Mr . Bouman stated th t this was project for a 2-1/2 acre
addition to the Commu ' ty Park It involves leveling of
land , installation of a water system , installation of trees
and the construction of a 1. n . It will provide an open
land area for soccer , touc football , etc . In Council ' s
consideration of this ma er , the Park & Recreation Com-
mission has requested t t the ouncil be aware that at
one time , this portion of the Pa , had been considered ,
and a request made , f donation to he Christina Sinatra
Youth Center for cc struction of a ew facility . The
Commission was not necessarily sayin that wanted it there .

Mr . Williams pointed ou tter had been con-
tinued from the meeting of May 11 , 1978 , in order for
Staff to prepare more information relative to the Parcel
?dap . He reviewed the area in which the parcel lies ,
stating that the City' s Zoning Ordinance can deal with
future development there through the effective use of
Conditional Use Permit procedures , parcel map procedures ,
and Design Review Board procedures . The present appli-
cant is proposing no grading or cut and fill operations
that would alter the natural contours of the land or result
in a padding or staircase effect . Staff recommended that
Council find that the Final Map is in conformance .
Councilman Brush moved and Councilman Wilson seconded to approve
the Parcel Map , 711388 , and authorized the City Clerk to certify and
record. Motion carried unanimously with the members present .

A. DISCUSSION:
Assuming Parcel Map PM 11388 is approved, the existing 5.06 acre parcel
would be divided into Parcel 1 having 1 .70 + acres and Parcel 2 having
3. 36 + acres. The present zoning, R-E 43,560 H, would allow construction
of one single-family residence on each parcel upon approval of a condi-
tional use permit as the subject site is located within the Hillside
Overlay District. The proposed parcel map is subject to the following density
restrictions prescribed by the Hillside Overlay Zoning District: A mini-
mum of 0.66 acres is required for each dwelling unit to be located on
Parcel 1 ; the applicant has 2. 70 + acres. A minimum of 2.50 acres is
required for each dwelling unit to be located in Parcel 2; the applicant has
3. 36 + acres. Therefore, as far as density is concerned, the applicant's
proposal is within the density range prescribed by the Ordinance. With
regard to the percentage of each lot required to remain in the natural state,
the applicant is required to preserve 32.5% of Parcel 1 in the natural state
and 92.5% of Parcel 2 in the natural state. This would mean that .55 acres
of Parcel 1 would have to remain in the natural state and 3.11 acres of
Parcel 2 remain intact, a goal easily achievable. As the larger of the two
proposed parcels contains an existing residence, we are in essence discus-
sing the addition of one more single-family residence within the area. The
major issue, then, is not one of the total number of proposed dwelling units ,
but one of the possibility of setting a precedent and the implications of
such action. During the year 1976 an application was made to the City of
Palm Desert for a parcel split in the general vicinity of the present site,
but at a much higher elevation. At that time, the City Council denied the
request as they felt approval would encourage rapid development of the
upper foothills area. Staff believes that line of reasoning is not appli-
cable to this case as the present site is located closer to the valley floor.
In addition, staff belives the City's Zoning Ordinance can deal with future
development in the foothills area effectively through the use of the Con-
ditional Use Permit procedure, parcel map procedure and the Design Review
process to insure that the goals, of the General Plan with regard to this
area are achieved. The present applicant is proposing no grading or cut
and fill operations that would alter the natural contours of the land or
result in a padding or staircase effect. Vistas, existing vegetation and
natural contours would remain intact.

in the application and any attachments thereto , and as shown on
the Plot Plan , labeled Exhibit A, and the requirements herein .
2. All requirements of any law, ordinance , or regulation of the
State of California, City of Palm Desert , and any other applicable
( government entity shall be complied with as part of construction .
SPECIAL CONDITIONS OF APPROVAL
I . Applicant shall offer to the City for public street purposes, an
easement at least 44 feet in width together with any required
slope easements . Acceptance by the City may be deferred inde-

I. REQUEST:
A request for approval of a Tentative Parcel Map to create two (2) lots

II. STAFF RECOMMENDATION:
Approve the Tentative Parcel Map by Planning Commission Resolution No. 308 ,
subject to the attached conditions.
Justification is based upon the following:
1 . Conformance of the Tentative Parcel Map to all requirements of the
Palm Desert Zoning Ordinance, General Plan, Subdivision Ordinance,
and the California Subdivision Map Act.
2. The proposed project would conform to all existing and proposed ad-
jacent land use.
3. The proposed project does insure the protection of the public health,
safety, and general welfare.
III . BACKGROUND:
A. Description: The subject site is described as Assessor's Parcel

B. Location: The subject site is generally located west of Highway 74,

IV. DISCUSSION:
The primary issue with regard to this case is that of the most appropriate
location to make the parcel split. The applicant is proposing to split the
parcel along the centerline of an existing dirt road. This action would
create one parcel 1 . 70 + acres in size and one parcel 3. 36 + acres in size.
The slope of the smaller parcel , Parcel 1 , is greater than 35% in the
southwestern portion of the lot, the interior actually a small plateau.
As a result, the average slope of Parcel 1 is 13%. Parcel 2, the larger of
the two parcels, has an average slope of 34%, the greatest slope being
located in the northeastern portion of the lot. The existing road, to a
great extent, follows the natural contours of the site. By splitting the
parcel along the centerline of the road the applicant is providing a
buildable site for a single family residence that would require very minimal
alterations of the land. Staff believes the proposed location of the
land division is the most logical and would insure that the land remains in
as natural a state as possible.

the Youth Soccer ssociation . He s ressed the need for a
major facility hich could include a wimming pool , gymna-
sium, etc. concluded by stating th t they were fighting
for the ver future of the Center .
MR. RIC RD KITE pointed out that if the J vis-Gann Initiative
passe , the funding from the C.V. Recreation District would
be c t by 2/3 , leaving a contribution of only 5 , 000.

XII . NEW BUSINESS
A. REQUEST FOR APPROVAL of Parce C:�

Mr. Beebe reported that this was .a simple division of a
5-acre parcel of land into two different parcels . At the
time it was presented to the Engineering Department , Staff
stipulated a dedication of right-of-way for future use .
Also required was that the owner sign a Future Improvement
Agreement . The division of this land in no way implies that
we will issue grading permits or building permits in the
Cahuilla Hills. The dedication of right-of-way is refused
on the map so that we do not have the liability of the
street that deadends. However , we do have the ability to
accept it in the future.
Councilman McPherson stated that he was of the opinion that
the City had gone on record with the County to oppose lot
splits until basic services can be provided.
Councilman Wilson stated his concern about taking this step
when it isn ' t in the Specific Plan .
Councilman McPherson moved and Councilman Wilson seconded to
continue the matter to the Meeting of May 25, 1978 , to allow time to
prepare additional input . Motion carried unanimously.

DISCUSSION:
This parcel of land is in the Cahillia Hills area and comprises
approximately five acres divided into two parcels. One re-
quirement was the dedication of the right of way for a future
street. Another requirement was signing a future improvement
agreement. This division of land in no way implies that build-
ing permits will be issued for these parcels.

I . REQUEST:
A request for approval of a Tentative Parcel Map to create two (2) lots
from a 5.06 acre parcel within the R-E 43,560, H zone generally located
west of Highway 74, south of Haystack extended in the foothills area of
Section 30.
II. STAFF RECOMMENDATION:
Approve the Tentative Parcel Map by Planning Commission Resolution No. 308 ,
subject to the attached conditions.
Justification is based upon the following:
1 . Conformance of the Tentative Parcel Map to all requirements of the
Palm Desert Zoning Ordinance, General Plan, Subdivision Ordinance,
and the California Subdivision Map Act.
2. The proposed project would conform to all existing and proposed ad-
jacent land use.
3. The proposed project does insure the protection of the public health,
safety, and general welfare.
III . BACKGROUND:
A. Description: The subject site is described as Assessor's Parcel
Number 628-130-001
B. Location: The subject site is generally located west of Highway 74,
south of Haystack extended in the foothills area of Sec. 30.
C. Size: The existing 5.06 acre parcel would be divided into Parcel 1 -
1 . 70 + acres, Parcel 2 - 3. 36 + acres
D. Existing Zoning: R-E 43,560 H
E. Adjacent-Zoning: North - R-E 43,560 H
South - R-E 43,560 H

G. EIR Finding: This project is exempt from the requirements of CEQA. A
Negative Declaration was filed on November 15, 1977 and

IV. DISCUSSION:
The primary issue with regard to- this case is that of the most appropriate
location to make the parcel split. The applicant is proposing to split the
parcel along the centerline of an existing dirt road. This action would
create one parcel 1 .70 + acres in size and one parcel 3.36 + acres in size.
The slope of the smaller parcel , Parcel 1 , is greater than 35% in the
southwestern portion of the lot, the interior actually a small plateau.
As a result, the average slope of Parcel 1 is 13%. Parcel 2, the larger of
the two parcels, has an average slope of 34%, the greatest slope being
located in the northeastern portion of the lot. The existing road, to a
great extent, follows the natural contours of the site. By split't�g the
parcel along the centerline of the road the applicant is providing a
buildable site for a single family residence that would require very minimal
alterationt of the land. Staff believes the proposed location of the
land division is the most logical and would insure that the land remains in
as natural a state as possible.

WHEREAS, the Planning Commission of the -City of Palm Desert ,
California, did receive a verified application from DAVID G. PREST re-
questing approval of a lot split of 5 .06 acres of land, located in the
R-E 43, 560 H (Residential-Estate , minimum 43, 560 sq. ft . lot size, Hill-
side Overlay) Zone District and generally located west of Highway 74,
south of Haystack extended in the foothills area of Section 30, more
particularly described as :

WHEREAS , said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution Num-
ber 77-7" , in that an Environmental Assessment form was submitted and a
Negative Declaration was made by the Director of Environmental Services,
and the appeal period has expired; and
WHEREAS, the Planning Commission did take into consideration the
Tentative Parcel Map as submitted, and the reports of the various review-
ing agencies; and,
WHEREAS, the Planning Commission did find that the subject Tenta-
tive Parcel Map does substantially comply with the City of Palm Desert
Municipal Code and the State of California Subdivision Map Act , as
( amended; and,
LWHEREAS, the Planning Commission did find that the subject Tenta-
tive Parcel Map does comply with the adopted General Plan .
NOW, THEREFORE , BE IT RESOLVED by the Planning Commission of the
City of Palm Desert , California, as follows :
1 . That the above recitations are true and correct .and constitute
the findings of the Commission in this case;
2. That it does hereby approve the above described Tentative Parcel
Map No. PM 11388, subject to the fulfillment of the attached conditions.

Description of Project: Request for a conditional use permit and
parcel map to subdivide an existing parcel of 5 .06 acres into
2 lots, which would be situated west of Highway 74, south of
Haystack extended in the foothill area of Section 30.
Finding: The project would not have a significant adverse impact
on the environment ; therefore, no further environmental documenta-
tion will be required.
Justification: Access to property is provided by an existing dirt road.
There is an existing dwelling on one of the lots and sufficient level
ground for a second dwelling on the other lot . Water and power al-
ready available to the site. No drainage or grading problems assoc-
iated with property. New construction would be subject to architecture,
grading and landscape control of Design Review Board process.
Any interested citizen may appeal this determination to the Planning Commission
within eight (8) days of the date of the posting of public notice by filing an appeal
in accordance with Resolution No. 77-7 with the Department of Environmental
Services located at 45-275 Prickly Pear Lane, Palm Desert, California. If no
appeal is filed within said time, this determination shall be final.

While we appreciate the City' s concern for excess land
dividing in the Hillside Overlay Zones of Sec . 30 we feel
the presence of two established pads on Mr. Prests ' s parcel
makes it an unusual case and a natural for two separate parcels .
No deviation from the 1-acre minimum lot size allowed by the
present zoning would result from approval of the C.U.P . , nor
does this application involve any proposed grading or building
permits .
