SUBJECT: .RELEASE OF BUILDING PERMITS FOR SANDROCK II DATE: OCTOBER 15, 1979
I have this date, reviewed the status of the Planning Approvals for
Sandrock II for the City Attorney. It is his opinion that suffi-
cient reliance on previous approvals has occurred and substantial
construction completed to allow us to construe that the Commission's
approval of DP 10-77 and 91 MF are valid at this time. Therefore,
it is to be my recommendation and finding that you should consider this
department's previous approvals of said project being in affect this
time.
I believe this will allow you then to issue the building permits on
this project.

6. Case No. 99MF - SUNRISE COMPANY - Final construction drawings for clubhouses
for 780-unit condominium project to be located north of the Whitewater Storm
Channel between Portola and Monterey. Applicant not present.
On a motion by Urrutia , seconed by Jackson, the Board approved the final con-
struction drawings. Carried 4-0 (Urrutia , Jackson , Minturn, Johnson) .
7. Case No. 89MF - JOSEPH MUSTASCIO - Final construction drawings for a duplex
to be located on the south side of Catalina , between San Rafael and San Carlos.
Applicant not present.
On a motion by Urrutia, seconded by Minturn, the Board approved the final
construction drawings subject to the applicant providing an. automatic sprink-
ling system. A drip system was recommended as an alternate system for land-
scaping around the structure; carried 4-0 (Urrutia , Minturn, Jackson, Johnson) .
8. Case No. 9OMF - JOSEPH MUTASCIO - Final construction drawings for a duplex
to be located on the west side of Monterey between San Nicholas and Santa
Rosa. Applicantnot present.
On a motion by Urrutia, seconded by Minturn, the Board approved the final con-
struction drawings subject to the applicant providing an automatic sprinkling
system. An alternate drip sprinkling system for landscaping around the struc-
ture was recommended. Carried 4-0 (Urrutia, Minturn, Jackson, Johnson).
9. Case No. 91MF - C G. DUNHAM - Final construction drawings for a 20-unit con-
do nium project o be located on the north side of Shadow Mountain, west of
Lu ine. Applic t present.
On a mo ion by Minturn, seconded by Jackson, the Board approved the final con-
struction drawings subject to the following: 111
Ja. Modify carport and roof treatment as shown on Exhibit A.
b. Roof tile shall be same as used on Phase I.
c. Revise landscaping plan to include:
1 . Grading plan
2. Use 2' to 3' 'berm along Shadow Mountain
3. Increase size of trees
4. Resubmit landscaping plan prior to issuing permits.
Carried 4-0 (Minturn, Jackson, Urrutia , Johnson).
10. Case No. 79C - C. G. DUNHAM - Preliminary site, floor and elevations for a com-
mercial project to be located on the south side of El Paseo between Lupine Lane
and Sun Lodge. Applicant present.
On a motion by Minturn, seconded by Jackson, the Board approved the preliminary
site, floor and elevation subject to the applicants compliance with special
conditions 6, 7, 8, 9 and 10. Carried 4-0 (Minturn, Jackson, Urrutia, Johnson) .
11 . Case No. 115MF - CHARLES KRUG - Preliminary site, floor and elevations for a
duplex to Fe located on the west side of Monterey,• south of 44th Avenue.
Applicant present.
On a motion by Minturn, seconded by Jackson, the Board agreed to accept the pre-
liminary plans as final construction drawings subject to staff's approval of the
following conditions to be complied with by the applicant:
a. Reduce parking space back-up areas by 3 feet and provide landscaping.
b. Provide a 6 foot high wall around 3 sides of building and structural land-
scaping.

STAFF RECOMMENDATION :
The one minor problem appeals to be the most westerly
driveway on Shadow Mountain which could be difficult
as far as exiting from the project . Staff would
recommend approval of the final construction drawings.

SPECIAL CONDITIONS
CASE NO. 91MF
1. The applicant shall comply with any and all requirements
or conditions mandated by Case No. DP 10-77.
2. Applicant shall provide evidence of approval of plans by
the Palm Desert Property Owners Association prior to sub-
mittal of Final Construction Drawings to the Design Review
Board.
3. Increase landscaping and it should relate to landscape pro-
gram of Phase I .
4. Simplify elevations to be more compatible to existing Phase
and reduce the ornamentation.
5. Car ports should have solid roofs.
6. Provide physical separation between driveway and public street .
7. Provide preliminary grading plan .
AGREEMENT
I accept and agree , prior to use of this permit or approval , to
comply with all the condiitons set forth , and understand that the
Department of Building and Safety will not issue a permit or allow
occupancy on the use permitted until this signed confirmation has
been received by the Department of Environmental Services.

IX. DESIGN REVIEW BOARD ITEMS (Cont . )
Commissioner Kryder asked if there would be any air condition-
ing on the roofs. Mr. Gibbs stated there would be none . Mr. Williams
stated that 42nd Avenue would be extended. Mr. Cipriani stated that
the project will be done in stages.
Mr. Beebe indicated that a change was needed in condition
7, it should read as follows : "Lighting of parking areas and premises
shall be provided as approved by the Director of Environmental Services .
Street lights shall be installed as approved by the City Engineer. "
Some discussion followed over this condition . Mr. Beebe noted that
street lights would be needed at Cook and 42nd.
It was moved by Commissioner Kelly, seconded by Commissioner
Kryder to approve the Design Review Board Actions of October 11 , 1977
with the addition to Condition No. 7 to read as follows : "Lighting
of parking areas and premises shall be provided as approved by the
Director of Environmental Services. Street lights shall be installed
as approved by the City Engineer" by Planning Commission Resolution
No. 299; carried unanimously (4-0) .
A. Review of cases acted on by the Design Review Board at
their meeting of October 25, 1977 .
Mr. Cipriani reviewed the cases starting with Case No. 88MF
and Mr. Williams noted that the Design Review Board wants a cluster
'of trees at the driveway and similar treatment at the end of the
building. Mr. Jennings the applicant was present .
Regarding Case No. 89MF and 90MF there was some discussion on
the driveways and the garages.
In reference in Case No. 32MF Mr. Williams noted that the Design
Review Board requests 32 trees in front . Mr. Williams also noted that
Case No. 92MF had been reviewed wit 77A earlier in the meeting.
Mr. Williams then reviewed Case N .(91AIF nd covered the various con-
corns of the Design Review Board 4 st d in . their minutes .
Mr. Cipriani reviewed Case No . 50C and there was some discussion
on the enclosure area. He then reviewed Case No. 61C. Mr . Bernie
Leung was present .
It was moved .by Commissioner Snyder and seconded by Commissioner
Kelly to approve the actions of the Design Review Board on October 25,
1977 by Planning Commission Resolution No. 299 ; carried unanimously (4-0) .

XII . COMMENTS
- A. City Staff - Mr. Cipriani noted that the Mayor has requested
that a member of the Commission serve on the CVAG
Housing and Community Development Subcommittee.
Commissioner Kryder volunteered to serve.
Mr. Williams stated that the first COD Area Specific
Plan neighborhood meeting would be on Nov. 2nd,
the 2nd on the 3rd, the 3rd on the 7th which they
expect to have a big turn out at this meeting, the
4th meeting on the 8th and the final meeting on
the 9th. He stated that he hoped a Commissioner
would be able to attend some of the meetings.

Agreement of compliance to be signed by those applying for review.
I hereby acknowledge that I have read and agree, to comply
with all the following requirements , and understand that
the Department of Building and Safety will not issue a
building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the
Department of Environmental Services.
The development of this project shall conform substantially
to all development plans submitted in behalf of this case,
and as revised according to the Design Review Board process.
Any minor change requires approval by the Director of Envi-
ronmental Services. Any substantial change requires ap-
proval by the Design Review Board.
All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
Landscaping (with irrigation system) shall be installed
prior to final inspection and receiving certificate of
occupancy.
Curb, gutter, curb cuts , and tie-in paving shall be provided
along the full frontage of the lot by means of installation
prior to final inspection or other provisions as approved by
the City Engineer. Construction shall conform to City Stan-
dards and all requirements of the City Engineer.

I have this date, reviewed the status of the Planning Approvals for
Sandrock II for the City Attorney. It is his opinion that suffi-
cient reliance on previous approvals has occurred and substantial
construction completed to allow us to construe that the Commission's
approval of DP 10-77 and 91 MF are valid at this time. Therefore,
it is to be my recommendation and finding that you should consider this
department's previous approvals of said project being in affect this
time.
I believe this will allow you then to issue the building permits on
this project.

admit their lights are too bright and they have
indicated they would only tu:n them on when
sorejr.e is playing and on Friday and Saturday
nights for advertising purposes.
We feel that this is only a temporary reprieve and

Gentlemen :
We, the undersigned, are residents adjacent to and
affected by these intensive lights .and we respectfully petition
and plead for some relief. When these lights are on in the even-
ing hours, from before dark to past 10:00 P.M. , they do greatly
affect our well-being and enjo ,nent of our properties here in
Palm Desert. Thev appear to us to he unnecessarily intense ; too
high and are directed not only onto the tennis courts but onto
our exposed windows, patios and yards . These lights are also
directed upon Shadow Mountain Drive to such an extent that we
believe their glare could become a traffic hazard.
We all realize that tennis playing has become very
popular here in Palm Desert and we do not wish to impose our wishes
or restrictions upon our neighbors, however, we do hope and plead
that our neighbors %- ill not impose these disturbing lights upon us.
We believe the height of these liy•hts can be lowered, can be less
intense and can be directed onto the tennis courts instead of into
our yards, patios and our windows. And cannot these lights be
turned on only when these courts are in use?
We cordially invite each of you' to visit any of us during
the evening hours when these lights are on to see for yourselves
the disturbing effect it has on our enjoyment of our beautiful
desert evenings.

Report On: Development Plan for Residential Condominium Project
Applicant: CURT DUNHAM

I . REQUEST:
That the Planning Commission approve a development plan for a 20-unit
residential condominium, which will be the second and final phase of
the Sandroc project and which will be located on a 2.48-acre site on
the north side of Shadow Mountain Drive and east of Tumbleweed Lane.
II . STAFF RECOMMENDATION:
That the Planning Commission adopt Resolution No. 272 approving the pro-
ject, subject to the attached conditions.
Justification is based upon:
1 . The project provides for a substantial reduction in density and is
compatible with existing and proposed development in the area.
2. The project does ensure the protection of the public health, safety, and
general welfare.
3.--The-project-does—con form-to_.a11 requirements_ of the General Plan—and-
Zoning Ordinance. --
III. BACKGROUND:
A. Description: The subject property is described as Lot 2, Tract 4866
B. Location: North side of Shadow Mountain Drive and east of Tumbleweed
Lane
C. Size: 2.48 acres (net)
D. No. of Units: 20
E. Density: 8.06 du/acre
F. Type of Units: The applicant has submitted plans for 13 1-story units
of 1350 sq. ft. and 7 2-story units of 1224 sq. ft.
Most of these will be built as duplex structures with 2
units side-by-side, although in 1 case there is a single
detached unit and 1 building of 3 units. Architecturally,
the units are contemporary in design with a Spanish motif.
Red clay tile is used on the roof with the exterior pre-
dominantly stucco with heavy wood beam trim. Both units
measure approximately 18-20 feet in height.

J. Parking: As a condominium project, the applicant is required to
provide 2.5 spaces per unit; in this case, 40 covered and
10 open spaces are needed. The site plan provides these
spaces.
K. Previous Actions: Phase I of the Sandroc project was approved by
Riverside County by Case No. CUP 1472 in November
16, 1972.
IV. DISCUSSION:
The applicant was the original developer of Phase I of Sandroc. At that
time, he envisioned building the entire_ project in a high-density design.
However, after building the first units, he discovered that the design
was not as popular as anticipated. Thus Phase II was completely changed,
but the site was predetermined by the lot design that had occurred when
the tract map was first filed.
Within this irregular site, the applicant has located 20 dwelling 'units-
approximately one-half of the total permitted by the Zoning Ordinance.
As the site slopes rather steeply from south to north, the units follow
the natural contour of the land, which means that drainage must be carried
out through the existing phase. This is a critical design element and if
the applicant can 't arrange this drainage pattern, the staff recommends
that the development plan become null and void and a new design be
submitted.
Because of the irregular lot size and slope, the staff feels that it would
be beneficial to minimize the amount of paved asphalt area, which contri-
butes to added water runoff and reduces landscaping. Without reducing the
number of spaces, the staff recommends that tseveral of the guest spaces
be located on extended driveways in front of covered spaces. Due to the
smaller size of these units and their anticipated use for weekend/recrea-..
tional purposes, it is unlikely that more than the 40 covered spaces will
be used at any one time.
The perimeter of the project is fairly well defined. To the south is
Shadow Mountina Drive, which has already been improved with curb and gutter.
The ;City Engineer is recommending that- a 6-ft. sidewalk be added around the.pro-
ject on Shadow Mountain Drive and along Lupine adjacent to Phase I. To
the east is the existing phase. On the north, the site abuts the commercial
lots on the south side of El Paseo. A 6foot masonry wall is recommended
along ,'this boundary. The western property line is adjacent to an existing
apartment complex. A second 6-foot masonry wall should be installed along
this property line. The City Engineer is requesting a street light at
Shadow Mountain Drive and Tumbleweed Lane, a somewhat hazardous intersection.
Besides use of the existing tennis courts, the .applicant indicates a large
recreation area west .of the tennis courts. The staff recommends a second,
smaller recreations area be added east of the courts, with possibly a
small jacuzzi , cabana, and barbeque. The project conforms to the open
space requirements of the Zoning Ordinance. The existing lighting of the
tennis courts does not conform to our present standards and should be modi-
fied accordingly.
The City received a letter from the Coachella Valley County Water District
requesting a delay in the issuance of building permits until some problems
about relocating an existing water line could be resolved with the developer.
A condition has been written which would require resolution of the problem
prior to the submittal of plans for Design Review Board approval .

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A DEVEL-
OPMENT PLAN TO ALLOW A 20-UNIT RESIDENTIAL CONDOMINIUM
PROJECT ON PROPERTY GENERALLY LOCATED NORTH OF SHADOW MOUN-
TAIN DRIVE AND EAST OF TUMBLEWEED LANE.
CASE NO. DP 10-77
_ WHEREAS, pursuant to the provisions of Article 25. 14 of the Palm Desert
Zoning Ordinance, the Planning Commission did on August 2, 1977, hold a duly noticed
public hearing to consider the application of CURT DUNHAM for a Development Plan to
allow a 20-unit residential condominium project on property located in the PR-16
Zone and situated at the northeast corner of Shadow Mountain Drive and Tumbleweed
Lane and more particularly described as:

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77-.7% in that the
Director of Environmental Services has determined on July 26, 1977 that the project
would not have a significant impact on the environment and the appeal did expire
on August 2, 1977, and;
WHEREAS, at said public hearing, upon hearing and considering all testimony
and argument, the Planning Commission did find the following facts and reasons to
exist to justify the granting of said Development Plan:
1 . The project provides for a substantial reduction in density and is
compatible with existing and proposed development in the area;
2. The project does ensure the protection of the public health, safety,
and general welfare;
3. The project does conform to all requirements of the General Plan and
Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert as follows:
1 . That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That the Development Plan, Case No. DP 10-77 is granted to CURT DUNHAM

CONDITIONS OF APPROVAL
CASE NO. DP 10-77
I . STANDARD CONDITIONS
1 . The development of the property shall conform substantially with that as
shown on plot plan marked Exhibit 'D' on file with the Department of En-
vironmental Services, Case No. OP 04-77, unless otherwise amended by the
following conditions.
2. Prior to the submittal of plans for building permits, the applicant shall
submit a copy of the CC&R's for approval by the City Attorney.
3. Prior to the issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following public agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be pre-
sented to the Department of Building and Safety at the time of the issuance
of a building permit for the use contemplated herewith.
4. A landscaping, grading, lighting, amenities , trash storage, walkway layout,
and irrigation plan shall be submitted through the Design Review Process.
The building permit when issued shall include the grading, lighting, ameni-
ties, trash storage, walkways , swimming pool equipment, and irrigation systems.
No final inspection or occupancy shall be given by the Department of Environ-
mental Services to this project until the aforementioned approved plans and
construction shall have been completed.
5. Install a water system capable of delivering 2500 GPM fire flow for a two
(2) hour duration in addition to domestic or other supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the
supply main from which the flow is measured at the time of measurement.
6. Install Riverside County super fire hydrants so that no point of any build-
ing is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
a. Hydrants shall not be located closer than 25 feet to any building.
b. Exterior surfaces of hydrant barrels and heads shall be painted chrome

9. This approval shall be used within one (1 ) year of this action, otherwise
it shall become null and void and of no effect whatsoever. By "use" is
meant beginning of construction of a portion of the project.
10. Prior to utilization of this Development Plan, the applicant shall agree
in writing to any conditions of approval .
11 . The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
requirements, limitations, and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
II. SPECIAL CONDITIONS
1 . A wall six (6) feet in height shall be required along the full length of
the west property line and along the north property line where adjacent to
the C-1 Zone, design and materials as approved by the Design Review Board
process.
2. A minimum of three hundred and twenty (320) square foot private yard or
patio shall be provided for each dwelling unit.
3. Street trees, 40 feet on-center, shall be included in the design, with
Ficus retusa nitida (24" box) utilized.
4. A second, smaller recreational facility shall be provided in an area east
of the tennis courts, as approved by the Design Review Board process.
5. The existing lighting system on the tennis courts shall be replaced with
a system conforming to present design standards for height & external glare,
unless written evidence is provided by the applicant that such a replace-
ment is not desired by the present owners.
6. Applicant shall install..6 foot sidewalks, to City. Standards , on Shadow..
Mountain to the intersection with Tumbleweed.
7. Install safety lighting at the intersection of Shadow Mountain and Tumbleweed
as required by the City Engineer.
AGREEMENT
I accept and agree, prior to use of this permit or approval , to comply with all the
conditions set forth, and understand the Department of Building and Safety will not
issue a building permit or allow occupancy on the use permitted until this signed

Gentlemen:
Prior to construction of any of the proposed buildings,, the following
conditions must be met :
1. Install a water system capable of delivering 2500 GPM fire flow for
a two (2) hour duration in addition to domestic or other supply.
The computation shall be based upon a minimum of 20 psi residual op-
erating pressure in the supply main from which the flow is measured
at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along
approved vehicular travel ways .
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direc-
tion from each hydrant.

The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its ci---
rent tariffs as approved b7r the California Public Utilities Commission.
The developer will be required to deposit the full cost of these faciii—
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no expertise on the asthetic
impact of trenching and cannot comment on this subject except to state
that the distribution facilities will be placed in a joint trench with
other utilities wherever possible.

Request for approval of a Development Plan for a 20-unit residential con-
dominium, which will be the second and final phase of the Sandroc project
and which will be located on a 2.48-acre site on the north side of Shadow
( Mountain Drive and east of Tumbleweed Lane.
I Mr. Freed reviewed the case pointing out various requirements of the City
111 Engineer.
Chairman Berkey asked if the Commissioners had any questions. Being none,
he declared the Public Hearing open.
CURT DUNHAM, 73-210 El Paseo, Palm Desert, spoke to the Commission
regarding the conditions. He expressed his view that Standard Con-
dition No. 9 be deleted as it is covered in Condition No. 3, and re-
quested changes in Special Condition No. 1 , 4, and 5, and noted with
regard to Special Condition No. 5 that he doesn't own the adjacent
property.
Mr. Cipriani read a letter (Exhibit B 1-5) from the adjacent property owners
noting their concern for the lighting of the tennis courts.
Some discussion followed regarding the need for sidewalks and the water
drainage from Phase I to Phase II.
Chairman Berkey asked if there was anyone wishing to speak in FAVOR or in
OPPOSITION to the request. Being none, he declared the Public Hearing closed and
asked for a motion. Commissioner Snyder moved, Commissioner Kryder seconded that
the Commission approve Planning Commission Resolution No. 272 with the deletion of
Standard Condition No. 9, and changes to Special Condition No. 1 , 4, 5, and 6;
motion carried unanimously (3-0) .
VII . OLD BUSINESS - None
VIII. NEW BUSINESS
Commissioner Snyder asked that the staff, with the help. of the City Engineer
study the various codes in the City that cover; whether 32 foot roads are adequate,
vertical curbing on all new developments, restrictions on parking in downtown areas,
and other areas of concern with all the new development in the City.
Mr. Freed stated that a Staff Report would be prepared for a Study Session
in the near future.
Chairman Berkey asked for a motion on the above suggestion by Commissioner
Snyder. Moved by Commissioner Snyder, seconded by Commissioner Kryder that a staff
report be prepared; carried unanimously (3-0).
XI. DESIGN REVIEW BOARD ITEMS
A. Mr. Freed noted that the cases had been reviewed at the Study Session
prior to the meeting and asked if the Commissioners had any further
questions. Mr. Cipriani noted that Case No. 79MF had been withdrawn
by the applicant and the case would be deleted from the Resolution.
Being no questions Chairman Berkey asked for a motion to accept the
Design Review Board cases by Planning Commission Resolution No. 273
with the deletion of Case No. 79MF; moved by Commissioner Kryder,
seconded by Commissioner Snyder; carried unanimously (3-0) .

is interested in the probable impacts on the natural environment (e.g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals, parks, power generation, sewage treatment, etc. )
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 p.m. July 22 , 1977, in order to be
discussed by the Land Division Committee at their meeting of July 27th .
The Land Division Committee (comprised of Director of Environmental
Services, City Building Official , City Engineer, Fire Marshal and a'
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received by this office after

copies (I colored) of an accurate scale drawing of a site plan, floor
plan, and elevations, indicating:

- current uses of adjacent properties
- design of parking area
- colors and materials to be used in construction
- landscaping and irrigation plans
- location of streets, property lines, and easements
- topographic contour lines
6. The applicant shall provide a list of all owners of property located
within 300 feet of the exterior boundaries of the subject property.
This list shall be keyed to a map showing the location of these properties
and shall include the name and address as shown on the latest available
assessment role of the Riverside County Assessor's Office.
7. The applicant shall submit a completed Environmental Assessment form.
