Gentlemen:
For what it is worth, I would like to
comment upon the proposed Hubbard Develop-
ment Project .
As a major stockholder of a Communications
Company in Palm Desert and a homeowner at
631 Monaco Circle , causes me to make the
following comments to wit:
It seems to me that the Planning Department
of Palm Desert could cause the property
owners or Albertson' s Market to properly
screen and beautify the north perimeter
of the property in question, so as to
protect those homeowners on Monaco Circle
as to their investment and as to their view.
In my view, the wheels of progress must
continue to turn in Palm Desert and that
there must be some way developed whereby
the proponents of the plan and the oppo-
sition can come to an arrangement that
will be satisfactory to all , including
the city planners .

I believe that a 15 or 20 feet planting
area along the north perimeter should
satisfy the immediate vicinity of home-
owners. As for myself, I believe that
the installation of a major market within
walking distance of the Hidden Palms Village
will substantially increase the value of
all of that property within the foreseeable
future.
As to hotel , or motel , I have no comments
thereon.
In any event , I urge the City Council to
negotiate with the homeowners so that the '.
market may be installed and that the home-
owners along the south perimeter of the
Hidden Palms Village be satisfied.
To stop this progress is to take away from
Palm Desert a great tax base which is not
in the best interest of Palm Desert , in
my opinion.

The Savings and Loan is an important integral part of

Dear Mr. Berwanger:
As you are probably aware the City of Palm Desert, for over the last 20
months, has been involved in a program to revise its General Plan. I
shall not review the process to date, as I am sure you and your clients
are familiar with the City's efforts to obtain public input into the plan.
The plan is now before the City Council for adoption. The Public Hearing
was first set for its meeting of March 12 and has been continued to March
26, 1981.
In terms of the site of the Fountains Development, the plan recommendation
is consistent with the letter received by this department from Mr. Winfield
on February 26, 1981. Any proposed development on that site will be so
conditioned to reflect the requests outlined in that communication. This
department will also attempt to assure that notices regarding specific
hearings on this site are sent .to the parties identified in your communi-
cation of March 9, 1981.

strong objection to the proposed zone change to
convert the property at the corner of Deep Canyon
Road and Highway 111 from residential to commercial .
As a homeowner at 439 Cannes Court, Hidden Palms,
we find the contemplated change of zoning to be
totally unacceptable, since the commercialization
of the property will destroy the peace and tran-
quility that our development now offers and cherishes .

In addition to adopting this position taken by
Mr . Barlow, I would like to emphasize the fact that
1 . I received no notice concerning this Planning
Commission meeting from the Planning Commission or the city
of Palm Desert.
2. I believe that the proposed. development
would have a very substantial negative impact on the environ-
ment of this area including traffic , health, air, noise , and
water pollution.
3 . In addition, the use which the Hubbard
Development proposes is completely inconsistent with the
pleasant, quiet residential atmosphere of Hidden Palms and
all of the surrounding community.
There appear to me to be ample shopping centers
within the city of Palm Desert to handle our local needs .-
Certainly, there is almost never a crowd in any of the
shops and to propose additional shops of any kind appears
unwise.
Also , the placement of the hotel/condominium
project would impinge substantially on the present scenic
beauty of the Date Palm Grove and the general area surrounding
Hidden Palms . Additionally, the placement of a 60-foot road

along our southern boundary is incompatible with a quiet
residential area. Such a boundary road would totally
destroy any separation between an already busy road
(Highway 111) and a quiet residential area. It appears
unthinkable that this Commission would even entertain such .a
proposal.
I also request that I be given specific notice
at my proper mailing address of any future proposals or
developments concerning this property. That address is

Gentlemen:
We are homeowners in the Hidden Palms development located on Deep Canyon
Drive. We have just learned of the plans to erect the Hubbard shopping
complex across the street from the development and are both excited as
well as a little disappointed at the prospect.
It appears to us an ideal location for a shopping center, the proximity
to our development being highly advantageous. The only negative aspect
we see is the fact that the loading and docking areas are planned to be
located directly across the street from Hidden Palms, which seems to us
to inevitably create. a great deal of traffic and noise for our entire
community.

Would it not be possible to somehow plan the project so that this heavy
traffic loading area would be located somewhere else, ideally near the
main highway, which would be much less destructive of peace and tranquility
in our lovely new community.
We certainly hope you will take these suggestions into consideration.

Dear Sir:
I am a Hidden Palms homeowner. I purchased the home about a
year ago. I purchased a home I was told, and it was my under-
standing, on checking the zoning laws , that the property between
Hidden Palms and Highway 111 contains a virgin, beautiful, palm
tree forest, regularly harvested for its dates , was zoned for
at best low density, high class condominiums.
I am horrified to learn that there is an application to place. on
this beautiful piece of property a large supermarket and a high
density two-story motel and put directly adjacent to the back wall
of Hidden Palms a commercial road.
If this is done, let me assure you that Palm Desert will be on
its way out as the community which would likely interest individuals
in relocating in the area. When I purchased the property at Hidden
Palms , the prime reason this property was desirable was the adjacent
zoning ordinances which prohibited development of such commercial
ventures. If such a blatant disregard for human values and privacy
would be accomplished by a zoning change, then frankly nobody could
.ever invest in Palm Desert with any assurance that their property
values and their expected lifestyle could be guarded by responsible
City Government.
Palm Desert does not need another supermarket. Palm Desert does
not need a large resort hotel adjacent to property owners who in-
vested in good faith, with the hope that they would maintain this
lifestyle in peace and tranquility.
- I believe that this application is an infringement upon the rights
of each and every Hidden Palms investor and homeowner and moreover,
it creates a grave danger to each and every Palm Desert resident,
that they can no longer expect reasonable protection by responsible
City Government, from individuals who wish to infringe upon the
rights of the citizens of Palm Desert for personal gain and profit.

Each and every homeowner in Palm Desert bought their property
with the knowledge that the property adjacent to it would not
be so developed. But what good are zoning laws if the laws
can be changed willy-nilly. When a person buys a piece of
property, they take into consideration zoning in adjacent areas.
It is an absolute infringement upon their rights if the zoning
laws are changed without their approval.
Let me tell you that in my discussions with other homeowners ,
that the homeowners of Hidden Palms, and frankly other homeowners,
are worried about this infringement of the Palm Desert area, and
will fight this in every way possible and moreover I believe that
the publicity that would be enormous if this zoning change goes
through, frankly would discourage future responsible development
of Palm Desert. As you can understand, why would anybody want
to buy a condominium home in Palm Desert if they realize that
anybody can come in, effect a zoning change, and put up a super-
market or a resort hotel, and indeed even put a road right next
to the property at their own pleasure.
I therefore ask you to seriously consider not only the effects
upon Palm Desert homeowners in this zoning change, but the future
of Palm Desert itself. The Planning Commission has a unique
opportunity to strike a blow for individuals ' rights against the
forces of commercialism in this issue - do not waste that chance.

oppose the above request for approval of zone change.
We believe the proposed encroachment of a heavy density
commercial zone in this area is totally unjustified.
It would seem that Palm Desert ' s present rush to overbuild
commercial buildings can only lead to disaster. How many
supermarkets can exist starting at Monroe in Indio to Bob
Hope Drive in Rancho Mirage? There are six presently in -
operation, Safeway moving to a new location, two proposed
at Washington and Highway 111 , and now this proposal for
Deep Canyon and Highway 111.
Enough is indeed enough.

have been necessary to create an uproar in order to gain time for analysis
and review, but cool, reasonable and intelligent compromise will now
result in the most benefit for all concerned; <
For the record, we are very much in favor of:
1. Albertson's Market located at the corner of 111 and Deep Canyon
2. The Hotel located at 111
3. A buffer, residential if possible, between Hidden Palms and
the commercial development
3. The development having the same PC-4 zoning as we have at
Hidden Palms for their area to our East.
We thank you for your efforts on the behalf of all the homeowners and
we close by stating that no one ever told us that all those palm trees
would be next to us in perpetuity.

regarding the zone changes for the property, located at the northeast
corner of Highway 111 and Deep Canyon Road.
I highly reccomend that this project, proposed by Mr. C. Robert Hubbard,
be APPROVED !
This project will benifit everyone in.the Palm Desert area. It will not only
create new jobs for a great number of people, but will also generate a great
financial boost, from the shopping center for the people of Palm Desert,
and of course the people on both sides of Highway 111. There are many shopping
centers located on the Rancho Mirage side of Palm Desert, but none at the
Indian Wells side.

We own Lot 4, Tract No. 9144-4 located at 569 Sorrento Ct. , Hidden
Palms, Palm Desert, California.
We purchased the property with the knowledge that the adjacent property
to the south was zoned residential. We now find that the property to the
south is being considered as commercial property.
We feel that the zone change would significantly lower the value of our
property due to noise, traffic and general confusion. We also feel that
the enjoyment of our property would be greatly decreased.
We strongly urge you to maintain the ,present residential zoning.

Dear Mr. Williams:
This letter is a follow-up to our telephone conversation of May 28, 1980.
As .I mentioned, I have several severe questions regarding the layout of
the Hubbard property as it has been shown.
First, the location of the market building and commercial space, and its
appurtenant service areas, will cause nighttime noise and lighting which
will unduly disturb the residents of Hidden Palms. As the property is not
now zoned for a use of the sort contemplated, I strongly recommend that the
variance be denied. However, an acceptable solution, to me, would be to
reorient the market building to an eastward-facing elevation and move the
entire structure toward Highway 111 a minimum of 200 feet. The service area
should then be screened from view of Deep Canyon by a wall structure and
berm landscaping. By doing the above, you remove the substantial noise
and nighttime light problems. Were the above solution, or something approxi-
mating same, be incorporated into the design, I would remove my opposition
to this part of the development.
The second area of concern is the insertion of a public road abutting the
Hidden Palms development. The traffic noise level on Deep Canyon is sub-
stantial now without adding another source of noise pollution. From the
plan of improvement, it appears that this access route is not necessary
to the commercialcenter or to the planned hotel site. Undoubtedly, curb
cuts can be installed at various points in Deep Canyon to allow access to
the shopping area from the west. All other traffic would most assuredly
be handled easier through the new intersection, shown on the scheme as
leading to the hotel. In the event that the road proposed is not removed
or substantially altered, I strongly recommend denial of a zoning variance.
As general observations , without a full set of plans, I foresee several
additional areas of concern. They are: (1) inclusion of a substantial
landscape buffer between the proposed development and Hidden Palms; (2)
recessing the tennis court area of the hotel so that nighttime play does
not disturb the residents of Hidden Palms; and (3) appropriate conditions
of approval, if all the other items are agreed upon, regarding the proposed

development not restricting the view to the mountains enjoyed presently
by the area.:residents:..
As a taxpayer, I recognize that the greater the base, the less burden the
individual homeowner must bear. Personally, I would like to see this
development completed, but not without some compromise on everyone's part
as to solving problems noted above. We need the added revenue that this
development would bring, in both real and personal property taxation and,
most assuredly, in sales tax rebates.
Let's find a reasoned middle ground that benefits all of us.

We are property owners at 44379 Porto Fino Ct . , Palm Desert,
in the Hidden Palms Homeowner ' s Association.
We object to the above proposed application for Commercial
Zone Change . We do not believe that it is reasonable to
have this heavy commercial development continguous to our,
or any, single family residence.
Palm Desert presently has three major markets--Safeway, Smith' s
and Market Basket. We assume that Safeway' s new location under
construction at ElPaseo and Highway Ill will be larger than
their present location. We assume that the Hahn Development
could also have a market. There is a new Von' s at Bob Hope
Drive and Highway 111. New construction on El Paseo has prob-
ably doubled Palm Desert ' s existing commercial developments in
the last year.
Does Palm Desert need to re-zone additional commercial? We
would hope that the existing commercially zoned vacant land
first be successfully developed before our city starts to
encroach into residential areas by new commercial zone changes .
We are in favor of .growth and realize the tax benefits derived
from commercial development, but we believe the growth should
be reasonable. We do not believe that the Hubbard zone `change
to commercial would be reasonable.

Gentlemen:
I have been informed as a homeowner in the Hidden Palms Development that there
is an impending development proposed to grant a zoning change on the property
adjacent to Hidden Palms. Such zoning change would convert the area from
residential to commercial thus enabling the installation of a small shopping
center.
As I will not be able to attend the meeting scheduled for June 3, 1980, I
would like to voice my opinion concerning this proposed change and my opposition
to it.
The Hidden Palms Development was well planned in a well situated area., One of
the selling points of acquiring property in that area was that it was isolated
and off the beaten commercial track. One of the reasons for zoning laws in the
first place is to allow the property owners to enjoy the peace and tranquility
of owning and using residential property without the noise, activity, and con-
gestion caused by the existence of surrounding commercial property. What good
are zoning laws and ordinances if they can be changed at the whim of profiteer-
ing developers and to the dismay and dissatisfaction of surrounding owners of
residential property who acquired that property in the first place because it
was residential and without any knowledge that it could conceivably be in close
proximity to commercial property one day.

I believe that Palm Desert has not yet become close to reaching a saturation
point from a population standpoint where developers must use this very desirable
residential property for commercial purposes. There seems to be an abundance of
property on the main thoroughfare to take care of commercial needs. I do not
believe that the lives of the commercial residents in Hidden Palms will be made
any easier with the existence of a small shopping center right next door. Most
of the residents,' I am sure, are more than happy to get in their cars and drive
up to Highway 111 to one of the grocery stores located on that street and not
feel too put out by the inconvenience.
Our property is not located directly on the south wall which will be immediately
adjacent to the Hubbard property but, be that as it may, we must feel for the
owners of that property who will be directly affected more than anyone else since
the activity of the proposed grocery market is going to seriously hinder their
privacy and disturb their enjoyment of their property because of all the noise
and congestion that is going to be generated from the market and the other stores.
Therefore, we request that this letter be entered in opposition to the proposed
zoning change and that the Hubbard twenty eight acres be restricted to residential
use only.

To all interested. parties:
This is to formally protest the building of the commercial center
and the rezoning of the properties surrounding Hidden Palms to
allow the commercial and two story building to occur.
This protest is made on the basis that the rezoning and building
will create the devaluation of Hidden Palms properties, will in-
crease the noise levels, will reduce safety for our childfen
from the resulting additional traffic and conjestion of traffic,
as well is adding a questionable tran"sciency to the area.
We trust that if this change in rezoning is allowed in this
individual case that it will set a.precedent that will allow
changes in rezoning to occur at will in the future.
It is felt that home owners in the area have not been properly
informed of, this rezoning. Therefore, it is recommended that
the rezoning question be deferred to a later meeting when the
proper channels of informing concerned parties can occur and
thus the representation in the area will be able to voice their
relevant opinions.

Just yesterday we were advised of- the possible zone- c.hange.. effec_ting_
the beautiful Hidden Palms Condominium development .
Please be advised that we as homeowners at 444-39 Baden Court are de-
finately against any zone change for the following reasons :
1 . We purchased this location especially for its non-commercial
surroundings and the quiet tranquilty which the present
zoning assures us .
2 . A commercial enterprise backing up to our property will
have a tremendously depreciating effect on our present
property value . I hasten to remind you that individual home
owners have the prior right to have their interests
protected especially when they had the positive assurance
of the existing zoning protection.
3. The environmental impact on our serene area would be im-
paired' due to the tremendous increase in traffic flow . This
fact is simple arithmetic ; if there were not to be heavy ++.
traffic increase in this area, obviously the newly planned
project would be unsuccessful .
Mrs . Reinfeld and I,_-.along-..with our friends and neighbors at Hidden
Palms are diametrically opposed to any zone change in this area.
We look to you and whomever sits with you to protect our prior
interests now, and in the future as well .
We are horrified to think this issue has ever been considered for
a hearing. ~
