I. DISCUSSION•
This project was formally owned by Mack Development, Inc. and foreclosed upon
and purchased by the above applicants. The development plan was approved on
September 4, 1979. The design review case approved on April 16, 1980. Extensions
were granted in 1980, 1981, and 1982. The associated tentative tract map which
was approved in 1979 has now expired and will have to be refiled.
The new applicants are asking for this extension due to the change of ownership.
They indicate they will soon begin working on beginning the project.
As you may recall, the planning commission recently denied an extension
for a residential conditional use permit approved in 1979, because of noncompliance
with current codes, especially those pertaining to building codes. Should you feel
this project falls within that same category, we would suggest you only deny the
design review process. This would allow the building design to be re-evaluated
based on current standards.
H. STAFF RECOMMENDATION:
Staff feels this request is acceptable and recommends approval of an extension to
September 4, 1984.

You may recall that you and I spoke briefly last Tuesday,
August 2, concerning the property which is the subject of the develop-
ment plan and architectural review approval described above. At that
time, I indicated that clients of this office were foreclosing on
that property and could soon become its owners .
The foreclosure sale took place—yes-ter-day--and—mac-U-ents-
Loma Linda Anesthesiology Medical Group , Inc. , Aquarius , and Johnny
J. and Carol E. Johnson, are now the record owners of the property.
From our discussion, it is my understanding that although
Tentative Tract Map No . 14996 has expired, both the development plan
and the architectural review approval may be extended for another
year beyond their September 4, 1983 , expiration. On behalf of my
clients , we ask the City to grant these extensions . Since we are
only now acquiring title to the property, it will take a good deal
longer than the September 4, 1983, expiration date in order to begin
working with this property.
If any appearance before Staff, the Planning Commission
or any other group will be necessary in order to pursue these exten-
sions , please notify this office right away.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
PRELIMINARY DEVELOPMENT PLAN TO ALLOW CONSTRUCTION
OF 116 CONDOMINIUM UNITS ON THE SOUTH SIDE OF
COUNTRY CLUB DRIVE, BETWEEN MONTEREY AVENUE AND
PORTOLA AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 4th day of September, 1979, hold a duly noticed
Public Hearing to consider a request by MACK DEVELOPMENT AND INVESTMENT CO.
for approval of a preliminary Development Plan to allow construction of j
116 residential condominium units on approximately 25 acres within the PR-5
(Planned Residential , max. 5 d.u./ac. ) zone located on the south side of
Country Club Drive, between Monterey Avenue and Portola Avenue, more par-
ticularly described as:

WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32" , in that the Director of Environmental Services has determined
that the project will not have a significant adverse impact on the environ-
ment and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring
to be heard, said Planning Commission did find the following facts to
justify their actions, as described below:
a. The proposed project generally conforms to the intent
and purpose of the PR Zone District.
b. The proposed project is adequately suited for the
specific site and is compatible with existing and
proposed development in the area.
c. The proposed project will not be detrimental to the
health, safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That the Planning Commission does hereby approve

Standard Conditions :
1. The development of the property shall conform substantially with
Exhibit A (Case No. DP 10 -79) on file with the Department of En- j
vironmental Services , as modified by the following conditions .
2 . Prior to the issuance of a building permit for construction of
any uses contemplated b this s approval , the applicant shall first �I
complete all the procedural requirements of the City which
include, but are not limited to, Design Review, Subdivision pro-
cess , and building permit procedures .
3. Construction of the total development may be done in phases ; how-
ever, each individual phase shall meet or exceed all Municipal
Code requirements to the degree that the City could consider each
phase as as single project.
4 . Construction of a portion of said project shall commence within
one year from the date of final approval otherwise said approval
shall become null, void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing
to these Conditions of Approval.
6. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
additions to all municipal ordinances and State and Federal Statutes {
now in force, or which hereafter may be in force. j
7. All existing electrical distribution lines , telephone, cable; an-
tenna television, and similar service wires or cables , which' are
adjacent to the property being developed shall be installed under-
ground as a part of development from the nearest existing pole
not on the property being developed.

8. All requirements of the City Fire Marshal shall be met as cart of j
the development of this project per attached letter dated August 14,
1979 .
9 . Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All conditions
shall be made a part of construction and no certificate of occu-
pancy shall be issued until completed.
10. Traffic control provisions shall be provided as required by the
Director of Public Works.
11. Curb, gutter, sidewalk or approved pathways , and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the Director of Public Works . j

12 . Prior to issuance of a building permit for construction of anv
use contemplated by this approval , the applicant shall first ob-
tain permits and/or clearance from the following agencies :
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies I III
shall be presented to the Dept. of Building and Safety at the
time of issuance of a building permit for the use contemplated
herewith.

R-2 , 8 , 000 , Conditional Use Permit to allow a 36 unit Planned
Residential Development, and a 38 lot Tentative Tract Map lo-
cated between Skyward Way and Homestead Road, and bounded on
the east by Arrow Trail (Chia Drive) .
Since there was a. lack of a quorum to consider this matter,
it was continued to the September 19 , 1979 meeting at 1: 00
P.M.
Commissioner Fleshman indicated a conflict and left the po-

C. Case N DP 10-79 and TT 14996 - MACK DEVELOPMENT AND
INVESTMENT . , Applicant
Request for approval of a preliminary Development Plan to
allow 116 dwelling units and tennis courts and a Tentative
Tract Map consisting of 118 lots on approximately 25 acres
within the PR-5 (Planned Residential, maximum 5 d.u./ac. )
zone located on the Soutside of Country Club Drive, between
Monterey Avenue and Portola Avenue.
Mr. Williams presented this case in detail stating that the
access points have been reviewed, that there is an emergency
access proposed to Country Club. It is felt that the recrea-
tional amenities proposed are in conformance with the City ' s
Zoning Ordinance. The Staff recommended approval of the de-
velopment plan by Resolution No. 523 subject to conditions .
Staff further recommended approval of the Tract Map by proposed
Resolution No. 524 subject to conditions.
There being no questions from the Commission, Chairman Snyder
opened the public hearing and asked if the applicant would like
to make a presentation.
INGRID MACK, 111 N. 5th Street, Redlands , refered to Page 4 ,
under Special Conditions , stating that it would be to the
benefit of she, as the applicant, and the owners to the east,
that this street be dedicated. She stated that there should
be no problem as far as obtaining an easement but that she
would like cooperation from the City in this matter if an
easement could not be obtained.
Chairman Snyder asked that she define what she meant by coop-
eration?
Ms . Mack stated that they would like to go ahead and develop
their side of the street and that the City should make sure
that when the owners to the east develop their property, they
are aware they must develop their portion of the street at
that time.
Mr. Williams explained that the City ' s Subdivision Ordinance
111 is quite specific as to the minimum width of 42 ft. so the
property owner either has to acquire an easement from the
adjacent property owner or provide the 42 ft. on their parcel
or said width must be provided on the subject property. Mr.
Beebe, Director of Public Works , was asked by Chairman Snyder
if the Staff has any flexibility in said ordinance? Mr. Beebe
replied by asking if the access rights were going to be denied
on Street "A"? If that is the case , then the 8 ft. parking
area may not be utilized.

Ms . Mack stated that she has no doubt that the easement can
be secured. Therefore, they will pursue development on that
basis.
BOB McFARLAND, 74075 E1 Paseo Suite A-7 , Palm Desert, of Bellew
and McFarland, Planners of the project, requested that under
Special Condition #2 , the figure be changed to a 10 ft. emer-
gency access only.
Chairman Snyder questioned Mr. Williams as to any objection
to this change? Mr. Williams suggested that a compromise be
made of 12 ft. This would also change Special Condition #6
on the Tract Map.
There were no questions from the Commission at this time,
therefore, Chairman Snyder asked if anyone present wished to
speak in FAVOR or OPPOSITION to the request. There being
none, Chairman Snyder closed the public hearing.
Upon motion made by Commissioner Berkey, seconded by Chairman
Snyder, Planning Commission Resolution No. 523 and No. 524
was adopted with the changes as previously mentioned. Car-
ried. 2-0-2-1. Commissioner Fleshman abstained.
D. Case No. DP 11-79 and TT 14998 - T & D CALIFORNIA INVEST-
MENTS, Applicant
Request for approval of a preliminary Development Plan to allow
22 dwelling units and recreational facilities and 26 lot Tenta-
tive Tract Map on approximately 5 acres within the PR-5 (Plan-
ned Residential, 5 d.u./ac. ) zone located at the southwest cor-
ner of Hovley Lane and Portola Avenue.
Mr. Williams presented this case stating that the applicant
requested that this case be continued in order that more modi-
fications can be made on this project.
Motion was made by Commissioner Berkey, seconded by Chairman
Snyder and carried, that this case be continued to September
19 , 1979 at 1: 00 P.M.
E. Case No DP 09-79 and TT 15000 - PACIFIC COAST BUILDERS ,
Applicant
Request for approval of a Residential Development Plan to
allow (upon annexation) construction of llll. condominium
units an 18 hole championship golf course, and a Tentative
Tract Map consisting of 1173 lots on 404 gross acres within
the PR-3 , S .P. (U.A. ) (Planned Residential , max. 3 d.u./ac,
Scenic Preservation Overlay, Upon Annexation) zone located
at the northeast corner of Cook Street and Country Club Drive.
Mr. Williams presented this case reminding the Commission
that this is a parcel that they previously considered for a
change of zone to PR-3 and a condominium development. He
stated that this has been refiled because of redesign. The
Staff feels that other than a few suggestions for improvement,
that overall this project is quite commendable. Suggestion
was made that the number of pools be increased to a ratio of
1 per every 35 units . Suggestion was also made that maybe
the location of the maintenance facility be reviewed, that
there may be a better location. He stated that the Fire
Marshal was very concerned about the long cul-de-sac . He sug-
gested in his memorandum that it be extended to make a loop
across the golf course. As an alternative, he was agreeable

Request for approval of a one year time extension of an approved
Preliminary Development Plan to allow 116 dwelling units and
associated recreational amenities on 25 acres within the PR-5
(Planned Residential , maximum 5 d.u./ac. ) zone generally located
on the south side of Country Club Drive, between Monterey Avenue
and Portola Avenue.
Mr. Sawa presented this case reviewing the Staff Report and explaining the
reasons .given by the applicant for this extension. He reviewed the original
proposed Development Plan and recommended approval .
Chairman Miller opened the Public Hearing asking if the applicant cared to
make a presentation.
INGRID MACK, 111 No. 5th Street, Redlands, explained that because of financial
reasons they are requesting this time extension.
Chairman Miller asked if there was anyone present who wished to speak in
FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed.
Motion was made by Commissioner Richards, seconded by Commissioner McLachlan,
to approve this time extension by adoption of Planning Commission Resolution No.
637. Carried unanimously (5-0).
B. Continued Case No. VAR 06-80 - QRS CORPORATION (for ANAHEIM SAVINGS),
Applicant
Request for approval of a Variance from Sign Ordinance standards
to allow three (3) main signs, one of which would be a freestanding
sign located within the C-1, S.P. ; (General Commercial, Scenic
Preservation Overlay) zone generally located at the southwest
corner of E1 Paseo and San Pablo Avenue.
Mr. Sawa presented this case stating that the Commission previously reviewed
this request and continued it for an alternative Sign Program. He explained that the
applicant is now requesting two wood signs 10" x 8' under the facia and a freestand-
ing wood sign 6'8" long by 3' high in a planter near the intersection of San Pablo
and E1 Paseo. Mr. Sawa stated that Staff did not feel there was justification for
three main identification signs and noted that it conflicts with the building's sign
program. Therefore, denial was recommended.
Chairman Miller opened the Public Hearing asking if the applicant cared to
make a presentation.
MR. BOB VAN GERPEN, 1002 Geneva Street, Glendale, explained what they were
proposing and described the size and location of the monument sign.
Commissioner Kryder asked the applicant if the two stores presently in that
building are in agreement with the proposed monument sign.
Mr. Van Gerpen replied that he did not know and explained that the entire
building will be used by the bank in the future.
Commissioner Kryder asked if the monument sign would be legal under these
circumstances. Mr. Crump replied that it would require a variance, at the present
time, and also when they were the only occupant, because the business was one of
many within the E1 Paseo Square center.
It was noted that E1 Paseo Square had freestanding center identification signs.
The Commission discussed with Staff possible combination of signs, freestanding,
wall and predestrian signs.

III. DISCUSSION:
A. Site Access - A primary feature of this development is
provision for a new street running south of Country Club
Drive. It will have the effect of reducing the number of
access points to Country Club while allowing entrance to
several properties. As the plans illustrate, this project
will have its entrance on the new street, necessitating
two travel lanes to be installed initially.
B. Site Design - Unit arrangement is around motor courts.
These modules of units and courts are rather ridgidly
laid-out, but changes in site grades would help the
appearance when actually constructed. Internal cir-
culation could be improved by providing a driveway
connection between two of the courts (between lot no.
102 and lot 103) .
C. Recreational Amenities - The project provides a central
recreation area containing a pool and four tennis courts.
The courts should be recessed to reduce their visual impact.
Four satelight pool areas are distributed in each quarter
of the site.
D. Architectural Approach - Buildings will incorporate hip
roofs with flat tile, and stucco wall . The applicant' s
architectural representative indicates that they will be
trying to achieve a modified version of the architecture
commonly found in Florida, rather than a repeat of a
Spanish approach.
E. Tract Map Considerations - While the filing of a Tract
Map can not be precluded, it is considered premature
until the Design Review process is completed. Therefore,
the map should be revised to reflect any subsequent changes
in the site design. A condition to this effect has been
included in the draft Resolution.
IV. STAFF RECOMMENDATION:
Based on the justification contained in the Resolution:
Approve DP 10-79 and TT 14996, subject to conditions, by adopting
Planning Commission Resolution Nos. _, and _, subject to conditions.

Project Objectives and Description
are; to-'create a balanced residential commun-
ity supported by .centralized recreational facilities ,
offering the privacy and security consistent with desert
living and;
To encourage pedestrian mobility within the com-
munity .while still maintaining ease of automobile access
for residents.
The project -:design meets these objectives in-the
following ways :
-The residential units within the community are
clustered around auto courts on one side providing the
ease of automobile access for residents while also being
oriented on the other side toward a common open space
which is part of a complete pedestrian system throughout
the project.
-The unit siting for the entire project is sym-
metrical in nature being balanced around a large central
recreational area. There are four smaller "satellite"
recreation areas all of which are linked to the larger
area by the pedestrian system increasing the ease of ac-
cess for residents.
-The privacy and security of this residential
project is maintained by the provision of a single access
point into the community which will be provided with a
security gate.
Phasing
The construction of this project will occur in
two phases . The first phase , scheduled to start in Jan-
uary of 19,80, will include 50% of the residential units
(58 units) two of the "satellite." recreation areas and .
the majority of the large central recreation area (exclud-
ing two of the four tennis courts) . Phase two will in-.
clude the remainder of the project and is scheduled to
begin in July of 1980.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 4th day of September, 1979, hold a duly noticed
Public Hearing to consider a request by MACK DEVELOPMENT AND INVESTMENT CO.
for approval of a preliminary Development Plan to allow construction of
116 residential condominium units on approximately 25 acres within the PR-5
(Planned Residential , max. 5 d.u./ac. ) zone located on the south side of
Country Club Drive, between Monterey Avenue and Portola Avenue, more par-

WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32" , in that the Director of Environmental Services. has determined
that the project will not have a significant adverse impact on the environ-
ment and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring
l to be heard, said Planning Commission did find the following facts to
l justify their actions, as described below:
a. The proposed project generally conforms to the intent
and purpose of the PR Zone District.
b. The proposed project is adequately suited for the
specific site and is compatible with existing and
proposed development in the area.
c. The proposed project will not be detrimental to the
health, safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That the Planning Commission does hereby approve

CONDITIONS OF APPROVAL

Standard Conditions :
1. The development of the property shall conform substantially with
Exhibit A (Case No. DP 10 -79) on file with the Department of En-
vironmental Services , as modified by the following conditions .
2 . Prior to the issuance of a building permit for construction of
any uses contemplated by this approval , the applicant shall first
complete all the procedural requirements of the City which
include, but are not limited to, Design Review, Subdivision pro-
cess , and building permit procedures .
3. Construction of the total development may be done in phases; how-
ever, each individual phase shall meet or exceed all Municipal
Code requirements to the degree that the City could consider each
phase as as single project.
4 . Construction of a portion of said project shall commence within
one year from the date of final approval otherwise said approval
shall become null, void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction . on said project, the applicant shall agree in writing
to these Conditions of Approval.
6 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
additions to all municipal ordinances and State and Federal Statutes
now in force, or which hereafter may be in force.
7. All existing electrical distribution lines , telephone, cable an-
tenna television, and similar service wires or cables , which are
adjacent to the property being developed shall be installed under-
ground as a part of development from the nearest existing pole
not on the property being developed.
8. All requirements of the City Fire Marshal shall be met as hart of
the development of this project per attached letter dated August 14.,
1979 :
9. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occu-
pancy shall be issued until completed.
10 . Traffic control provisions shall be provided as required by the
Director of Public Works .
11. Curb, gutter, sidewalk or approved pathways , and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the Director of Public works .
12 . Prior to issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first ob-
tain permits and/or clearance from the following agencies :

Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County water District
Evidence of said permit or clearance from the above agencies
shall be presented to the Dept. of Building and Safety at .the
time of issuance of a building permit for the use contemplated
herewith.

13. No development shall occur on the subject property prior to the

SPECIAL CONDITIONS:

of a 24 ft. wide driveway.
3. Recess tennis courts to a depth to be determined in the Design Review process.

City Council of the City of Palm Desert of the above described
Tentative Map No. 14996 for the reasons set forth in this
Resolution and subject to the attached conditions.
FURTHER, BE IT RESOLVED that the recommended conditions of approval
do include a requirement that the applicant pay in-lieu fees to comply with
the requirements of Article 26.48 of the City of Palm Desert Subdivision
Ordinance. In return, it is recommended that the City Council agree to use
said fees for park purposes in conformance with an adopted master plan,
within five (5) years of the recordation of the final map.

STANDARD CONDITIONS OF APPROVAL
CASE NO. TENTATIVE TRACT 14996
1. The development of the property described herein shall ' be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations , and restrictions
of all municipal ordinances and State and Federal statutes now
in force, or which hereafter may be in force.
2. Full public improvements including traffic safety lighting as
required by Ordinance and the City Engineer shall be installed
in accordance with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide
the Department of Environmental Services with a list of proposed
street names with at least three alternatives. The approval of
the final street name shall be made by the Director of Environmental
Services.
4. Access rights to Country Club Drive and proposed north-south street
(except for approved openings) shall be offered to the City as a
dedication on the Final Map.
5. The C.C. & R. 's for this development shall be submitted to the City
Engineer for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. Management and maintenance agreement to be entered into
with the owners of the units of the project.
6. Improvement plans for water and sewer systems shall meet the re-
quirements of the respective service districts.
7. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
9. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision
improvements by the City.
11. In order to maintain reasonable fire protection during the construction
Period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal .
12. Prior to recordation of the Final Map, the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review.
13. All requirements of the City Fire Marshal from his letter of August
14, 1979 shall be met as a part of the development of this tract.
14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system of Tract No. 14996 is in
accordance with the requirements prescribed by the City Fire Marshal.. "

15. Drainage shall be subject to approval of the City Engineer.
Applicant shall provide engineered data as requested.
16. All private streets shallbe inspected by the Engineering Depart-
ment and a Standard Inspection Fee shall be paid.
- 17. All requirements of the Planning Commission action on the Develop-
ment Plan 10-79 shall be met as a part of the development of this
Il tract.
18. The total number of lots shall be limited to 116 for condominium
unit use, and other lots for common purposes as deemed necessary.
19. The applicant shall have twelve (12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen (18)
months is granted by a Resolution of the City Council .
20. Drainage and Signalization Fund contributions as required by City
Ordinance shall be made prior to recordation of the Final Map.
21. Developer shall pay in-lieu fees for Park and Recreation purposes
to comply with the requirements of Article 26.48 of the City of
Palm Desert Subdivision Ordinance.
SPECIAL CONDITIONS:
1. Provide Right-of-way design as follows:
Country Club Drive - dedication and improvement of 55 ft.
half street. Half street section to contain one-half of
22 ft. raised center median (ultimate installation) , 36 ft.
wide travel lane, and 12 ft. wide public parkway with and
adjacent 20 ft. wide public access easement. Easement and
parkway to be developed with an 8 ft. wide meandary pedestrian/
bike path, ornamental landscaping, and tract boundary wall .
Proposed North-South Street - Secure easement from property
owner to the east, and install partial 60 ft. wide street
with 30' half street dedication, consisting of two 12 ft.
travel lanes, curb and gutter, and 10 ft. public parkway
(developed with a 5 ft. sidewalk adjacent to curb if required
by the Director of Environmental Services) .
Revise all street sections to agree with the above.
2. Provide a minimum 6 ft. high solid masonary wall , as approved
through the Design Review process, around the entire perimeter
of the tract (except for approved openings) .
3. Install safety street lighting at tract entrance and "A" street.
4. Subdivider shall pay $5,800 into the Signalization Fund, and
$1,500 per gross acre into the Drainage Fund of the City of
( Palm Desert.
I 5. The design of the tract entrance on "A" street shall provide
111 for the stacking of six vehicle on-site (out of the public
Right-of-way) .

Gentlemen:
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome ,yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 10-79 is in accordance with the
requirements prescribed by the Fire Marshal . "
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.

Mr. Williams presented this case in detail stating that the
access points have been reviewed, that there is an emergency
access proposed to Country Club. It is felt that the recrea-
tional amenities proposed are in conformance with the City ' s
Zoning Ordinance. The Staff recommended approval of the de-
velopment plan by Resolution No. 523 subject to conditions .
Staff further recommended approval of the Tract Map by proposed
Resolution No. 524 subject to conditions.
There being no questions from the Commission, Chairman Snyder
opened the public hearing and asked if the applicant would like
to make a presentation.
INGRID MACK, 111 N. 5th Street, Redlands , refered to Page 4 ,
under Special Conditions, stating that it would be to the ,
benefit of she, as the applicant, and the owners to the east,
that this street be dedicated. She stated that there should
be no problem as far as obtaining an easement but that she
would like cooperation from the City in this matter if an
easement could not be obtained.
Chairman Snyder asked that she define what she meant by coop-
eration?
Ms. Mack stated that they would like to go ahead and develop
their side of the street and that the City should make sure
that when the owners to the east develop their property, they
are aware they must develop their portion of the street at
that time.
Mr. Williams explained that the City ' s Subdivision Ordinance
- is quite specific as to the minimum width of 42 ft. so the
property owner either has to acquire an easement from the
adjacent property owner or provide the 42 ft. on their parcel
or said width must be provided on the subject property. Mr.
Beebe, Director of Public Works , was asked by Chairman Snyder
if the Staff has any flexibility in said ordinance? Mr. Beebe
replied by asking if the access rights were going to be denied
on Street "A"? If that is the case , then the 8 ft. parking
area may not be utilized.

Ms. Mack stated that she has no doubt that the easement can
be secured. Therefore, they will pursue development on that
basis.
BOB McFARLAND, 74075 El Paseo Suite A-7 , Palm Desert, of Ballew
and McFarland, Planners of the project, requested that under
Special Condition #2 , the figure be changed to a 10 ft. emer-
gency access only.
Chairman Snyder questioned Mr. Williams as to any objection
to this change? Mr. Williams suggested that a compromise be
made of 12 ft. This would also change Special Condition #6
on the Tract Map.
There were no questions from the Commission at this time,
therefore, Chairman Snyder asked if anyone present wished to
speak in FAVOR or OPPOSITION to the request. There being
none, Chairman Snyder closed the public hearing.
Upon motion made by Commissioner Berkey, seconded by Chairman
Snyder, Planning Commission Resolution No. 523 and No. 524
was adopted with the changes as previously mentioned. Car-
ried. 2-0-2-1. Commissioner Fleshman abstained.

Request for approval of a preliminary Development Plan to allow .
22 dwelling units and recreational facilities and 26 lot Tenta-
tive Tract Map on approximately 5 acres within the PR-5 (Plan-

ner of Hovley Lane and Portola Avenue.
Mr. Williams presented this case stating that the applicant
requested that this case be continued in order that more modi-
fications can be made on this project.
Motion was made by Commissioner Berkey, seconded by Chairman

E. Case No DP 09-79 and TT 15000 - PACIFIC COAST BUILDERS ,
Applicant
Request for approval of a Residential Development Plan to
allow (upon annexation) construction of 1111 condominium
units an 18 hole championship golf course, and a Tentative
Tract Map consisting of 1173 lots on 404 gross acres within
the PR-3 , S.P. (U.A. ) (Planned Residential, max. 3 d.u./ac,
Scenic Preservation Overlay, Upon Annexation) zone located
at the northeast corner of Cook Street and Country Club Drive.
Mr. Williams presented this case reminding the Commission
that this is a parcel that they previously considered for a
Ill change of zone to PR-3 and a condominium development. He
stated that this has been refiled because of redesign. The
Staff feels that other than a few suggestions for improvement,
that overall this project is quite commendable. Suggestion
was made that the number of pools be increased to a ratio of
1 per every 35 units. Suggestion was also made that maybe
the location of the maintenance facility be reviewed, that
there may be a better location. He stated that the Fire
Marshal was very concerned about the long cul-de-sac. He sug-
gested in his memorandum that it be extended to make a loop
across the golf course. As an alternative, he was agreeable

CONDITIONS OF APPROVAL
CASE NO. DP 10.-79
Standard Conditions:
1. The development of the property shall conform substantially with
Exhibit A (Case No. DP 10 -79) on file with the Department of En-
vironmental Services , as modified by the following conditions .
2 . Prior to the issuance of a building permit for construction of
any uses contemplated by this approval, the applicant shall first
complete all the procedural requirements of the City which
include, but are not limited to, Design Review, Subdivision pro-
cess , and building permit procedures .
3. Construction of the total development may be done in phases ; how-
ever, each individual phase shall meet or exceed all Municipal
Code requirements to the degree that the City could consider each
phase as as single project.
4 . Construction of a portion of said project shall commence within
one year from the date of final approval otherwise said approval
shall become null, void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing
to these Conditions of Approval.
6 . The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
additions to all municipal ordinances and State and Federal Statutes
now in force , or which hereafter may be in force.
7. All existing electrical distribution lines , telephone, cable an-
tenna television, and similar service wires or cables , which are
adjacent to the property being developed shall be installed under-
ground as a part of development from the nearest existing pole
not on the property being developed.
8 . All requirements of the City Fire Marshal shall be met as Dart of
the development of this project per attached letter dated August 14,
1979.
9 . Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All conditions
shall be made a part of construction and no certificate of occu-
pancy shall be issued until completed.
10 . Traffic control provisions shall be provided as required by the
Director of Public Works .
11. Curb, gutter, sidewalk or approved pathways, and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the Director of Public Works.
12 . Prior to issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first ob-
tain permits and/or clearance from the following agencies :
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies
shall be presented to the Dept. of Building and Safety at the
time of issuance of a building permit for the use contemplated
herewith.

California, did on the 4th day of September, 1979, hold a duly noticed

structed the applicant to check the private deed restric-
tions to insure that the garden entry did not encroach
into the non-buildable area.
On a motion by Leung, seconded by Jackson, the Board
continued this item until September 25, 1979 with the
applicant to contact the original architect and to
provide plans which will be architectually compatible
with the existing building.
