.
demand for schools, hospitals, parks, power generation, sewage treatment, etc.) and site
and building plan acceptability.
Your comments and recommended conditions of approval must be received by this office
prior to 4:30 p.m. August 17, 1983, in order to be discussed by the land division committee
at their meeting.
The land division committee (comprised of director of environmental services, city
building official, city engineer, fire marshal and a representative of CVWD) will discuss
the comments and recommended conditions of approval and will forward them to the
planning commission through the staff report. Any information received by this office
after the receipt deadline will not be discussed by the land division committee nor will it
be forwarded to the planning commission for consideration.
