Eldon Prock, -I)-.-V.i—. Gentlemen: The Palm Desert City Planning Commission, at their regular meeting of August 18, 1975, approved the subject parcel map and CUP-04-75 with conditions. It is the intent of this letter to respectfully request special Council consideration of two of the recommended conditions of approval for the parcel map. The property in question, is presently divided into three lots with 60' of frontage each on Palm Desert Drive, and is owned by the Taylor Estate. Dr. Prock is pur- chasing the westerly 90' of these three subdivided lots for the purpose of construct- ing the small animal hospital set forth in CUP-04-75. Dr. Prock has also been le- gally authorized to process the parcel map which is required by the City's subdivi- sion ordinance to reduce the total number of parcels from three with 60' frontage each to two with 90' frontage each with the understanding that the Taylor Estate would not be obligated financially for any of the consequences of the parcel map. The conditions of approval which are of concern to us are as follows: 3. As part of construction, the applicant shall underground all electrical, tele- phone, cable television and other utility service lines to the unit. In addition, the applicant shall underground the overhead distribution lines along the front and rear property lines of both parcels . At the discretion of the Planning Commission or where partial undergrounding is feasible, the applicant may submit a cash bond for a propor- tionate share of undergrounding the utility lines for the entire block based on cost es- timates determined by the Southern California Edison Company. 4. As a part of construction, the applicant shall install a full-width paved alley along the entire rear propertly line of Parcel 1 & 2 and build to Riverside County standards. Said improvement shall be based on a consideration of the drainage re- quirements for the entire alley between Monterey Avenue and San Marcos Avenue, and shall be subject to review and approval by the Director of Environmental Services. -' Honorable Mayor and City Council Page 2 August 21, 1975 Before discussing these two conditions it should be pointed out that Dr. Prock is not requesting that he be released of the responsibility for improvements normally required of a developer of property, but is merely requesting special consideration as to the manner in which these requirements are imposed. To begin with, it would appear that the subject land division is somewhat unique when compared with the majority of land divisions which are processed in your City. Where the normal land division application results in the creation of additional lots or parcels, this land division will result in a reduction in the number of parcels from three to two. While it doesn't make sense from a land planning standpoint, Dr. Prock could develop the proposed verterinary hospital on two of the 60' parcels, leaving a residual unde- veloped 60' parcel for future development without going through the expense of pro- cessing a parcel map. This point is made in hopes that it justifies the application of any conditions of approval to the parcel which Dr. Prock is proposing to develop and not to the 90 ' parcel which will not be developed at the present time. It is our under- standing that at such time as the other parcel is developed, the City has the legal machinery available to require those improvements which are included as conditions of approval on this parcel map. With respect to Condition No. 3 relating to the undergrounding of all overhead utility lines , we are familiar with the City Ordinance No. 38 and the desires of your commun- ity to ultimately underground all overhead utility lines. As discussed earlier, Dr. Prock is not questioning his obligation of participating in the cost of undergrounding utilities in his area. It does seem, however, that there is an equitable means of assuring his participation in this undergrounding other than the manner in which Condition 3 provides . As you are aware, Dr. Prock will have a controlling interest in 90' of frontage in a block which is in excess of 1000' in length. It hardly seems practical for him to be required to physically underground the utilities along his 90' frontage, as provided in the second sentence of Condition 3 . In addition, it is our understanding that the City has no specific plans for the undergrounding of the utilities in this area, and if Dr. Prock were to submit a cash bond for a proportionate share of the cost, this could be held for an indefinite period of time before the entire block is undergrounded. During this period of time he would be required to pay the annual bond premiums. It must be remembered that while this is a commercial development, it can't be compared in size or scope with a large shopping center that covers a square block or so. It is with this in mind that we are hopeful that your Honorable Body will see justification for a minor deviation of the requirements of Ordinance No. 38 and the Planning Commission's rec- ommended condition of approval for this land division, and permit the owners of the property to fulfill the requirements of Condition 3 by entering into an agreement which y � Honorable Mayor and City Council Page 3 August 21, 1975 would be recorded and become a cloud on the title to the property which, in effect, would provide that at such time as an undergrounding project is established for this area, they (the property owners and/or subsequent property owners) will agree to participate in the project based on their prorata cost thereof. With regard to Condition No. 4, the Planning Commission in approving same, sug- gested that it might be reasonable to only impose this condition on the 90' frontage parcel being developed by Dr. Prock with the understanding that the other 90' frontage would be improved at such time as it is developed. While Dr. Prock is not objecting to the improvement of the alley along the rear of his parcel, he is concerned that it will be his responsibility to provide the engineering survey and design for the entire alley between Monterey Avenue and San Marcos Avenue which would be necessary to establish a proper grade for the 90' of alley to be installed along his property. In addition to this concern, it would appear that a 90' strip of improved alley with un- improved alley on either side thereof would be subject to fairly rapid deterioration. It is with this in mind that we are requesting Condition 4 to be modified in a manner such that Dr. Prock could enter into an agreement similar to that suggested for com- pliance with Condition 3-to guarantee his participation in the cost of improving the alley at such time as the entire alley is improved. Prior to the issuance of a Building Permit , the Developer shall furnish the original and four copies of the water system plan to the Riverside County Department of Fire Protection for review. Case No. CUP-1357 ENVIRONMENTAL DEVELOPMENT CO. : Request for a 12 month extension on the conditional use permit covering the final 209 units for the Mountainback project on the west side of Highway 74, between Homestead and Portola (Carriage Trail) . r Due to a conflict in schedule, the applicant requested that this case be continued to the Planning Commission meeting of September 2 to be considered along with the Tract Case No . 4442 which was also on this meeting ' s Agenda listed under New Business. Because this public hearing was noticed, Chairman Seidler opened the hearing for persons to speak in favor or against this case. There being no comments, Commissioner Mullins moved, Com- missioner Berkey seconded the motion to continue this public hearing until September 2 . Motion carried unanimously. VII . OLD BUSINESS A. Case No. PM 6912 ELDON PROCK: Consideration of a parcel map to convert three 60 foot wide lots into two 90 foot lots on the north side of Highway 111 , between Monterey and San Marcos . This case was continued from August 4 , 1975. Paul Williams presented the staff report . This case was continued in conjunction with the conditional use permit on the small animal hospital . He then proceeded to outline the two most major concerns expressed at the last Planning Commission meeting which dealt with the undergrounding of utilities and the require- ment of the installation of a full-width paved alley along the entire rear property line of parcels 1 and 2. i Staff recommended that the condition regarding undergrounding { hold as previously specified. Condition #3 should remain unchanged. Regarding condition #4, the Commission may wish to 'review this and require some modification to this condition to which the applicant was in objection to. Staff ' s recommended modification to be con- sidered by the Commission was as follows : That an additional alternative be added to the condition stating that the applicant may submit a cash bond for the value of the proposed construction where immediate installation was infeasible . Chairman Seidler stated that this was not a public hearing, but the Commission welcomed any comments from the applicant or his representatives at this time. JACK GHORMLEY, project engineer , 82640 Highway 111 , Indio , spoke on behalf of the project . He advised that it was his under- standing that the Commission really was without authority to modify condition #3 beyond what had already been recommended by Staff. He wanted to convince the Commission that there were extenuating cir- cumstances in this case; and requested that the Commission more strongly ask the City Council to give Dr. Prock special consideration . From a practical standpoint , he felt it wasn ' t feasible to underground at the present time. Dr. Prock would have to underground in front of his and other property as well because of the location of the existing power poles. Because of the size of the project and the facility, perhaps Ordinance 1'T38 did not apply in application to this particular project . MINUTES -4- August 18, 1975 Regarding condition #4 , Mr. Ghormley asked for relief or modification for Dr. Prock to pave only the maximum of 1/2 the alley, which would be the entire rear property line of parcel #1 . Commissioner Berkey asked for clarification of City Council policy regarding a bond in lieu of paving. Discussion then ensued between staff and the Commissioners regarding the alternative of paving 1/2 the alley and how the remainder of the alley would be paved in the future . LLOYD MOUNT, Walker & Lee, Palm Desert , spoke in favor of the project . He advised that the applicant ' s request for paving 1/2 of the alley specifically referred to 1/2 long, not wide. Mr . Mount ' s primary concern was that if the applicant was required to pave the full 180' he would be financially penalized due to the fact that he only owned 90' of the two parcels . Therefore, he requested relief for the applicant to only pay for improvements on his frontage. He felt it was preferable for a bond to be posted and to install the improvements at the same time when the rest of the street was done since this was mostly undeveloped property along Palm Desert Drive. After a lengthy discussion, Commissioner Mullins moved that Planning Commission Resolution No. 73 be approved with the 10 con- ditions as written. Commissioner Berkey seconded the motion which carried unanimously. Chairman Seidler abstained from voting. Commissioner Berkey commented that his vote was on the basis that this was a policy matter and that the final decision of changes to the conditions should be made by the City Council . Commissioner Berkey stressed the fact that he felt Dr. Prock should only improve the alley for the full length of his parcel which was 90 ' ; or have the option of posting a cash bond for the value of the proposed construction where immediate installation was infeasible. - Commissioner Mullins agreed with Commissioner Berkey and recommended by minute motion that the Planning Commission recommend to the City Council , that condition #4 be modified to require paving for 1/2 of the alley (90 ' ) ; and that the applicant be permitted the option of posting a cash bond in lieu of paving. Commissioner Berkey seconded the motion which carried unanimously. Chairman Seidler abstained from the vote. VIII . NEW BUSINESS A. Paul Williams presented the staff report . It was staff ' s recommendation that the 12 month extension be granted by Planning Commission Resolution No. 74 ; and that such a recommendation be made to the City Council by said resolution with the additional condition stipulated in the resolution that requires Design Review Board process prior to any construction and that that process include landscaping, irrigation , and lighting plans as a part of the approval . Case No. PM 6912 ELDON PROCK: Consideration of a parcel map to convert three Vi foot wide lots into c two 90 foot lots on the north side of Highway 111 , D between Monterey and San Marcos . This case was continued from August 4 , 1975. Paul Williams presented the staff report . This case was continued in conjunction with the conditional use permit on the small animal hospital . He then proceeded to outline the two most major concerns expressed at the last Planning Commission meeting which dealt with the undergrounding of utilities and the require- ment of the installation of a full-width paved alley along the entire rear property line of parcels 1 and 2. Staff recommended that the condition regarding undergrounding hold as previously specified. Condition #3 should remain unchanged. Regarding condition #4, the Commission may wish to review this and require some modification to this condition to which the applicant was in objection to. Staff ' s recommended modification to be con- sidered by the Commission was as follows : That an additional alternative be added to the condition stating that the applicant may submit a cash bond for the value of the proposed construction where immediate installation was infeasible . Chairman Seidler stated that this was not a public hearing, but the Commission welcomed any comments from the applicant or his representatives at this time. Ile advised that it was his under- standing that the Commission really was without authority to modify ' condition #3 beyond what had already been recommended by Staff. He wanted to convince the Commission that there were extenuating cir- cumstances in this case; and requested that the Commission more strongly ask the City Council to give Dr. Prock special consideration . 'From a practical standpoint , he felt it wasn ' t feasible to underground at the present time. Dr. Prock would have to underground in front of his and other property as well because of the location of the existing power poles. Because of the size of the project and the facility , perhaps Ordinance #38 did not apply in application to this particular project . r MINUTES -4- August 18, 1975 Regarding condition #4 , Mr. Ghormley asked for relief or modification for Dr. Prock to pave only the maximum of 1/2 the alley , which would be the entire rear property line of parcel #1 . Commissioner Berkey asked for clarification of City Council policy regarding a bond in lieu. of paving. Discussion then ensued between staff and the Commissioners regarding the alternative of paving .1/2 .the alley and how the remainder of the. alley would be paved in the future . LLOYD MOUNT, Walker & Lee, Palm Desert , spoke in favor of the project . He advised that the applicant ' s request for paving 1/2 of the alley specifically referred to 1/2 long, not wide. Mr . Mount ' s primary concern was that if the applicant was required to pave the full 180' he would be financially penalized due to the fact that he only owned 90 ' of the two parcels . Therefore , he requested relief for the applicant to only pay for improvements on his frontage. He felt it was preferable for a bond to be posted and to install the improvements at the same time when the rest of the street was done since this was mostly undeveloped property along Palm Desert Drive. After a lengthy discussion, Commissioner Mullins moved that Planning Commission Resolution No . 73 be approved with the 10 con- ditions as written. Commissioner Berkey seconded the motion which carried unanimously. Chairman Seidler abstained from voting. Commissioner Berkey commented that his vote was on the basis that this was a policy matter and that the final decision of changes to the conditions should be made by the City Council . The lots extend from the north side of the frontage road to a depth. of 120 feet , where they abut a 20 foot alley. Palm Desert Drive has already been improved with curb and gutter. However, the alley is currently unimproved and the staff is recommending that the applicant provide a full width paved alley to County Standards along the entire 180 feet adjacent to the rear property line. Along both the front and rear property lines are existing overhead utility distribution lines. As a condition of approval , the staff is recommending that the applicant underground the distribution lines along the front and rear property lines of both parcels as a part of con- struction. The staff is recommending undergrounding during construction due to the potentially major impact of the project on the adjacent single- family residential neighborhood. In most cases , a major street and multi-family residential areas serve as a buffer between commercial and R-1 areas. Here , however, the two are separated by only a 20 foot alley. To prevent commercial-type uses from encroaching any further into the residential area, the ,tioundary between the 2 uses should be clearly drawn. The undergrounding of overhead utility lines will contribute to this goal. In addition, undergrounding at this time would eliminate the need to tear up. the newly installed alley at the rear of the property or other improvements that would be made at this time. Should the Commission decide to delay the undergrounding improvements, the staff recommends thAt the applicant be required to submit a cash bond for a proportionate share of undergrounding the entire block based on a cost estimate provided by the Southern California Edison Company. The City Attorney was consulted on this matter and it was his opinion that any other arrangements concerning undergrounding would have to be approved by the City Council. Project was reviewed by Riverside County Department of Health and the Palm Desert Community Services District . Neither agency had any objections to the proposal . The Riverside County Road Depart- ment recommends that alley access for delivery vehicles should be provided and that engineering plans for the entire block be com- pleted before any alley improvements are made . Additional conditions requested by the Riverside County Fire Protection Planning Officer and the Coachella Valley County Water District have been attached to the proposed resolution. V . PLANNING COMMISSION COMMENTS : Both the Prock conditional use permit and parcel maps requests were first heard by the Planning Commission on August 4. The minutes of that meeting have been included in this report to provide additional background information on the Commissioner ' s reactions to the project and the proposed conditions of approval . -2- P. At that time, several new conditions had been added, as requested by the Commission , particularly in regards to control of nuisance noise and odor problems cause by the proposed small animal hospital . The applicant requested that he be permitted to submit an agreement to join any future under- grounding district created for that block and that his responsibility should be limited to improvements adjacent to parcel 1 only , since the cost of undergrounding both parcels would be an extreme financial burden for a small property owner . The Planning Commission seemed to share many of the applicant ' s concerns. Commissioner Berkey thought that the City would derive a great benefit by creating larger parcels in that part of the City and that the applicant should not be discouraged by excessive improvement requirements.
