Dear Mr. Krause:
Investigation has revealed that two problems exist, on the property which
your corporation has submitted plans for development.
The property in question is located at Fairhaven & Parkview, Palm Desert.
First be advised that a construction trailer" has been placed on the property
without a permit. This must be removed or a permit obtained within ten (10)
days. Second, a large amount of asphalt paving has been dumped on the property,
by Reseborough Backhoe Service. The operator of the dump truck was cited
per our request by the Riverside Sheriff's Department. The truck operator
claimed that he had permission to dump the asphalt at the location, to be used
as fill once grading started. He was advised that asphalt paving was not ap- _
proved in the City of Palm Desert as fill . This man claimed to be sub-contracting
for your company and had grading prints indicating where the asphalt was to be
dumped. This problem must be resolved before any further action will be taken
by the City towards approval of your project.

H. DWELLING UNIT DESCRIPTION:
51, 2 bedroom, 2 bath units; ranging in size from 1,113 sq. ft. to
1,432 sq. ft.
I. PARKING ANALYSIS:
- Required parking, 2 covered spaces per unit, plus 0.5 open guest
spaces per unit (total 128 required).
- Proposed parking, 2 garage spaces per unit, 29 open guest bays ,
plus parking on one side of a 32 ft. wide private street, and 6
screened storage parking spaces.
III. DISCUSSION:
A. PROJECT DESIGN - features duplex to fourplex buildings served by a
perimeter internal private loop street, with a water element run-
ning through the interior of the project. Access is by means of
Parkview Drive, and an emergency entrance is located on Fairhaven
Drive.
B. ARCHITECTURAL DESIGN - representative elevations have been submitted
to depict the architectural approach. While the unit floor plan is
based on a single story, the roof design incorporates a "clear story"
providing for a variation in roof elements and hei`glit,to 18 ft.
C. DESIGN REVIEW - the project exhibits were discussed with the Design
Review Board, for purposes of providing input to Staff. Members of
the Board ._indicated that they,would prefer to see the lake area width
reduced,.-.with units, jogged in_'an'd'out more.
Realizing that the residential land area within the City is fixed,
attention should be turned to creating a unique environment within
each project on the remaining lands. Imaginative design is particu-
larly important in the smaller scale development. Staff considers
the conceptual design of the subject project to comply with that
objective.
D. FAIRHAVEN DESIGN - a couple alternatives exist with regard to the
street design, as follows :
a. Provide a knuckle as shown on the subject site plan; or
b. Continue Fairhaven Drive north to intersect with Parkview
Drive; and, cul-de-sac the existing connection.
There are pros and cons for each alternative. Alternative "a"
would forego the opportunity to improve the intersection design.
Alternative "b" would allow a more clearly defined access between
Parkview Drive and 44th Avenue, which may result in its use as an
alternative route for traffic circulating to the Regional Shopping
Center site via E1 Paseo (extended) .
The most appropriate choice of designs is also contingent upon how
and when the properties to the east of the site develop (cul-de-
sacing proposed in "b", may or may not be practical ). Staff has
selected to recommend (in Special Condition No. 3) a reservation
for a future connection; it could then determine whether it was
practical to implement based on plans for development of the adja-
cent property.

IV. STAFF RECOMMENDATION:
Based on the justification contained in the Resolution:
Approve DP 13-79, by adopting Planning Commission Resolution No. 544 ,
subject to conditions.
PLANNING COMMISSION RESOLUTION NO. 544
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A RESIDENTIAL DEVELOP-
MENT PLAN, TO ALLOW CONSTRUCTION OF 51 CONDOMINIUM UNITS
LOCATED WEST OF FAIRHAVEN DRIVE AND SOUTH OF PARKVIEW
DRIVE.
CASE NO. DP 13-79
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 30th day of October, 1979, hold a duly noticed
Public Hearing to consider a request by San Clemente Group Development
Corp. for approval of a Development Plan to allow construction of 51
condominium units on approximately ten (10) acres within the PR-7, S .P.
(Planned Residential , maximum 7 d.u./ac. , Scenic Preservation Overlay)
zone located west of Fairhaven Drive .and south of Parkview Drive, more
particularly described as :

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
78-32" , in that the Director of Environmental Services has determined that
the project will not have a significant adverse impact on the environment
and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring to
be heard, said Planning Commission did find the following facts to justify
their actions, as described below:
a. The proposed project generally conforms to the intent and/,
purpose of the PR Zone District.
b. The proposed project is adequately suited for the specific
site and is compatible with existing and proposed development
in the area.
c. The proposed project will not be detrimental to the health ,
safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. That the Planning Commission does hereby approve conceptual
Development Plan No. 13-79 (Exhibit A) subject to those
conditions attached hereto.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 30th day of October, 1979, by the

CONDITIONS OF APPROVAL
CASE NO. DP 13-79
Standard Conditions :
1. The development of the property shall conform substantially with
Exhibit A (Case No. DP 13-79) on file with the Department of Environ-
mental Services , as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any
uses contemplated by this approval , the applicant shall first complete
all the procedural requirements of the City which include, but are not
limited to, Design Review, Subdivision process, and building permit
procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code require-
ments to the degree that the City could consider each phase as a
single project.
4. Construction of a portion of said project shall commence within one
year from the date of final approval otherwise said approval shall
become null , void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing to
these Conditions of Approval .
6. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addi-
tions to all municipal ordinances and State and Federal statutes now
in force, or which hereafter may be in force.
7. All existing electrical distribution lines , telephone, cable antenna
television, and similar service wires or cables, which are adjacent
to the property being developed shall be installed underground as a
part of development from the nearest existing pole not on the property
being developed.
8. All requirements of the City Fire Marshal shall be met as part of the
development of this project per attached letter dated October 12, 1979.
9. Construction plans shall be submitted for approval to the City Fire Mar-
shal prior to issuance of building p u g permits. All conditions shall be
made a part of construction and no certificate of occupancy shall be
issued until complete.
10. Traffic control provisions shall be provided as required by the
Director of Public Works.
11. Curb, gutter, sidewalk or approved pathways , and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works.
12. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies :
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Department of Building and Safety at the time of
issuance of a building permit for the use contemplated herewith.

13. No development shall occur on the subject property prior to the
recordation of a tract map.
SPECIAL CONDITIONS:
1. Perimeter streets shall be developed with full improvements to
achieve the following:
a. Parkview Drive, 44 ft. half street width; and
b. Fairhaven Drive, 33 ft. half street width.

AGREEMENT
I accept and agree, prior to use of this permit or approval , to comply
with all the conditions set forth, and understand that the Department L
of Building and Safety will not issue a building permit or allow occu-
pancy on the use permitted until this signed confirmation has been
received by the Department of Environmental Services.

Reference: Case No. DP 13-79
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two
(2) hour duration in addition to domestic or other supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular travel
ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) , shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval , one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification : "I certify that the design
of the water system in Case Number OP 13-79 is in accordance with the require-
ments prescribed by the Fire Marshal . "

(1 ) It is recommended that safety street lighting be installed at the entrance
off of Parkview Drive and approved by the Director of Public Works.
(2) This development shall pay the required drainage and park fees to the City
of Palm Desert.
(3) This development shall pay $2,550 into the signalization fund of the City
of Palm Desert.
(4) Full street improvements shall be required along Parkview and Fairhaven
Drives.
(5) The right of way shall be dedicated to make Parkview Drive a 44 foot width
for one-half street.
(6) Fairhaven Drive shall be dedicated for a 66 foot street -- 33 foot one-half
street.
(7) It is recommended that Fairhaven Drive be extended to Parkview Drive.

Request for approval of a Parcel Map to consolidate
two (2) lots into one parcel on approximately .52
acres within the R-2, S.P. (Single Family Residential
Scenic Preservation Overlay) zone generally located
at the Northwest corner of San Gorgonio and San Pablo
Avenues.
Mr. Crump presented this case explaining why it would be necessary
to dedicate and improve the right-of-way on San Pablo. If this was
satisfied the request would be acceptable. He then reviewed the conditions.
Chairman Snyder opened the Public Hearing asking if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none,
the Public Hearing was closed.
Upon motion made by Commissioner Berkey, seconded by Commissioner
Kryder, case No. PM 15550 was approved by adoption of Planning Commission
Resolution No. 542. Carried unanimously (5-0) .
H. Case No. TT 15366 - SILVER SPUR ASSOCIATES, Applicant
Request for approval of a Tentative Tract Map to subdivide
an administrative and models complex within Ironwood
Country Club located at the southeast corner of Irontree
Drive and Mariposa Drive.
Mr. Crump described the purpose of the map, which was to define
lots for existing models, proposed models, and future models and also for it
the administration sales complex. He pointed out on the map the access
to the proposed models through the administration building.
Commissioner Fleshman left the room at this time because of a
conflict of interest.
Chairman Sndyer asked if.the applicant cared to make a presentation.
LARRY SPICER, 49-200 Mariposa Drive, gave a short presentation for
this request.
Chairman Snyder declared the Public Hearing open asking if anyone
present wished to speak in FAVOR or OPPOSITION to this case. There being
none, he declared the Public Hearing closed.
On a motion made by Commissioner Miller, seconded by Commissioner
Berkey, case No. TT 15366 was approved by Planning Commission Resolution
No. 543, subject to conditions. Carried 4-0 (Commissioner Fleshman
Abstained)
Commissioner Fleshman returned to the Council Chambers at this time.

Mr. Crump presented this case noting that this request has received
a Negative Declaration. He then used the illustrations in describing
the areas to the north, south, east and west of the project. He reviewed
the staff report describing what would be involved in the development of
this project. He stated that the Design Review Board reviewed these
drawings and noted that they preferred to see the water element reduced.
He concluded by reviewing the alternatives of the proposed Fairhaven Street.
Chairman Snyder asked if the applicant cared to make a presentation.
MR. BOB CRAUSE, San Juan Capistrano, Developer, stated that the
Engineer for the project was present for any questions.
Chairman Snyder declared the Public Hearing open asking if anyone
present wished to speak in FAVOR or OPPOSITION to this case. There being
none, the Public Hearing was closed.
A short discussion proceeded on what might be developed on the
west side of the project.
Commissioner Fleshman asked Mr. Crause if he understood the
Design Review Board's condition regarding the reduction of the lake.
Mr. Crause replied stating that there would be no problem in
reducing the size of the lake.
Upon motion made by Commissioner Fleshman, seconded by Commissioner
Kryder, this case was approved by adopting Planning Commission Resolution
No. 544, with Special Condition Nos. 2 and 3 deleted. Carried unanimously
(5-0).

IX. DESIGN REVIEW BOARD ITEMS
A. Consideration of cases action on by the Design Review
Board at their meeting of October 23, 1979.
Mr. Sawa presented this case stating the Design Review Board
approved a guard house located at the westerly end of Portola Avenue
just west of Mesa View Drive, and this guard house is similar to the one
at the entrance of Mariposa Drive. He concluded by recommending approval .
Upon motion made by Commissioner Berkey, seconded by Commissioner
Kryder, this case was approved by Planning Commission Resolution No. 545.
Carried (4-0) , Commissioner Fleshman abstained.
_- B. Security Pacific Site
Mr. Sawa presented this case noting that this was only a discussion
item. He stated that this site was reviewed and approved by the ORB and
subsequently denied by the Planning Commission and City Council . The applicant
has now submitted a revised plan that will provide a retail building and bank
with a drive-thru with egress to Portola Avenue. He stated there would also
be a driveway on Larrea and Prickly Pear Lane. He then asked for input from
the Commission.

standards of this article; economic feasibility studies and other
studies as required by the City.

Dear Sirs:
The San Clemente Group Development Corporation is proposing a 51 unit townhouse
community, The Waterworks. All units front on a manmade lake that meanders
through the center of the site providing a focus for the project. The lake
concept is intended to create a cool, tranquil environment that increases the
sense of privacy. The density of the project is also less than the maximum
allowable, adding to the feeling of openness. All townhouses are passive solar,
one story buildings with heavy box outs, blue tile roofs, and attached covered
parking. In addition to the lake, there are numerous recreational amenities
such as tennis courts, raquet ball courts, 2 swimming pools and 2 jacuzzi.
A security gate system and information booth for guests are located at the
entrance on Parkview Drive. Convenient guest parking is provided throughout
the project.
The Preliminary Development Schedule for The Waterworks will be in two
phases. Phase I will begin May 1980 and will include 28 units. The remaining
23 units will be built in Phase II with a final completion date of August 1981.
