HomeMy WebLinkAboutColonnade Bldg One a paw { a PREST - VUKS(C :DECEIVED Colonnade Pf-- I I N't Building One aY0 PALM0E E T Palm Desert, CA 92260 Sign and Awning Program Sign Program: The purpose of the Sign Program is to ensure:design,production,implementation,consistency,quality coordination,proportion, enhancement,image compatibility between all signs within the Sign Program area. As such,the Sign Program is intended to address placement,color,style,sign material,and their consistency on the property. This program also serves to communicate particular tenant sign parameters to compliment the project as a whole,while achieving a unified,attractive balanced appearance. Although the Sign Program exhibits established letter and sign dimensions,all signage shall comply with applicable provisions of the Zoning Ordinance and land use plans of the City of Palm Desert. Applicability: A sign program is a coordinated sign plan for an individual building or a group of buildings. For those buildings requiring a program,no permit shall be issued for an individual sign unless and until a Sign Program for the lot on which the sign will be erected has been submitted and approved by the City in conformance with the City of Palm Desert Sign Ordinance. General Requirement,Standards and/or Provisions: All signs shall be constructed,installed and maintained in accordance with the following standards: L All sign(s)shall comply with the Sign Program,current local zoning,meet with the provisions of the Uniform Building and electrical codes,be maintained in good structural condition and appearance,and MUST be Underwriters Laboratory(U.L.)and BEAR the U.L. listing. 2. The tenant,the tenant's agent and/or the tenant's sign contractor and/or general contractor shall be responsible for obtaining any and all permits required. 3. Former tenant(s)shall be responsible for the removal of the signage,including:sealing patching,painting,and electrical disconnect(s). Removals to be completed within a 10(ten)day period of lease termination at the tenant's expense. It is required that you use a sign contractor for signage and signage component removal and electrical disconnect,and a painting contractor for finishing and painting work. All repair work must match the building color and texture. Working area must be left in a neat and clean condition. 4. No audible,flashing,animated,moving,pulsating,electronic and/or search lighting or similar sign(s)not specifically mentioned herein shall be permitted. 5. A permit must be obtained from the City of Palm Desert Planning Department for all new wall signs. Building permit fees may also apply depending on the type of sign installed. 7. No exposed raceways,crossovers,conductors,wiring,or junction boxes. Transformer boxes will be used to cover and/or conceal transformers. All bolts,fastenings,and clips shall be non"rust prone"and painted to match the exterior building color permitted. a. Except when the designated sign location(s)has support beams,no access,and/or a non-working and/or building inspector area behind the designated sign location,a race way may be incorporated if the raceway is designed to be an architectural element that is aesthetically pleasing. 8. Sign Contractor must have the following: General Liability Insurance,Workers Compensation,Contracting and City Business License. Tenant will be responsible for its sign contractor to indemnify,defend and hold harmless the Landlord and its agents from any damage or liability resulting from the contractor's work. Tenant will also provide adequate evidence of the contractor's insurance coverage,naming the Landlord as additional insured. 9. Sign labels that pertain to construction and installation shall be permitted and placed in a conspicuous location for inspections and/or emergencies. 10. Penetrations of the building structure required by installation(s)shall be neatly scaled in a"water tight"condition and painted to match exterior surface. I I. Sign(s)shall have access and/or adequate"crawl space"for inspection(s)and servicing. 12. No live and/or simulated animals or humans may be used as a sign. 13. No sign(s)shall be permitted that pose a nuisance or hazard. 14. No exposed lamps,tubing,and/or bulbs,shall be permitted. Exposed open pan neon is permitted with Landlord and City of Palm Desert approvals. 15. Temporary identification signs such as:construction,developer,seasonal promotions and/or compliance non- illuminated advertising displays permitted as per Palm Desert City Code. Some time restrictions may apply. 16. The tenant will be responsible for the maintenance of their sign(s). Repairs may be required within 30(thirty)days of repair/servicing. If not mitigated within 30(thirty)days,the Landlord may repair and/or service the sign at the tenant's expense. 17. Owner shall reserve the right to have architectural control over all signage and awnings. 18. Sign contractor to obtain structural construction documents and visit project site to confirm shear wall locations prior to installing signage.No penetrations of any kind in existing shear walls will be allowed without Architect of Record's review/approval and written documentation approving location or locations and sizes of penetration by a Structural Engineer licensed in the State of California. 19. No signage or awning may be attached to the building's aluminum storefront window frames. Tenant is responsible for protecting these storefront frames in place,if damaged or if hole penetrations are made,Tenant will be responsible to replace these frames at Tenant's cost. 20. Where permanent metal eyebrows exist at the southeast and the northwest corners of the building over the first floor, signs may be mounted along the face of this eyebrow. These signs should be individually mounted letters. 21. Blade signs for the second floor restaurant will be permitted in the locations shown on the attached building elevations. 2 r Colonnade Sign and Awning Program Building Signs: 1. Signs shall be individual mounted illuminated Reverse ChanneU"Halo-Lit"lettering,pan channel lettering or exposed open pan neon.All other letter styles as approved by landlord and City. 2. Reverse Channel lettering and logo(s)to be fabricated from aluminum,formed into a pan Channel configuration with approximately 2"—4"return and"pinned"off the building fascia approximately 1 ''/z". 3. Tenant signs shall include the business name only as registered on the lease agreement. 4. Lettering to be single line or double line copy in locations shown on elevations. 5. Sign illumination may range to 4500 neon or equal with 30MA transformers. LED may be used in place of neon. 6. Lettering referenced herein shall be consistent with tenant's national branding identity. Signage may be any color approved by the Landlord and the City that is considered complementary to the color palette of the building.The Landlord reserves the right to alter the hue of any color to make it more subdued. Logos referenced herein shall be aesthetically tasteful and subject to approval by landlord and City of Palm Desert. 7. Tenant(s)with nationally recognized lettering and/or logo(s)LE.,trademarks and/or franchises must provide the Landlord and sign contractor copies for permitting. The tenant is responsible for conformance to signage area allocations and must be approved by the Landlord and the City Of Palm Desert. *SEE PROVISIONAL CLAUSE 8. Sign lettering square footage shall not exceed size allowed by the City of Palm Desert sign ordinance. 9. Signage to stay within designated area as shown on elevations. 10. See exhibits for material and location requirements. 11. Signs and logos to stay within the zones outlined on the attached exhibits. 12. A tenant may have a maximum of I (one)sign on any building elevation in which the tenant occupies space(see attached exhibits). 13. Signage to stay within designated area as shown on exhibits. Color: 1. Tenants with established trademark logo graphics may utilize their custom colors upon approval by the Landlord and the City of Palm Desert. 2. Tenants without established graphics must select from the following colors: a. All color options are possible but the Landlord and the City of Palm Desert reserve the right to require that colors be muted,if it is determined that this is to the benefit of the tenant mix as a whole. For example,a bright red color could be required to be rust color. b. Channel letter returns are to match the face color unless otherwise approved by the Landlord and City for aesthetic effect. C. Additional colors for accent vinyl applications on tenant's signs will be acceptable provided the color represents less than 25%of the total size of the sign,subject to approval by the Landlord and the City of Palm Desert. 3 Colonnade Sign and Awning Program Window Signs (Secondary) 1. Each tenant is allowed one(1)information sign at the entry to their store. The copy for this sign is limited to pertinent business information such as store hours,telephone numbers,emergency information or other business information. 2. Lettering type to be Helvetica(medium)or Optima or as approved by the Landlord and the City of Palm Desert. 3. Maximum area allowed for the sign is 144 square inches and maximum height must not exceed four feet,six inches (4'-6")as measured from the top of the sign to the height of the floor. Store Numbers 1. Landlord shall install a store number over each store front door. The numbers must be vinyl machine-cut numbers, four inches(4")in height using the project typestyle. The numbers are to be installed centered both vertically and horizontally within the glass panel area over the door. Awnings 1. Variation in awning size,configuration,shape and color is encouraged and tenant awning proposals will be reviewed in the context of other awnings when applicable. Scalloped aprons are not permitted. Exceptions are permitted,but would be reviewed on a case by case basis,and must be approved by the Landlord and the City of Palm Desert. 2. Awning colors will be reviewed on a case by case basis and must be approved by the Landlord and the City of Palm Desert. 3. Signage is permitted on awnings and would undergo the same scrutiny as other building signage. Any of the awning Awhk locations indicated in the attached diagrams would be a potential location for signage,but all awnings may not be permitted to have signage. 4. Awning signage would be non-illuminated or illuminated from an external light source.An awning illuminated through the face would not be permitted. An awning illuminated from an external light source must be approved by the Landlord and the City of Palm Desert. 5. Awning framework must be constructed in a professional manner. Exposed plates and screws must be minimized, clean and tasteful,and may not be permitted if it is determined by the Landlord that a better aesthetic solution is reasonably achievable. Connection details and awning shop drawings must be submitted to the Landlord for approval prior to fabrication. 6. The City of Palm Desert Architectural Review Commission's approval is required for all awnings per City of Palm Desert Municipal Code Section 25.68.080E. 4 Colonnade Sign and Awning Program Submittal Requirements: A sign and awning application consistent with this program shall consist of the following: For each proposed sign and/or awning application on the building,the following shall be specified or drawn to scale and dimensioned plans(Min. I Ixl7=I %"= 1'-0): 1.) A dimensioned location of each sign in the building and/or property. 2.) Sign dimensions including letter height,color,sign length and sign projection from the building. 3.) Color scheme. 4.) Type style or graphic style. 5.) Material being used. 6.) Method of installation/attachment/cross-section. 7.) Required structural details and calculations,if required by Landlord and/or the City of Palm Desert. 8.) Site plan indicating the location of the occupant space on the site. 9.) Fabrication and installation details. 10.) Provide a Photoshop representation of signage and graphic logo superimposed on a photograph where signage is to be located. Provide a photograph to include entire storefront and neighboring tenants. All permits for sign(s)and their installation shall be obtained by the sign applicant(s). The sign applicant shall satisfy all requirements and specifications herein. Binding Effect: No sign shall be erected,constructed,installed,displayed,altered,placed or maintained except in conformance with this program. In case of any conflict between the provisions of this program and any other provisions of the City of Palm Desert's Zoning ordinance,the City Zoning Ordinance shall prevail. Approvals: The design and construction of the tenant's signage must receive written approval by the Landlord/Owner and the City of Palm Desert before fabrication and installation. The owner's or managers written approval shall be submitted to the City,along with a completed City application,approved plans,and fees. Owner's approval shall be based on the following: 1. Conformity to the provisions of this sign program. 2. Complete information, i.e.contractor's name,company name,address, license number,and workers compensation number. To secure the owners approval,3 (three)copies of the design drawing of the signage must be submitted directly to the Owner. 5 Colonnade ' Sign and Awning Program Final Inspection of Sign Installation: l. The installing sign contractor shall call the City for a final inspection after having installed the sign. 2. The Final Inspection Card must be maintained on file with the Sign Contractor. 3. Signs that deviate from this Sign Program will be removed at the tenant's expense. *Provisional Clause: This Sign Program is intended to address nearly all sign types while adhering to City sign codes and facilitating business operations. It is understood that a tenant could have sign needs that may not"fit"the Sign Program. With this understanding and in all fairness to applicants,landlord and the City of Palm Desert Community Development Department will reserve the right to review proposals on a"case by case"basis. Applicants that fall into this category are strongly encouraged to meet with the landlord and the Community Development Department rp for to sign design to review and exhaust all options prior to using said provision due to legal sensitivity and extended lead times of provision: The following situations are candidates for this provision: 1. Franchise/Business Opportunities/Operations Systems that specifically mandate certain lettering and/or logos. 2. Hardships as set forth in the City Code. A letter will be required from tenants on corporate letterhead indicating the business noted on#I above plus an approval from the Landlord approving the non-conforming signage. THIS MUST BE SUBMITTED WITH APPLICATION TO SATISFY CITY OF PALM DESERT COMMUNITY DEVELOPMENT DEPARTMENT SIGN APPLICATION REQUIREMENTS. BE ADVISED: This clause is set forth to be fair and just. If it is determined that this provision has been disregarded,abused,altered or falsified in any way,the offending tenant will be cited,and the sign may be removed by Landlord within 30 days of citation,and legal action may be initiated. 6 d I.
