We respectfully request your honorable body to initiate an amendment to the General Plan reducing the proposed Right-of-Way for Magnesia Falls Drive from 110 feet to 88 feet. - In considering this request, your attention is invited to the following: 1. Over six years ago the County of Riverside requested a dedication of one-half of Magnesia Falls Drive which was. planned to have an 88 ' Right-of Way. . The requested 44 ' dedication was made on the assurance that it would be. all that would be required. We realize that the City is not bound by representations of the County, but as a matter of equity, they should be considered. 2. The School District , which owns the property on the other side of Magnesia Falls Drive, has dedicated 481 . Obviously, it was the plan at that time to make Mag- nesia Falls Drive 96 ' wide. 3. To the east of the School property, the southerly half of Magnesia Falls Drive was dedicated and improved to p a width of 48 ' by Tract No. 8237 for a distance of 934' easterly of the School property. At th•,at point, Magnesia Falls Drive curves southerly, leaves our property and is adjacent to the Right-of-Way for the Whitewater Channel. For the next 430 ' to Deep Canyon Road the entire� nti e Right-of-Way was dedicated by Tract No. 8237 and it totals 88 ' . Through this area it will be a physical improbability that the City could or would widen the Right-of-Way. tven if the CVCWD did relinquish a portion of their Right-of-Way, any construction of roadway in the added easement would be over the actual side slope of the Channel. Some type of retaining wall would be required. -2- City Council, City of Palm Desert (cont!d) November 299 1979 4, In comparing the Standard Cross-Sections for the Hd ' , 961 , or 110 ' Rights-of Way, it is significant that each of them contemplate four traffic lanes and two parking lanes, or if parking is prohibited, six traffic lanes. Therefore, the traffic carrying capac- ity of all three widths is the same, b. The 110 ' Right-of-Way provides a 14 ' median. , 1f it is the intent of the City to use this median to preserve the .row of tamarisk now existing with Magnesia. Falls Drive, then it would be necessary to center the proposed Right-of-Way to coincide with the location of the trees. , Any other location of the median would not work. Since the tamarisk trees are generally U1 south of our Drop- erty line, it would mean that we should dedicate bb ' less 81 , or 47 , and the School District must dedicate bbi plus V or 63 ' , it the IIU ' total Right-ot-Way is to be maintained with the tamarisk trees located in the center of-the median. In conversations with the Depart ment . of Public .Works , we are informed that tamarisk trees cause a very expensive maintenance problem and they may not recommend their preservation in any event. b . if it is the City' s idea to have the center divider for aesthetic reasons , then they must .consideir the added traffic hazard. A motorist driving west from Deep Canyon Avenue will be on a six lane highway with no median for the first 4UU1 . 'Then rounding a fairly sharp curve , he approaches a section where a median could be built . (IU3 ' R/W) but if a median is built , there is no douDt that it will be a distinct hazard to an unsuspecting motorist approaching around the curve from the east. For the next 9341 , the ultimate Right-of-Way will unlikely ever exceed . 1031 , so that a full width median cannot be built without' sacrificing some other desirable feature. Along .the School District property, acquiring the full 110 ' ::Right-of7Way depends on the willingness of the School District. In any event , it is our opinion that the added maintenance expense of a well-planted median strip will .be out of all propor- tion to the few people who will travel this section and enjoy it . -3- City Council , City of Palm Desert (cont 'd) November 29 , 1979 7. One reason for added width at Portola could be to provide channelization for left and right turns . This is desirable if traffic is heavy enough to warrant it. However, this kind of widening can be . accomplished in the 200 or so feet immediately east of Portola. It does not require extra width for the full half mile to Deep Canyon. Road . 8: Because our property has a very long narrow,.triangular: shape, the dedication of any amount of. lane for Mag- nesia Falls Drive requires an unusually high percent- age of our property for such use. We have already dedicated 16% of our holdings for the 441 . 48 ' will require an overall dedication of over 17% of our prop- erty and 55 ' a dedication of 19% of the land. Lo' /pms INTEROFFICE MEMORANDUM City of Palm Desert TO: PLANNING COMMISSION FROM: PRINCIPAL PLANNER SUBJECT: CONSIDERATION OF ALIGNMENT OF MAGNESIA DATE: SEPTEMBER 17, 1980 FALLS DRIVE On August 5, 1980 the Planning Commission requested Staff to study the specific alignment of Magnesia Falls Drive in light of Case Nos. DP 08-79 and CUP 09-80. The purpose of this memorandum is to present Staff's findings and recommendations relating to the specific alignment of subject street between Monterey Avenue and Cook Street. To gain an understanding of the existing and potential situation along said street, Staff had completed base maps (see attachments 1 and 2) to indicate the. following information: 1. Section lines (including half section and quarter corners) . 2. Existing public owned right-of-way and existing improvements in the right- of-way. 3. Existing land uses showing the location of any structures (obtained from current air photos and/or field survey inspections) . 4. Potential right-of-way dedications as shown on approved "active" Tentative Tract and Parcel Maps. 5. Proposed improvements (i .e. , bridge structure, design width and alignment) . 6. Proposed improvements which are a part of approved "active" Development Plans or Conditional Use Permits (for which a Subdivision Map has not been processed). Based on the information on these base maps it seems that the appropriate roadway designation would be Scenic Secondary Roadway. The draft Transportation/Circulation Element to the General Plan Update defines this roadway as a street that collects and distributes traffic to destinations. It also serves secondary traffic generators, such as small business centers, schools, and major parks. With the scenic secondary designation, Magnesia Falls Drive would consist of four lanes of traffic (two lanes in each direction) encompassing 52 feet of road surface and a 16 foot wide raised landscaped center median. In addition, a ten foot public parkway on each side of the roadway will be designated. Finally, a scenic easement of up to 20 feet may be required, in addition to the required public parkway. This scenic easement is to provide for a pedestrian/bike path system separated from automobile traffic and/or to provide for the enhancement of City edges and scenic corridor through landscape treatment. This discussion is important to resolve an issue that was raised in conjunction with Case No. CUP 09-80. The imple- mentation of the planned right-of-way for Magnesia Falls, as adopted in the Collge of the Desert Specific Plan, would require the relocation of five mobile homes. The proposed scenic secondary roadway designation, with variation in the parkway requirements, would not result in the removal of subject mobile homes. This subject CUP request proposed to offer for dedication 30 feet of right-of-way south of an existing chain link fence (which is proposed to be removed) to the half section line. The scenic secondary designation requires 34 feet for road surface; obviously there is a difference of four feet between the two proposals. After careful consideration for the safety of all potential users (motorists, pedestrians and bicyclists) Staff feels that 34 feet road surface should remain. Attachment 3 illustrates the situation. The solid line represents the area 44 feet from the midsection line, which normally would be required for the road surface and parkway. As indicated, this line passes through three of the five effected mobile homes. The broken line represents the roadway without the minimum 10 foot parkwayincluded; no mobile homes would have to be relocated. However, the mobile homes would be inconsistent with the setback provisions of the Zoning Ordinance (Section 25.22.100). The parkway requirement and the four feet of right-of-way difference between the subject CUP proposal of 30 feet and Staff's recommendation of 34 feet remain. Before final action on the CUP request occurs, it is imperative that said differences be mitigated. Options available to the City include: 1) Require the 34 foot right-of-way and 10 foot parkway, which would result in the relocation of the five mobile homes as a condition of approval for any use permit application. 2) Require the 34 foot right-of-way, but forego the 10 foot park- way requirement, as a condition of approval for any use permit application. 3) If no further development occurs, the City could acquire the needed right-of-way and, if necessary, the effected mobile homes, prior to the development of Magnesia Falls Drive. continued . . . . The development of the property shall conform substantially with Exhibit A (Case No. DP 08-79) on file with the Department of Environ- mental Services , as modified by the following conditions . 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval , the applicant shall first com- plete all the procedural requirements of the City which include, but _are not limited to, Design Review, Subdivision process , and building permit procedures. 3. Construction of the total .development may be done in phases; how- ever, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 4 . The Staff recommends approval of DP- 08-79 and 178 MF by adopting Planning Commission Resolution No. 505 . SITE PLANNING CONSIDERATIONS: The proposal seeks to develop sixty apartment units in duplex buildings in the Planned Residential Zone. The zoning district was designed to encourage planned developments (typically condominium ownerships) with large caimlon use open space and recreational amenities. From the pro- ject Background and Analysis Report Section there appears to be two central site planning issues: percentage of ocmmn use open space; and scale of recreation amenities. Individual enclosed rear yards have been allocated to eachldwelling unit; '_' which reduces the common use open space percentage. A portion of the site is also covered by a recreational vehicle parking lot. If these areas were recaptured in common use, the rr nim mm open space percentage could be achieved. .4, Page Three The quantity of recreational amenities is less than typically expected in planned developments. At a minimum, one additional pool area should be added, and other recreational equipment such as volley ball court(s) , and play furniture for children. B. ARCHITECTURAL DESIGN: The duplex dwelling units are depicted as single-story with what might be described as a composite of architectural styles.._ Primary window orientations are east-west. C. C. DESIGN--REVIEW- The Design Review Board considered the related Design Review case at their June 27, 1979 meeting. Board discussion concerned sun shading (screening) of window areas, recreation amenities, and landscaping. The two regular Board members in attendance found the recreational vehicle parking area to be very desirable, and asked that a recommen- dation be carried forward to the Commission requesting that RV park- ing lots be counted in the required 50% conmron open space. Presently, (Municipal Code Section 25.24.270 E.) ". . .parking areas" are excluded from the definition of common open space. IV. Statement of Planning Objectives It is the objective of W.E . Development Co. , the owner; and Transcopic Development Corporation, the applicant of the pro- posed project to identify the need of apartment type dwelling units in the framework of the existing markets within the Coachella Valley and to fill those voids quickly. While most desert developers would recognize the fact that a healthy housing market is one in which residents of the Coachella Valley have a choice of housing opportunities and a choic necessary to achieve a stable regional economy, there exists within the Coachella Valley a serious shortage of at- tractive, safe, decent and AFFORDABLE rental housing which persons and families of moderate means can afford. This si- tuation is caused by any one or a combination of the following reasons : 1. Developers ' concentration shifted towards the deve- lopment of recreation oriented second homes in con- dominium projects due mainly to the economic feasi-: J. . bility; 2 . The inevitable aspect of inflation caused by the spiraling costs of construction further crippled the attractiveness of rental housing construction due to both the lack of financing and negative cash flow. W.E. Development Co. ' s planning objectives with regard to this development is as follows : Accompanying the growth of various commercial activities come the need for housing for local residents. In today 's real estate market, the -cost of homes and the cash re- quirement for purchase can be prohibitively high. The only alternative left would be the .rental housing. The proposed project offers the perfect location for this specific sector of the market in terms of its proximity to the schools , shopping centers, hospital and medical facilities, commercial offices, and most importantly, being in the midst of established residential areas zoned specifically for this type of development under the master plan of the City of Palm Desert.
