Services located at 45-275 Prickly Pear Lane, Palm Desert, California. If no

II . STAFF RECOMMENDATION: That the City Council uphold the findings
of the Planning Commission and adopt Resolution No. 75-96
approving Parcel Map 7078 and waiving the requirements of the
final map.
Justification is based upon :
1. Consolidation of 3 lots would help reduce lot parcelization
problem that now exists in core commercial area.
2. Proposed development would be compatible with existing and
proposed development in the area.
3. Parcel Map does comply with all requirements with the Palm
Desert Subdivision Regulations (Riverside County Ordinance
No. 460, as amended) and the California Subdivision Map Act .

CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE I
CITY COUNCIL, APPROVAL OF A TENTATIVE PARCEL MAP AND WAIVER OF A
FINAL MAP, FOR A PARCEL CONSOLIDATION ON .71 ACRES OF LAND GENERALLY
LOCATED ON THE NORTH SIDE OF EL PASEO, APPROXIMATELY 300 FEET EAST OF
SAN LUIS REY. CASE NO. P.M. 7078.
WHEREAS, the Planning Commission of the City. of Palm Desert did receive a
verified application from IRIS CARMEL, requesting approval of a lot consolidation
on .71 acres of land, located in the C-P-S zone and situated on the north side of
E1 Paseo, approximately 300 feet east of San Luis Rey, more particularly described
as: Lots 27 28, and 29 of Block S, Palm Desert Unit No. 1
WHEREAS, said application had complied with the requirements of the "City of
Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an
Environmental Assessment form was submitted and a Negative Declaration was made by
the Director of Environmental Services and the appeal period has expired; and
WHEREAS, the Planning Commission did take into consideration, the Tentative
Parcel Map as submitted, and the reports of the various reviewing agencies; and
WHEREAS, the Planning Commission did find that the subject Tentative Parcel
Map does substantially comply with the City of Palm Desert Code (County Ordinance
Number 460) , and the State of California Subdivision Map Act as amended.
WHEREAS, the Planning Commission did find that the subject Tentative Parcel
Map does comply with the adopted General Plan; and
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert as follows: (1 ) that the above recitations are true and correct and
constitute the findings of the Commission in this case; and (2) that it does
hereby recommend approval to the City Council of the City of Palm Desert of the
above described Tentative Parcel Map No. PM 7078, and a waiver of a final map
subject to the fulfillment of the attached conditions.

3. As a part of construction., the applicant shall submit a cash
bond for a proportionate share of undergrounding the utility
lines for the entire block based on cost estimates determined

Steve Fleshman presented the staff report . It was staff ' s
recommendation that the Planning Commission approve the parcel con-
solidation and waiver of the final map by Planning Commission
Resolution No. 81 with the attached conditions .
After a review of the conditions , Chairman Seidler asked for
comments from the applicant , if present . The applicant was not
present and there were no further comments.
Commissioner Mullins moved, Commissioner .Van de Turk seconded
the motion to approve Resolution No. 81 with the attached conditions .
Motion carried unanimously.

IV. DISCUSSION: Applicant is proposing to connect to sanitary sewers
for the entire site. The staff is requesting that the applicant
post a cash bond for a prorata share of the cost of undergrounding
the overhead utility lines for the entire block. In addition ,.
condition #5 would require the applicant to join any assessment
districts created in this area that might be established to perform
other improvements . As in other cases, the applicant is being
requested to submit an agreement to the City of Palm Desert allow-
ing a public access easement over the parking areas of the site.

Gentlemen:
The above tract lies on the Dead Indian Canyon and Deep Canyon debris
cone. This area is protected from stormwater flows by a system of channels
and dikes built and maintained by this District. This tract may be con-
sidered safe from stormwater flows except in rare instances.
The Coachella Valley County Water District will furnish domestic water and
sanitation service to said tract in accordance with the currently prevailing
regulations of this District.
The District requests that the attached Conditions of Approval be included
with the recommendations to be made to the Planning Commission.
There may be conflicts with existing District facilities. We request the
appropriate public agency to withhold the issuance of a building permit un-
til arrangements have been made with the District for the relocation of
these facilities.
