CASES Case No. 191 MF - PDV LIMITED, dba SHADOW MOUNTAIN RESORT AND RACQUET CLUB - approval to replace existing tennis court lighting and place new lighting on additional courts on the east side of San Luis Rey at Juniper Circle; Ron Miguel was present. The Board discussed the type of lighting which was proposed to be used for this project. The applicant stated that the project would be a two-year phased project. The Board reviewed the phasing of the project as presented by the submitted plan. Two features of the project which were not previously reviewed were the signing and exterior lighting plan. Therefore, the Staff is submitting these items for your review. STAFF ANALYSIS: The Board should review the submitted exhibits and determine acceptability. With regard to the lighting plan, the proposed tennis court lighting should be replaced with a black box type of lighting which will minimize glare and spillover. With regard to the signing, the applicant has presented three alternatives for the project identification signs. Staff recommends that the letters mounted on the walls be utilized. The development of the property shall conform substantially with Exhibit A (Case No. DP 14-79) on -file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval , the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permit procedures. 3. . -Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code require- ments to the degree that the City could consider each phase as a single project, 4. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null , void and of no effect whatsoever. 5. Prior to the issuance of any City permits for the commencement of construction on said project, the applicant shall agree in writing to these Conditions of Approval . 6. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in additions to all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 7. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are adjacent to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property, being developed. 8. All requirements of the City Fire Marshal shall be met as part of the development of this project per attached letter dated November 27, 1979. 9. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. Traffic control prov.isions shall be provided as required by the Director of Public Works. 11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the Director of Public Works. 12. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: L Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley County Water District Evidence of said permit or clearance from the above agencies shall be presented to the Dept. of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 13. No development shall occur on the subject property prior to the record- ation of a tract map. PLANNING COMMISSION RESOLUTION NO. 557 Page -3- SPECIAL CONDITIONS 1. A number of units on the cul-de-sacs do not provide a 20 foot deep clear parking apron. These units shall be redesigned in order to provide that 20 foot deep apron, without access conflicts. 2. The perimeter wall along Portola Avenue and Hovley Lane should be set back an average of 20 ft. from the property line with a distance of less than 20 ft. permitted for the wall as presently shown on the plot plan. 3. Along the westerly property line, a minimum 30 foot distance between .property line and dwelling units should be provided for blowsand protection, as approved through the Design Review process . 4. The meandering pedestrian-bikeway path is required to be 8 ft. wide with the path to be a minimum of 4 ft. from'curb line. 5. East, west, and south elevations shall be restudied to provide solar protection for glass areas with cross sections submitted with final working drawings showing sun penetration plotted for June 21; design of landscape plan to also consider providing solar protection. 6. Eliminate golf cart doors to provide visual relief for large expanses of wood doors where feasible. . 7. Undulate building setbacks for units on north side of road which connects east and west portions of project. 8. In areas where only a jacuzzi is shown, add swimming pool (minimum size 20'x4O' ) . 9. Where feasible, undulate building setbacks for units fronting on cul-de- sacs. 10. Provide enriched street paving in cul-de-sacs and at project entrances , with enriched paving optional at private intersections. 11. Avoid use of Albizzia Julibrissin, Magnolia St. Mary, and Platanus Acerifolia, and concentrate on utilizing evergreens. l AGREEMENT I accept and agree, prior to use of this permit or approval , to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) , shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification : "I certify that the design of the water system in Case Number DP 14-79 is in accordance with the requirements prescribed by the Fire Marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. XI David J. Ortegel Fire Marshal DJO:dt MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 4, 1979 Page -5- Chairman Snyder stated that the solution would be to create a condition to provide for the required covered spaces with a bond specifying that it would be done within a one year period, but if at the end of the one year period it was determined that the covered spaces were not necessary they would not require it. Mr. Williams then added to Special Condition No. 1: "The applicant may bond for the installation of the additional covered parking within one year of the recordation of the Final Map. " Chairman Snyder open the Public Hearing asking if anyone wished to speak if FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed. Upon motion made by Commissioner Berkey, seconded by Commissioner Kryder, Case Nos. TT 15734 and TT 15735 were approved by adoption of Planning Commission Resolution Nos. 555 and 556, as amended. Carried unani- mously (4-0) . G. Case Nos. DP 14-79 and 189 MF, KENT LAND CO. , Applicant Request for approval of a Planned Residential Development and Preliminary Design Review case to allow construction of 134 condominium units on approximately 29.7 gross acres within the PR-5 (Planned Residential District, Max. 5 d.u./ac. ) zone, located at the northwest corner of Portola Avenue and Hovley Lane. Mr. Williams presented this case with a review of the proposed accesses. . He added that there was some question as to the setbacks between the buildingsthat had to be resolved.The Design Review Board recommended approval with Special " Condition requirements. He then reviewed the conditions and recommended approval with the suggested revisions. Commissioner Berkey asked Mr. Williams what the required distance was between the structures. Mr. Williams stated that the ordinance suggests it be 20' but the Commission had reduced it to 15 ft. in similar uses as was being requested. Commissioner Berkey asked if the grading on Hovley Lane would be leveled? Mr. Williams stated the engineer was present to answer%ny questions relative to the grading and drainage. Chairman Snyder asked if the applicant cared to make a presentation. JOHN ABEL, Representative, 18902 Bardeen Way, Irvine, introduced Mr. Fitch, the engineer. BILL FITCH, Engineer, Wallach & Associates, stated that . Hovely Lane would be rebuilt and explained in detail how this would be done. Chairman Snyder asked Mr. Fitch if they were considering proper drainage in that area. Mr. Fitch replied that being the first project in that area they were aware of the drainage problem. They do have a ( proper drainage system and felt it would benefit other future projects. I Commissioner Miller asked where would the water drain to on the L west side. Mr. Fitch explained specifically stating it would go two ways, west and then east. Mr. Williams noted the drainage for the north sphere area would be discussed at the next study session meeting. Chairman Snyder opened the Public Hearing asking if anyone present wished to speak in FAVOR or OPPOSITION to this case. DP 14-79 and 189 MF were approved by adoption of Planning Commission Resolution No. 557, subject to conditions. Carried unanimously (4-0) . THERE WAS A 10 MINUTE BREAK -- THE MEETING RECONVENED AT 8:55 P.M. H. Case Nos. C/Z 09-79 and DP 15-79 (Upon Annexation) , MAYER GROUP, INC. , Applicant. Request for approval of a Change of Zone from R-1, 12,000 (River- side County Zone) to PR-7 (U.A. ) (Planned Residential District, Max. 7 d.u./ac.) (Upon Annexation) or other zone as deemed appro- priate, and approval of a Planned Residential Development to allow construction of 264 condominium units and nine acre public park on 39. 1 gross acres, located at the northeast corner of Country Club Drive and Monterey Drive. Mr. Williams presented this case with a short review of the staff report. He used the map illustrations to point out the design and features which included a public park, bicycle/pedestrian system, pool areas, and a variety of sizes of units. The Design Review Board had made suggestions to the design of the park. He also pointed out that the density was high but the project was a unigue one. The County of Riverside submitted a concern and also felt the density was too great. Mr. Williams added that the County thought the density should be restricted to 4.5 dwelling units per acre. Another issue was the park development, it was suggested the park be improved. He concluded stating that this project was unique and recommended approval . Commissioner Berkey was very concerned on the density matter. He stated that he needed very strong justification to approve this. Mr. Williams explained that he felt they had provided an amenity for the area, the design was unique, and also felt it was compatible to the areas surrounded. Commissioner Berkey stated that if this were for rental housing he would be favorable for it but for condominiums he was not. Commissioner Miller pointed out that the project was not within the five mile limit for the fire department. Mr. Williams pointed out the fire station was programed for two years on a site to the east. Chairman Snyder asked if the applicant cared to make a presentation. STEVE FLESHMAN, 74-075 E1 Paseo, stated he was aware of that they were not within the five mile limit but pointed out that the situation would change in the future when the new Fire Station is constructed. He added that this parcel would be the only one that is not a Mobile Home Park in the area. He further stated that the City needed the park site. He concluded that these units would be at an affordable price and introduced Mr. Ballew. JOHN BALLEW, Ballew-McFarland, added to Mr. Fleshman's comments stating that the developer agreed to dedicate the entire parcel but did not know the cost. He agreed with the conditions but wanted Condition No. 2 to be clarified to indicate specific responsibility of the applicant regarding the park. Commissioner Kryder commented on how well the project was designed and did not agree the area needed to be upgraded. Staff reviewed the items of concern brought up by the Design Review Board at the study session. Additionally, the applicant questioned Staff revision No. 3 pertaining to the minimum 30 ft. distance for . blowsand protection. Applicant stated that it would be difficult to provide the minimum 30 ft. requested. After discussion on this item, it was generally decided that the smaller units should be utilized in these areas and the outside activity should be orientated to the side as opposed to the rear. Additionally, denser landscaping could also be utilized in these areas. Staff revision No. 4 was also discussed with it ultimately being decided that the 8 ft. width for the bicycle/ pedestrian path should be maintained. On a motion by Holden, seconded by Johnson, the Board granted prelimi- nary approval of this project, subject to the following revisions : 1. A number of units on the cul-de-sacs do not provide a 20 foot deep clear parking apron. These units shall be redesigned in order to provide that 20 foot deep apron, without access conflicts . 2. The perimeter wall along Portola Avenue and Hovley Lane should be set back an average of 20 ft. from the property line with a distance of less than 20 ft. permitted for the wall as presently shown on the plot plan. i 3. Along the westerly property line, a minimum 30 foot .distance between property line and dwelling units should be provided for blowsand protection, as approved through the Design Review process. 4. The meandering pedestrian-bikeway path is required to be 8 ft. wide with the path to be a minimum of 4 ft. from curb line. 5. East, west, and south elevations shall be restudied to provide solar protection for glass areas with cross sections submitted with final working drawings showing sun penetration plotted for June 21; design of landscape plan to also consider providing solar protection. 6. Eliminate golf cart doors to provide visual relief for large expanses of wood doors where feasible. 7. Undulate building setbacks for units on north side of road which connects east and west portions of project. 8. In areas where only a Jacuzzi is shown, add swimming pool (minimum size 20'x4©' ) . 9. Where feasible, undulate building setbacks for units fronting on cul-de sacs. 10.
