Dear Mr. Robbins :
I have reviewed the Water Improvement Plans for PM13559
relative to the required nine (9) foot easement along Hwy 111 .
The City has required the applicant to revise the approved
landscape plan so that no trees will be located within said
easement, per your request.
I would appreciate it if you could consider one exception to
your requirements relative to the existing tree at the corner
of Painters Path and Hwy 111 . It would be unfortunate if this
tree would have to be removed. Perhaps some adjustment could
be made so that said tree could be preserved.
If you have any questions regarding this matter please feel
free to contact me.

under Development Plan No. "01-78 amended" and approved

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, APPROVING THE FINAL PARCEL MAP OF TRACT NO. 13559,
APPROVING THE AGREEMENTS RELATING THERETO
BE IT HEREBY RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. The Final Parcel Map of Tract No. 13559, City of Palm Desert,
California, is hereby approved as the official Parcel Map of said
tract, subject to the conditions of the Tentative Map.
2. The Mayorl and City Clerk are authorized to execute on
behalf of the City a Standard Parcel Agreement guaranteeing completion
of the public improvements required by law.
3. The City Engineer is authorized to receive the improvement
security as required by law on behalf of the City, subject to the
approval of the City Attorney as to form.
4. The City Engineer is directed to process the Final Maps for
recording upon receipt of the required improvement security and the payment
of all fees.

Mr. Crump presented a staff report , noting the previous
related cases DP 01-78 (amend. ) and the original PM 13559, containing
three parcels. He also related the adjacent zoning, and square footage of
each proposed parcel .
He then noted that the proposed revised map is generally consistent

With previous action on the development ; and that staff ' s recommendation
is to approve the proposal, subject to conditions.
Chairman Snyder declared the Public Hearing open, and asked if the
applicant were present . The applicant was not present , so Chairman
Snyder asked if anyone present wished to speak in FAVOR or OPPOSITION
to the request . There being none, he declared the Public Hearing closed,
and asked for the pleasure of the Commission .
On a motion by Commissioner Berkey, seconded by Commissioner
Kryder, the case was approved by adopting Planning Commission Resolution
No. 473 as submitted; carried unanimously (4-0) .

ITS FINDINGS AND APPROVING A REVISED TENTATIVE

WHEREAS, the Planning Commission of the City of Palm Desert ,
l California, did hold a duly noticed Public Hearing on April 3, 1979, to
consider a request by PDR Associates for approval of a revised Tentative
Parcel Map to divide an 8 acre parcel within the P. C. (4) , S .P. (Planned
Commercial Resort , Scenic Preservation Overlay) zone, north of
Avenue 44 , between Painters Path and Highway 111 into four
parcels, the site being more particularly described as :

WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said Planning Commission did find the following facts and
reasons to exist to justify approval of the Parcel Map:
1. The subject Revised Tentative Parcel Map does substantially
comply with Chapter 26 of the City of Palm Desert Municipal
Code, and the State of California Subdivision Map Act, as amended.
2. The subject Revised Tentative Parcel Map does comply with the
adopted General Plan and Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of development
proposed.
4. The design of the subdivision and the proposed improvements
are not likely to cause substantial environmental damage or
serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows :
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case;
2. That it does hereby approve the above described Tentative
Parcel Map NO. 13559 Revised, subject to fulfillment of the
attached conditions .

CONDITIONS OF APPROVAL
CASE NO. PM 13559 REVISED
1. The Tentative Parcel Map is granted for the land as described in the
attachments, thereto, and as shown on the plot plan labeled "Exhibit A" ,
and the requirements herein.
2. All requirements of any law, ordinance, or regulation of the
State, City, and any other applicable government entity shall
be complied with as part of any construction.
3. Full public improvements including traffic safety ligting as required
by Ordinance and the City Engineer shall be installed in accordance
with City standards.
4. Access rights on Highway 111 shall be offered to the City as a
dedication on the Final Map.
5. Improvement plans for water and sewer system shall meet the requirements
of the respective service districts.
6. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.
7. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert , without cost to the City and
free of all liens and encumbrances.
8. All on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view except certain appurtenances
as may be approved by the Director of Environmental Services .
9. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision
improvements by the City.
10. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to
all buildings. An adequate number of fire hydrants with required
fire flows shall be installed as recommended by the Fire Marshal .
11 . Prior to recordation of the Final Map, the developer shall furnish the .
original and three copies of the water system plan to the Fire Marshal
for review.
12. All requirements of the City Fire Marhsal in letter dated
3/20/79 shall be met as a part of the development of this Parcel Map.
13. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification :
"I certify that the design of the water system of Parcel Map No. 13559
is in accordance with the requirements prescribed by the City Fire
Marshal . "
14. Drainage shall be subject to approval of the City Engineer. Applicant
shall provide engineered data as requested.
15. All requirements of the Planning Commission action on the Development
Plan 01-78 shall be met as a part of the development of this map.
16. The total number of parcels shall be limited to four .
17 . Drainage and Signalization Fund contributions as required by City
Ordinance shall be made prior to recordation of the Final Parcel Map .
18 . The applicant shall install and maintain a thirty (30) foot wide
landscape strip parallel to the curb line on Highway 111 ; and,
dedicate to the City an easement over that portion inside of the
applicant ' s property line, for public access and use.
19. The applicant shall install a six foot wide meandering bicycle path
along the entire Highway 111 frontage. , The precise design and
location shall be subject to the approval of the Director of
Environmental Services .
120. The map shall be revised to reflect the easement to contain the
City entrance sign.

Gentlemen :
Provide the following fire protection in accordance with the Uniform Fire Code :
1. Install a water system capable of delivering 3000 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure
in the supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 400 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
s 3. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
4. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the
design of the water system in Tract No. 13-559 is in accordance with the require-
ments prescribed by the Fire Marshal . " Upon approval , the original plan will be
returned to the developer.
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow. j

This letter is not to be interpreted as a contractual commitment to
serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project coUld" be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of aas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy
conservation techniques for a particular project. If you desire further

TENTATIVE PARCEL MAP
Both State Law and the Palm Desert Subdivision Ordinance require that when any parcel of
contiguous parcels in one ownership is proposed to be divided into less than five parts,
now, or in the future, a parcel map must be processed through the City.

Applications for a Tentative Parcel Map are accepted only on the first working Monday of
each month. Prior to submittal , it is recommended that the map be fully discussed with the
City Engineer. The staff will investigate the request and notify adjacent property owners
of the Public Hearing. The average review period for a parcel map is five weeks. Prior
to the Public Hearing, the map may be reviewed by the Land Division Review Committee. Said
Committee reviews with the applicant to propose recommendations to the Planning Commission,
including any conditions. Prior to the Hearing, the applicant will receive a copy of the
Agenda and a copy of the staff report concerning the case. If the parcel map is approved
by the Planning Commission, preparation of the final parcel map may begin. The final par-
cel map is processed through the Engineering Department.
CONTENTS OF A TENTATIVE PARCEL MAP
The Tentative Parcel Map shall be in a form acceptable to the City Engineer and shall com-
ply to the provisions of Sections 66444-50 of the State Map Act.

10. names, locations and widths of proposed streets; cross-sections;
11. approximate grades of proposed and existing streets ;
12. streets and rights-of-way providing legal access to the property;
13. excavations within 200 feet of the subdivision;
14. approximate radii of curves ;
15. widths of alleys and easements ;
16. names of utility companies and location of existing and proposed
public utilities;
17. elevations of sewer at proposed main connections ;
18. existing culverts and drain pipes;
19. water courses and channels including existing and proposed
facilities for control of storm waters;
20. land subject to overflow, innudation or flood hazard;

Supplemental Information
Reports and written statements on the following matters shall accompany the tentative map
unless waived in writing;
1. Subdivision building or development plan;
2. proposed method of control of storm water; including data as to grade
and dimensions;
3. protective covenants proposed to be recorded;
4. if private streets are proposed, the method by which their maintenance
will be accomplished and financed;
5. proposed tree planting;
6. a written statement from the City Health Officer stating the type of
sewage disposal that will be permitted. To aid in this determination,
the City Health Officer may require soil percolation tests or other
pertinent information.
7. Proposed landscaping and irrigation.
8. Preliminary soils report and grading plan.
Required Materials to be Submitted
1. A completed Application form.
2. Twenty (20) copies (folded 812" x 13") of the Tentative Parcel Map
and an unfolded sepia.
3. Required fee.

INSTRUCTION FOR OBTAINING
PROPERTY O,INERS NAMES
In order to expedite the processing of Changes of Zone, Variances , and
Conditional Use Permits , all applicants will furnish the Department of Environmental
Services with a list (in duplicate) of the property owners and their addresses for
all parcels within 300 feet of the application. Said list shall include the owner
of the property under consideration. These property owner names may be obtained in
one of the two following manners:
A. Contact a title company and request that they furnish you with
a list of names , for which there will probably be a charge.
B. You may obtain them yourselves in the following manner:
1. Secure from the County Assessor's Office parcel maps covering
your application and all lands within at least 300 feet,
2. Indicate the area of your request by a red outline on the
parcel maps.
3. Delineate, in red, all property within 300 feet of the area
of your request.
4. From the parcel map, make a list of book, pace, block number ,
and parcel number within the above 300 foot area.
5. Using the Visual Numerical Index File, which is to be found
in the Assessor's Office, place the name and address for each
parcel opposite the number described in No. 4 above.
6. Sign Affidavit attesting to name list.
7. Return this list with your application to the Department of
Environmental Services.

I. FILING PROCEDURE: Prior to submittal the applicant shall discuss his pro-
posal with the Planning staff to determine whether or not the proposal is
in conformance with the General Plan and to determine zoning ordinance,
subdivision ordinance, or other requirements.
II . GENERAL INFORMATION:
A. Meetings : 1) City Council meetings are held on the second and fourth
Thursday of each month, at 7:00 PM in the Council Chambers in the City
Hall , 45-275 Prickly Pear Lane. 2) Planning Commission meetings are
held on Tuesday, nine (9) days prior to the first Council meeting of-
the month, also at 7:00 PM in the Council Chambers and Wednesday, eight
(8) days prior to the second Council meeting of the month, at 1 :00 PM
in the Council Chambers. 3) The Design Review Board convenes on Tues-
day, a week before the Planning Commission, at 5:30 PM in the Council
Chambers.
B. Public Hearing: Public hearings are held when the City considers re-
quests for a change of zone, variance, conditional use permit, general
plan amendment, etc. Legal notices for these hearings are published
in the Palm Desert Post at least ten (10) days prior to the hearing.
Public hearing items before the Palm Desert Redevelopment Agency are
published in the Desert Sun.
C. Appeals : Where the Zoning Ordinance provides for appeal to the City
Council or Planning Commission, the appeal shall be made within fifteen
(15) days of the date of the decision by filing an application of appeal
with the Director of Environmental Services.
D. Fees : All required fees are listed in the Fee Schedule, as approved by
the City Council .
E. Building Permits : Building permits are issued by the Department of
Building and Safety and are required before any new construction, re-
construction , plumbing, mechanical work is commenced.
F. Business License: Prior to engaging in an enterprise for profit, zoning
and building code clearance for the proposed use is required and a city
business license obtained. Application should be made to the Code En-
forcement Supervisor.
G. Private Deed Restrictions : Many parcels of land in the City of Palm
Desert are subject to private covenants, conditions , and deed restrictions
which may conflict with the requirements of the City Zoning Ordinance.
The applicant is responsible for resolving conflicts with deed restriction
requirements. -

Gentlemen:
Thank you for the opportunity to review Tentative Parcel Map No.
13559 on the westerly side of State Highway Route 111 between
Avenue 44 and 1000 ' north.
State Highway Route 111 is the principal traffic artery between
the upper and lower Coachella Valley. It carries the heaviest
traffic in the area, resulting in substantial congestion and
traffic safety problems. Development and the resultant density
increases are occurring rapidly in this area. We do not
anticipate any improvements that will significantly increase the
capacity of this facility within the foreseeable future.
Therefore, it is imperative that the traffic-carrying
capabilities and safety of the existing circulation system be
maintained at as high a level as possible.
The highway is at times subject to flooding from rainstorms.
Development along the highway has at many locations increased,
concentrated, and confined runoff at the highway, causing
additional incidents of flooding. Care must be taken when
developing along the highway to insure that drainage will be
adequate for both the present and future higher densities in the
Valley area. Any necessary highway drainage improvements should
be included as part of the development of property along the
highway.
Even though division of this property in itself may not cause
serious consequences, its development or redevelopment will have
a cumulative effect on the traffic congestion along this highway.
For this reason we strongly urge the following:
- Development of these parcels include normal street
improvements including curb and gutter in
accordance with the City's Master Plan.
- All vehicular access be provided by either Painter ' s
Path or Avenue 44. No driveway to Route 111 be
allowed.

- In developing this property, care should be taken to preserve
and perpetuate the existing drainage patterns of the highway.
The cumulative effect from this project combined with that of
others could produce flooding along this section of highway.
The property should be developed in a manner that will insure
that the cumulative increased storm runoff from this property
and others in the area will not create a problem on the
highway.
- It is recognized that there is considerable public concern
about noise levels adjacent to heavily traveled highways.
Land development, in order to be compatible with this concern,
may require special noise attenuation measures. This
development should include any necessary noise attenuation.
- This portion of Route 111 is included in the California
Master Plan of State 'Highways Eligible for Official Scenic
Highway Designation, and in the future the City may wish to
have this route officially designated as a scenic highway.
Development in this corridor should be compatible with the
scenic highway concept.
An encroachment permit must be obtained by the developer from the
District 8 office of the State Department of Transportation prior
to doing any work within the state highway right of way.
We would like to receive a copy of any conditions of approval for
this proposal when they become available.
We would also like the opportunity to review a copy of the
proposed Parcel Map during the City review and checking process.

with the bike bath proposed for Highway 111 and it will tie into the
one in Rancho Mirage.
Chairman Kelly declared the Public Hearing open and asked if the
applicant would like to speak at this time. The applicant was not
present . Chairman Kelly asked if there was anyone wishing to speak in
FAVOR or in OPPOSITION to the project . Being none, she declared the
Public Hearing closed and asked for the pleasure of the Commission.

to consider : a) the expansion of the exterior modification all around

Chairman Kelly noted her concern and disgust with the
landscaping that is being put in that is -not as approved by
the Commission. Also the construction trucks are a nuisance
and a hazard. The names should he taken and something done.
Regarding Design -Review Board cases, they should not come
before the Planning Commission unless the projects are com-
plete.
Commissioner Kryder asked why no. one else has taken care
of their trash enclosures as he was required to do.
Mr . Williams stated that all these problems will be checked
into and handled .

The applicant is proposing to divide an approved restaurant/commercial
complex into three parcels. The first northern parcel would contain
a restaurant site and related parking area. The second and largest
proposed parcel would include a restaurant site and the ancillary com-
mercial uses. The southern most proposed parcel , along Avenue 44,
encompasses the third restaurant site and its parking area. The parcel
map will provide for reciprocal access and parking arrangements, there-
fore, the proposed division may be viewed as only defining ownerships/

electric loads of the project are within parameters of projected load growth
which Edison is planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our
estimates, and provided that there are no unexpected outages to major sources
of electrical supply, we expect to meet our electrical F.oad requirements for
the next several years.
Our total system demand is expected to contir>ue to increase
annually; and, if our plans to proceed with future construction of new generat-
ing facilities are delayed, our ability to serve all customer loads during peak
demand periods could become marginal by 1981.
In addition, the major fuel used in Edison's generating facilities
is low sulfur fuel oil. We now believe our low sulfur _;�vel oil inventory,
together with our contractual commitments for delivery, and our customers'
conservation efforts, will permit us to meet the forecasted demand for electricity
during 1978.
It is our intention to continue to do everything that can reasonably
be accomplished to provide our customers with a continuous and sufficient supply
of electricity.

schools , hospitals, parks, power generation, sewage treatment, etc. )
-Your comments and recommended conditions of approval must be received -
by this office prior to 5:00 p.m. Sept�p2_, 1978, in order to be
discussed by the Land Division Committee at their meeting of Sept. 27th •
The Land Division Committee (comprised of Director of Environmental
Services, City Building Official , City Engineer, Fire Marshal and a
representative of CVCWD) will discuss the comments and recommended
conditions of approval and will forward them to the Planning Commission
through the staff report. Any information received by this office after
the receipt deadline will not be discussed by the Land Division Com-
mittee nor will it be forwarded to the Planning Commission for consid-
eration.
