BACKGROUND: (Continued) G. PRELIMINARY DEVELOPMENT SCHEDULE: Construction of this project .will be done in three (3) different stages. Projected date of commencement of project will be in the latter part of the first quarter of 1981.. Phase 1 (March, 1981) - Initial offsite and site improvements, models (2) and twenty (20) production units. Phase 2 (June, 1981) - Sixteen (16) production units. Phase 3 (Sept. , 1981) - Twenty-two (22) production units. III . DISCUSSION: The Site Plan modifications sought in this amendment are minor in nature. The significant subject before the Commission is a change in approved use, from apartments to individually-owned condominiums. The reason the change is a significant question is because the City has a general interest in increasing its rental housing stock for persons employed in the community. Geographically, the subject site appears to be a prime location for rental units. Depending on the outcome of the General Plan Update, the site may be considered for a higher density than is presently provided, further enhancing its viability .for apartment development. The applicant's desire is to proceed with the first phase of development (some twenty units) subject to obtaining the required approvals. Staff has discussed with the applicant the desire for rental housing and there appears to be an alternative development approach that he would be amenable to. The alternative would consist of approval for thirty-eight (38) condo- minium units being developed west of the .second entry driveway on Magnesia Falls (located on the east side of the central recreation area) , and the balance of the site would be left for future apartment use under the plan now presented, or preferably at a higher density subsequent to the General Plan Update adoption; in which case a revised site design would be submitted for the eastern half of the property. IV. STAFF RECOMMENDATION: Clearly, the Commission' s options for action on the requested amendment are: 1. Deny the Amendment. In this case the approval for sixty (60) apartment units would stand and the developer could determine if he wanted to proceed with this original approval . 2. Approve the Amendment as -Requested. In this instance the project would proceed with minor site plan . refinements and be sold to individual owners. 3. Grant Modified Approval for a change of thirty-eight, (38) units to condo- minium use (or some other number of units as specified) requiring the balance of the site to .be developed as rental units. If this is the agreeable alternative, it would be the understanding that the applicant would seek a revised Development Plan approval to agree with any resulting General Plan density change for the bal.ance of the site, or that it would be built-out per the approved plans as rental units. Based on the justification contained in the draft Resolution, Staff would recommend option No. 3. Approve in Modified Form, Amendment to DP 08-79, providing for thirty-eight (38) condominium units, by adoption of Planning Commission Resolution No. subject to the attached conditions. WEDGEWOOD GLEN A PLANNED UNIT DEVELOPMENT Written Documents (Case Nos. DP08-79 and 178MF) STATEMENT OF PLANNING OBJECTIVE It is the objective of W.E. Development Co. , the owner; and Transcopic Development Corporation, the applicant ;of this proposed project. to identify the need of moderately priced dwelling units in the framework of the existing markets within the Coachella Valley and to fill this void quickly. While most desert developers would recognize the fact that a healthy housing market is one in which residents of Coa- chella Valley have a choice of housing opportunities and a choice necessary to achieve a stable regional economy, there exists within the Coachella Valley a serious shortage of attractive, safe, decent and affordable housing which persons and families of moderate means can afford. W.E. Development Co. ' s planning objective with regard to this development is as follows : Accompanying the growth of various commercial acti- vities come the need for housing for local residents. In today' s real estate market, the cost of homeowner- ship can be prohibitively high. This proposed pro- ject offers the perfect location for this specific sector of the market in terms of its proximity to the schools, shopping centers, hospital and medical faci- lities, commercial offices and most importantly, being in the midst of established residential areas zoned specifically for this type of development under the Master Plan of Palm Desert. After spending considerable time studying the exis- ting and potential markets , W.E. Development Co. em- phasizes priority on the property ' s location, the way the land is used, architectural design, topogra- phy, density, landscape design, view orientation, amenities package and quality of construction. DP 08-79 AMENDED Standard Conditions : 1. The development of the property shall conform substantially with Exhibit A (Case No. 08-79 Amended) on file with the Department of Environmental Ser- vices, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval , the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permit procedures. 3. Construction of the total development may be done in phases ; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 4. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null , void and of no effect whatsoever. 5. Prior to the issuance of any City permits for the commencement of construc- tion on said project, the application shall agree in writing to these Conditions of Approval . 6. Prior to issuance of a building permit for construction of any use contem- plated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies : Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley County Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. PLANNING COMMISSION RESOLUTION NO. 634 Page Three Special Conditions 1. All of the requirements of Planning Commission Resolutions Nos. 505 and 622 shall be observed except as herein provided or as modified by this amendment approval . 2. Public right of way requirements shall be established in accordance with the General Plan Circulation Eleruent as they now exist, or as they may subse- quently be amended. 3. Provide stormwater channel bank landscaping, or rip-rap, as approved by the City Director of Environmental Services and Coachella Valley Water District. l � q / �-✓7 / CITY OF PALM DESERT STAFF REPORT To: Planning Commission Report on: Reconsideration of Alignment of Magnesia Falls Drive Date: December 17, 1980 I. REQUEST: Reconsideration of Commission's decision of September 17, 1980, on the alignment of Magnesia Falls Drive in light of new information received by staff. II. BACKGROUND: The Magnesia Falls Drive alignment issue first arose in August of this year, in conjunction with Case Nos. DP 08-79 (amendment) and CUP 09-80. (See attached memorandum dated August 5, 1980 for description of cases) . In September 1980, staff prepared a memorandum and exhibits regarding Magnesia Falls Drive. Based on the information provided, the Commission directed staff to designate said street as a Scenic Secondary Roadway in the draft Transportation/Circulation Element of the General Plan Update. With this designation, Magnesia Falls would consist of four lanes of traffic (2 lanes in each direction) encompassing 52 feet of road sur- face and a 16 foot wide raised landscaped center median. A parkway ranging from 0-30 feet may also be required, depending on available area. The September memorandum is also attached for reference. III . DISCUSSION: Of special concern to the Commission, has been the north side of Magnesia Falls that traverses an area 250 feet west of Portola Avenue. The property owner to the north- Palm Desert Estates,i�formerly known as Marco Polo Mobile- home Park - has filed a Conditional Use Permit to expand the Mobilehome Park. (CUP 09-80) With the proposed Scenic Secondary Roadway designation, the applicant could be required to dedicate at least one half of the street (or 34 feet) , excluding any possible parkway requirements. The applicant has brought to staff's attention that a gas transformer and other utility meters are located approximately 30 feet north of the proposed alignment of Magnesia Falls, would require the relocation of the transformers and meters. Based on this new information, staff feels a reconsideration of the align- ment is in order. The safety of all potential users (motorists , pedestrians and bicyclists) remains the primary concern. Staff feels that a reduction of the raised center median from 16 feet to 12 feet wide adjacent to the property in question, could solve the problem created by the transformers and still provide for the safety of all users. IV. STAFF RECOMMENDATION: Staff recommends that the Planning Commission retains Magnesia Falls Drive as a Scenic Secondary Roadway as defined in the draft Transportation Circulation Element of the General Plan Update, but with a center median width of 12 feet adjacent to the property in question. INTEROFFICE MEMORANDUM City of Palm Desert TO: PLANNING COMMISSION FROM: PRINCIPAL PLANNER SUBJECT: CONSIDERATION OF ALIGNMENT OF MAGNESIA DATE: SEPTEMBER 17, 1980 FALLS DRIVE On August 5, 1980 the Planning Commission requested Staff to study the specific alignment of Magnesia Falls Drive in light of Case Nos. DP 08-79 and CUP 09-80. The purpose of this memorandum is to present Staff's findings and recommendations relating to the specific alignment of subject street between Monterey Avenue and Cook Street. To gain an understanding of the existing and potential situation along said street, Staff had completed base maps (see attachments 1 and 2) to indicate the following information: 1. Section lines (including half section and quarter corners) . 2. Existing public owned right-of-way and existing improvements in the right- of-way. 3. Existing land uses showing the location of any structures (obtained from current air photos and/or field survey inspections) . 4. Potential right-of-way dedications as shown on approved "active" Tentative Tract and Parcel Maps. 5. Proposed improvements (i .e. , bridge structure, design width and alignment). 6. Proposed improvements which are a part of approved "active" Development Plans or Conditional Use Permits (for which a Subdivision Map has not been processed). Based on the information on these base maps it seems that the appropriate roadway designation would be Scenic Secondary Roadway. The draft Transportation/Circulation Element to the General Plan Update defines this roadway as a street that collects and distributes traffic to destinations. It also serves secondary traffic generators, such as small business centers, schools, and major parks. With the scenic secondary designation, Magnesia Falls Drive would consist of four lanes of traffic (two lanes in each direction) encompassing 52 feet of road surface and a 16 foot wide raised landscaped center median. In addition, a ten foot public parkway on each side of the roadway will be designated. Finally, a scenic easement of up to 20 feet may be required, in addition to the required public parkway. This scenic easement is to provide for a pedestrian/bike path system separated from automobile traffic and/or to provide for the enhancement of City edges and scenic corridor through landscape treatment. The 68 feet of road surface and raised landscaped center median (except for over the proposed San Pasqual Channel Bridge where a landscaped median is not practical ) will be consistent throughout the entire length of said street if adopted. However, the parkways and scenic easements adjacent to the road- way will vary in different areas. The following chart indicates the surface and parkway allocation for various sections of the roadway. Each section is divided by the north and south side of the road with the mid-section line serving as the road's centerline. The data provided below are a result of the information collected for the base maps. This discussion is important to resolve an issue that was raised in conjunction with Case No. CUP 09-80. The imple- mentation of the planned right-of-way for Magnesia Falls, as adopted in the Collge of the Desert Specific Plan, would require the relocation of five mobile homes. The proposed scenic secondary roadway designation, with variation in the parkway requirements, would not result in the removal of subject mobile homes. This subject CUP request proposed to offer for dedication 30 feet of right-of-way south of an existing chain link fence (which is proposed to be removed) to the half section line. The scenic secondary designation requires 34 feet for road surface; obviously there is a difference of four feet between the two proposals. After careful consideration for the safety of all potential users (motorists, pedestrians and bicyclists) Staff feels that 34 feet road surface should remain. Attachment 3 illustrates the situation. The solid line represents the area 44 feet from the midsection line, which normally would be required for the road surface and parkway. As indicated, this line passes through three of the five effected mobile homes. The broken line represents the roadway without the minimum 10 foot parkway included; no mobile homes would have to be relocated. However, the mobile homes would be inconsistent with the setback provisions of the Zoning Ordinance (Section 25.22. 100). The parkway requirement and the four feet of right-of-way difference between the subject CUP proposal of 30 feet and Staff's recommendation of 34 feet remain. DP 08 7(AND CUP 09-80 COMPLIANCE DATE: AUGUST 5, 1980 WITH GENE L�LAN COD S ECT PLAN) CIRCULATION ELEMENT The College of the Desert Area Specific Plan, adopted in January of 1978, designates Magnesia Falls Drive..(43rd Avenue) as a "Major Highway". ,(110 feet right-of-way width) . Both of the referenced cases, now before the Commission, abut the Magnesia Falls Drive alignment. In lieu of discussing General Plan Circulation Element compliance individually, in a staff report for each case, it appears that this subject deserves special attention before going further into the merits of_ the project. The first staff report description page for each case with exhibits and correspondence is attached to this memorandum for reference. Case No. DP 08-79, now before the Commission for consideration of a time extension, is located on the northeast corner of Magnesia Falls Drive and Portola Avenue. The plans for development of this site include dedication and improvement of a 55 ft. half street on Magnesia Falls Drive, which at a first glance, would appear to be consistent with the Circulation Element. The COD Specific Plan Circulation Element (attached excerpt from page V-3) , speaks to a necessary shift of the roadway center- line north of the half-section line,l to enable the planned Magnesia Falls roadway to be established and allow a separate roadway/driveway entrance to the south of Magnesia Falls to be maintained to serve the Community Park Site (see illustration) . In the original Public Works/Engineering analysis of the proposed Development Plan, it was not recognized that the southern property line of this site was the half- section line, and therefore, not only did a 55 ft. half street need to be dedicated, but also the additional right-of-way necessary to shift the roadway centerline north to preserve a separate access drive to the Park. A right-of-way requirement such as this would not have affected the maximum number of dwelling units permitted by the zone, because density is based on gross site area before street dedications, but it would have. reduced the net site the units were actually to be built upon. Case No. CUP 09-80, now before the Commission for consideration of a Conditional Use Permit which would allow an existing mobile home park to expand by 17 spaces, is located on the northwest corner of Magnesia Falls Drive and Portola Avenue. The COD Specific Plan Circulation Element recognizes that implementation of the planned right-of-way for Magnesia Falls would require the relocation of 5 mobile homes. The subject CUP request proposes to offer for dedication 30 feet of right-of-way south of those existing mobile home lots to the half-section line. Together with the existing City right-of-way on the south side of the half-section line, the total width available for Magnesia Falls Drive at this point would be 74 feet, and not the planned 110 feet. IA Section is a term used in survey descriptions indicating a one square mile area, the half-section line runs through the middle of the section. ��. Page Two From a review of the adopted COD Specific Plan, it would appear that the City was committed 21-2 years ago to the acquisition and improvement of Magnesia Falls Drive as planned (as well as the other features of the COD Specific Pla n). The im ple- mentation section of the fairly orate detail , calculating costof right-of-way acquisitionanimprovement wthaprojectedbudgetdistribtion between private and public funds. Therefore, at the time of adoption, it must have been presumed that the plan was reasonable to implement and that the public agency commitment to expenditure of funds had been made by virtue of this document's approval . The complex dilemma we face today is the question of whether the planned right-of-way acquisition for Magnesia Falls Drive is reasonable in light of the public expenditures required, versus what can be expected from voluntary and/or required dedications from new development, recognizing the proposals which are now before you for action and the City's desired timing for acquisition of this right-of-way. With regard to action on these two cases, the first obvious option is to require implementation of the Circulation Element as a condition of approval . This would require new site planning for DP 08-79, and a redesign of CUP 09-80 yielding less than the desired 17 space expansion. Whether either of these developments would elect to proceed is unknown. The second option would be to recognize that we are now in the process of reevaluating and updating the General Plan Circulation Element, and through that process direct that alternatives for Magnesia Falls be studied while the subject cases are continued for evaluation in light of a potentially amended policy. A third more ambiguous approach, would be to conditionally approve the requests, requiring a redesign to conform to the resulting Circulation Element features. Particularly in the case of the mobile home park expansion, this would not ensure that it could eventually proceed as now planned. These three options are summarized by the following: 1. Approve with implementation of the adopted Circulation Element. 2. Continue consideration of these requests and study alternatives to the adopted Circulation Element in the General Plan Update process. Take action when a new policy is adopted. - 3. Conditionally approve the requests at this time, requiring conformance to any subsequently adopted Circulation Element policy, with implementation not permitted until that policy has been adopted. Some might perceive a fourth option would be to do whatever seems reasonable at this moment. The response to this is clearly that we do not have all of the necessary information to determine what is "reasonable". We have the expressed desires of the private project sponsors and there is no mistake about their position, but we have not fully explored the public interests to be served. It may very well be that an alternative to the adopted Circulation Element is more desirable from the public perspective, but this determination should only come after viewing an engineered concept design of the Magnesia Falls right-of-way alignment which defines existing City right-ment, mighty, dedications n t could reasonaly of-of and the location of the roadway centerline with respect to those constraints. Unfor- tunately, an alternative concept design for Magnesia Falls does not exist presently. The only reference or guide we have today is the existing COD Specific Plan Text and sketch of the intersection with Portola Avenue. Page Three STAFF RECOMMENDATION: It is now obvious that the two proposals before the Commission are not in concurrence with the adopted Circulation Element, therefore, Staff would recommend that consider- ation be continued until the General Plan Update has been concluded (with the under- standing that the specific alignment for Magnesia Falls will be studied); or, a denial without prejudice, of the requests, finding that they are not in conformance with the General Plan (allowing the projects to be redrafted and submitted to corres- pond to the present Circulation Element requirements or to any subsequent amendment) . DP 08-Z9 AND CUP 09-80 COMPLIANCE DATE: AUGUST 5, 1980 WITH GENE LAN (COD S EC1 PLAN) CIRCULATION ELEMENT The College of the Desert Area Specific Plan, adopted in January of 1978, designates Magnesia Falls Drive (43rd Avenue) as a "Major Highway" (110 feet right-of-way width) . Both of the referenced cases, now before the Commission, abut the Magnesia Falls Drive alignment. In lieu of discussing General Plan Circulation Element compliance individually , in a staff report for each case, it appears that this subject deserves special attention before going further into the merits of_ the project. The first staff report description page for each case with exhibits and correspondence is attached to this memorandum for reference. Case No. DP 08-79, now before the Commission for consideration of a time extension, is located on the northeast corner of Magnesia Falls Drive and Portola Avenue. The plans for development of this site include dedication and improvement of a 55 ft. half street on Magnesia Falls Drive, which at a first glance, would appear to be consistent with the Circulation Element. The COD Specific Plan Circulation Element (attached excerpt from page V-3) , speaks to a necessary shift of the roadway center- line north of the half-section line,l to enable the planned Magnesia Falls roadway to be established and allow a separate roadway/driveway entrance to the south of Magnesia Falls to be maintained to serve the Community Park Site (see illustration) . In the original Public Works/Engineering analysis of the proposed Development Plan, it was not recognized that the southern property line of this site was the half- section line, and therefore, not only did a 55 ft. half street need to be dedicated, but also the additional right-of-way necessary to shift the roadway centerline north to preserve a separate access drive to the Park. A right-of-way requirement such as this would not have affected the maximum number of dwelling units permitted by the zone, because density is based on gross site area before street dedications, but it would have reduced the net site the units were actually to be built upon. Case No. CUP 09-80, now before the Commission for consideration of a Conditional Use Permit which would allow an existing mobile home park to expand by 17 spaces, is located on the northwest corner of Magnesia Falls Drive and Portola Avenue. The COD Specific Plan Circulation Element recognizes that implementation of the planned right-of-way for Magnesia Falls would require the relocation of 5 mobile homes. The subject CUP request proposes to offer for dedication 30 feet of right-of-way south of those existing mobile home lots to the half-section line. Together with the existing City right-of-way on the south side of the half-section line, the total width available for Magnesia Falls Drive at this point would be 74 feet, and not the planned 110 feet. 1A Section is a term used in survey descriptions indicating a one square mile area, the half-section line runs through the middle of the section. ,y Page Two From a review of the adopted COD Specific Plan, it would appear that the City was committed 22 years ago to the acquisition and improvement of Magnesia Falls Drive as planned (as well as the other features of the COD Specific Plan) . The imple- mentation section of the plan goes into fairly elaborate detail , calculating cost of right-of-way acquisition and improvement with a projected budget distribution between private and public funds. Therefore, at the time of adoption, it must have been presumed that the plan was reasonable to implement and that the public agency commitment to expenditure of funds had been made by virtue of this document's approval . The complex dilemma we face today is the question of whether the planned right-of-way acquisition for Magnesia Falls Drive is reasonable in light of the public expenditures required, versus what can be expected from voluntary and/or required dedications from new development, recognizing the proposals which are now before you for action and the City's desired timing for acquisition of this right-of-way. With regard to action on these two cases, the first obvious option is to require implementation of the Circulation Element as a condition of approval . This would require new site planning for DP 08-79, and a redesign of CUP 09-80 yielding less than the desired 17 space expansion. Whether either of these developments would elect to proceed is unknown. The second option would be to recognize that we are now in the process of reevaluating and updating the General Plan Circulation Element, and through that process direct that alternatives for Magnesia Falls be studied while the subject cases are continued for evaluation in light of a potentially amended policy. A third more ambiguous approach, would be to conditionally approve the requests, requiring a redesign to conform to the resulting Circulation Element features. Particularly in the case of the mobile home park expansion, this would not ensure that it could eventually proceed as now planned. These three options are summarized by the following: 1. Approve with implementation of the adopted Circulation Element. 2. Continue consideration of these requests and study alternatives to the adopted Circulation Element in the General Plan Update process. Take action when a new policy is adopted. 3. Conditionally approve the requests at this time, requiring conformance to any subsequently adopted Circulation Element policy, with implementation not permitted until that policy has been adopted. Some might perceive a fourth option would be to do whatever seems reasonable at this moment. The response to this is clearly that we do not have all of the necessary information to determine what is "reasonable". We have the expressed desires of the private project sponsors and there is no mistake about their position, but we have not fully explored the public interests to be served. It may very well be that an alternative to the adopted Circulation Element is more desirable from the public perspective, but this determination should only come after viewing an engineered concept design of the Magnesia Falls right-of-way alignment which defines existing City right-of-way, dedications that could reasonably be expected to come from new develop- ment, right-of-way that would have to be acquired through condemnation and purchase, and the location of the roadway centerline with respect to those constraints. Unfor- tunately, an alternative concept design for Magnesia Falls does not exist presently. The only reference or guide we have today is the existing COD Specific Plan Text and sketch of the intersection with Portola Avenue. Page Three STAFF RECOMMENDATION: It is now obvious that tiie two proposals before the Commission are not in concurrence with the adopted Circulation Element, therefore, Staff would recommend that consider- ation be continued until the General Plan Update has been concluded (with the under- standing that the specific alignment for Magnesia Falls will be studied) ; or, a denial without prejudice, of the requests, finding that they are not in conformance with the General Plan (allowing the projects to be redrafted and submitted to corres- pond to the present Circulation Element requirements or to any subsequent amendment) . 141k�1t! Its development as a through street from Mon- terey Avenue to Cook Street will make it the only other east-west arterial in the College area besides 44th Avenue. Along one route, it would connect Monterey Avenue, College of the Desert, San Pablo Avenue, the municipal golf course site, Portola Avenue, the Lincoln/Middle School complex, the Palm Desert Community Park, Deep Canyon Road, the proposed high school site, and Cook Street. Its alignment adjacent to the Whitewater River Storm Channel would make it one of the most beautiful and scenic in all the desert. This road should be shifted slightly to the north of the present half-section line so as to preserve the existing access road to the Community Park as a separate right-of-way.
