RESOLUTION NO. 78-168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING THE FINAL PARCEL MAP 13583 BE IT HEREBY RESOLVED by the City Council of the City of Palm 1 Desert, California, as follows: 1 . The Final Parcel Map 13583, City of Palm Desert, California, is hereby approved as the official parcel map of said parcels, subject to the conditions of the tentative parcel map. 2. The City Engineer and City Clerk are authorized to execute said Parcel Map 13583 on behalf of the City. Chairman Kelly declared the Public Hearing open and asked if the applicant wished to speak at this time. RON ROBERTS, SGPA, representing Hughes Investments, referred to Condition No . 4 on both cases and asked if they could have CC&R' s instead of this condition. Commissioner Fleshman stated that the easement in question should be recorded as part of the final recordation of the Tract Map. Mr . Williams noted that they could make it read "restriction" instead of "reciprocal" easement . Condition No. 4 was changed to read on both cases : CC&R' s that include a recorded easement , shall be approved as a part of t-he Final Map that would include all the parcels of. CUP 09-78 . On a motion by Commissioner Fleshman, seconded by Commissioner Snyder , the Commission approved Case No. PM 13583 by Planning Commission Resolution No. 416 and Case No. PM 13584 by Planning Commission Resolu- tion No. 417 ; carried unanimously (5-0) . Case No. TT 3008 - COVE CONSTRUCTION CO. , Applicant Request for a roval of a Tentative Tract Map to create 161 sin e-family residential lots on approxi- mately 64 .4 acre within the R-1 12, 000 and R-1 12, 000, S.P. (Single-fami y residential , min. 12, 000 sq. ft . lot area, Scenic P eservation Overlay) zones generally located east of Hig way 74 , south of Homestead Road . Mr . Williams reviewed the ase and the Conditions of Approval . He also noted the concerns noted 'n the previous related cases. Commissioner Snyder asked ab t Mesa View. Commissioner Berkey asked if Condition No. 2 was suffici t . And, Chairman Kelly asked if lot sizes met the requirements of e zoning designation. Mr . Williams replied to these concerns tha Condition No. 1 and 2 seem to cover the concerns and that some of e lots are larger and the size on the smaller ones can be adjusted . Commissioner Berkey asked about the status of the fire station Mr . Williams stated that the City has the land and the fire sta ion should be under . construction by the end of the year . Chairman Kelly declared the Public Hea ' ng open and asked if the applicant wished to speak at this time. ED WRIGHT, Pres. of Cove Construction stated that he feels that the drainage problems ca be handled and that he agrees with the staff ' s rec mmendations. Chairman Kelly asked if there was anyone wis ' ng to speak in FAVOR or OPPOSITION to the project . ROSE FREELANDER, 48485 Praire Dr . , noted he concern with the drainage on Mesa View and Praire. Mr. Williams noted that Mesa View will be double "dth and part of it will have a 16 foot median . He also noted tha there will be improvements to the curbing so that the water won ' t flo onto yards. Mr . Wright noted that the additional width of th street will allow for more water to be carried . Chairman Kelly declared the Public Hearing closed and sked for the pleasure of the Commission. Commissioner Kryder noted his concern with the drainage ut stated that the conditions should take care of that . Commissioner Fleshman stated that cross gutters will not handle the situation on Homestead . Mr. Beebe stated that most of the storm drains are short and that the City will maintain them as the streets are public . Commissioner Fleshman asked the applicant if he would provide drainage easement on Section H, and he suggested that he make the easement through one property instead of two . CITY 'OF PALM DESERT STAFF, REPORT To: Planning Commission Report On: Parcel Maps to implement an approved commercial development Applicant: HUGHES INVESTMENTS Case Nos: PM 13583 and PM 13584 Date: October 31 , 1978 I. REQUEST: Request for approval of two Parcel Maps which implement an approved Conditional Use Permit for a commercial development generally located east of Highway 74, between Highway Ill and E1 Paseo, as follows: A. PM 13583 - A map combining four 0.25 acre parcels into one parcel of 1 acre, on the south side of Highway 111 (frontage road) ; occupying the northeastern corner of the develop- ment site. B. PM 13584 - A map dividing a 1 .2 acre parcel into two parcels con- taining 0.41 acres and 0.79 acres, on the southwestern portion of the development site. II. DISCUSSION: The subject parcel maps implement the applicants ' approved Conditional Use Permit (CUP 09-78) and Preliminary Design Review (91C) cases approved by the Planning Commission on September 5, 1978. The property involved in PM 13583 includes the north eastern most 9,000 sq. ft. commercial building and the parking area to the south. PM 13584 concerns the ir- regular shaped parcel on the southwestern portion of the development site. Proposed parcel No. 1 (0.41 acre) , contains a proposed 6,000 sq. ft. com- mercial building and adjacent parking area; now existing on the parcel is a one story frame structure. Proposed parcel No. 2 (0.79 acre) incorporates the area containing a proposed 12,800 sq. ft. _"shops" building, and a pro- posed 19,600 sq. ft. two story commercial build n'g'; now existing on the par- cel is a one story frame shed and garage. Subject:3to the provisions of the CUP approval , and the designation of reciprocal access and parking easements, the Parcel. Maps appear to be acceptable. III. STAFF RECOMMENDATION: It is recommended that the Planning Commission take the following actions, based on the justification provided in the Resolution: Approve Tentative Parcel Map No. 13583 by adopting Planning Commission Resolution No. 416. PM 13583 WHEREAS , the Planning Commission of the City of Palm Desert , California, did hold a duly noticed Public Hearing on October 31 , 1978, to consider a request by HUGHES INVESTMENTS for approval of a Tenta- tive Parcel Map to combine four 0. 25 acre parcels within the C-1, S .P. (General Commercial District , Scenic Overlay) zone, on the south side of Highway 111 , east of Highway 74 into one parcel, the site being more particularly described as : APN 627-19-002 APN 627-19-003 APN 627-19-004 APN 627-19-005 WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1 . The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act , as amended. 2 . The subject Tentative Parcel Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3 . The site is physically suitable for the type of develop- ment proposed. 4 . The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert , California, as follows : 1 . That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2 . That it does hereby approve the above described Tentative Parcel Map No. 13583 , subject to fulfillment of the attached conditions. Unless the demand for electrical generating capacity exceeds our estimates, and provided that there are no unexpected outages to major sources of electrical supply, we expect to meet our electrical load requirements for the next several years. Our total system demand is expected to continue to increase annually; and, if our plans to proceed with future construction of new generat- ing facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1981. In addition, the major fuel used in Edison's generating facilities is low sulfur fuel oil. we now believe our low sulfur fuel oil inventory, together with our contractual commitments for delivery, and our customers' conservation efforts, will permit us to meet the forecasted demand for electricity during 1978. It is our intention to continue to do everything that can reasonably be accomplished to provide our customers with a continuous and sufficient supply of electricity.
