Caltrans has given permission for an access to Highway 111 , provided it is directly across from the access to the planned hotel across the highway and that the crossing be provided with a traffic signal. At present , the Engineers are Din-pointing the exact location of that access . The Applicant is also working with Caltrans for acquisition of the pro- perty now set aside for the previously intended frontage road . We will need to know exactly how much this will extend our north property line. These items will have to be verified and transmitted to this office be- fore we can proceed with an accurate Site Plan . Therefore , we must ask for an extension of our Hearing until probably the middle of Deceruber. If there are revisions to that schedule , we will contact you with the information. Unless the demand for electrical generating capacity exceeds our estimates, and provided that there are no unexpected outages to major sources of electrical supply, we expect to meet our electrical load requirements for the next several years. Our total system demaid is expected to continue to increase annually; and, if our plans to proceed with future construction of new generat- ing facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1984. CASE NO: CDP 08-81 \J REQUEST: . Approval of a Development Plan and Negative Declaration of Environmental Impact to allow construction of a 172 unit (168 is revised number of units) hotel (condotel) on 7.88 acres within the PC-4, S.P. (Resort Commercial, Scenic Preservation) zone, located on the south side of Highway Ill, approximately 300 feet east of Shadow Hills Road. APPLICANTS: J.D.F. FINANCIAL CORP. WILLIAM E. SEXTON, ARCHITECT 68-733 Perez Road, #1 71-537 Highway III Cathedral City, CA 92234 Rancho Mirage, CA 92270 1. BACKGROUND: A. PREVIOUS CONSIDERATION: This request was first considered on July 15, 1981, and continued four subsequent times to this hearing. The postponements were due to concerns regarding access to the site and use of frontage road right-of-way for the project. The applicants have submitted a revised site plan which they say Caltrans has indicated a positive position towards. The plan provides an access to Highway I I I with no access to the frontage road which ends at the west end of the property. Several other changes have also been incorporated into the plan. These changes along with the overall plan are analyzed in this report. B. DESCRIPTION OF SITE: The site is vacant and relatively flat. Utility poles cross the site parallel to Highway 111. C. ADJACENT ZONING AND LAND USE: North: PC (4)N, S.P./vacant South: PR-6/Condo project East: Indian Wells/Commercial (proposed) West: C-1, S.P./Commercial and public utility D. GENERAL PLAN LAND USE DESIGNATION: Resort Commercial II. PROJECT DESCRIPTION: The revised site plan eliminates all access to the frontage road to the west and provides a street intersection to Highway 111. The intersection will be required to be aligned with the Solomon project access across the street and signalized, for safety. Staff is recommending that the intersection be redesigned to provide on- site stacking for approximately 4 cars. Staff is recommending that this case, if approved, be subject to obtaining Caltrans approval of all work pertaining to Highway I11. The applicant, although not utilizing the frontage road, will dedicate and improve a cul-de-sac bulb on his property. -1- An emergency access is shown to Highway I I I at the east boundary. The revised plan utilizes the frontage road right-of-way currently owned by Caltrans. This right-of-way will have to be acquired for this approval to be valid. Because of the revisions to the site plan, several parking spaces were eliminated necessitating the deletion of four hotel rooms. Therefore, this proposal is for 168 rooms rather than 172 rooms. The proposed project would be operated under a condo/hotel concept similar to the Stein-Brief/Vista project on Highway 111. Attached is a letter from the applicant, explaining the proposed project and concept. The revised project still consists of six buildings for hotel units and a reception building. Internal circulation is provided by a loop road around the site. The Master Drainage Plan for the City requires an easement and drainage facility be provided along the east property line. The submitted plans do not indicate the required easement. The plans show a storage yard and a storage building adjacent to the south property line. This would be next to a residential condominium project. Therefore, it should be relocated to an area near the east property line which is adjacent to proposed commercial development in Indian Wells. The preliminary elevation submitted indicates a spanish style architecture with a tile roof, stucco walls and wood trim. The quantitative data for the project is as follows: 1. Site size: 7.88 acres with vacated frontage road 2. Condotel units: 168 units at 21.3 units/acre 3. Site covered by structures: 77,360 sq.ft. (22.5%) max. 4. Open space: 168,000 sq.ft. (48.9%) min. 5. Recreation facilities: 2 tennis courts 3 swimming pools 3 spas 2 cabanas 6. Parking required: 1.1 per guest unit or 185 spaces 7. Parking provided: 187 spaces U1. ANALYSIS: A. FINDINGS: Specific findings for approval of a Development Plan (same as for Conditional Use Permit) must be justified. Those findings and justification are as follows: Finding l: That the proposed location of the use is in accord with the objectives of this title and the purpose of the district in which the site is located. Justification: The property in question is in the Resort Commercial zone which permits hotel usage. Finding 2: That the proposed location of the use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. Justification: The property in question will be professionally operated as a hotel and will be required to comply with all applicable Federal, State and local laws. Finding 3: That the proposed use will comply with each of the applicable provisions of -2- fr I this title, except for approved variances or adjustments. Justification: The project as proposed complies with all applicable requirements or will be required to and needs no variances or adjustments. Finding 4: That the proposed use complies with the goals, objectives and policies of the City's General Plan. Justification: The General Plan indicates the subject property as Resort Commercial which conforms with the existing zoning and proposed use. It appears that there are sufficient grounds for supporting the required findings. B. ENVIRONMENTAL REVIEW: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. IV. STAFF RECOMMENDATION: Based on the findings and justification contained in this report, staff recommends that the Planning Commission adopt the findings and adopt Planning Commission Resolution No. , approving DP 08-81. SEXTON, Applicants Request for approval of a conartercial development plan to allow construction of a 172 unit condotel on 7.27 acres in the PC (4) , S.P. zone located on the south side of Highway 111, approximately 300 feet east of Shadow Hills Road. Mr. Diaz stated that Cal Trans would not allow direct access to Highway 111 or slip ramps. Cal Trans felt it would create a traffic hazard; the possibility of installing traffic signals to prevent a traffic hazard was discussed with Cal Trans but they felt that the signals would be too close to the others located at Cook Street and Deep Canyon Road. Mr. Diaz indicated that the installation of a median curb was also discussed with Cal Trans but they still felt they could not allow access to Highway 111. Commissioner Richards was dismayed at Cal Trans decision and offered alternate solutions. The Commission discussed the possibility of signalization for this project and the hotel development directly across Hwy 111 (Granada Royal ). Vice Chairman Kryder opened the hearing and asked the applicant if he wished to make a presentation. MR. BILL SEXTON, Architect, explained that there would be a shopping center _ developing adjacent to this development, which was in the Indian Wells ' city limits and they were allowed two accesses to Highway 111 from Cal Trans in San Diego. PUBLIC HEARINGS (cont. ) Discussion ensued regarding the possibility of the applicant sharing the accesses with the shopping center. Mr. Diaz advised Commission that permission would be needed by the City of Indian Wells. Commissioner Richards felt that this matter was a major problem and there were several alternatives the applicant could consider. He felt that the applicant i should research the matter before any decisions are made. Commissioner Wood agreed. Commissioner Berkey believed that the solution would be to install traffic signals. Commissioner Richards did not approve of the entry way as designed and was concerned if the operation of this project would be as a "hotel ". Discussion on how a Condotel is operated and used proceeded. MR. DENNIS FREEMAN, 68-713 Perez Road, Representative, explained how each unit is owned and used, stressing that it will operate as a hotel . I Commissioner Berkey suggested that condition no. 21 be revised to say: "Agreements concerning the ownership and operation shall be subject to the City Attorney approval . " Mr. McClellan, Public Works Director, agreed that the only solution to the access problem would be signalization, if access to the east of the project cannot be acquired. Commissioner Berkey stated that since Mr. McClellan agreed that traffic signals would be the solution to the access problem he suggested that this matter be taken to a higher district of Cal Trans. Mr. McClellan assured Commission that he would follow-up with a letter to the District Engineer of Cal Trans.. Because of concerns expressed by Commission regarding access, Mr. Diaz suggested an additional condition be added to read: "Signalized entry to the facility shall be developed from Highway 111 and aligned with the entry of the proposed hotel development on the north side of Highway 111. The plans reflecting said access shall be submitted to Planning Commission for approval ." Commission felt there were too many major problems unresolved, therefore, agreed to continue this case. Commissioner Richards also requested that the applicant give input regarding j the next door development, at the next public hearing for this case. i Motion was made by Commissioner Richards, seconded by Commissioner Berkey, to continue this case to October 14, 1981. Mr. Drell reviewed the proposed modifications to the sign ordinance and recommended a continuance f r consideration of Commission and public comments. SEXTON, Applicants Request for approval of a commercial Development Plan to allow construction of a 172 unit condotel on 7.27 acres in the PC(4) S.P. zone, located on the south side of Highway 111, approxi- mately 300 feet east of Shadow Hills Road. Staff presented this case reviewing the staff report and noting that the unused right-of-way for the extension of the Frontage Road would be vacated and in lieu of the Frontage Road the applicant was proposing a cul-de-sac which would also provide entry to the project. Staff recommended approval . Commissioner Richards expressed concern for assurance that the Development would operate as a hotel . An additional condition (No. 21) was recommended to read: Development shall be operated and licensed as a hotel . Commissioner Berkey felt that an access from the project site to Highway 111 should be considered, being that the hotel would generate a high volume of traffic and the intersection of Deep Canyon and Highway 111 was presently hazardous. Commissioner Richards agreed. Mr. Diaz stated that Cal Trans would be hesitant in approving an access onto Highway 111 and suggested consideration of a slip ramp. Chairman Berkey opened the hearing and asked if the applicant wished to make a presentation. MR. BILL SEXTON, Architect, agreed that a slip ramp might solve the problem but would talk with Cal Trans about the possibility of an access. Commissioner Richards suggested a continuance until this matter is resolved. MR. DENNIS FREEMAN, 1150 East Palm Canyon, Representative, believed this matter could be resolved with a condition' that could state a slip ramp would be provided for exit only. There was discussion regarding the possibility of continuing this case until Cal Trans could give input or imposing a condition to allow the project to continue development subject to approval by Cal Trans for an access to Hwy 111. Mr. McClellan, Director of Public Works, also believed that Cal Trans would be hesitant in approving an access but might permit a slip ramp. Chairman Berkey asked if anyone present wished to speak in FAVOR or OPPOSITION to this case; there was none. Motion was made by Commissioner Richards, seconded by Commissioner McLachlan, to continue this case to August 19, 1981, for further evaluation of an access. Carried 3-0. The development of the property shall conform substantially with approved Exhibits (Case No. DP 08-81) on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permit procedures. 3. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 4. SEXTON, Applicants Request for approval of a commercial development plan and a Negative Declaration of Environmental Impact to -I- MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 16, 1981 allow construction of a 172 unit condotel on 7.27 acres in the PC (4), S.P. zone located on the south side of Highway 111, approximately 300 feet east of Shadow Hills Road. Mr. Sawa presented this case and in reviewing the staff report the concerns expressed at prior meetings were access to Highway III and Frontage Road usage. Caltrans has indicated approval of the new plans but no formal approval has yet been received. Mr. Sawa noted a revision to Condition No. 12 (D), to read: "Signalization of access to Highway III at no cost to the City". He also noted that the proposed access would line up with the Solomon project across the street. Chairman Kryder opened the public testimony and asked for the applicant to give a presentation. MR. MACK WATTS, Representative of JDF Financial Corp., stated that Dick Longstreet, of Caltrans, would like to study the plans further and would contact him regarding the Signalization and design. Commissioner Richards wanted it clarified to the applicant that if Caltrans did not approve the plans then they could not proceed with the project. Chairman Kryder asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public testimony was closed. Chairman Kryder asked if bed tax would be collected. Mr. Sawa replied that this project would be treated like a regular hotel. Commission questioned condition No. 10, which states swimming pools are to be provided with solar heating. Mr. Ortega additionally asked for comments on the EIR, noting that this EIR was scheduled to go to the Council on October 22, 1981. Commissioner Crites asked how much land would be affected by the rights-of-way. Mr. Ortega pointed out some locations on the map stating that one property owner affected would be Bella Vista. Commissioner Richards asked if the financing for the channel was settled. Mr. Ortega replied that Bella Vista would give Redevelopment Agency $1.5 million to assist in constructing some of the facilities and would be donating the right-of-way. Commissioner Richards also asked if property owners in the newly created redevelopment area would be subject to requirements by the City. Approval of Resolution regarding conformity of proposed Redevelopment Plan, as amended, to City's General Plan. Mr. Ortega presented the proposed amendments to the Redevelopment Plan asking Commission to make specific findings in Section 4, which was for rights-of-way needed for flood control project in areas in the southwest corner of the City, specifically in the Cahuilla Hills. Mr. Ortega additionally asked 'for comments on the EIR, noting that this EIR was scheduled to go to the Council on October 22, 1981. Commissioner Crites asked how much land would be affected by the rights-of-way. Mr. Ortega pointed out some locations on the map stating that one property owner affected would be Bella Vista. Commissioner Richards asked if the financing for the channel was settled. Mr. Ortega replied that Bella Vista would give Redevelopment Agency $1.5 million to assist in constructing some of the facilities and would be donating the right-of-way. Commissioner Richards also asked if property owners in the newly created redevelopment area would be subject to requirements by the City. Mr. Ortega stated only if they are affected by a right-of-way. Commissioner Wood asked how the east side of the Cahuilla Hills would have access once the channel is constructed. Mr. Ortega indicated there would be access provided. Commissioner Crites asked if all homeowners affected will be provided a bridge. SEXTON, Applicants Request for approval of a commercial development plan to allow construction of a 172 unit condotel on 7.27 acres in the PC (4) , S. P. zone located on the south side of Highway 111, approximately 300 feet east of Shadow Hills Road. Mr. Diaz stated that Cal Trans would not allow direct access to Highway 111 or slip ramps. Cal Trans felt it would create a traffic hazard; the possibility of installing traffic signals to prevent a traffic hazard was discussed with Cal Trans but they felt that the signals would be too close to the others located at Cook Street and Deep Canyon Road. Mr. Diaz indicated that the installation of a median curb was also discussed with Cal Trans but they still felt they could not allow access to Highway 111. Commissioner Richards was dismayed at Cal Trans decision and offered alternate solutions. The Commission discussed the possibility of signalization for this project and the hotel development directly across Hwy 111 (Granada Royal ) . Vice Chairman Kryder opened the hearing and asked the applicant if he wished to make a presentation. MR. BILL SEXTON, Architect, explained that there would be a shopping center developing adjacent to this development, which was in the Indian Wells ' city limits and they were allowed two accesses to Highway 111 from Cal Trans in San Diego. PUBLIC HEARINGS (cont. ) Discussion ensued regarding the possibility of the applicant sharing the accesses with the shopping center. Mr. Diaz advised Commission that permission would be needed by the City of Indian Wells. Commissioner Richards felt that this matter was a major problem and there were several alternatives the applicant could consider. He felt that the applicant should research the matter before any decisions are made. Commissioner Wood agreed. Commissioner Berkey believed that the solution would be to install traffic signals. Commissioner Richards did not approve of the entry way as designed and was concerned if the operation of this project would be as a "hotel ". Discussion on how a Condotel is operated and used proceeded. MR. DENNIS FREEMAN, 68-713 Perez Road, Representative, explained how each unit is owned and used, stressing that it will operate as a hotel . Commissioner Berkey suggested that condition no. 21 be revised to say: "Agreements concerning the ownership and operation shall be subject to the City Attorney approval . " Mr. McClellan, Public Works Director, agreed that the only solution to the access problem would be signalization, if access to the east of the project cannot be acquired. Commissioner Berkey stated that since Mr. McClellan agreed that traffic signals would be the solution to the access problem he suggested that this matter be taken to a higher district of Cal Trans. Mr. McClellan assured Commission that he would follow-up with a letter to the District Engineer of Cal Trans. Because of concerns expressed by Commission regarding access, Mr. Diaz suggested an additional condition be added to read: "Signalized entry to the facility shall be developed from Highway 111 and aligned with the entry of the proposed hotel development on the north side of Highway 111. The plans reflecting said access shall be submitted to Planning Commission for approval . " Commission felt there were too many major problems unresolved, therefore, agreed to continue this case. Commissioner Richards also requested that the applicant give input regarding the next door development, at the next public hearing for this case. Motion was made by Commissioner Richards, seconded by Commissioner Berkey, to continue this case to October 14, 1981. Carried (4-Q). B. BACKGROUND: This case was continued from the meeting of July 15, 1981 , in order for the applicant to meet with Caltrans to determine whether access to Highway III was feasible. The applicant as well as city staff has been informed by Caltrans representatives that direct access to (or from) Highway 111 would not be allowed. We have also found out that the frontage road right-of-way is owned by Caltrans and not the City. Therefore, for the project to utilize the right- of-way as a part of the project, Caltrans will have to vacate or sell the land to the applicant. They have indicated a positive attitude towards doing this. The applicant has indicated a desire to keep the plan as submitted. As previously stated in the staff report of July 15, 1981 , the plan with conditions is acceptable. If approved, it would be subject to obtaining the right-of-way from Caltrans. An additional condition added is that the project be operated and licensed as a hotel . The findings and justification noted in the previous staff report are still valid and can be used to approve this request. II. Staff presented this case reviewing the staff report and noting that the unused right-of-way for the extension of the Frontage Road would be vacated and in lieu of the Frontage Road the applicant was proposing a cul-de-sac which would also provide entry to the project. Staff recommended approval . Commissioner Richards expressed concern for assurance that the Development would operate as a hotel . An additional condition (No. 21) was recommended to read: Development shall be operated and licensed as a hotel . Commissioner Berkey felt that an access from the project site to Highway 111 should be considered, being that the hotel would generate a high volume of traffic and the intersection of Deep Canyon and Highway 111 was presently hazardous. Commissioner Richards agreed. Mr. Diaz stated that Cal Trans would be hesitant in approving an access onto Highway 111 and suggested consideration of a slip ramp. Chairman Berkey opened the hearing and asked if the applicant wished to make a presentation. MR. BILL SEXTON, Architect, agreed that a slip ramp might solve the problem, but would talk with Cal Trans about the possibility of an access. Commissioner Richards suggested a continuance until this matter is resolved. MR. DENNIS FREEMAN, 1150 East Palm Canyon, Representative, believed this matter could be resolved with a condition that could state a slip ramp would be provided for exit only. There was discussion regarding the possibility of continuing this case until Cal Trans could give input or. imposing a condition to allow the project to continue development subject to approval by Cal Trans for an access to Hwy 111. Mr. McClellan, Director of Public Works, also believed that Cal Trans would be hesitant in approving an access but might permit a slip ramp. Additionally, vacating this area eliminates the need for the City to maintain an expansive parkway. In lieu of the Frontage Road, the applicant is proposing a cul-de-sac at the terminus of the existing Frontage Road. The entry to the project would be through the cul-de-sac. The Master Drainage Plan for the City requires an easement and drain- age facility be provided along the east property line. The submitted plans do indicate the required easement. The plans show a storage yard and a storage building adjacent to the south property line. This would be next to a residential condominium project. Therefore, it should be relocated to an area near the east property line which is adjacent to proposed commercial development in Indian Wells. Staff presented this case reviewing the staff report and noting that the unused right-of-way for the extension of the Frontage Road would be vacated and in lieu of the Frontage Road the applicant was proposing a cul-de-sac which would also provide entry to the project. Staff recommended approval . Commissioner Richards expressed concern for assurance that the Development would operate as a hotel . An additional condition (No. 21) was recommended to read: Development shall be operated and licensed as a hotel . Commissioner Berkey felt that an access from the project site to Highway 111 should be considered, being that the hotel would generate a high volume of traffic and the intersection of Deep Canyon and Highway 111 was presently hazardous. Commissioner Richards agreed. Mr. Diaz stated that Cal Trans would be hesitant in approving an access onto Highway 111 and suggested consideration of a slip ramp. Chairman Berkey opened the hearing and asked if the applicant wished to make a presentation. MR. BILL SEXTON, Architect, agreed that a slip ramp might solve the problem. but would talk with Cal Trans about the possibility of an access. Commissioner Richards suggested a continuance until this matter is resolved. MR. DENNIS FREEMAN, 1150 East Palm Canyon, Representative, believed this matter could be resolved with a condition that could state a slip ramp would be provided for exit only. There was discussion regarding the possibility of continuing this case until Cal Trans could give input or imposing a condition to allow the project to continue development subject to approval by Cal Trans for an access to Hwy 111. Mr. McClellan, Director of Public Works, also believed that Cal Trans would be hesitant in approving an access but might permit a slip ramp.
