A . REQUEST FOR APPROVAL OF PARCEL MAP 11680, J. M. Peters ,
Applicant : 1
nor. Clyde Beebe stated that this was r the dividing of
the Deep Canyon Tennis b into f parcels for condo-
minium purposes . The subjec parcel map has met all condi-
tions required for the approval of same , including the
special condition of grading the retention basins prior
to recordation . This map was approved by the Planning
Commission on January 3 , 1978 .
Mr . Bouman questioned whether or not the retention basins
were only for the new portion of the project as there is a
problem with the basins in the old portion . Mr. Williams
pointed out that the Design Review Board had required some
supporting retention basins in the old portion which will
alleviate the drainage problem now existing .
Councilman McPherson moved and . Councilman Wilson seconded to
waive further reading and adopt Resolution No. 78-21 . Motion carried
unanimously with the members present .

Air . Bouma reported that the Ci is holding in trust $1 , 000
which was . ven by the Palm D ert Rotary Club for the
Community Pa However , it was decided at that time to
hold the money until the P k Foundation could determine
the proper use r the mo ey. They have now decided to
install pre-schoo tot- of equipment in the park, and they
have requested tha tl money be released. This can be
accomplished by minu e motion. '
Councilman McPherson ved nd Councilman Newbrander seconded to
approve the release of the 1 , 000 b ing held in trust to the Palm Desert
Community Park Foundation or use in urchasing and installing tot-lot
equipment in the Communi Park. Aloti n carried unanimously with the
members present .

C uncilman Wilson stated concern over th traffic speed on
airway Drive and requested that a study b made as to why
it is 25 mph in Indian Wells , but 40 mph in Desert .
Air. Williams reported that a study had been m de earlier ,
and a recommendation of 45 mph had been made ; wever ,
Council had at that time lowered it to 40 mph . e matter
will be referred to the Traffic Committee .

BE IT HEREBY RESOLVED by the City Council of the City of Palm
Desert, California, as follows :
1 . Parcel Map 11680 located in the City of Palm Desert,
Illfff California, is hereby approved subject to the condition of the
Tentative Parcel Map.
2. The City Clerk and the Director of Public Works are
authorized to execute said Parcel Mao 11680 on behalf of the City.

_14 "lliams reviewed the case and noted that the new owner
was required to update the lots for the current market.
Chairman Berkey declared the Public Hearing open and asked if
the applicant would like to speak at this time.
GREG ERICKSON, representing J. M. Peters Co . , addressed
the Commission and noted that for the catch basins to
be operable and completed by recordation of the map is
not feasible because of the heavy equipment that will
be used during the completion of the project .
Some discussion followed as to whether the case should be con-
tinued until the catch basin question was solved. Mr. Williams suggested
that Mr. Erickson and Mr . Beebe take time at this time to discuss the
issue and try to solve it now.
Commissioner Snyder noted that he would not approve any changes
with regard to the retention basins because this has been a problem from
the start of the whole project .
Chairman Berkey suggested that Mr. Erickson and Mr. Beebe take
time now to discuss and the case would be held over until later in the
meeting.

Mr. Beebe noted the following change to Condition No. 3
with regard to the catch basins : "All of the retention basins shall
be graded and in operation, as requied by the Director of Public Works
prior to the recordation of this map. "
Commissioner Reading asked if this will help the flood pro-
blem. Mr. Beebe stated that it would help most flood problems, but
not from a big storm as in September of 1976.
Chairman Berkey declared the Public Hearing closed and asked
for the pleasure of the Commission .
On a motion by Commissioner Kelly, seconded by Commissioner
Kryder, the case was approved subject to the conditions of approval,
by Planning Commission Resolution No . 322 ; carried unanimously (5-0) .
H. Case Nos . CUP 18-77 and 67C - HUGHES INVESTMENTS, Applicant
Request for approval of a Conditional Use Permit and
Preliminary Design Review to construct and operate
a grocery store, restaurant , and related retail shops
in a commercial center within the C-1 , . .P . zone generally
located east of Highway 74 and north of E1 Paseo.
Mr. Williams reviewed the case and noted that the abandonment
of the road would have to be considered by Caltrans. He also stated
that the Design Review Board was recommending continuance so that
a traffic study and consideration of a possible redesign by the ap-
plicant could be considered. Mr. Williams indicated that the appli-
cant had submitted a traffic study report but that the deficiency
the parking, pedestrian orientation in relationship to buildings is
not satisfactory.
Some discussion followed with regard to the entrance on Highway
111 & how many parking spaces there are. Mr. Williams replied that the
entrance on Highway 111 is entrance only and to exit you can use El
Paseo or other exits. With regard to parking, there are 421 spaces,
proposed and the Ordinance required 440 spaces.
Chairman Berkey declared the Public Hearing open and asked if
the applicant wished to speak at this time .
RON ROBERTS, Architect with SGPA of San Diego, represent-
ing Hughes Investments, addressed the Commission , noting
the following : the Property Owners ' Association and the
Design Review Board had requested some activity on El
Paseo; the Redevelopment Plan cannot be adhered to exactly
but they have made a positive approach to the problems
that exist ; the gross area has been reduced 700 sq. ft . ;
he wants development at signal at the corner of E1 Paseo
and Highway 74; would like to have the traffic report
and the revised site plan reviewed by the Commission and
requests that the case be continued to the meeting of
January 18, 1978.
Commissioner Reading asked about the present Safeway and what
would be done with it . Mr . Roberts stated that he was not sure but
that the real estate wastoo valuable to let it set .
On a motion by Commissioner Reading, seconded by Commissioner
Kelly, the case was continued to the meeting of January 31 , 1978 due
to the crowded agenda of the January 18th meeting; carried unanimously
(5-0) .

1 . The Tentative Parcel Map is granted for the land as described
in the application and any attachments thereto, and as shown
on the plot plan, labeled Exhibit A, and the requirements herein.
2. All requirements of any law, ordinance , or regulation of the State ,
City, and any other applicable government entity shall be complied
with.
3. All of the retention basins. shall be graded and in operation ,
as required by the Director of Public Works , prio to the recorda-
tion of this map .
AGREEMENT
I accept and agree , prior to use of this permit or approval , to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow oc-
cupancy on the use permitted until this signed confirmation has been

Gentlemen:
This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that .there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

This letter is not to be interpreted as a contractual commitment to
serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Comuany's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
.jurisdiction of the California Public Utilities Commission, We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to ,
provide assistance in selecting the most effective applicaticns of energy
conservation techniques for a particular project. If you desire further
inforiiration on any of our energy conservation programs , please contact
this office for assistance.

Finding:
Project is exempt, pursuant to Section 5( i) of Palm Desert Resolution
No. 77-7, in that it would not possibly have any significant effect
On the environment .
Justification:
The proposed lot splits are being made merely for legal purposes .
No alteration of the land or change in the design of the project will
occur. Nor will there be any effect on the flora, fauna, water or
air quality of the area.
Any interested citizen may appeal this determination to the Planning Commission
within eight (8) days of,the date of the posting of public notice by filing an appeal
in accordance with Resolution No. 77-7 with the Department-of Environmental
Services located at 45-275 Prickly Pear Lane, Palm Desert, California. If no
appeal is filed within said time, this determination shall be final.

Dear Mr. Williams:
We respectfully request waiver of final parcel map approval
on Parcel Map 11680 .
All required dedications and public street improvements have
been met, constructed and accepted by the City of Palm Desert..
Our reasons for filing the Parcel Map on the balance of the
Deep Canyon property is to create reasonably sized increments
for processing through the Department of Real Estate .
The Department of Real Estate requires that all improvements
(including house construction), be bonded or 100 percent com=
pleted before the first unit within a phase can close escrow.
It is our choice to complete all of the improvements rather
than post bonds, and for that reason it is imperative to
keep the increments at a reasonable size, The Parcel Map
will also facilitate the recording of construction loans.
