units in the PR-7 zone located at the southeast corner of Fairhaven Drive
(future) and Park View Drive.

I. DISCUSSION:
The development plan, tentative tract map, and design review case provide for a
ten unit condominium project on the subject property. The tentative tract map
also provides for five duplex lots. Original approval date of these cases is May 13,
1982.
An'extension was granted in May, 1983, by the planning commission. The applicant
is requesting a one-year extension for the development plan, design review case,
and the tentative tract, as allowed by municipal code. This would be the last
extension for the tentative tract map permitted.
The city council recently denied a rezoning and precise plan request by the
applicant for a 48 unit affordable high density project on this site. The applicant is
also in the process of requesting approval for a new project utilizing a 25% density
bonus. If that project is approved, this approval will be null and void.
II. STAFF RECOMMENDATION:
Staff feels this request is acceptable and recommends:
1. Approval of a one-year extension for DP 09-81, TT 18027, and 229 MF with
all previous conditions to apply;

ENVIRONMENTAL IMPACT TO ALLOW DEVELOPMENT
OF 10 RESIDENTIAL CONDOMINIUM UNITS IN THE PR-7
ZONE LOCATED AT THE SOUTHEAST CORNER OF
PARKVIEW DRIVE AND FAIRHAVEN DRIVE.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 2nd day of March, 1982, hold a duly noticed public hearing to consider a request by
HOFFMAN BUILDERS, INC. for approval of a Development Plan, Preliminary Design
Review Case and Negative Declaration of Environmmental Impact to allow development
of 10 residential condominium units in the PR-7 zone located at the southeast corner of
Fairhaven Drive and Parkview Drive, more particularly described as:
Lot 6 TT 18027
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-8911, in that the Director of Environmental Services has determined that
the project will not have a significant impact on the environment and a Negative
Declaration of Environmental Impact has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts to justify their actions, as described below:
a. The proposed project generally conforms to the intent and purpose
of the PR Zone District.
b. The proposed project is adequately suited for the specific site

and is compatible swith existing and proposed development in the
area.
C. The proposed project will not be detrimental to the health, safety
and general welfare of he community.
WHEREAS, THE Design Review Board did on February 23, 1982, approve
preliminary plans for said project.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That the Planning Commission does hereby approve
Development Plan No. 09-81 and Design Review Case No. 229 MF
subject to the same conditions imposed on
the approval of TT 18027 (Amendment) and as attached hereto.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert

CONDITIONS OF APPROVAL
Case No. DP 09-81 and 229 MF
Department of Environmental Services:
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all the
requirements, limitations, and restrictions of all municipal ordinances and State
and Federal statutes now in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as required by ordinance
and the City Engineer shall be installed in accordance with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the Department of
Environmental Services with a list of proposed street names with at least three
alternatives. The approval of the final street name shall be made by the Director
of Environmental Services.
4. The CC&R's for this development shall be submitted to the Director of
Environmental Services for review, and final approval by the City Attorney prior to
the issuance of any building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the owners
of the units of the project.
5. Improvement plans for water and sewer systems shall meet the requirements of the
respective service districts.
6. Area shall be annexed to appropriate Improvement Districts having jurisdiction
over the subject area.
7. All dedicated land and/or easements required by this approval shall be granted to
the City of Palm Desert, without cost to the City and free of all liens and
encumbrances.
8. All on-site utilities, including cable TV, shall be placed underground and shall be
completely concealed from view except certain appurtenances as may be approved
by the Director of Environmental Services.
9. Complete plans and specifications shall be submitted as required by Ordinance to
the City Engineer for checking and approval before construction of any
improvements is commenced. The Subdivider shall submit "as-built" plans prior to
acceptance of the subdivision improvements by the City.
10. In order to maintain reasonable fire protection during the construction period, the
subdivider shall maintain passable vehicular access to all buildings. An adequate
number of fire hydrants with required fire flows shall be installed as recommended
by the Fire Marshal.
11. Prior to recordation of the Final Map, the developer shall furnish the original and
three (3) copies of the water system plan to the Fire Marshal for review.
12. The water system shall be signed by a registered civil engineer and approved by the
water company, with the following certification: "I certify that the design of the
water system of Tract No. 18027 is in accordance with the requirements prescribed
by the City Fire Marshall'
13. All private streets shall be inspected by the Engineering Department and a
Standard Inspection Fee shall be paid.
14. The applicant shall have twelve (12) months from the date of the approval of the
tentative map for filing of the final map unless an extension of time of up to
eighteen (18) months is granted by a Resolution of the City Council.
15. Drainage and Signalization Fund contributions as required by City Ordinance shall
be made prior to recordation of the final map.
16. Development shall pay a fee in lieu thereof as a condition of the final map for park

and recreation purposes, based upon the densities developed on lot 6.
17. Final map not to be recorded until design changes, if required by approval of
preliminary plans by the Design Review Board are incorporated.
18. Subdivision to be provided with minimum six foot high solid masonry wall around
project (except for approved openings) as approved by Design Review Board.
19. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
20. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Public Works Director.
21. Waiver of access to Fairway Drive and Parkview Drive shall be offered on the final
map except at one authorized location on Fairway Drive.
22. The emergency access gate on Fairhaven Drive shall be located south of the
proposed curb return.
23. A turnaround facility shall be provided within the development.
24. The applicant's civil engineer shall submit a boundary survey map.
25. The installation of curb and gutter on Fairhaven Drive at 20 feet from centerline,
sidewalk and matching paving.
26. The private drive shall be shown as lot 7 on the Final Map.
27. The installation of curb and gutter on Parkview Drive at 32 ft. from centerline,
sidewalk and matching paving.
28. All existing electrical distribution lines, telephone, cable antenna television, and r.
similar service wires or cables, which are adjacent to the property being developed
shall be installed underground as a part of development from the nearest existing %''"
pole not on the property being developed.
Fire Marshal
29. Install a water system capable of delivering 2500 GPM fire flow from any fire
hydrant for a two hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
30. Install Riverside County super fire hydrants located at each street intersection (a)
but not greater than 500 feet apart in any direction.
a. Exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. Curbs shall be painted red 15 feet in either direction from each hydrant.
31. Prior to recordation of the final map, the developer shall furnish the original and
three (3) copies of the water system plan to the Fire Marshal for review.
32. The water system plan shall be signed by a registered civil engineer and approved
by the water, with the following certification: "I certify that the design of the
water system in Tract No. 18027 is in accordance with the requirements prescribed
by the Fire Marshal." Upon approval, the original plan will be returned to the J
developer.
33. Prior to the delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
34. Fire lane required as per municipal code.
35. Cul-de-sac required as per municipal code.

Environmental Services for review, and final approval by the City Attorney prior to
the issuance of any building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the owners
of the units of the project.
5. Improvement plans for water and sewer systems shall meet the requirements of the
respective service districts.
6. Area shall be annexed to appropriate Improvement Districts having jurisdiction
over the subject area.
7. All dedicated land and/or easements required by this approval shall be granted to
the City of Palm Desert, without cost to the City and free of all liens and
encumbrances.
8. All on-site utilities, including cable TV, shall be placed underground and shall be
completely concealed from view except certain appurtenances as may be approved
by the Director of Environmental Services.
9. Complete plans and specifications shall be submitted as required by Ordinance to
the City Engineer for checking and approval before construction of any
improvements is commenced. The Subdivider shall submit "as-built" plans prior to
acceptance of the subdivision improvements by the City.
10. In order to maintain reasonable fire protection during the construction period, the
subdivider shall maintain passable vehicular access to all buildings. An adequate
number of fire hydrants with required fire flows shall be installed as recommended
by the Fire Marshal.
11. Prior to recordation of the Final Map, the developer shall furnish the original and
three (3) copies of the water system plan to the Fire Marshal for review.
12. The water system shall be signed by a registered civil engineer and approved by the
f water company, with the following certification: "I certify that the design of the
water system of Tract No. 18027 is in accordance with the requirements prescribed
by the City Fire Marshal."
13. All private streets shall be inspected by the Engineering Department and a
Standard Inspection Fee shall be paid.
14. The applicant shall have twelve (12) months from the date of the approval of the
tentative map for filing of the final map unless an extension of time of up to
eighteen (18) months is granted by a Resolution of the City Council.
15. Drainage and Signalization Fund contributions as required by City Ordinance shall
be made prior to recordation of the final map.
16. Development shall pay a fee in lieu thereof as a condition of the final map for park

and recreation purposes, based upon the densities developed on lot 6.
17. Final map not to be recorded until design changes, if required by approval of
preliminary plans by the Design Review Board are incorporated.
18. Subdivision to be provided with minimum six foot high solid masonry wall around
project (except for approved openings) as approved by Design Review Board.
19. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer. ^1
20. Drainage facilities shall be provided per Ordinance No. 218 and the Master Ji
Drainage Plan to the specifications of the Public Works Director.
21. Waiver of access to Fairway Drive and Parkview Drive shall be offered on the final
map except at one authorized location on Fairway Drive.
22. The emergency access gate on Fairhaven Drive shall be located south of the
proposed curb return.
23. A turnaround facility shall be provided within the development.
24. The applicant's civil engineer shall submit a boundary survey map.
25. The installation of curb and gutter on Fairhaven Drive at 20 feet from centerline,
sidewalk and matching paving.
26. The private drive shall be shown as lot 7 on the Final Map.
27. The installation of curb and gutter on Parkview Drive at 32 ft. from centerline,
sidewalk and matching paving.
28. All existing electrical distribution lines, telephone, cable antenna television, and
similar service wires or cables, which are adjacent to the property being developed
shall be installed underground as a part of development from the nearest existing
pole not on the property being developed.
Fire Marshal
29. Install a water system capable of delivering 2500 GPM fire flow from any fire
hydrant for a two hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
30. Install Riverside County super fire hydrants located at each street intersection (a)
but not greater than 500 feet apart in any direction.
a. Exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. Curbs shall be painted red 15 feet in either direction from each hydrant.
31. Prior to recordation of the final map, the developer shall furnish the original and
three (3) copies of the water system plan to the Fire Marshal for review.
32. The water system plan shall be signed by a registered civil engineer and approved
by the water, with the following certification: "I certify that the design of the I

stores having a larger area would not have congestion, so it should be left up to the
descretion of market owners to determine the number of machines to be used within the
limits of the proposed Ordinance.

Planning Commission Resolution No. 784, recommending approval to the City Council of
ZOA 02-82, as presented by staff, defining arcades as 5 or more electronic and
mechanical machines with a Conditional Use Permit. Carried 3-0-2 (with Commissioner
Wood abstaining; and, Commissioner Richards abstaining because of lack of any real
feeling on the issue).

Request for approval of a Development Plan, an amended
Tentative Tract Map for condominium purposes and
preliminary 10 condominium units in the PR-7, S.P. zone
(Planned Residential, 7 d.u./acre, Scenic Preservation
Overlay) located at the southeast corner of Parkview Drive
and future extension of Fairhaven Drive.
Mr. Smith presented the staff report for this request stating that the main concern
was the height of 30 ft. The Municipal Code limits height in the PR-7 to 30 ft. or two
stories, therefore, the proposed project would conform if the garages were lowered 4 feet
below grade to conform to the definition of "basement". Staff recommended approval.
Commissioner Richards asked if the actual 30 ft. limit is from normal grade or
could they build pads up and then dig down.. Mr. Diaz replied that height is measured from
finished grade but the review process precludes artifical pad construction.
Commissioner Wood asked for clarification of the height. limit because of
misunderstandings with the project on Ryway Place. Mr. Diaz explained that the
Ordinances written in 1975 state that a basement is not to be included as a story and the
height of the basement above grade is not to be included in the height limit. In the case,
of Ryway Place and this project, staff did include the area above grade in measuring total
height.
Chairman Kryder opened the public hearing and asked if the applicant wished to
make a presentation.
MR. CHARLES MARTIN, 73-160 El Paseo, stated he was present to answer any
questions the Commission might have.
In response to a question relating to garage drainage, Mr. Martin explained that the
Civil Engineer would resolve this problem. Mr. Martin then stated that they were now
looking into the correct definition of a story to exclude a mezzanine with a bathroom.
Mr. Diaz clarified to Mr. Martin that the definition in the Municipal Code would have to
be followed, and any determination by ICBO would not impact the code.
Chairman Kryder closed the public hearing and asked for further comments from
the Commission.
Commissioner Richards wanted the applicant to understand that in no way would
the height of the building exceed 30 ft.
Mr. Martin reviewed the conditions briefly and stated he concurred.
Moved by Commissioner Crites, seconded by Commissioner Richards, to adopt
findings as recommended by Staff. Carried unanimously 5-0.

III. DISCUSSION:
TT 18027 was approved in September 1981. The map provided 5 lots for the
construction of a duplex on each, a private street and a remaining parcel on which
to construct 10 residential units.
The present applications involve the development of the 10 residential units.
Development Plan approval is required for all developments in the PR zone and a
tract map is required because the units are to be condominiums. The building plans
have been reviewed by the Design Review Board and obtained preliminary approval.
Affirmation of the DRB action is required.
The applicant proposes 10 condominium units in 3 structures. Two structures will
contain 3 units and the third building will have 4 units.

The property in question is zoned PR-7, which permits a maximum height of two
stories or 30 feet. The buildings in question conform to the 30 foot limit. The
structures are two (2) story units over the garage area. In order to comply with the
code provisions relating to stories, the garage level must be submerged to qualify
as a *basement, so that no more than four feet of the garage extends above
adjacent existing grade. If more than four (4) feet extends out of the ground, then
this level is considered a story and the project would not be in compliance with the
height limit. (i.e., the maximum 2 story limit).
The grading plan submitted indicates that the garages will exceed the permitted
limit. The grading will need to be revised in order to comply. Each unit will be
provided with a private yard in the rear.

Specific findings and justifications must be made in order to approve a
Tentative Tract Amendment to permit condominiums. Those findings are as
follows:
1. That the proposed map is consistent with applicable general and
specific plans.
2. That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
*Basement means that portion of building between floor and ceiling which is partly
or wholly underground. A basement shall be counted as a story for purposes of height
measurement where more than one-half of its height is above the average level of the
adjoining ground.

3. That the site is physically suitable for the proposed density of
development.
4. That the site is physically suitable for the proposed density of
development.
5. That the design of the subdivision or the proposed improvements are

6. That the design of the subdivision or the type of improvements are
not likely to cause serious public health problems.
7. That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of property within the proposed subdivision.
The justification for recommending approval of the Tentative Tract
Amendment to permit condominium is as follows:
1. The density allowed by this map is consistent with General Plan and
College of the Desert Specific Plan.
2. Fairhaven Drive will be dedicated, improved and drainage facilities
will be provided in conformance with adopted General Plans, Master
Drainage Plans and Zoning Ordinances.
3 & 4.
The site is of sufficient size, shape and topography for the proposed
type and density of development.
5 & 6.
The design of the subdivision is not likely to cause substantial
environmental damage or serious public health problems because it
will be developed in concert with applicable local, state and federal
regulations.
7. There have been no easements acquired by the public at large for
access through or use of property within the proposed subdivision.
Staff feels there are sufficient grounds to justify recommending approval of
the Tentative Tract amendment to permit condominiums.
B. DEVELOPMENT PLAN:
Staff feels that plans submitted are adequate for approval of the
development plan subject to lowering of the garages as required by
Municipal Code.
C. DESIGN REVIEW BOARD:
The Design Review Board reviewed the plans and granted preliminary
approval at its February 23, 1982, meeting.
V. STAFF RECOMMENDATION:
Based on justifications contained in this report and the attached draft Resolutions,
staff recommends that the Planning Commission adopt the findings for the
Tentative Tract Map as noted above, and adopt Resolution Nos. ,
approving DP 09-81 and 229 MF, and recommending approval to the City Council of

the project will not have a significant impact on the environment and a Negative
Declaration of Environmental Impact has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts to justify their actions, as described below:
a. The proposed project generally conforms to the intent and purpose
of the PR Zone District.
b. The proposed project is adequately suited for the specific site
and is compatible swith existing and proposed development in the
area.
C. The proposed project will not be detrimental to the health, safety
and general welfare of he community.

CONDITIONS OF APPROVAL

Department of Environmental Services:
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all the
requirements, limitations, and restrictions of all municipal ordinances and State
and Federal statutes now in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as required by ordinance
and the City Engineer shall be installed in accordance with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the Department of
Environmental Services with a list of proposed street names with at least three
alternatives. The approval of the final street name shall be made by the Director
of Environmental Services.
4. The CC&R's for this development shall be submitted to the Director of
Environmental Services for review, and final approval by the City Attorney prior to
the issuance of any building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the owners
of the units of the project.
5. Improvement plans for water and sewer systems shall meet the requirements of the
respective service districts.
6. Area shall be annexed to appropriate Improvement Districts having jurisdiction
over the subject area.
7. All dedicated land and/or easements required by this approval shall be granted to
the City of Palm Desert, without cost to the City and free of all liens and
encumbrances.
8. All on-site utilities, including cable TV, shall be placed underground and shall be
completely concealed from view except certain appurtenances as may be approved
by the Director of Environmental Services.
9. Complete plans and specifications shall be submitted as required by Ordinance to
the City Engineer for checking and approval before construction of any
improvements is commenced. The Subdivider shall submit "as-built" plans prior to
acceptance of the subdivision improvements by the City.
10. In order to maintain reasonable fire protection during the construction period, the
subdivider shall maintain passable vehicular access to all buildings. An adequate
number of fire hydrants with required fire flows shall be installed as recommended
by the Fire Marshal.
11. Prior to recordation of the Final Map, the developer shall furnish the original and
three (3) copies of the water system plan to the Fire Marshal for review.
12. The water system shall be signed by a registered civil engineer and approved by the
water company, with the following certification: "I certify that the design of the
water system of Tract No. 18027 is in accordance with the requirements prescribed

13. All private streets shall be inspected by the Engineering Department and a
Standard Inspection Fee shall be paid.

Request for approval of a Change of Zone from R-3, 18,000
(3) S.P. (Multiple Family Residential, 18,000 sq.ft.
minimum lot size, 1 d.u. per 3,000 square feet of land area,
Scenic Preservation Overlay) to C-1 S.P. (General
Commercial, Scenic Preservation) for property located on
the east side of Highway 74, approximately 120 ft. south of
El Paseo.
Mr. Sawa reviewed the staff report stating that the reason for the request is to
bring the property in compliance with the General Plan. Staff is recommending that the
Scenic Overlay be retained with the Change of Zone approval.
Chairman Kryder opened the public hearing and invited input in FAVOR or
OPPOSITION to this request.
MRS. JEAN DAILY, 38B Sandpiper, asked if a Conditional Use Permit would be
required to expand existing buildings (i.e. Adobe). Mr. Sawa replied affirmative.
Mr. Sawa noted that a letter was received by Mr. Chester Brabyns, 4515 Fairfield
Dr., Corona Del Mar, also Sandpiper property owner, opposing the Change of Zone.
MR. TOM TAYLER, 37C Sandpiper, was concerned for any future developments in
that area that might be objectional to the neighboring property owners. Mr. Sawa
explained that he would be notified of any development plans.
Chairman Kryder closed the public hearing.
Moved by Commissioner Miller, seconded by Commissioner Richards, to waive
further reading and adopt Planning Commission Resolution No. 777, recommending
approval of C/Z 01-82. Carried unanimously 5-0.
C. Case No. CUP 15-80 (Renewal) - FRANZ TIRRE, Applicants
Request for approval to renew a CUP to allow construction
of a 10 unit residential condominium project on a 25,200
sq.ft. site, within the R-3 zone located at the southeast
corner of Las Palmas Avenue and San Gorgonio Way.
Mr. Sawa reviewed the staff report and stated the applicant is requesting Condition
No. 5, undergrounding the utility poles, be waived because the poles would also service
adjacent properties. Staff recommends that if the undergrounding is waived, a
requirement or condition be added to relocate the poles if found necessary by staff and a
future undergrounding agreement be signed by the applicant. Commission concurred,
Condition No. 5 was amended to read: "Applicant shall record agreement guaranteeing
property will voluntarily be a part of any undergrounding district which is subsequently
established; however, utility poles are to be relocated at expense of applicant if
determined necessary by City.'
Commissioner Crites asked staff what size area was included in the Land Use
Element to justify density conformity. Mr. Sawa replied within 2 to 3 blocks of this
project.

Dear Mr. Diaz:
Prior to construction of any of the proposed buildings, the following
conditions must be met:
1 . Install a water system capable of delivering 2500 G.P.M. fire flow
for a two (2) hour duration in addition to domestic or other supply.
The computation shall be based upon a minimum of 20 psi residual
operating pressure in the supply main from which the flow is measured
at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along
approved vehicular travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review. Upon approval , one copy will be sent to the
Building Department, and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer,
and approved by the water company, with the following certification:
"I certify that the design of the water system in Case Number DP 09-81
is in accordance with the requirements prescribed by the Fire Marshal ."
5• Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating and delivering
the required flow.

6. A 20 feet fire alternative access is required.
7. Electronic gate control waives 40 feet cul-de-sac radius requirement.

1. , The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all the requirements, limitations, and restrictions, of all municipal
ordinances and State and Federal statutes now in .force, or which here-
after may be in force.
<w 2. _ Full public improvements including traffic safety lighting as required by
ordinance and the City En_ g�irieer shall be installed in accordance with ,
City standards.
3. Prior to submittal of the Final Map, the applicant shall provide the
Department of Environmental Services with a list of proposed street
names with at least three alternatives. The approval of the final street
name shall be made by the Director of Environmental Services.
4. The CC&R's for this development shall be submitted to the Director of
Environmental Services for review, and final approval by the City Attorney
prior to the issuance of any building permits. Prior to recordation of
the final subdivision map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
C. Management and maintenance agreement to be entered into with the
owners of the units of the project.
5. Improvement plans for water and sewer systems shall meet the requirements
of the respective service districts.
6. Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject area.
[ 7. All dedicated land and/or easements required by this approval shall be
granted to the City of Palm Desert, without cost to the City and free of
all liens and encumbrances.
8. All on-.site utilities, including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as
may be approved by the Director of Envirenmental . Services.
9. Complete plans and specifications shall be submitted as required by Ordi-
nance to the City Engineer for checking and approval before construction
of any improvements is commenced. The subdivider shall submit "as built
plans prior to acceptance of the subdivision improvements by the City. .
10. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
11. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
12. All requirements of the City Fire Marshal from his letter of August 14, 1981,
shall be met as a part of the development of this tract.
13. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system of Tract No. 18027 is in accor-
dance with the requirements prescribed by the City. Fire Marshal . "

15. The applicant shall have twelve (12) months from the date of the approval
of the tentative map for filing of the final. map unless an extension of
time of up to eighteen (18) months -is granted by a Resolution of the City

16. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the final map.
17. Development shall pay a fee in lieu thereof as a condition of the final rup
for park and recreation purposes, based upon the densities developed on
lot 6.
18. Final map not to be recorded until design changes, if required by approval of
preliminary plans by the Design Review Board are incorporated.
19. Subdivision to be provided with minimum six foot high solid masonry wall
around project (except for approved openings) as approved by Design Review
Board.
20. Additional storm drain construction shall be contingent upon a drainage
study by the private engineer.
21. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Public Works Director.
22. Waiver of access to Fairway Drive and Parkview Drive shall be offered on
the final map except at one authorized location on Fairway Drive.
23. The emergency access gate on Fairhaven Drive shall be located south of the
proposed curb return.
2.4. A turnaround .facility shall be provided within the development.
25. The applicant's civil: engineer shall submit a boundary survey map.
26. The installation of curb and gutter on Fairhaven Drive at 20 feet from center-
line, sidewalk and matching paving.
27. The private drive shall be shown as lot 7 on the Final Map.
