located at the northeast corner of El Cortez Way
and Santa Ynez Avenue.
Mr. Crump reviewed the staff report and noted the revisions,
as suggested by the staff , to the lot line. He then reviewed the
conditions for the Parcel Map.
Commissioner Fleshman asked about the positioning of buildings
on the two lots and why the need to move the lot line. Mr . Crump
stated that 2 , 000 sq. ft. buildings would then be available. Commissioner
Fleshman asked how the front and side yards are figured with this
shape of parcel .

Mr . Williams stated that a tangent of 10 feet denotes the start
of the front yard , side and rear .
Chairman Kelly declared the Public Hearing open and asked if the
applicant wished to speak at this time.
CHARLES RILEY, applicant , noted that he believed
the reason for the large lots was originally to
have enough room to keep horses. He noted that
he had no objection to the Conditions of Approval
or to the lot line being moved, if the staff feels
this is better .
Chairman Kelly asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the proposed project .
HENRY MCCANN, 44-558 Santa Ynez, noted his objection
to the proposed lot split as it is not consistent
with the lots in the area. They are all large and
he feels they should remain that way.
Chairman Kelly declared the Public Hearing closed and asked for
the pleasure of the Commission.
Mr . Williams referred to the Assessor ' s Parcel Map for this area
and noted the size of the lots. Commissioner Fleshman noted that the
lot split would still keep the lots within conformance to the other
lots in the area.
Chairman Kelly noted her agreement with Mr . McCann that the
large lots are an asset , but she did not feel that the split would
create a problem.
On a motion by Commissioner Berkey, seconded by Commissioner
Kryder , the Commission approved the cases by Planning Commission Resol-
ution No. 428 , subject to conditions; carried unanimously ( 5-0) .

Mr . Williams reviewed the st report and noted the staffs recom-
mendation that the Commission d ermin . f the requested use is appro-
priate in conjunction with an utomobile vice station or inappropriate,
or direct the applicant to repare detailed p ns and continue the matter
( until January 2 , 1979, t allow plans to be subm ' ted and reviewed by
IL Staff and the Design view Board.
Commission Berkey asked if there were any other s vice stations
in the area t sell beer . Mr . Williams stated that as far s he knew
the closest ne was in Banning .

I. REQUEST:
Request for approval of a Tentative Parcel Map to create a 15,170 sq. ft.
parcel and a 12,634 sq. ft. parcel from an existing 27,804 sq. ft. sub-
divided lot; and, a Variance from the minimum lot width standards of the
R-1 zone, for property generally located at the northeast corner of E1
Cortez Way and Santa Ynez Avenue.
II. BACKGROUND:
A. R-1 Zone Requirements:
1 . Minimum Street Frontage
Cul-de-sac or Knuckle lot - 35 feet
Flag 'lot - 20 ft. ..." ,
2. Minimum Lot Width - 75 feet
Lot Width" means the horizontal distance between the side lot
lines, measured attright angles to the lot depth at a point
midway between the front and rear lot lines. "Lot Depth" means
the average horizontal distance between- the front and rear lot
lines measured in the mean direction of the lot lines. (Some
interpretation is necessary with irregular shaped lots)
Proposed Lot Widths
Knuckle - 115 ft.
Flag - 32 ft. (Variance situation)
3. Minimum Lot Area - 8,000 Sq. ft.
Proposed Knuckle lot - 15,170 sq. ft. -
Proposed Flag lot - 12,634 sq. ft.

The Director Environmental Services has determined that the subject
project will not have a significant adverse impact on the environment
and a Negative Declaration was prepared.
III. DISCUSSION:
The proposed division meets or exceeds the R-1 zone standards, except for the
width of the proposed flag lot. The requirement for a minimum lot width to be
maintained at the mid-point between front and rear property lines restricts the
design configuration of flag lots. As in this case, if the staff of the flag
lot is long, the minimum mid-point width can not be achieved.
The concern in this parcel map review .is not necessarily the degree of variance
from the width standard being sought, but probably more importantly the con-
figuration of the resulting parcel , as it may be used for a building site. To
that end it is noted that atsegmenf3of the proposed common side property line
could be shifted_ to the west to gain a more suitable shape for the fl.ag
lot. This would not significantly effect the width variance, but it would
achieve a more useful parcel configuration. (See Special Condition No. 3)

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FIND-
INGS AND APPROVING IN MODIFIED FORM A TENTATIVE PAR-
CEL MAP TO DIVIDE AN EXISTING 27 , 804 SQ. FT. LOT INTO
TWO PARCELS, WITH RELATED VARIANCE FOR LOT WIDTH, ON
PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF
EL CORTEZ WAY AND SANTA YNEZ AVENUE.

WHEREAS, the Planning Commission of the City of Palm Desert ,
California, did hold a duly noticed Public Hearing on December 5, 1978 ,
to consider the request of CHARLES D. & LORETTA I . RILEY for approval of
a Tentative Parcel Map to create a 15, 170 sq. ft . parcel and a 12, 634
sq. ft . parcel from an existing 27, 804 sq. ft . subdivided lot ; and, a
Variance from the minimum lot width standards of the R-1 zone, for pro-
perty generally located at the northeast corner of E1 Cortez Way and Santa
Ynez Avenue , the site being more particularly described as :

WHEREAS , at said Public Hearing, upon hearing and considering the
testimony and arguments, if any, of all interested persons desiring to be
heard, said Planning Commission did find the following facts and reasons
to exist to justify approval of the Parcel Map :
1 . The Subject Tentative Parcel Map, as modified, does sub-
stantially comply with Chapter 26 of the City of Palm
Desert Municipal Code, and the State of California Sub-
division Map Act , as amended.
2 . The subject Tentative Parcel Map, as modified, does sub-
stantially comply with the adopted General Plan and the
Palm Desert Zoning Ordinance.
3 . The site is physically suitable for the type of develop-
ment proposed.
4. The design of the subdivision and the proposed improve-
ments are not likely to cause substantial environmental
damage or serious health problems.
WHEREAS, at said Public Hearing, upon hearing and considering the
testimony and arguments, if any, of all interested persons desiring to be
heard, siad Planning Commission did find the following facts and reasons
to exist to justify the approval of the Variance :
1 . That strict or literal interpretation and enforcement of the
minimum lot width of the R-1 zone would result in practical
difficulty or unnecessary physical hardship inconsistent with
the objectives of the ordinance;
2 . That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved or to the
intended use of the property that do not apply generally to
other properties in the same zone;
3 . That strict or literal interpretation and enforcement of the
specified regulation would deprive the applicant of privileges
enjoyed by the owners of other properties in the same vicinity
and zone;
4 . That the granting of the variance or adjustment will not be
detrimental to the public health, safety, or welfare, or
materilaly injurious to properties or improvements in the

On behalf of the Palm Desert Community Services District
we wish to make the following comments :
1. The Palm Desert Community Services District
currently provides adjacent parcels with
water service.
2. Water meters that will be required for the
newly formed lots will be paid for by the
subdivider.
3 . Any additional fire hydrants required by
the Fire Marshal will be installed at the
subdivider' s expense.
4. Frontage fees will be imposed on the newly
formed lots . Fees will be collected when
application is made for water service .
5 . The subdivider must comply with all current
Palm Desert Community Services District
ordinances .
6 . The subdivider should contact the District
for further details .

Environmental Impact Report
Gentlemen:
This is to advise that the subject property is located within the
service territory of the Southern California Edison Company, and that the
electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical load requirements for
the next several years.
Our total system demand is expected to continue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity-.

construction by the end of the year

street will allow for more water to be carried.
Chairman Kelly declared the Public Hearing close and asked
for the pleasure of the Commission. L
Commissioner Kryder noted his concern with the drai age but
stated that the conditions should take care of that .
Commissioner Fleshman stated that cross gutters will of
handle the situation on Homestead .
Mr. Beebe stated that most of the storm drains are short and
that the City will maintain them as the streets are public .
Commissioner Fleshman asked the applicant if he would provi e
drainage easement on Section H, and he suggested that he make the
easement through one property instead of two.

CALIFORNIA, APPROVING THE FINAL PARCEL MAP 13558 AND APPROVING
THE AGREEMENTS RELATING THERETO
BE IT RESOLVED by the City Council of the City of Palm Desert,
California, as follows:
1. The Final Parcel Map 13558, City of Palm Desert, California, is
hereby approved as the official parcel map of said parcels, subject to the
conditions of the tentative map.
2. The City Clerk is authorized to execute on behalf of the City a
Standard Subdivision Agreement guaranteeing completion of the public improve-
ments required by law.
3. The City Engineer is authorized to receive the improvement security
as required by law on behalf of the City, subject to the approval of the City
Attorney as to form.
4. The City Engineer is directed to process the final Parcel Map for

Recommendation: Approve and authorize the City Clerk to execute Parcel
Map No. 13558.
Discussion: This property is located at the intersection of El Cortez
Way and Santa Inez Ave. This was an exceptionally large lot, and the
Planning Commission approved the splitting of this lot into two lots.
On December 5, 1978. All of the requirements as placed upon this par-
cel map have been met. Therefore it is the recommendation of the Public
Works Dept. that this parcel map be approved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, APPROVING THE FINAL PARCEL MAP 13558 AND APPROVING
THE AGREEMENTS RELATING THERETO
BE IT RESOLVED by the City Council of the City of Palm Desert,
California, as follows:
1. The Final Parcel Map 13558, City of Palm Desert, California, is
hereby approved as the official parcel map of said parcels, subject to the
conditions of the tentative map.
2. The City Clerk is authorized to execute on behalf of the City a
Standard Subdivision Agreement guaranteeing completion of the public improve-
ments required by law.
3. The City Engineer is authorized to receive the improvement security
as required by law on behalf of the City, subject to the approval of the City
Attorney as to form.
4. The City Engineer is directed to process the final Parcel Map for
recording upon receipt of the required improvement security and payment of all
fees.
