Mountain Drive at the Kings ' Point condominium project .
Mr. Williams noted a letter received from the lawyer for the
property owners noting the approval of the plot plan . Mr.
Williams handed out a new resolution which had been approved
by the City Attorney and Mr. Bach the Property Owners ' attorney.
Chairman Berkey opened the public hearing and asked if the ap-
plicant was present and wished to speak at this time.
TOM ESSEN, 431 S. Palm Canyon , Palm Springs, representing
the applicant Philip Abrams, spoke to the Commission noting
that they preferred the tentative parcel map as opposed to
the lot line adjustment .
Chairman Berkey asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the project . Being none he declared the
public hearing closed and asked for the pleasure of the Commission .
It was moved by Commissioner Snyder and seconded by Commissioner
Kelly that the case be approved by Planning Commission Resolution No . 290;
carried unanimously (5-0) .

Mr. Williams reviewed the case noting that the staff recommends
that the request be denied but that a lot line adjustment be
approved thereby incorporating parcel 2 into lot 1 of Tract
4380-1 .
Chairman Berkey opened the Public Hearing and asked if the
applicant would like to speak. The applicant not being present , he then
asked if there was anyone wishing to speak in FAVOR of or in OPPOSITION
to the project .
DAVID MAYBERRY, President of Kings ' Point Property Owners
Association, spoke to the Commission and placed this ques-
tion before them. Would it require a unanimous vote of
the property owners to have the tennis courts relocated?
Mr. Williams informed him that he would have to check the CC&R' s
of t�%,Pissociation.
V� AM.irman Berkey indicated that before the case could be approved
� 'hat ;6th the property owners and the Commission should obtain some
be .l advice. The Public Hearing was closed and it was moved by Commis-
oner Kelly and seconded by Commissioner Reading the the case be con-
tinued to the October 19th meeting; carried unanimously (5-0) .

Report On: Tentative Parcel Map to create two (2) lots from a 2.53 acre parcel
Applicant: PHILIP ABRAMS CONSULTING ENGINEERS, INC.

I. REQUEST:
Request for approval of a Tentative Parcel Map to create two (2) lots,
one of 0.40 acres and one of 2. 13 acres in size from a 2.53 acre parcel
generally located west of Shadow Mountain Drive at the Kings ' Point
condominium project.
II. STAFF RECOMMENDATION:
By Planning Commission Resolution No. _ deny_the:trequest for- approval;
of the parcel map and approve a lot line adjustment thereby incorporating
parcel 2 into Lot 1 of Tract 4380-1 . .
Justification:
1 . A lot line adjustment would be more appropriate than a parcel map to
accomplish the applicant's objectives.
2. The proposed parcel split might have the potential of subverting the
intentions of the original conditional use permit by prohibiting the
effective development of the originally planned project as a single,
integrated development.
III . BACKGROUND:
A. Description: The subject site is described as A portion of Sec. 30,
T5S, R6E, SBB&M.
B. Location: The subject site is generally located west of Shadow Moun-
tain Drive at the King's Point Condominium Project.
C. Size: The existing 2.53 acre parcel would be divided into Parcel 1 -
2.13 acres, Parcel 2 - 0.40 acres.
D. Existing Zoning: PR-7
E. Adjacent Zoning: North - PR-7
South - PR-7
East - PR-7
West - PR-7
F. EIR Finding: This project is exempt, pursuant to Section 5(i ) of Palm
Desert Resolution No. 77-7, in that it would not have any
significant effect on the environment.
IV. DISCUSSION:
At the present, thirty-six of the 222 units permitted under an amended
Conditional Use Permit have been constructed at the Kings ' Point Condominium
Project. It is reasonabl`e� to assume that those who purchased these units
did so believing they would have permanent access to the two tennis courts
located on Parcel 2. The present action by the applicant to create two
parcels appears to be a response to efforts to secure the recreation facili-

ties for the present residents of the development. Considering that
the only access to the tennis courts is from Lot 1 where the only residents
of the project reside, Staff believes that a simple lot line adjustment
which would incorporate Parcel .2 of the subject parcel map into Lot 1 of
Tract 4380-1 would accomplish the applicant's objectives. The filing of
a parcel map appears to be an unnecessary measure. In addition, the possi-
bility always exists, even though it may be very.rtmo't that Parcel 1 might
be developed on an individual basis if the parcel split were approved and
this action might subvent the original intention to have the entire property .
developed as a single, unified project.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FIND-
INGS AND APPROVING A REQUEST FOR APPROVAL OF A TENT-
ATIVE PARCEL MAP GENERALLY LOCATED WEST OF SHADOW
MOUNTAIN DRIVE AT THE KINGS ' POINT CONDOMINIUM PRO-
JECT .

WHEREAS, the Planning Commission of the City of Palm Desert , did
receive a verified application from PHILIP ABRAMS CONSULTING ENGINEERS ,
requesting approval of a Tentative Parcel Map to create two (2) lots,
one of 0. 40 acres and one of 2 . 13 acres from 2. 53 acres of land, located
in the PR-7 zone and situated west of Shadow Mountain Drive at the Kings '
Point Condominium project more particularly described as :
A portion of Sec . 30,
TSS, R6E, SBB&M.
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No.
77-7" , in that the Director of Environmental Services has determined
on September 9, 1977 that the project would not have a significant im-
pact on the environment and the appeal period did expire on September
19, 1977; and,
WHEREAS, the Planning Commission did take into consideration the
Tentative Parcel Map as submitted, and the reports of the various re-
viewing agencies, and;
WHEREAS, the Planning Commission did find that the proposed
Tentative Parcel Map conforms with all of the requirements of the Palm
Desert Zoning Ordinance, the Palm Desert General Plan, the Subdivision
( Ordinance , and the California Subdivision Map Act .
L NOW, THEREFORE , BE IT RESOLVED by the Planning Commission of the
City of Palm Desert as follows :
1 . That the above recitations are true and correct and constitute
the findings of the Commission in this case;
2. That it does hereby approve the request of PHILIP ABRAMS CON-
SULTING ENGINEERS for approval of Tentative Parcel Map 11050.

This letter is not to be interpreted as a contractual commitment to
serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy
conservation techniques for a particular project. If you desire further
information on any of our energy conservation programs, please contact
this office for assistance.

The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its cur—
rent tariffs as approved by the California Public utilities Commission.
The developer will be required to deposit the full cost of these facili—
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates
are developed over a large base. We have no evoertise on the asthetic
impact of trenching and cannot comment on this subject except to state
that the distribution facilities will be placed in a joint trench with
other utilities wherever possible.

Dear Mr. Williams :
As per our telephone conversation of Tuesday, October
18, 1977, and after discussing the pros and cons of the
above matter with our clients, my associate, and the attor-
ney for the applicant, Mr. James Schlecht, it is the posi-
tion of the King' s Point at Palm Desert Homeowners ' Associa-
tion that the above application should be granted.
While it is our fundamental objective to obtain title
to the tennis courts at King' s Point free and clear for the
permanent and unimpaired use of the homeowners , an while
the granting of said application will not immediately have
that result, we feel that this course may be desirable in
lieu of a lot line adjustment at this time.
An immediate lot line adjustment would, I am informed,
require the unanimous written consent of every unit owner
and mortgage holder. The mechanics of obtaining these con-
sents, together with the possibility that unanimity may not
be obtained, make this course undesirable. Furthermore, an
immediate lot line adjustment would result in the acquisition
of property presently encumbered by a blanket Trust Deed in
favor of McKeon Construction, which is also undesirable from
the standpoint of the homeowners .
We are reasonably certain that, come what may, the de-
veloper must ultimately convey the tennis courts to our
clients . It has even been suggested that the developer exe-
cute a Deed to that effect for the City of Palm Desert to
hold, while it may be best that the homeowners association
itself be given the Deed to hold.

dikes built and maintained by this District. This area may be considered
safe from stormwater flows except in rare instances .
Parcel Map 11050 is within Tract 4380-1 which has not been completed. District
records indicate that the area is bound to the terms of the tract agreement and
that performance bonds for these improvements have not been released. The
District recommends this parcel map request be denied until the subdivider and/or
City define the objective desired and make arrangements to void the outstanding
bonds and agreement.
