Reques for a oval of a Tentative Parcel Map to both

ment purposes at a site located north of El Pasco and
east of Highway 74 within the C-1 , S .P. zone.
Mr. Cipriani noted that the applicant had requested an inde-
finite continuance and he then stated the reasons for the staff
recommending that the case be denied without prejudice which include :
The applicant has asked for an indefinite continuance for related
Case No. CUP 18-77 in order to greatly modify the proposed develop-
ment which will necessarily require a revised tentative parcel map;
and, as the Planning Commission is confronted with time constraints
which compel the Commission to take action on submitted parcel maps
during a limited time period, the applicant ' s request for an inde-
finite continuance makes it imperative to act on the submitted parcel
map at this time. _.
On a motion by Commissioner Snyder, seconded by Commissioner
Reading, the Commission denied the request without prejudice by
Planning Commission Resolution No. 333; carried unanimously (5-0) .
I . OLD BUSINESS
A. City Council request for Study and Report on Ca e No.
C/Z 12-77.
Co ssioner Kelly noted that the minutes fro the City Council
meeting did n change her mind and that by recomm ding R-1-12, 000
she was acting behalf of the citizens. Commiss ' ner Kryder concur-
red with Commissio er Kelly. Commissioner Snyd read a statement
summarizing the vie of the Commission (see E ibit A) . Commis-
sioner Reading noted h ' agreement with Commissioner Snyder. Chair-
man Berkey agreed with t other Commissio rs and read his state-
ment (see Exhibit B) . Cc ssioner Kell asked that the comments of
the Commission at this meeti be forwa ded to the City Council and
perhaps the Council would take seco look at the request . Commis-
sioner Snyder asked to review the S ff report prior to its going to
the Council.
On a motion by Commissi er Kel seconded by Commissioner
Kryder, the Commission reaffi ed their p evious recommendation of
R-1-12, 000 to the City Coun 1 ; carried una imously (5-0) .
B. Status Repo on the Cove Communities -Pass Project .
Mr . Cipriani oted a letter received from CVAG see Exhibit C)
noting that CVAG 11 present the problem to the Techni 1 Advisory
Committee on Feb uary 23, 1978 .
Chairm n Berkey noted that since CVAG was handling the tua-
tion that St ff could discontinue their study but keep in touch ' th
CVAG as to heir progress.
VIII . NEW BUSINESS
A. Advanced Planning Program for 1978-80

Mr. Cipriani noted that two major and two minor studies could
be handled by the Staff in the coming year and that the housing
element has to be completed by July of 1979 . He also .noted the im-
portance of a Specific Plan covering the area west of the Palm Valley
Channel . Where was some discussion as to the location of the BLM
land.

1 . The applicant has asked for an indefinite continuance for related Case

2. As the Planning Commission is confronted with time constraints which
compel the Commission to take action on submitted parcel maps during

CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH
ITS FINDINGS AND DENYING WITHOUT PREJUDICE A TENTA-
TIVE PARCEL MAP TO BOTH DIVIDE AND ASSEMBLE VARIOUS PARCELS
OF LAND FOR DEVELOPMENT PURPOSES AT A SITE LOCATED
NORTH OF EL PASEO .AND EAST OF HIGHWAY 74 WITHIN
THE C-1 , S. P. ZONE:
CASE NO. PM 11796
WHEREAS , the Planning Commission of the City of Palm Desert , did
receive a verified application from CHARLES HAVER AND ASSOCIATES , re-
questing approval of a Tentative Parcel Map (PM 11796) to both divide
and assemble various parcels of land for development purposes at a site
located north of E1 Paseo and east of Highway 74 within the C-1 , S .P.
zone , more particularly described as :
A portion of the Southwest Quarter of
Section 20, TSS , R6E , S .B.M.
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No .
77-7" , in that the Director of Environmental Services has determined on
December 12, 1977 that the project would not have a significant impact
on the environment and the appeal period did expire; and,
WHEREAS, the Planning Commission did take into consideration the
Tentative Parcel Map as submitted, and the reports of the various re-
viewing agencies, and;
WHEREAS, the applicant has asked for an indefinite continuance for
related Case CUP 18-77 in order to greatly modify the proposed develop-
ment which will necessarily require a revised tentative parcel map .
WHEREAS, as the Planning Commission is confronted with time con-
straints which compel the Commission to take action .on submitted parcel
maps during a limited time period, the applicant ' s request for an in-
definite continunace makes it imperative to act on the submitted parcel
map at this time.
NOW, THEREFORE, BE IT-RESOLVED by the Planning Commission of the
City of Palm Desert as follows :
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case ;
2 . That it does hereby .-deny without prejudice the above des-
cribed Tentative Parcel Map No . 11796 .

At this time Mr . Williams noted two items that had been in-
advertently omitted from the agenda, that the applicant had requested
be continued to the February 15th meeting, by a letter addressed to

Mr. Williams also informed the Commission of the Council ' s
consideration of Case No. C/Z 12-77, Lewis Homes of California,
applicant at their meeting of January 26, 1978. He noted the map
showing the Council ' s proposal . Since their proposal is different
that the recommendation of the Planning Commission , the case must be
referred back to the Planning Commission for further review and a
report must be reported back to the Council within 40 days. Mr.
Williams noted the alternatives the . Commission could take, which _
are as follows :
1 . Reaffirm its previous recommendation of R-1-12 , 000 on the total
property.
2. Concur with the action of the City Council on this matter .
3. Consider other alternatives.
There was some discussion with regard to when the case should
be discussed and when the Planning Commission makes their recommenda-
tion, can the City Council continue the case at their meeting. Mr.
Williams noted that the City Council can continue the case and take
a second reading of the Ordinance .

This area is protected from stormwater flows by a system of channels
and dikes . This area may be considered safe from stormwater flows
except in rare instances .
The District will furnish domestic water and sanitation service to
said area in accordance with the currently prevailing regulations
of this District.
There will be conflicts with existing District facilities on the
interior of the project. We request the appropriate public agency
to withhold the issuance of a building permit until arrangements
have been made with the District for the relocation of these facilities .

I. All improvements for this parcel map should conform to the
Redevelopment Agency's plan.
2. This parcel map should participate in a signal at E1 Paseo and
Highway 74. It is suggested that one-fourth of signal costs be
borne by this parcel.
3. All - street improvements, curbs, gutters and tie-in paving, on
the parameter of the parcel shall be constructed.
4. Traffic safety lighting shall be provided as directed by the
Director of Public Works.
5. Ingress and egress for this parcel shall have the approval of
the Traffic Committee for the City of Palm Desert and the
Director of Public Works approval .
6.. This parcel shall pay drainage fees as required by
ordinance.
Subject: Tentative Tract 11883
1. All improvements, curbs, gutters, sidewalks and tie-in paving,
shall be installed on Candlewood Street in front of Lots 2
through 8. Curbs, gutters and pavement shall be installed on
the access easement from Shadow Hills Road to Driftwood Drive,
and on the access easement in the interior of the development.
2. Traffic safety lighting shall be installed as requested by the
Director of Public Works.
3. This tract shall pay the park fees as required by the Palm Desert
Ordinances.
4. This tract shall pay into the City of Palm Desert Drainage Fund
in the amount equal to $1,500 per gross acre.
5. The necessary right-of-way shall be dedicated to make Candlewood
Street a 60 foot street.

2. Right-of-way shall be deeded to enable 60 foot streets to
be constructed,

4.. Driveway accesses off of Sun Lodge, Shadow Mountain and
Lupine Lane shall be at a minimum and as-approved by the

1. No access shall be permitted from Highway 111,
2. It is recommended that the Lake Park and Fountain proposed
at the northerly intersection of Painters Path and Highway
111 be relocated for less disturbance and better protection
from traffic.
3. Traffic safety lighting shall be provided on all three sides
of the proposed development in accordance with the Director
of Public Works approval ,
4. This development should make a contribution towards the signals
at 44th and Highway 111.
5. Storm waters shall be dispersed by adequate drainage means
for the subject development.
6. This development shall also pay drainage fees according
to the City of Palm Desert ordinances.

to you for comments and recommended Conditions of Approval . The City
is interested in the probable impacts on the natural environment (e.g.
water and air pollution) and on public resources (e.g. demand for
schools, hospitals, parks, power generation, sewage treatment, etc. )
Your comments and recommended conditions of approval must be received
by this office prior to 5:00 p.m. Jan. 20 1977, in order to be
discussed by the Land Division Committee at their meeting of Jan. 25th .
The Land. Division Committee (comprised of Director of Environmental
Services, City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received by this office after
the receipt deadline will not be discussed by the Land Division Com-
mittee nor will it be forwarded to the Planning Commission for consid-
eration.

parcel located north and east of the College of the

Mr . Williams reviewed the case , noting some of the history
of the case and its present status and the request being made at this
time.
Chairman Berkey declared the Public Hearing and asked if there
was anyone wishing to speak in FAVOR or in OPPOSITION of the proposed
Change of Zone .
WILLIAM BONE, 65 Barsalona, Rancho Mirage , asked to
have the density of the proposed zones explained .
Mr. Williams noted that PR-6 was 6 units to the acre, maximum
and PR-4 was 4 units to the acre, maximum.
Chairman Berkey declared the Public Hearing closed and asked
for the pleasure of the Commission.
On a motion by Commissioner Kelly , seconded by Commission
Kryder, the Change of Zone was approved by Planning Commission Resolu-
tion No. 323 ; carried unanimously (5-Xamendment

WHEREAS, the Planning Commission of the City of Palm Desert , did
receive a verified application from CHARLES HAVER AND ASSOCIATES, re-
questing approval of a Tentative Parcel Map (PM 11796) . to both divide
and assemble various parcels of land for development purposes at a site
located north of E1 Paseo and east of Highway 74 within the C-1, S .P .
zone, more particularly described as :
A portion of the Southwest Quarter of
Section 20, TSS , R6E, S .B .M.
WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Environmental Quality Procedure Resolution No. 77-7" ,
in that the Director of Environmental Services has determined on December
12, 1977 that the project would not .have a significant impact on the
environment and the appeal period did expire ; and,
WHEREAS, the Planning Commission did take into consideration the
Tentative Parcel Map as submitted, and the reports of the various re-
viewing agencies, and;
WHEREAS, the Planning Commission did find that the proposed Tentative
Parcel Map conforms to all applicable requirements of the Palm Desert Zon-
ing Ordinance , General Plan, Subdivision Ordinance and the California
Subdivision Map Act.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert as follows :
1 . That . the above recitations are true and correct and consti-
tute the findings of the Commission in this case;
2. That it does hereby approve the request of CHARLES HAVER AND
ASSOCIATES for approval of Tentative Parcel Map PM 11796.

This letter is not to be interpreted as a contractual commitment to _
serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
sarvice to, the project could be provided from an existing main without,
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service , as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are.-available, upon request, to
provide assistance in selecting the most effective applications of energy
conservation techniques for a particular project. If you desire further
information on any of our energy conservation programs , please contact

This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing drain without
any significant impact on the environment. Tire service would be in
accordance with the Company 's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilitiq.:s Commission. We cars
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition

storm drain facilities . Same -comment applies to water being received
by Marrakech. Concrete channel shown on drawings seems to be insufficient
r in size. There is nothing beyond Grapevine to receive this water.
3. Water on Haystack should not be allowed to run through
the subdivision.
4 . When project is developed, approximately 65 to 75% of
the land will be covered with hard surface materials and buildings ,
all draining to and through the streets .
Larger lot sizes would allow the opportunity for better
percolation, but of even more importance would be the compatibility ,
with adjacent development
The smallest PDPOA lot in the area is 13,500 square feet .
